HomeMy WebLinkAbout20230223.tiffRESOLUTION RE: APPROVE TWO -LOT RECORDED EXEMPTION, RECX20-0078 - BARRY AND JOYCE BROMLEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Two -Lot Recorded Exemption, RECX20-0078, was submitted by Barry and Joyce Bromley, 5501 County Road 38, Platteville, Colorado 80651-9627, for property which is located on the following described real estate, to -wit: Part of the SE1/4 of Section 36, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant, said plat to be recorded, and WHEREAS, the Board of County Commissioners, pursuant to its authority under C.R.S. §30-28-101(10)(d), did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption, RECX20-0078, does not come within the purview of the definition of the terms "subdivision" and "subdivided land," and WHEREAS, this request is to divide the property into two parcels estimated to be approximately 7.00 acres and 2.00 acres in size. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that the application of Barry and Joyce Bromley for Recorded Exemption, RECX20-0078, be, and hereby is, approved subject to the following conditions: 1. If residences or structures requiring water and sewer are constructed or used for the proposed lots, Weld County On -site Wastewater Treatment System (OWTS) Permits are required for septic systems and shall be installed according to the Weld County OWTS Regulations. 2. Prior to recording the plat: A. The applicant is proposing access from County Road 38 across Lot A of RE -3487 (PIN: #106136400068), which is a parcel not included in the Recorded Exemption. Existing access for the subject parent lot is across Lot A of RE -3487. The applicant shall submit to the Weld County Department of Planning Services, as follows: 1) A recorded copy of a 30 -foot access and utility easement agreement signed by all of the owners of the property crossed by the access. 2) The access and utility easement shall be shown clearly on the plat with the reception number and recording date. B. The applicant shall address the concerns of the Department of Public Works Referral dated August 13, 2020, relating to the proposed Lot A and Lot B access location(s). C. The applicant shall attempt to address the requirements of Front Range Fire Rescue, as stated in the referral response dated July 2, 2020. Evidence of such shall be submitted, in writing, to the Weld County Department of Planning Services. D. Lot A shall comply with the one (1) acre net minimum lot size required by Section 24-8-40.L of the Weld County Code. Net acreage calculations should not include future road right-of-way. 3. Items to be included on the plat: A. The plat shall be titled: Recorded Exemption No. 1061-36-4 RECX20-0078. B. Weld County does not ensure access across the tracks of the Great Western Railroad. The property owner has the sole responsibility to ensure such access. C. A 30 -foot -wide joint access and utility easement extending across Lot B for the benefit of Lot A, shall be shown clearly on the plat. The joint easement shall be dedicated for the use as shown using the language set forth in the Weld County Code, Appendix 24-F.2. The easement shall be graded and drained to provide all-weather access. D. Show and label the existing and proposed access points and the usage types (Agricultural, Residential, Commercial/Industrial, and/or Oil and Gas). The Department of Public Works will review access locations as a part of the plat submittal. E. County Road 38 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance #2017-01) as a collector road, which requires 80 feet of right-of-way at full buildout. The applicant shall delineate and label on the plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. If the existing right-of-way cannot be verified it shall be dedicated. The applicant shall also delineate the physical location of the roadway. This road is maintained by Weld County. F. Setback radiuses for existing oil and gas tank batteries and wellheads shall be indicated on the plat, per the setback requirements of Section 23-3-70.E of the Weld County Code. G. All recorded easements and rights -of -way shall be delineated on the plat by book and page number or reception number. H. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No occupied building or structure shall be constructed within 200 feet of any tank battery, within 150 feet of any oil and gas wellhead or within 25 feet of any plugged or abandoned oil and gas well. 2) Any future structures or uses onsite must obtain the appropriate zoning and building permits. 3) Lots A and B are not eligible for a future land exemption, in accordance with Section 24-8-20.C.4 of the Weld County Code. 4) The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 5) Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the existing County right-of-way. 6) Access on the site shall be maintained to mitigate any impacts to the public road, including damages and/or off -site tracking. 7) Prior to the release of building permits, the applicant shall be required to submit a complete access application for a "preliminarily approved" access location as shown on this plat. 8) Any work that may occupy and/or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. 4879586 Pages: 3 of 6 01/31/2023 03:09 PM R Fee:$0.00 Carly Koppes, Clerk and Recorder, Weld County , CO VIII iVr1ni IIMO iIVINE JAN irgit illIKI U.Iv i 1I II 2023-0223 RECX20-0078 RECORDED EXEMPTION, RECX20-0078 — BARRY AND JOYCE BROMLEY PAGE 4 9) The historical flow patterns and runoff amounts will be maintained on the site. 10) All access and utility easements are dedicated for the benefit of all owners of lots depicted on this plat, including owners of future lots created therefrom, regardless of lot configuration or number of users, and without limitation of the use or intensity of the use of such easements. No lot owner may install a gate or otherwise impede the use of such easements without the approval of all persons with rights of use of such easements. 11) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 12) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot A has an adequate water supply of sufficient quality, quantity, and dependability. 13) Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and Section 29-3-20.B.13 of the Weld County Code, do not need Building Permits; however, a Certificate of Compliance must be filed with the Department of Planning Services and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 14) Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Facility Fee, County -Wide Road Impact Fee, and Drainage Impact Fee Programs. 15) Potential Purchasers are hereby notified that an agricultural service establishment, including a rail line is permitted by AMUSR-935 and is located directly west of the Recorded Exemption. Off -site impacts that may be encountered include noise and dust from trucks, tractors and equipment. 16) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County has some of the most abundant mineral resources, including, but not limited to, sand and gravel, oil, natural gas, and coal. Under Title 34 of the Colorado Revised Statutes, minerals are vital resources because (a) the State's commercial mineral deposits are essential to the State's economy; (b) the populous counties of the state face a critical shortage of such deposits; and (c) such deposits should be extracted according to a rational plan, calculated to avoid waste of such deposits and cause the least practicable disruption of the ecology and quality of life of the citizens 4879586 Pages: 4 of 6 01/31/2023 03:09 PM R Fee:$0.00 Carly Kopp., Clerk and Recorder, Weld County , CO 1111 INFJP1,11 rL1101IAi34 EOM 111 2023-0223 RECX20-0078 RECORDED EXEMPTION, RECX20-0078 — BARRY AND JOYCE BROMLEY PAGE 5 of the populous counties of the state. Mineral resource locations are widespread throughout the County and people moving into these areas must recognize the various impacts associated with this development. Oftentimes, mineral resource sites are fixed to their geographical and geophysical locations. Moreover, these resources are protected property rights and mineral owners should be afforded the opportunity to extract the mineral resource. 17) The Weld County Right to Farm Statement, as it appears in Section 22-2-30.A.4.a of the Weld County Code, shall be placed on the map and recognized at all times. 4. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The applicant shall submit an electronic copy (PDF) of the plat for preliminary approval to the Department of Planning Services. Upon approval of the plat, the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the County Clerk and Recorder by the Department of Planning Services. The Mylar plat and additional requirements shall be recorded within sixty (60) days from the date the administrative review was signed. The applicant shall be responsible for paying the recording fee. 5. In accordance with Weld County Code Ordinance #2005-7, approved June 1, 2005, should the plat not be recorded within the required 60 days from the date of the Board of County Commissioners Resolution, a $50.00 recording continuance charge shall be added for each additional 3 month period. 6. The applicant shall create and record deeds for all the newly created lots; deeds shall include the legal description of each lot and the reception of the recorded exemption. New deeds are required even if lots will remain under the same ownership. The applicant is unable to comply with the Great Western Railway condition of approval. Therefore, this application is being forwarded to the Board of County Commissioners with a recommendation for denial. The Department of Planning Services staff has reviewed this request and recommends that this request be denied. As stated, two -lot Recorded Exemption RECX20-0078 was administratively approved with conditions on September 3, 2020 as detailed in the Staff Report as prepared by the Department of Planning Services. The purpose of the proposed recorded exemption was to split a parcel of land into a two (2) acre Lot A and a seven (7) acre Lot B. This was a one -time -only split of a parcel created prior to subdivision regulations, being a provision in the Weld County Code at the time of application. Condition of Approval item #7 in the RECX20-0078 Staff Report states: "If the exemption plat has not been recorded within sixty (60) days from the date the administrative review was signed, or Board of County Commissioners resolution, or if an applicant is unwilling or unable to meet any of the conditions within sixty (60) days of approval, the application will be forwarded to the Board of County Commissioners with a staff recommendation for denial. The Director of Planning Services may grant an extension of time, for good cause shown, upon a written request by the applicant." The applicant has attempted to complete various conditions of approval that were detailed in the application. In an effort to best support the needs of citizens of Weld County, staff has understood that extenuating circumstances existed, being the need to complete these conditions that would eclipse this period. In particular, the applicant worked for over a year to secure a recorded access and utility easement across the adjacent property to the south. With the exception of submitting a formal Recorded Exemption plat for redline review, there is only one remaining condition of approval that has proved to be insurmountable for the applicants. Specifically, the applicants are unable to comply with Condition of Approval item # 2.6 and its subparts, regarding the integration of Great Western Railway interests. The applicant shall contact the Great Western Railroad, regarding the following topics: 1) A crossing agreement may be required to cross the 100 -foot railroad right-of-way. