APPLICANT : Guy Akins Jr. CASE NUMBER : Z-197 tape 425 SUBJECT : Zone change A - MH-UD LOCATION : SE; Sec 28 T1 R68 APPEARANCE : Mr. Akins DISCUSSION : Mr. Lorenson stated the planning staff recommends to the Planning Commission that the request for a zone change be denied for the following reasons : a letter from School District Re-1J stating there were no school facilities to take the student load from this project. There is strong objection from the Weld County Health Department. It does not lend itself to the Weld County Comprehensive Plan concept. It is too large and poorly located in regard to Regional housing analysis as presented May 1972 page 32 Sec II Item C. Water is to be obtained from Left-Hand Water Co . which is pressed to serve existing needs . New facilities are con- templated but would require a complete review. It does not fit the Boulder County plan . Lafayette has no comprehensive plan to accomodate such a large development, Potential conflict with ad- jacent land use , namely Ranch Eggs Subdivision . The application is premature in that service for sewer , fire protection , and schools are not available at this time . The letters from the Health Dept. and the school district were read. Petitions from surrounding property owners were read . Mr. Bowles asked Mr. Akins what Left- Hand Water Company had committed at this time . Mr. Akins stated they had committed service , however, the service will not be forthcoming for at least two years and there will be additional pumping stations , storage facilities as well as a new line . This development is geared to a new sewage treatment facility which Lafayette has applied for federal funds for, Mr . Akins presented 768 his plans for the proposed park. Plans have been presented to the Town of Lafayette and the Lafayette Planning Commission and both have given their approval : MOTION: By Mr. Nix that the matter be taken under advisement. Harrison stated four of them were present from the Ranch Eggs Subdivision and they are opposed to the development. She stated the water pressure is not adequate at times . The people in Ranch Eggs moved to that area because they desired country living and this development would change all of that . RESOLUTION : tape 427 Be it therefore resolved to recommend denial to the Board of County Commissioners upon the recommendations of the Planning staff. Motion by Mr. Nix , second by Mr. Weigand . A vote of "AYE" by Bowles , Anderson , Nix , Watson and Weigand. Abstain by Heitman . Motion carried APPLICANT: Mt. States Tel . & Tel . Co . If approved it should be subject to : adequate ROW being granted ( 100' on the west side of 35th Avenue) or as required by the City of Greeley. Adequate parking facilities of one space per 2 employees . All ditch lines to be preserved . Limitation of access to 35th Ave .. to one entrance and exit point. CLARK WEAVER,, Attorney ,at Law, Monfort of Colorado, Greeley, Colorado, Appearing on behalf of Monfort of Colorado. Pursuant to the zoning laws of the State of Colorado, a public hearing was held in the office of the Board of .County Commissioners of Weld County, Colorado, on the 30th • day of June, 1972, at 2:00 o'clock p .m. , before the Board . of County Commissioners , Glenn K. Billings , Chairman, Marshall H. Anderson and Harry S .. Ashley, members of the. Board.' • Joseph J . Rusk Certified Shorthand Reporter • Weld County Courthouse .Greeley; Colorado J The following proceedings vere duly had: ' CHAIRMAN GLENN BILLINGS: We will call this hearing . to or'der'. Case Number 156 , Monfort Feed Lot, Inc . , P . 0. Box 1290, Greeley, Colorado, requested land use site of approval for the relocation of . feed lots . At this time, Mr. Telep, would you make the record. MR. TELEP : Thank you; iMr. Chairman.' Let the record show that this cause came on for' hearing this day, June 30, 1972, on the application of Monfort Feed Lots , Inc. , P . 0. Box 1290, Greeley, Colorado, for site approval of the relocation' of feed lots to be located, for want of a concise and distinct legal description, let the record show that the site location will be in various sections consisting of many parcels , and all seems to be located in Township 5 North, Range 63 and 64, Weld County, Colorado. Let the record further show that hearing this morning was duly published as required by law in the Greeley Booster on May 26th and June 16th, 1972 , respectively. • ' Let the. record further show that. there are, in the file many receipts indicating that the adjacent • landowners have been notified of this hearing this morning, thus affording them an opportunity to be present and to testify either in favor, or against the ,2_ • • granting of this permit. Let the record still -further show that the Weld County Planning Commission recommended favorably ,as to this. site approval; and the reasons therefore can, be gone into in more detail with our planning director, Mr. Burman Lorenson.' ' Let the record still further show that the petitioner this morning is represented by Dr. Duane Flack and by its general counsel, Mr . Clark Weaver. • Mr. Chairman, I believe we, are ready to proceed. CHAIRMAN GLENN BILLINGS: Thank you, Mr. Telep. • Dr. . Flack, I call .on you first and you can designate - those people that you want to speak on behalf , of Monfort Feed Lots , Inc . , in presenting the proposal and explaining the exact operations and how you propose to operate the feed lot. - - DR. FLACK: Thank you, Mr . Billings . I will turn it over to Clatk to.startwith. CHAIRMAN/GLENN BILLINGS As each one of you speak, would you give your