M. , in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Weld County Landfill, Inc. , Box 596, Evans, Colorado; requesting approval of site for a sanitary landfill, also known as a solid and/or liquid waste disposal business on the following described property, to-wit: A parcel of land located in the Northwest Quarter of the Southeast Quarter (NWISE4) of Section 19., Township 1 North, Range 66 West of the 6th P. M. , Weld County, Colorado, more particularly described as follows: • • Beginning at the Northeast corner of the Northwest • Quarter of the Southeast Quarter (NWISE,) of Section • 19, Township 1 North, Range 66 West, thence 400 feet west along the north line of the Northwest Quarter • of the Southeast Quarter (NW4SE-), Section 19, to the • true point of beginning. Thence south 790 feet and parallel to the east line of said Section to a point, thence west and parallel to the North line of said section, 150 feet to a point, thence south 400 feet and parallel to the east line of Section to a point, thence • west 320 feet and parallel to.the north line of said • Section to a point, thence north 1, 190 feet and parallel to the east line of said Section to a point, thence east 470 feet along the north line of the Northwest Quarter of the Southeast Quarter (NW+SE4) of Section 19, to • the point of beginning, containing 11. 4 acres, more or less, and • WHEREAS, the petitioner was present' and represented by Earl Moffat, and - ' WHEREAS, there was some opposition to the request of petitioner for the location • ,of,a sanitary:landfill 'at said location, and •WHEREAS, the said requested sanitary landfill operation is located in an agricultural zone as set forth in the Weld County Zoning Resolution, and • WHEREAS, according to Section 3. 3(2)'of the Zoning Resolution -of Weld County, said sanitary landfill operation may be authorized upon • the ap'p'_roval of the Board of County Commissioners of Weld County, - and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner; and studied the recommendations of the Weld County .Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado; that the application of Weld . County Landfill, Inc. to locate-a sanitary landfill on the premises indicated above; be, and it is hereby granted under the conditions following: , 1. That any sanitary landfill facility to be_installed shall be approved by the State Health Department. • 2. Mr. Lorenson stated it is generally following the preliminary that was submitted in 1966. Survey data has not been submitted, street grades, right angles on the streets are required. The bond required would be $53,400.00 for paving, curb, gutter and side— walks. A 1' strip along County Road #52 is required to prevent double front- age. Mr. Paul stated a cell will have to be built along side of the present lagoon which belongs to Hill IN Park Sanitation System. Mr. Bowles stated a letter is required to this effect. MOTION: By Mr. Bowles to take the matter under advisement. Second by Mr. LePore. A unanimous vote of "Aye". Motion carried. . RESOLUTION: Be it therefore resolved to recommend approval to the Board of County Commissioners subject to a statement from the Sanitation District that the sewage facilities are adequate as required by the Health Department, post- ing a bond and modifications acceptable by the Planning Commission. Motion by Mr. Bowles, second by Mr. Anderson. A unanimous vote of "Aye". Motion carried. • • APPLICANTS: Country Club Estates Inc. The County Commissioners are not approving any zoning until the 16th Street drainage is resolved between the County, the City and the developers. Recommended the decision be tabled until this problem is re— solved. MOTION: By Mr. Bowles that the application be tabled until such time the Planning Commission is furnished with favorable written report from both the County .Engineer and the Engineer of the City of Greeley stating that the drainage problem is acceptable to both. Second by Mr. Watson. A unanimous vote of "Aye". Motion carried. APPLICANT: Weld County Land Fill - SUBJECT: Application Tape 306 +'307 LOCATION: SEl Sec 19 Tl R66 DISCUSSION: Site has been approved by Mr. Paul. Mr. Lorenson stated the site is adjacent to a major highway. Mr. Bowles stated if dirt for the necessary covering can be furnished, it would be an ideal location. Mr. Lorenson suggested the matter be tabled and schedule a meeting between the Planning Commission and the County Commissioners before a decision is made. MOTION: By Mr. Anderson to table the matter until it can be discussed with the • County Commissioners. Second by Mr. LePore. A unanimous vote of "Aye". Motion carried. SUBJECT: Discussion regarding platting for R. H. Jacobson DISCUSSION: Mr. Lorenson stated Mr. Jacobson could not be present and asked him to present his proposal. Mr. Jacobson is interested in possibly sub- dividing 180 acres near Mead. Mr. Lorenson stated he had checked the assessors records and it is some of the best farming ground.• Mr. Jacobson suggested about 60 acres be developed in long narrow lots, which violates to 1 radio required by the Subdivision Regulations. I hope this letter will be carefully considered by the Commissioners. We are vitally concerned about this problem and feel constrained to take whatever steps may be needed to keep a dumping facility out of the populated valley area and to help the Commissioners locate it in a less populated high ground area. After reviewing the pit site, we have no objection to making a sanitary land fill out of this area, if the following provisions can be adhered as far as the portion that lies within State High- way Right of Way. 1. No dumping will be allowed from Highway 85 into the pit. 2. County will be responsible for no trash or litter blowing onto Highway Right of Way. 3. County will be responsible for removing present right-of- way fence and replacing after land fill is complete. 4. Final pit elevations will be such that drainage is away from Highway Right of Way. 5. County will be responsible for seeding and mulching area within Highway Right of Way after fill is complete.