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. 2) The applicant is proposing access across Lot B of RECX20-0078 to Lot A of RECX20-0078 via a proposed access and utility easement, to be dedicated on the plat map under item 3.B of this staff report. The easement will be physically located to take advantage of an existing field road. If a portion of that access road is located within the Great Western Railroad right-of-way (to be verified by survey), the applicant shall obtain written permission from Great Western for the access road to cross the right-of-way. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. If permission from Great Western cannot be secured, the access road must entirely be located on proposed Lot B. 3) A northern spur line crosses proposed Lot B of RECX20-0078 and may have associated fee -owned right-of-way. a. If fee -owned right-of-way exists, the portion of land between the northern spur line and southern mainline shall be excepted out of proposed Lot B. A draft deed for this excepted parcel shall be submitted to Planning staff for review. The deed shall be recorded in conjunction with the RECX20-0078 plat map. The excepted parcel may be non -buildable. b. If no fee -owned right-of-way exists, an easement for the northern spur line shall be shown on the plat map, in accordance with easement requirements as detailed by Great Western Railroad." This Condition of Approval was included in the Staff Report by Planning staff and did not originate from a Great Western Railway, as no referral was submitted by that agency. It was the intention of Planning staff that all potentially affected parties would be involved in this process. The applicants therefore reached out to Great Western Railway in order to address this condition; however, they have been met with onerous requirements that they are unable to complete. On September 13, 2022, the applicants submitted a request letter that there case be presented to the Board of County Commissioners. After repeat attempts to work with Great Western Railway and OmniTrax, they have been unsuccessful at obtaining the required crossing agreements and supplemental items. The Department of Planning Services likewise entered into discussion with Great Western Railway and OmniTrax to work to an equitable solution. To -date no agreements have been obtained between the property owner and railroad company. As a result, Planning staff is presenting this previously administratively approved with conditions application to the Board of County Commissioners with a recommendation for denial as the applicant has unsuccessfully completed the conditions of approval. Should the applicant's request be approved, the applicant shall submit the draft Recorded Exemption plat to Planning staff for redline review. Upon approval of the recorded exemption plat, the plat shall be signed by the property owners and submitted for recording to the Weld County Department of Planning Services. Once submitted, the plat will be signed by the Board of County Commissioners and recorded. An Appeal to Weld County Planning Department We have attached here a copy of the Final Staff Report for our Recorded Exemption, RECX20-0078. We applied in June of 2020 and have been working on meeting the two conditions ever since. We did finally get an easement agreement with Christian Matthisen, also attached. What we have been unable to do is get an agreement with the railroad. Great Western is owned by Omnitrax, whom we contacted. Because we approached them and offered, they were trying to accommodate us, but the truth is they do not have a residential application for crossing or utilities. We have been working with them since January, filling out expensive applications and trying to get a clear answer on what they need from us, and they don't seem to have an answer. That leads us to believe that residential crossings is not something they do. Barry and Joyce have lived here for 28 years, and the ditch and lake owners have also been using the road, without ever being approached by the railroad. We even asked Omnitrax for an example of another residential situation who needed an agreement so that we could try to copy it, and the closest they could give us was a church in Georgia. The requirements for commercial crossings are far beyond what we could manage — an insurance policy of one million dollars, a yearly fee of $1,000, etc. We do not believe that is necessary for our little dirt driveway that is the only way to access the property. We currently live with Barry and Joyce, and have for two years, so the crossings wouldn't increase significantly if we were to build here. On the attached staff report, under condition B, number 2 it says: If permission from Great Western cannot be secured, the access road must entirely be located on proposed Lot B. The plat map will confirm, when completed, that we left the access road in the larger lot, which is Lot B. This appears to us that we have met this requirement. Our surveyor has been waiting for us to complete this step in order to finalize the plat map. We respectfully request that the County agree that we have met the conditions by a thorough attempt to obtain an agreement with the railroad, but having failed to acquire it, leaving the access road with Lot B is sufficient. If we may include a second request, we have been working for two years on this application process, and would like to finish it as quickly as possible. The Parties wish to enter into this Agreement to resolve such dispute and document certain rights and obligations with respect to use of the Easement. NOW, THEREFORE, in consideration of the above recitals, and in consideration of mutual concessions contemplated hereunder, the following terms, representations, and undertakings herein, and other good and valuable consideration, the receipt, adequacy and sufficiency of which are hereby acknowledged, the Parties hereby agree to be bound as follows: TERMS 1. Incorporation of Background Statements. The Background Statements are hereby incorporated into the operative portion of this Agreement as if set forth in full. 2. Release of Prior Rights. The parties agree that this Agreement is intended to comprehensively address all easement rights of Bromleys in the Mathisen Property. To that end, Bromleys, their heirs and assigns, hereby release and quitclaim to Mathisen, his heirs and assigns, any and all easement rights in the Mathisen Property other than the rights in this Agreement. 