name and address for the reporter so that we will be able to identify those. making comments either for or against 'the approval of the feed lots . - MR. WEAVER: . My name is Clark Weaver, I am general counsel of Monfort of 'Colorado, Incorporated, and assistant secretary of Monfort Feed Lots , Inc . • -3- ' I) My address is 4724- West 13th' Street in Greeley, and my business address is Post 'Office Box G, Greeley, Colorado. Also speaking on behalf of the petitioners will be Dr. Flack, who will later on explain the particulars of, construction of our proposed feed lot and operation. By way of background, Monfort of Colorado has two separate and distinct feed lot locations , one being just north of Greeley, Colorado. I think it can be indicated easiest. by looking at the diagram that we brought. The north feed lot location is approximately a mile north of Greeley. We also have a south feed' lot located in the vicinity of Gilcrest, ColoSo, This particular feed lot was the subject matter of a hearing held in 1969- here. The proposed location, just for reference, is east of the City of Greeley in the , approximate vicinity of the Town of Kersey. • I would like to reiterate the fact that this proposed site location is a relocation from the existing facility north of Greeley, Colorado, and does not involve a new location per se. - What Monfort of Colorado•plans to do is move all of its existing facilities to the new proposed_ location. Therefore, there would be yery little anditional economic impact in the Weld County area as a whole . -There wouldn' t be any great shift in the put-Chasing of -4- _ i • • available feeder cattle or of the purchase of feed for . these cattle. . - - The reason for the move is essentially one for environmental reasons as mentioned by the president of • Monfort Feed Lots,, Mr. Monfort. We realize that we are very close to the City of Greeley. The proximity of our location of our feed lot is of great concern to us and has been ,for some time. I don' t think it's any . secret that the people of Greeley have from time to. time expressed their feelings on the existence of Monfort Feed.: Lots north of the city. ' We have for some time expressed the fact that we would be looking for a new location, and• this is the culmination of our research. We recognize that Monfort of Colorado, and its existing subsidiaries , as a citizen of the City of Greeley, as it is as well as a citizen. of the County of Weld. ,This, was :brought to our ,attention at the time we renegotiated a sewer contract with the City of Greeley, • • as I am sure you are well aware .. • The way we have gone about the purchase or the • proposed purchase of this new location, we have acquired a number of options from the existing landowners . This was all accomplished in approximately thirty days . The large bulk of these options were acquired in that time. - The approximate cost has been, of the acquisition of the -5- i • I ' options , has been .in excess of fifty thousand dollars . There are twenty two options involved with twenty two separate :and distinct landowners . This covers approximately one 'thousand acres , and the ,facility will run at approximately four hundred to four hundred and fifty acres . - I would like to point out that our options start expiring on July 1st, which is tomorrow, so we can' t over emphasize the need for a decision in the very near . future. Our overall purchase cost of this land alone is . approximately one million dollars, which comes down to approximately one thousand- dollars per acre on an overall average basis . The total cost of the propcs ed move of all of our facilities , which will be, as mentioned by Mr. Monfort, approximately five million dollars . We intend to do this over a period of several years . Mr. Telep has stated the chronology of our petition. The petition was filed• on April 21st„ the planning commission hearing was held on May 16th, and I believe the planning commission's recommendations are a matter of record. I would like to go into that• and -review it very briefly shortly. This culminated in the presentation of our proposal here today. By way of observations from our standpoint, we are extremely satisfied with our present location north -6- of the city. It has in the past proven more profitable, to us from an economic .standpoint than even 'the Gilcrest facility. I think this is largely because of start up costs and inefficiencies of the new operation, But I would like to 'reiterate the fact that we -arequite pleased' with our present location: ' However, as I mentioned before, we are concerned with our proximity to the City of Greeley. • There has been a thorough investigation of the - factors concerned' with this proposed new location. Dr. Flack will go into this in greater detail later. We have considered the available natural resources necessary to supply an operation like this , and we have also considered the environmental impacts of this new location on the existing environment up in that vicinity. - I would like to point out also, just by way of passing, that we certainly ask no special favors , and certainly we know of none that have been granted anyhow. We have engaged 1..h no publicity campaign here . We have solicited no extensive support, but we don't see any - reason in playing numbers games for people to come -out and-raise their hands in support or opposition. We believe that our petition and the reasons for this transfer are self explanatory and will be self evident • to the members of the commission. The conduct of our presentation will be basically- -7- I