A public hearing was conducted on November 22,2023,at 10:00 a.m.,with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 17, 2023, and duly published
October 20,2023,in the Greeley Tribune,a public hearing was conducted to consider the request
of Cervi Enterprises, Inc., do Kerr-McGee Oil and Gas Onshore, LP, for a Site Specific
Development Plan and Use by Special Review Permit,USR23-0037,for Oil and Gas Support and
Service(storage area for parts for drilling rigs,drilling iron pipe and fittings,poly pipe and fittings,
two[2]parts trailers and rig mats,light plant trailers and general oil and gas equipment supplies)
in the A(Agricultural)Zone District.Karin McDougal,Deputy County Attorney,made this a matter
of record.
IE Chris Gathman,Department of Planning Services,presented a brief summary of the proposal,
relayed the site will be surrounded by either a chain link fence or a cattle fence,and stated there
will be no permanent employees.He explained the site will be visited by an employee for one(1)
to two(2)hours daily,the facility will include one(1)job trailer and four(4)storage containers for
construction and operation usage,and a temporary construction trailer during construction.He
stated ten(10)to 20 trips per day will occur during set-up,with trip amounts reduced to one(1)to
five(5)per day during operation.He shared,per the Development Review staff,there is an
existing Colorado Department of Transportation(CDOT)permitted access onto U.S.Highway 34,
utilizing unmaintained right-of-way for County Road (CR)69. He relayed the applicant has
submitted an acceptable Drainage Report,which includes authorization from a neighboring
property owner for the stormwater to discharge onto his parcel,noting Cervi Enterprises is the
owner of the parcel and the owner of the downstream property.He stated 12 referrals were sent

out,four(4)were received with comments, and three (3) received without comments. He
described the surrounding uses and stated the nearest residences are located more than one(1)
mile from the site. Mr. Gathman entered the favorable recommendation of the Planning
Commission into the record,as written,and displayed images of the site and surrounding views.
Ei Lauren Light, Department of Public Health and Environment, stated the applicant has
proposed a portable toilet,which is acceptable,they will provide a dumpster for waste handling,
and a Dust Abatement plan has been submitted which reflects water will be used during
construction,revegetation during operation,and gravel for parking and drive aisles.Ms.Light
shared Environmental Health is listing eight(8)Development Standards to be adhered to,and
there are no outstanding items with the request.
Chair Freeman reviewed the procedures to follow should this case result in a tie vote due to
four(4)Commissioners being present and Commissioner Ross being excused.
Matt Wells,applicant,relayed the reason for laydown yard facility is to avoid unnecessary
truck trips into populated areas.
Edwin Grant,Greeley resident,inquired whether this company is part of Oxidental Petroleum,
which was confirmed.
The Board reviewed the Conditions of Approval and Development Standards, and no
changes or corrections were made.
El In response to Chair Freeman,Mr.Wells,on behalf of Cervi Enterprises,Inc.,c/o Kerr-McGee
Oil and Gas Onshore,LP,indicated they have reviewed,and agreed to abide by,the Conditions
of Approval and Development Standards,as presented.
Commissioner James moved to approve the request of Cervi Enterprises, Inc.,
c/o Kerr-McGee Oil and Gas Onshore,LP,for a Site Specific Development Plan and Use by
Special Review Permit,USR23-0037,for Oil and Gas Support and Service(storage area for parts
for drilling rigs,drilling iron pipe and fittings,poly pipe and fittings,two[2]parts trailers and rig
mats,light plant trailers and general oil and gas equipment supplies)in the A(Agricultural)Zone
District,based on the recommendations of Planning staff and the Planning Commission,with the
Conditions of Approval and Development Standards,as presented.The motion was seconded by
Commissioner Buck,and it carried unanimously.There being no further discussion,the hearing
was completed at 10:56 a.m.
