NOTICE IS HEREBY GIVEN that a special meeting
of the Board of Directors of Eaton Fire Protection
District (herein the "District") will be held at the
Eaton Fire Station, 220 First Street, Eaton, Colorado,
within the boundaries of the District and in Weld County
at 8/?p P.m. , on TU6sopyi , the /refit day of
September, 1974 , for the purpose of canvassing the results
of a special election of the District, and for the trans-
action of such other business incidental to the foregoing
as may come before said meeting.

tection District, County of Weld and State of Colorado ,
met in Sc /Rt. session at the Eaton Fire Station, Eaton,
Colorado, within the boundaries of the District and in

Thereupon, the following proceedings , among others,
were had and taken, to wit:
The Secretary of said District presented and read
an affidavit showing that the notice of the special bond
election of the 17th day of September, 1974 , had been duly
published on Rujausf 25 , 1974, on SF0't 3T, 1974 ,
and on gagipt /2., 1974 , in the G4ton/ /447i€,91--D ,
and in due form and manner as required by law, and said affi-
davit was ordered filed and preserved as a part of the records
of the District.
The Secretary then announced that this was the
time and place for canvassing the returns of said special
bond election being within three days after the date thereof
and that he had received the returns of the judges of said
election, held as aforesaid, which he proceeded to open and
read, as follows :

PROTECTION DISTRICT, IN THE COUNTY OF WELD AND STATE
OF COLORADO:
The undersigned respectfully report and certify:
1. That a special bond election of the District
was held at the Eaton Fire Station, 220 First Street, Eaton,
Colorado, within said District, on Tuesday, the 17th day of
September, 1974, between the hours of 7 :00 a.m. and 7 :00 p .m. ,
at which election a question concerning the issuance of gen-
eral obligation fire protection bonds of the District in the
principal amount of not exceeding $90,000 was submitted.
2 . That the undersigned were the duly appointed
judges of election for said special election at the polling
place at Eaton Fire Station, 220 First Street, Eaton, Colorado,
being the polling place for the District, the boundaries of
the District constituting one precinct for said election .
3. That the polls for the purpose of said elec-
tion were opened at the hour of 7 :00 a.m. and remained open
continuously and were closed at the hour of 7 :00 p.m. ; that
every person, otherwise qualified to vote, who was standing in
line waiting to vote at 7 :00 p.m. was permitted to vote; that
we kept the register in pollbooks provided for that purpose of
the name and address of each elector voting on the question
submitted at said election; that immediately after the closing
of the polls we counted the ballots cast; that there were
93 ballots cast by electors upon the question submitted,
of which .O were "For the Bonds" and C5 were "Against
the Bonds, " there r/ being `/M spoiled ballots, 0 ex-
cess ballots, 3L07 unused ballots , and C defective
ballots .
4. That the question of contracting a bonded debt
by the District in the amount of $90,000 by the issuance and
sale of the negotiable, coupon, general obligation fire pro-
tection bonds of the District, was decided in the *l 1 4 n. .
by a majority of - ( 572) of all the allots

cast upon said question at said polling place by the electors
of the District.
5. That all of the ballots cast at said election
were so cast by persons, who were qualified to vote at gen-
eral elections in the State, registration pursuant to Section
89-26-6, Colorado Revised Statutes 1963, or to the general
election (or any other) statutes not being required, and who
were residents of the District on the day of election or who,
or whose spouse, owned real or personal property within the
District; and that no person possessing the proper qualifi-
cations was refused the privilege of voting at said election.

The undersigned respectfully report and certify:
1. That a special bond election of the District,
in the County of Weld and State of Colorado, was held at
the Eaton Fire Station, 220 First Street, Eaton, Colorado
in said District, on Tuesday, the 17th day of September,
1974, between the hours of 7 :00 a.m. and 7 :00 p.m. , at
which election questions concerning the issuance of general
obligation fire protection bonds of the District in the
principal amount of not exceeding $90 ,000 was submitted.
2 . That all absent voters ' ballots for said election
were delivered to us unopened by the Secretary of the District
on the day of election. After opening the packages in which
they were delivered, we determined that each of the voter 's
individual identification envelopes was properly sworn. There-
after one of us, in the presence of the other two, after announc-
ing in an audible voice the name of the absent voter, tore open
each envelope without defacing the affidavit or certificate
printed thereon, or without mutilating the enclosed ballot, and
deposited the unfolded ballot in the appropriate ballot box.
3. That prior to opening said envelope and deposit-
ing said ballot into the ballot box as aforesaid, we deter-
mined that the elector' s certificate with each envelope was
properly executed and acknowledged or certified.
4. That immediately after the closing of the polls we
counted the absentee ballots cast; that there were / absen-
tee ballots cast by electors upon the bond question sub-
mitted, of which / were "For the Bonds" and 0 were
"Against the Bonds , " there being p spoiled ballots, ()
excess ballots, 9 unused ballots, and O defective
ballots . /

