SQTATEllENT By the Comniesiori• • Decision No. 656 issued November 6, 1923, by-this Commission established a public highway crossing at grade over the right-of-way and track of the Chicago, Burlington & Quincy Railroad on the east and west section line between Sections Nos. 16 and 21, T. 1 N., R. 65 I7., -of the 6th P.L-t as petitioned- in -Applicstion No. 256 by the Board of - County Commissioners of 17e1d County, Colorado. The respondent. railroad had filed Application No. 271 request- ing permission to close the public highway crossing at grade on the north and south section line between Sections 20 and 21, T. 1N., R. 65 57., of the 6th P.M. with permission to open a public crossing at grade on the east and west section line between Sections 20 ors 29, T. 1N., R. 65 W., of the 6th POI., the latter location being one at which a private cross- ing existed. The facilities at the two latter locations described in Ap- plication No. 271 had been establishe^ by Decision No. 255 by the Conmis- °ion on June 13, 1919, in Application No. 38. At that time the convenience and necessity of those residents situated east of the Chicago, Burlington & Quincy Railroad track between Hudson and Tonville seemed to require one public crossing as a means of entering the main highway which parallels the railroad track on the north- west side. The one on the line between Sections 20 and 21 was selected at that time on account of its location being approximately midway between -1- in-VS- \� Hudson and Tonville. There have bean enbmitted certain exhibits marked Chicago, Burlington & Quincy Exhibit, Bo. 1 and Chicago, Burlington & Quincy Exhibit No. 2. The creasing on the line between Sections 20 and 21 is designated as Point B on these exhibits. The private crossing on or near the section line between Sections 20 and 29 is designated on. the exhibit as Point "C". The crossing nearest Hudson on the line between Sections 16 and 21 is designated as Point "1". The petition now before us asking for a reopening of Applications Hos. 256 and 271 and a modification of the orders made therein was filed September 29, 1924, in accordance with section 29 of the Public Utilities Act as amended April 16, 1917, and it alleges that the insistent' use of the private croesing•at "0" as a public one produces a condition wherein throe public crossings exist within one and one-eighth miles of track;• and that so many crossings in such close proximity are unnecessary and unreasonable, " "- a source of useless expense, and create a situation of unnecessary danger • " to the traveling public both on the highways and on said railroad. Notices were issued by the Commission setting the matter for hearing on Decanter 22, ' 1924, at 10'00 A.H. in the Hearing Roam of the Commission, 305 State Office Building, Deaver, Colorado. The matter was heard at that time. J. L. Rice appeared for the Chicago, Burlington & Quincy Railroad Company. W. R. Kelly appeared for the Board of County Commissioners of Weld County. The railroad had several of their employees present, including H. B. McLaren, superintend-, ent, C. 7. Charleston and H. A. Aallberg, Engineers,- B. Herigstad, Headmaster, and A. W. Jones, section foremea;, each of wham testified to the failure of the railroad in its attempt to keep the private crossing "C" closed to public use on account of the repeated destruction of fences and gstes by persons un- known to them, and they expressed their belief that a greater volume of travel "passed over this crossing than over the public crossing at '1B" 3/8 of a mile northeast. It seems evident from the testimony that the crossing at "A", which is the one nearest Hudson, should remain open if for no other reason than for the convenience of the school busses that use it. ' 1/9- 9V • • W. Is. Reynolds, Engineer for the Commission, was called. by Mr. Rios and questioned regarding the situation. Prom the testimony of witnesses named, three crossings are not needed between Hudson and Ton— , villa. The logical solution of'the matter is to retain two that will bast serve those residents east of the track 1n, reaching either Hudson • or Tonville. It appears to the Commission that the locations "A" and "C" will serve the general public' to the best advantage, even though some few residents directly east of crossing "BIT would prefer the retention of facilities at this point. • D. C. Converse appeared as a protesting witness and testified that he, as well as several other neighbors whom he named, preferred location "B" • ' to location "C" for the public crossing; but the preponderance of evidence indicates more travel on crossing "C" even in its present unsuitable condition than on crossing "B" adequately ,constructed. and graded. The Commission will, • therefore, issue its order granting the changes requested in the application • of the Chicago, Burlington & Quincy Railroad, as set forth herein. • ORDER IT IS THratBP01B ORDERED, That, in accordance with Section 29 'of the Public Utilities Act of the State of Colorado, as amended April 16, 1917, the public highway crossing at grade that has been permitted to be opened and es- tablished across the right-of-:way and track. of the Chicago, Burlington G Quincy railroad at a point where the main line of said railroad intersects the section line between Sections 16 andl, 21, T. 1 N., R. 65 W. of the 6th P.H. in Wold County, Colorado, in Decision No. 866 on November 6, 1923, shall be retained. - • and maintained for public use in-accordance with said decision. - IT Is EMITTER ORDERED, That the public crossing an the section line between Sections 20 and 21. While I was not present at the hearing in these particular oases in September of this year, I did go upon the ground in at= of 1919 when this matter was before the Commission sail am, therefore, familiar with the to- pography of the country. While the opening of the additional crossing as ap- plied for in Application No. 256 will meet the sonvscienow of sere people, that would be true were there a crossing at grade at every half mile or less throughout the entire length of the railroad; but, as I understand, the govern- ing and controlling principle in cases of this character is, that the con- venience of the public mast give way to the safety of the public whenever and wherever it is practically possible so to do. I would have been in favor of permitting the establishment of the crossing at grade as applied for in Application No. 256 provided the existing crossing, as described in .pplica- Sion No. 271, were permitted to have been closed. The permitting of two crossings at grade, with a private crossing midway, in this western country where the density of population is by am . means congested is, in my opinion, not only contrary to the principle of safety first in the interest of the public, bat is unreasonable, unwarranted and unjustified from any point that it may be viewed. Dear Sir : I have received from the Burlington Division Superintendent at McCook, Nebraska, some papers originating with your letter of Sept. 27, 1916, addressed to John F. Vallery, General Agent, Denver, requesting the construction of a crossing and cattle guards along the south line of section 20, township 1 north, range 65 west. o Our engineer reports that the proposed crossing is near station 421 and about two miles -west of Hudson, an6 that there o is an undergrade crossing about 400 feet away from the proposed o new crossing. Of course the railroad company desires very much to avoid all grade crossings possible and if we are correct in our under- standing about the existence of an undergrade crossing in the immediate vicinity of the proposed new crossing, it seems to me that the county commissioners ought not to insist on the con- struction- of-the -additional crossing. Won' t you- kindly advise me whether I am correct in this and whether as a matter of • pfact there is an undergrade crossing in the immediate vicinity of the proposed new crossing. It does not seem to me that the county commissioners should go to the expense of a new crossing 'under the circumstances.