3. Grant of Easement. Mathisen, his heirs and assigns, hereby grants to Bromleys, their heirs and assigns, a perpetual, non-exclusive access and utility easement on the terms described herein (the "Easement"). 4. Easement Area. The Easement Area is described as a thirty-five (35) foot wide area for the ingress and egress to the Bromley Property across the Mathisen Property, as depicted in Exhibit A and corresponding to the location of the Existing Easement. 5. Nature of Easement. The Easement shall be for the sole purpose of providing the Bromleys access and utility access across the Mathisen Property for the benefit of the Bromley Property. At no time will Mathisen take any actions or place any impediments in the Easement that impede or limit the ability of the Bromleys and their invitees or guests to utilize the Easement for ingress and egress to the Bromley Property, as may be divided according to RECX20-0078, including ingress and egress with heavy equipment and vehicles. 6. Utilities. Any party installing utilities in the Easement Areas shall be responsible, at its sole cost and expense, to repair any damages to the respective Easement Area caused by such installation. Any fixtures or improvements needed for the installation of utilities shall not impede or limit the ability of either party to utilize the Easement Area as described herein. 7. No Obstructions. The Parties shall keep the Easement Area free of any obstruction, gate, or fence. Mathisen may landscape or make improvements, so long as such landscaping or improvements do not impair the surface of the Easement Area or impair the Bromleys' use of the Easement Area. Bromleys shall grade, or shall cause grading to be performed by a contractor of Bromleys' choice, the Easement Area twice per year at their sole expense. The grading provided shall be substantially the same as exists as of the date of this Agreement (the "Minimum Maintenance"). During periods of active construction, Bromleys shall also take reasonable measures to control dust from such construction traffic. 9. Improvements. "Improvements" means changes to the Easement which result in conditions better than Minimum Maintenance, such as asphalt or other upgraded road surface, dust control, or drainage alterations. Bromleys shall not make Improvements to the Easement without prior consent of Mathisen. Should Mathisen choose to make Improvements to the Easement, Mathisen shall bear the cost of same. Nothing herein shall preclude the parties from making improvements to the Easement Area by agreement. 10. Speed Limit. Bromleys shall not exceed twenty (20) miles per hour on the Easement Area, regardless of the vehicle used. 11. Further Subdivision. Bromleys covenant and agree that they will not further subdivide the Bromley Property after completing the subdivision RECX20-0078 for a period of twenty (20) years after the effective date of this Agreement. 12. Notice. The Parties shall make reasonable efforts to give notice to the other Party at least three days prior to the installation, maintenance, or repair of any Utilities, Improvements or other necessary causes which might cause the Easement to become temporarily impassable. 13. Termination. This Agreement may only be terminated by express written agreement of all Parties. 14. Continuity. The Easement and this Agreement runs with the land, whether as a whole or divided, and is binding upon and for the benefit of the successors, heirs, and assigns of each party. 15. Samuel Gunter. Bromleys understand and agree that Samuel Gunter may use the Easement Area occasionally in order to access the Gunter property, which lies to the east of the Mathisen Property. 16. Attorney Fees. Should either Party be required to enforce this Agreement, the prevailing party will be entitled to recovery of costs and attorney's fees. 17. Severability. If any provision of this Agreement is held illegal, invalid, or unenforceable, such holding shall not affect any other provision hereof. Waiver. A party's failure or neglect to enforce any of its rights under this agreement will not be deemed to be a waiver of that or any other of its rights. A party's waiver of any right hereunder will not be deemed to be a waiver of any other of its rights. 19. Counterparts. The Parties may execute this Agreement in counterparts which, when taken together, shall constitute one agreement. The Parties may execute this document by facsimile or electronic signature, which shall be as effective as if an original signature. 20. Colorado Law. This Agreement shall be interpreted and construed according to the laws of the State of Colorado, without regard to its conflict of law provisions. The Parties consent to the exclusive jurisdiction and venue of the Colorado state court located in the County of Weld, State of Colorado, for any action arising out of or relating to this Agreement. 21 Entire Agreement. This Agreement constitutes the complete understanding between the undersigned concerning the subject matter herein. This Agreement supersedes and replaces all other agreements, contracts, statements, representations, or understandings between or among the Parties, whether written or verbal. The Parties acknowledge that there have been no promises or representations concerning the subject matter of this Agreement other than those set forth herein. This Agreement cannot be altered, amended, or modified in any respect, except by a writing duly executed by the Parties. 