5. That the question of contracting a bonded debt
by the District in the amount of $90 ,000 by the issuance and

The undersigned, being first duly sworn deposes
and says :
1. That he is the duly chosen, qualified and
acting Secretary of the Board of Directors of the Eaton Fire
Protection District.
2 . That pursuant to the provisions of Section
89-26-33, Colorado Revised Statutes 1963, and all laws there-
unto enabling, applications for absent voters ' ballots were
permitted to be filed with said Secretary from at least
Wednesday, the 28th day of August, 1974, i .e. , a date not
earlier than twenty days before the election, until the close
of business , on Friday, the 13th day of September, 1974, being
the Friday immediately preceding said election, held on
Tuesday, the 17th day of September, 1974.
3. That for each application therefor properly
so filed he delivered to the applicant personally in his
office or by mail to the mailing address given in the
application, an official absent voter 's ballot, together with
the other material required by law.
4 . That at 8: 30 a.m. on Tuesday, the 17th day of
September, 1974, i .e. , the date of the election , he delivered
to /3/44.6:A7 r/bN/( , Judge of Election, all the absent
voters ' ballots on the list received up to that time in sealed
packages as provided by law and that he continued so to deliver
such envelopes as were received thereafter during said day to
and including 7 :00 p.m. on the day of election.
5. That all absent voters ballots filed in the hands
of said Secretary after 7 :00 p.m. on the day of election (if
any) remained in a sealed envelope pursuant to Section 49-14-15,
Colorado Revised Statutes 1963 and remained in the office of
the Secretary of the Board of Directors of the Eaton Fire
Protection District to be destroyed later as provided in Section
49-12-18, Colorado Revised Statutes 1963.
6 . That affiant, as said Secretary, in addition,
did all acts and things necessary to carry out absentee

the following resolution, which was thereupon read in full,

RESOLUTION
WHEREAS , the Board of Directors of Eaton Fire Pro-
tection District did meet in ✓$f'G_e,iRi, session on -yejoso4y ,
the /7611- day of September, 1974, being not more than three
days after the date of a special election held on Tuesday , the
17th day of September, 1974 , to canvass the results of said
special election; and
WHEREAS , at said special election the following ques-
tion was submitted to the qualified electors of the District:
GENERAL OBLIGATION BOND QUESTION SUBMITTED:
Shall the Eaton Fire Protection District,
in the County of Weld and State of Colorado ,
be authorized to issue, in one series or
more, its negotiable , coupon, general obli-
gation fire protection bonds , in the
principal amount of not exceeding $90 ,000 ,
or so much thereof as may be necessary,
for the purchase and other acquisition of
one or more suitable fire trucks, vehicles ,
and other fire protection and fire fighting
equipment, and any other equipment, facili-
ties and appurtenances therefor necessary
or desirable for providing fire protection
to the property within the District, each
series bearing interest at a net effective
interest rate not exceeding 55uOn/ RNA 6W4517,441
per cent ( "`'i %y%) per annum, maturing seri-
ally commencing not later than three years
and extending not more than twenty years
from their date or dates, payable from an-
nual, general (ad valorem) tax levies with-
out limitation as to rate or amount, and to
be issued and sold at one time, or from time
to time, in such manner, upon such terms and
conditions, with such covenants and agree-
ments , and with such other detail as the
Board of Directors may determine, including
at its option provisions for the redemption
of bonds prior to maturity with or without
the payment of a premium not exceeding three
per cent (3%) of the principal amount thereof?
and
WHEREAS , the Board has received, opened and examined
all the certificates of return for said special election.
NOW, THEREFORE , BE IT RESOLVED BY THE BOARD OF
DIRECTORS OF THE EATON FIRE PROTECTION DISTRICT, IN THE
COUNTY OF WELD AND STATE OF COLORADO:
Section 1. That a special bond election held in
the District, on Tuesday, the 17th day of September, 1974 , be,

and the same hereby is, determined and declared to have been
duly called, ordered and held in strict compliance with law.
Section 2. That it is hereby declared that the result
of the canvass of all the votes cast on the bond question by
electors in the special bond election held in the Eaton Fire
Protection District on Tuesday, the 17th day of September,
1974 , is as follows:

Section 4. That the Secretary of the Board of Direc-
tors shall immediately post the certificate of election results
for said election at the Eaton Fire Station, 220 First Street,
Eaton, Colorado, i .e. , at the regular meeting place of the
District.
Section 5. That the Secretary of the Board of Direc-
tors shall immediately enter in the records of said Board, and
file with the County Clerk and Recorder a statement showing
(1) a copy of the affidavit of the publication of the notice of
said election, (2) the names of the judges of said election, ( 3)
the whole number of votes cast in said District by electors , (4)
the number of votes for and against said bond question sub-
mitted, and (5) the results of said election, and forward to
the State Division of Local Government a duplicate of the cer-
tificate of election results as provided in Section 89-26-35 ,
Colorado Revised Statutes 1963.
