RE: REGULATING, WARNING, AND GUIDING TRAFFIC DURING EXTENSION OF
TEMPORARY CLOSURE OF COUNTY ROADS 74 AND 33 INTERSECTION FOR
APPROXIMATELY AN ADDITIONAL FOUR (4) MONTHS, DUE TO LAWSON
CONSTRUCTION COMPANY FALLING SIGNIFICANTLY BEHIND SCHEDULE WITH
UNANTICIPATED DELAYS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to C.R.S. §42-4-106(6)(a):
"...local authorities, with their respective jurisdiction may, for the
purpose of road construction and maintenance, temporarily close to
through traffic or to all vehicular traffic any highway or portion
thereof for a period not to exceed a specified number of work days
for project completion and shall, in conjunction with any such road
closure establish appropriate detours or provide for an alternative
routing of the traffic affected...", and
WHEREAS, on the 3rd day of April, 2023, pursuant to said statute and upon the basis of
traffic and personnel investigations, the Board determined that conditions existed which made it
necessary to temporarily close the intersection of County Roads 74 and 33, to through traffic and
to regulate, warn and guide vehicular traffic by posting signs thereon, with said closure being
effective April 17, 2023, for approximately four (4) months, through August 14, 2023, for a
roundabout construction project, and
WHEREAS, on the 7th day of August, 2023, pursuant to said statute and upon the basis
of traffic and personnel investigations, the Board has determined that conditions continue to exist
which make it necessary to extend said temporary closure of the intersection of
County Roads 74 and 33, with said extended closure being effective August 14, 2023, for
approximately an additional four (4) months through December 1, 2023, as a result of Lawson
Construction Company falling significantly behind schedule due to unanticipated delays, and
further, that standard official traffic control devices shall be erected at said closure giving notice
of the restrictions.

NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, deems it necessary to regulate, warn and guide vehicular traffic on County
roads and any intersections thereof, and it hereby authorizes and orders the posting of such traffic
control devices as shall be reasonably necessary to regulate, warn and/or guide traffic thereon
for the safety of the general public and that said traffic control devices shall conform to the Federal
Manual on Uniform Traffic Control Devices.
BE IT FURTHER RESOLVED that the Board of County Commissioners of Weld County,
Colorado, does declare and establish that the closure of the intersection of County
Roads 74 and 33, be, and hereby is, extended, with said extended closure being effective
August 14, 2023, for approximately an additional four (4) months through December 1, 2023, as
a result of Lawson Construction Company falling significantly behind schedule due to
unanticipated delays, and further, that standard official traffic control devices shall be erected at
said closure giving notice of the restrictions.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 7th day of August, A.D., 2023.

SUBJECT: BOCC Agenda Item
Weld County Public Works is requesting approval to extend the road closure on Weld County Road 74
and Weld County Road 33 due to the contracting company (Lawson Construction) falling significantly
behind schedule.
The original closure dates were April 17, 2023 thru August 14, 2023, Weld County Public Works would
like to extend this road closure to December 1, 2023.

Brief description of the problem/issue:
The WCR33/74 Roundabout Project requires full closure of the intersection to accommodate the ongoing
roadway construction. The project was bid with this in mind, and the closure period described in the bid
specifications is April 17 through August 14, 2023. The following surrounding roads are being utilized as
signed detour routes; 31, 35, 72, and 76. Unfortunately, a series of circumstances and challenges during
construction have led to the construction contractor (Lawson Construction) falling significantly behind the
planned schedule. Public Works currently estimates the closure period will need to be extended to December 1,
2023. Lawson Construction will be assessed $7,800 per day in liquidated damages, starting on August 15,
2023, and continuing until such time as the intersection is deemed safe to be reopened to the public.
What options exist for the Board? (Include consequences, impacts, costs, etc. of options):
• Allow the requested intersection closure extension so ongoing construction can continue. This item will
he placed on the next available BOCC agenda for approval.
• Request a work session to discuss.
Recommendation:
Staff recommends approval of the intersection closure extension as planned.
