THE NORTH HALF OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER

WHEREAS , on May 5 , 1972 , the General Assembly
of the State of Colorado , enacted Senate Bill #35 as relates
to Chapter 106 of the Colorado Revised Statutes , and
WHEREAS , on August 30 , 1972 , the Board of County
Commissioners of Weld County, Colorado , adopted Subdivision
Regulations for Weld County, Colorado to comply with the
prescribed Senate Bill #35 , and
WHEREAS , the Weld County Planning Commission
has recommended to the Board of County Commissioners for
recording of plat number 0963- 28- 3-RE- 83 as provided in
Section 9 of the Subdivision Regulations (exemption rules and
regulations) for Weld County, Colorado .
Said division of land determined to be exempt
from the definition of subdivision is more particularly
described as follows :
The North Half (N1/2) of the Southwest Quarter of the
Southwest Quarter (SWQSW'q) of Section 28 , Township
5 North, Range 64 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows :
Beginning at the Southwest Corner (SWCor) of said Section
28 , and considering the East line of said Section 28 , as
bearing North 00°00 ' 00" East, with all other bearings
contained herein relative thereto; Thence North 00°00 ' 00"
East, along the East line of said Section 28 , 661. 00 feet
to the True Point of Beginning;
Thence continuing North 00°00 ' 00" East, along the East
line of said Section 28 , 661. 00 feet;
Thence South 89°39 ' 03" East , 1325 . 19 feet;
Thence South 00°00 ' 11" West, 659 . 81 feet;
Thence North 89°42 ' 08" West, 1325 . 14 feet to the True Point
of Beginning . Said described parcel of land contains
20 . 090 acres , more or less , including a strip of ground
30 feet in width along the East line of said Section 28 ,
reserved for County Road Right-of-Way purposes and is
subject to any rights-of-way or other easements as recorded
by instruments of record or as now existing on said
parcel of land.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners of Weld County, Colorado, that the
Chairman be and he is hereby authorized to sign the plat of a
division of land determined to be exempt from the definition
of Subdivision No . 0963-28-3-RF.-83 , for recording.

THIS AGREEMENT, made and entered into this 13th day of Aug�t , 19 69
by and between the CENTRAL WELD COUNTY WATER DISTRICT, hereinafter called the
District, and Lean H. Gierhart and Frank C. Reedy
hereinafter called Customer, WITNESSETH:
WHEREAS, District has been organized as a legal body and is known as the
Central. Weld County Water District, and .
WHEREAS, Customers are taxpaying electors within said District, or desiring
to join said District, or and,
WHEREAS, Customers are desirous of purchasing One water tao of 3/4
inches'in diameter from the said District,
NOW, THEREFORE, in consideration of the nremises and the terms of this agreement,
it is mutually Agreed. as follows: `
1. Customer agrees to pay the plant investment fee of $ 45°4°
•
Four Hundred, Fifty and No/100----- Dollars.
2. In the event is is not economically feasible to extend the water to the
property line of Customer, which matter is in the entire discretion of District,
then all sums paid hereunder shall be returned to Customer and the agreement shall
be null and void.
3. The description of the premises for which these taps are being purchased
is as follows:
The N4 of SW} of SW'/ of Section 28, Towhship 5 North, Range 64 West of
the 6th P.M., Held County, Colorado
4. This agreement, when approved by the Board of Directors, shalt become a
legal and binding contract upon all parties hereto.
- 5. Customer further agrees to execute any and all easements needed by District
at no expense to District, across Customer's property for the purpose of installing
any pipelines constructed by District. District shall be responsible for restoring
surface area back to reasonable condition at District cost. -
6. It is further mutually agreed that this agreement shall- extend to and be
binding upon the heirs, executors, administrators and assigns of the parties hereto.
7. Customer further agrees to the following special provisions: .
8. Customer further agrees to abide by the rates established and the rules
and regulations of the District.