will give the. brief background and Dr . Flack will then cover the specifics of the operation. We will hope that Dr. Flack would be able to entertain questions of the members of the commission or other interested parties . I would like to point out that we have, responded to the request of the planning commission in presentation of plans for the property location, pen locations that ' will be brought to your attention a little later, drainage and 'retention ponds and greenbelts . Therefore, we will present no expert testimony on our behalf, nor are we soliciting any petitions or petitioners on our behalf. I would like to point out that we have received copies of letters from the Kersey Board of Education District RE-7., and.from Central Weld Water District • in support of our move, just by way of passing. • Our presentation I hope will be informal and, we again would hope that you ask questions . ' Concerning the planning commission's recommendation, the recommendation, for site approval was subject to three • ' •_p'articular:' stipulations• or conditions . - - - First, .a land swap arrangement with the State Highway Department for ' right- of way or the granting of two hundred twenty foot right of way to north of existing Highway 34 and a single access point to Highway 34. . -8 • Two.. A greenbelt at least fifty• feet wide along the south of lot, screening of Highway 34 with a suitable type of vegetation. Three: Both proposed lagoons being sealed and the north lagoon being protected •from the flood plain. Certainly these latter two conditions are suitable. We agree that they, are a necessity for this location. This is certainly agreeable to us . Condition number one, however, has three parts., two, alternatives and one other condition. The one condition being the single access point to Highway 34. This again is what we have, proposed initially, and its totallyacceptable. - The first two parts , however, are extremely difficult for us to accept. We have talked to Mr. Lorenson and the Highway Department a number of times . The first is a 'land swap arrangement with the State Highway Department for right of way. This is almost impossible for us to accept because of the fact that a land swap arrangement, the details of a land swap arrangement are almost impossible, and some of the following suggestions we ask to be considered are the present plans of the Highway Department, as we understand them, are that the existing Highway 34, as is ,indicated in yellow, these; the proposed highway location of the new four •lane facility, will be as in red, and will proceed down off of the map -9- and come back south again at approximately the location I believe it's called the sand bluffs , or something like this . But this is the tentative arrangement set up by the Highway Department. And I will refer to this briefly, and I think Dr. Flack will talk about it a little more later on. MR. ANDERSON: I have a question. How are you going to make a land swap if you don' t know where the highway is going? M. WEAVER: This is one of our points, Mr. Commissioners . We considered this . One of the possible arrangements was that we could purchase our land and then pay the difference that the highway department would have to pay if the highway were later required to be routed south of the existing Highway 34. But, again, these plans are fairly tentative. I think the highway , department has stressed the fact that it may be eight to ten years down the road before construction is even commenced or condemnation is under way. ; From our 'understanding, it 's a public held corporation, to-.have this -unknown liability on our books for eight to ten years I think from an accounting stand- point would be unsuitable . So we don't really know what the valuations of the lands are . We don' t know of any condemnation in the near future, and as far as we know, I think this is fact, that from the point of the existing -10- • • the existing railroad overpass , right here, I don' t think any hearings have been held on this portion in the • -southeasterly direction. I think hearings have been held up . to this- point covering this here. But I don' t • think any hearings have been held on the south part, so we haven't heard -from these, people living north or • south of the highway. I think these plans are relatively tentative. I believe' the reason for this prdposed_routing- was the , present valuerof the' land. I think even by looking at the aerial photograph you can see the character of the lands involved. The lands north of the highway are semi-arid; the land south of the highway being irrigated lands . . • • I would like to point •out that Monforts has certainly no right of condemnation, so we can' t purchase this land. 4.e have been required to purchase the land, or optioned to purchase the land for one thousand dollars an acre . And I am sure- the highway department wouldn' t want to pay that amount for it- because they could condemn it for a lot cheaper price. Therefore, although we have investigated the possibility of land swap arrangements , I just don't have any idea how this could possibly work. The other alternative is a two hundred twenty • foot right of vay just tD the north of existing Highway 34- -11- • • • in the south portion here (indicating) . I think Dr. Flack will point this out. Let me refer to it briefly so you know what I am talking about. I believe ' this was their recommendation., that we give them approximately a two hundred twenty foot right of way north of existing Highway 34, in addition, or perhaps in conjunction with our