22. Interpretation. This Agreement is mutually negotiated and should not be construed against any party. Since this Agreement was mutually drafted and negotiated, this Agreement shall not be construed against the "drafter" of the Agreement. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. * No occupied building or structure shall be constructed within two -hundred (200) feet of any tank battery, within one hundred -fifty (150) feet of any oil and gas wellhead or within twenty-five (25) feet of any plugged or abandoned oil and gas well. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Lots A and B are not eligible for a future land exemption in accordance with Section 24-8- 20.C.4 of the Weld County Code. 4) The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. 5) Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the existing County right-of-way. 6) Access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. 7) Prior to the release of building permits, the applicant shall be required to submit a complete access application for a "preliminarily approved" access location as shown on this plat. 8) Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. 9) The historical flow patterns and runoff amounts will be maintained on the site. 10) All access and utility easements are dedicated for the benefit of all owners of lots depicted on this plat, including owners of future lots created therefrom, regardless of lot configuration or number of users, and without limitation of the use or intensity of the use of such easements. No lot owner may install a gate or otherwise impede the use of such easements without the approval of all persons with rights of use of such easements. 11) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 12) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot A has an adequate water supply of sufficient quality, quantity and dependability. RECX20-0078 Page 3 of 5 13) Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and Section 29-3-20.B.13 of the Weld County Code do not need building permits, however, a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 14) Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Facility Fee, County -Wide Road Impact Fee, and Drainage Impact Fee Programs. 15) Potential Purchasers are hereby notified that a agricultural service establishment including a rail line is permitted by AM USR-935 and is located directly west of the Recorded Exemption. Off -site impacts that may be encountered include noise and dust from trucks, tractors and equipment. 16) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County has some of the most abundant mineral resources, including, but not limited to, sand and gravel, oil, natural gas, and coal. Under title 34 of the Colorado Revised Statutes, minerals are vital resources because (a) the State's commercial mineral deposits are essential to the State's economy; (b) the populous counties of the state face a critical shortage of such deposits; and (c) such deposits should be extracted according to a rational plan, calculated to avoid waste of such deposits and cause the least practicable disruption of the ecology and quality of life of the citizens of the populous counties of the state. Mineral resource locations are widespread throughout the County and person moving into these areas must recognize the various impacts associated with this development. Often times, mineral resource sites are fixed to their geographical and geophysical locations. Moreover, these resources are protected property rights and mineral owners should be afforded the opportunity to extract the mineral resource. 17) WELD COUNTY'S RIGHT TO FARM STATEMENT: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well -run agricultural activities will generate off -site impacts, including noise from tractors and equipment; slow -moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. RECX20-0078 Page 4 of 5 Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of State and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 5. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The applicant shall submit an electronic copy (PDF) of the plat for preliminary approval to the Department of Planning Services. Upon approval of the plat, the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the County Clerk and Recorder by the Department of Planning Services. The Mylar plat and additional requirements shall be recorded within sixty (60) days from the date the administrative review was signed. The applicant shall be responsible for paying the recording fee. 6. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not be recorded within the required sixty (60) days from the date the Administrative Review was signed a $50.00 recording continuance charge shall added for each additional 3 month period. 7. If the exemption plat has not been recorded within sixty (60) days from the date the administrative review was signed, or Board of County Commissioners resolution, or if an applicant is unwilling or unable to meet any of the conditions within sixty (60) days of approval, the application will be forwarded to the Board of County Commissioners with a staff recommendation for denial. The Director of Planning Services may grant an extension of time, for good cause shown, upon a written request by the applicant. 8. The applicant shall create and record deeds for all the newly created lots; deeds shall include the legal description of each lot and the reception of the recorded exemption. New deeds are required even if lots will remain under the same ownership. Failure to do so may create issues with the proper assessment of the lots by the Weld County Assessor's Department and may create a clouded chain of title.
