There were also present: ( ',6'/ & PotP Ava 77&v T aA15/1/ Thereupon, the following proceedings , among others, were had and taken, to wit: The Secretary of said District presented and read an affidavit showing that the notice of the special bond election of the 17th day of September, 1974 , had been duly published on Rujausf 25 , 1974, on SF0't 3T, 1974 , and on gagipt /2., 1974 , in the G4ton/ /447i€,91--D , and in due form and manner as required by law, and said affi- davit was ordered filed and preserved as a part of the records of the District. The Secretary then announced that this was the time and place for canvassing the returns of said special bond election being within three days after the date thereof and that he had received the returns of the judges of said election, held as aforesaid, which he proceeded to open and read, as follows : -22- (Form for Returns of Election Judges) STATE OF COLORADO ) ) COUNTY OF WELD ) SS . That a special bond election of the District was held at the Eaton Fire Station, 220 First Street, Eaton, Colorado, within said District, on Tuesday, the 17th day of September, 1974, between the hours of 7 :00 a.m. and 7 :00 p .m. , at which election a question concerning the issuance of gen- eral obligation fire protection bonds of the District in the principal amount of not exceeding $90,000 was submitted. 2 . That the undersigned were the duly appointed judges of election for said special election at the polling place at Eaton Fire Station, 220 First Street, Eaton, Colorado, being the polling place for the District, the boundaries of the District constituting one precinct for said election . 3. That the polls for the purpose of said elec- tion were opened at the hour of 7 :00 a.m. and remained open continuously and were closed at the hour of 7 :00 p.m. ; that every person, otherwise qualified to vote, who was standing in line waiting to vote at 7 :00 p.m. was permitted to vote; that we kept the register in pollbooks provided for that purpose of the name and address of each elector voting on the question submitted at said election; that immediately after the closing of the polls we counted the ballots cast; that there were 93 ballots cast by electors upon the question submitted, of which .O were "For the Bonds" and C5 were "Against the Bonds, " there r/ being `/M spoiled ballots, 0 ex- cess ballots, 3L07 unused ballots , and C defective ballots . 4. That the question of contracting a bonded debt by the District in the amount of $90,000 by the issuance and sale of the negotiable, coupon, general obligation fire pro- tection bonds of the District, was decided in the *l 1 4 n. . by a majority of - ( 572) of all the allots -23- cast upon said question at said polling place by the electors of the District. 5. That all of the ballots cast at said election were so cast by persons, who were qualified to vote at gen- eral elections in the State, registration pursuant to Section 89-26-6, Colorado Revised Statutes 1963, or to the general election (or any other) statutes not being required, and who were residents of the District on the day of election or who, or whose spouse, owned real or personal property within the District; and that no person possessing the proper qualifi- cations was refused the privilege of voting at said election. That prior to opening said envelope and deposit- ing said ballot into the ballot box as aforesaid, we deter- mined that the elector' s certificate with each envelope was properly executed and acknowledged or certified. 4. That immediately after the closing of the polls we counted the absentee ballots cast; that there were / absen- tee ballots cast by electors upon the bond question sub- mitted, of which / were "For the Bonds" and 0 were "Against the Bonds , " there being p spoiled ballots, () excess ballots, 9 unused ballots, and O defective ballots . / -25- 5.