proposed fifty-foot greenbelt that Dr. Flack will speak to later . If you look at the, character of this particular piece of property, the optioned lands are in yellow within ` the black area . . The 'facilities, •feedlot facilities and supporting facilities will -be within the green area . So . you can see that this is triangular in nature, it 's fairly narrow. And what I would like to point out is, • that if a two hundred twenty foot right of way were , -granted along the north side of Highway 34, this would, - have a substantial impact on our plans . It:'would change the overall character of the feed lot itself.. I am sure the highway department right now does not want to condemn this right of way. If we were to give them two hundred and twenty feet it would be approximately forty acres ; somewhere in that neighborhood, and it would cost us about- forty thousand dollars just to give them this right of. Way that they may or may not use in the future. • Just in passing, I think it 's probably immaterial. to the highway, department whether the highway- is north, -12- • or south in the future. Again, that is entirely their opinion. I would point out that on the other. diagram we had it shown that the highway proceeded to the north side of existing 34, and then came back south of Highway,. existing Highway. 34. It 's our point of view that it would probably be more correct if• the highway ran directly south of the existing highway. Again, if a purchased or condemned purchase of the land was made eight years down the road I think it would be very difficult to determine what the cost of the land on either side of the highway would be, whether or not Monfort did actually purchase this land. According to my count, and I' may be wrong, I just drove past there a number of times., but as far as the relocation of existing improvements , I believe there is probably one dwelling located south of the existing Highway 34, and as I counted somewhere in the neighborhood of five occupied dwellings and two. commercial establishments north. I would like to point out again that, hearings have not been held here so we haven't heard from the oil company, for instance, or the people that live in the dwelling places north of the highway. Therefore, we would respectfully request that the alternative, the alternative portions of the conditions of number one, of the planning Commission's :recommendations, 'be stricken. Of course • -13 • • this is out point of view. Dr. Flack will. nowspeak- ( as to the construction of the facility and the proposed operation of the facility. - , Dr. Flack did, as you recall, speak on the Gilcrest • - . opera•ftibn, so he is thoroughly familiar with feed lots and with =respect to' the-operation of both of our feed lots . Dr. . Flack • = DR. FLACK: 'I was just 'going to say I think I • • went through this before. I would like t'o turn this around a little bit so ,you three gentlemen can see it a little bit more, I • think. There is not a County board of commissioners who . is not more familiar with and listening to propositions and listening to hearings in commercial feed lots in the • • - whole country. I would like to point out several of the factors that relate to, first of all, location in their • relationship toithe total proposal . These aerial photographs look good once you get used to them, but this is the city of Kersey in this area , • you can get the blocking here as far as the mile sections , the lines are pretty clear. This point at the underpass is 'Highway 34 (indicating) . .Progressing along the north side of Kersey, across the angle just below the bluff, underneath the present underpass , and the Union Pacific Railroad, and it comes on down here on the angle. You -14- . are talking about approximately ten miles from this point straight into town to what would be the interchange, intersection between Highway 34 and Highway 85 located out here on the southeast corner of Greeley: MR. ANDERSON: Where that flares off north, this ' would be west (indicating) , you have got all that sand hill on the west side of the highway? DR. FLACK: Yes . All right. Now, everything, so far as the boundaries are concerned here, again,. just to be descriptive a little bit, ,in case you can ' t see it, this is the underpass , as you are familiar with them, the Union Pacific Railroad, this is the service station, this being the north and south road through Kuner, the old Kuner schoolhouse is right here at this corner . Now,we have obtained options on all the grounds outlined in black, the feed lot sited south as -far as the construction of the lot aid its facilities would be in this area outlined with the green. Now,, as you will notice, we do not have the border area to the south of existing Highway. This gets into this highway difficulty. We do have a good wide area of the farm ground to the east, because of this particular farm actually overlaps on both sides of the road, as far as the property is concerned. That explains why this is blocked off on the basis of 'this . The only egress. - :ingress to the site is through this county road, service -15- going through here (indicating) , which I will get into in more detail, because this county road cuts , or bisects the site, and becomes very pertinent to the operation. And then we do have one eighty acre piece that I am going to have to back up a little bit on statements I made, as faras- the complete acquisition of all these options . We have, at the time we made the original statements to the board, ;, acquired all these options., in fact, which we have with the exception of this one eighty acre piece that lies in here. Now, we' have the options on this, • on that ground, 'but, _those .involve some land swap arrangement in order to purchase it. We have been assured verbally time and time again that it was under complete control, and we have no •reason' to think that it's not. But we do not have the contract with the name on the dotted line in bur hands . So, therefore , I merely want• to inform you that there is this one piece of ground on the north • edge that theoretically the negotiations did come to a stop on and we could possibly •could, end up with one acre piece in yellow that is not involved. It is on the north side of it. The vast majority of the eighty acres is in the bottom ground area down from the west. There is access to that eighty acres from the east, but we have a stipulation, there that theoretically something could go wrong, I don 't want you to believe we have that thing and then have it not develop along that line. -16- • • • Okay. The present Highway 34 coming down this side; you are aware of this, Clark has gone into this . This indicates the approximate land route of the now highway. We have here• marked in green the two county roads that are involved in the. site. And the small service, station just south or just east, excuse me, . east and south of the underpass , we have a north-south county road that just completely cuts the site in half , and then angles down along the river. This is the one that you relocated this portion of the road Some years - back, cuts down along the side and' comes down by the ' • schoolhouse . Have one small short piece of the county road an -the north`-south line there. -For the deVelopment 'of •the ground we will have to ask, as we have informed you b:y letter, that those county roads be closed. You have answered back that this can't be determined prior to the facts , and we understand that. But we want you to understand that those roads make a • . quite critical relationship to what we would do with the site. Obviously we can't have the road going through the middle of the feed lot. The railroad connection I can probably.show best on this , and get into the otherutilities and services . We have the Union Pacific. Railroad traversing along the northern border of the site. We have talked to the Union Pacific about a spur siding coming off of -17- • • thatsite: ; •There'.is no local, 'so to speak, on the U.P. going into that area at this time. There is a local that goes through in there to Eaton, Ault and- Pierce every afternoon, but due to the traffic that would be involved with the grain cattle operation that would . ` probably be instituted, which would increase the service to other sidings lup and down the area on that thing, or they would just merely run switch service by extending yard limits out of LaSalle . We are on the main line going east to North Platte, Nebraska, which -is the primary route, so we, from a railroad point of view, the connections are very good, and there would be no problem with the construction of the siding in relation to the other ground. From a county standpoint, we have made statements to and try- to explain- the fact that we do have at the • present time approximately eight .thousand acres of corn contracted for production of sileage into the Greeley • . feed lots . We anticipate that about thirty five percent of that, those acres under contract this year, would be within our ten to twelve mile radius of this feed • -lot for easy operation. This means that approximately seventy percent of those acres will have to be transferred to the Kersey and -east district.' A great portion of that, -well, all of that ' thirty five percent I am • -18- • ,.* ' = • referring to, plus a -great portion of the increase, , - • - would obviously. :come' from the area north of the South Platte -River, which means that traffic on this county road, coming across the Kuner -Bridge, which is a good '• bridge, but up this' county road, that winds back and forth along the east and north, as you are well aware, is not really a road at this time capable of handling truck traffic in large quantities . Sothis is something that -you need to be .aware of ., We have certainly .thought of it, it would. obviously_•get ; indolved as traffic increases on that road, and it would increase. • We also have -the: source•+ of power, electrical power, from either R.E.A , or Home Light and Power. Home Light and Power does service a' portion of this area , there is a division line between the two. Actually , - it 's just slightly split. 'So we have alternate sources • of power to us . ' • - Our communications , at this date, have been • .primarily with:Home Light and Power, although we have • been contacted by R.E.A : , and they are interested, too, in supplying power. And lean see even the possibility of a conflict there between the two. Natural gaa ' service to the area is -supplied by the Greeley Gas •Canpany. . They have -mains right through this area at the present time, but it's anticipated - - • those mains would•.not be capable of handling the demands -19- - • of the feed lot. Plans were already on the drawing boards toincrease the size of those mains . This has been scheduled for approximately a year from this fall. We have talked to the transmission line company, who would be putting in additional lines, we assured them we will have no call for gas out of those mains until after the time they are planning- on construction of those lines anyway. The development of this site would merely kind of iron out their plans and- would make them more concrete as far as getting the gas serviceavailable to that area by the fall of ' 73 . A rather insignificant factor to most concerns probably, but yet to rural people it certainly is a factor, the phone service, and obviously the phone company has already gone into planning construction facilities to increase the' phone service to that area . Quite frankly, the phone lines aren't available to give us the service we would require-. Water is obviously the big question. Water is the big ingredient as far as an operation of this size is concerned. The availability of, both domestic water and well water. - Domestic water is serviced to the area by the Central Weld Water District, who service our Gilcrest lot. •We have talked with them. You have received, I believe, a pair of letters from their board of directors. _20_ Assuming their willingness to supply us that water, , they have -a four inch main' -in that area , but we require . a four inch tap. .411e. six inch main that- they have that - runs along the section 'line, that would be, one mile , . ' ' south of this , where this closest six. inch. line is , they : . ` - would probably have. to put .inlan additional line there.. . But this is in the immediate vicinity.. You have letters. • to that effect. , . - - From - the well water standpoint. The sites that are involved in .the •options .:do include twelve adjudicated . irrigation wells.. .We have been assured by all of the ., people that the-, wells work::' Our consultants in this , matter state that these 'wells are among the' best in the county as far, as recharge rates are concerned. We: have run water samples on, a sampling of the wells and found " • the water to be very satisfactory for, use as far as the water call is concerned for cattle ' I have copies of laboratory- reports" £ 'you" would be 'interested. As far as the site development itself is concerned, on: this blue paper, this., doesn''t show real well, : there . are sections in more detail on .it, and- I .have actually ' • two or three different things- on this one. I actually / have the plans:t here to go into detail.. I think the. best example here, or the description of what we are " . talking :tout, is the kind. of existing feed loe which' you;all are •eertainly.familiar with. We will have the -2I1 ' feed ,lots essentially. the same' in size and the same service available 'that we :are replacing north- of Greeley. ' It °Fwouldlbe - involved.-with approximately two hundred and- •• fifty'.primary feeding ,pens , split in the middle with the service area; That would be an area- for the servicing - of cattle, receiving pens,. indoctrination area , hospital services , sorting area , this sort of thing. - The silo ' - pits -again would be at the back of the site.. The feed lots and -elevators ,would be literally located in the . ' center of the lot,-with one entrance on"Highway 34, at - -approximately- the same point. And this actually takes . . some surveying- and staking on the sites , but we aren',t , going to miss very far, being the exact point where the . , . ' highway intersects on the north-south line through that ' • (indicating) : In other words, here is your filling station aid then down here. approximately two-thirds of a mile across the 'section is where that intersection -is . ' at. .The one access point specified by the planning - commission is exactly whatwwe want; we want this control - of ingress and egress , services - to, the site. There is . obviously the problem of the added truck traffic turning - - off and turning in and entering highway problem. But - yet we -do not -feel it muldbe necessary, we have , discussed this .with the highway department as , far as ' • any type •of overpass type of - arrangement. The intersection • north of Greeley right now not only, handles our traffic , -22- . 4 but a considerable more than 'that, and -that -intersection has not proven to. be an exceptionally dangerous inter-, section. our amounts of traffic at - this site would be less , than that one,. The site would not go all the way . to the east boundary of the property, which would allow ' us the farm ground on the east end right. now to be _ • developed for. the, use of runoff water for- utilizing as. ` - well. as the farms`-across the road- to the east of, the site. The mill that will be constructed on the site' . would be very"similar to the 'one that you are familiar . with at the Gilcres,t site, • approximately the same capacity, three hundred to,three hundred and fifty- thousand bushel: There, is a question about whether we would 'Be able• to, - 'buiid 'one like:that because"'of thetbeering- capacity of • ' the soil 'in•the :Gilcrest area`, it ,may, not be exactly ' that,:high. So.'it ,may not be; exactly the same' s.tructure 'by- blueprint but 'as. far as' the holding capacities , it ' ' ' would to about the same type of facility. The mill"and the machinery., this type of equipment • 'will be identical .to that at .the Gilcrest lot. ' ' There will be' service administration facilities , ' offices , minimal, we will not try to Staff- O -large office, staff. at this site as we do now at the north lot. .The. . , • administration office will •be maintained where they are, but we will have administration services much the same • as you are famil'iar•with .at the Gilcrest site . -23- • . Now, the - storm water management is obviously the prime concern in site approval. I' think you are • familiar 'with .the` site. enough• to, visualize what .I am • • ' referring to here.. There is a natural crest tb the ground .that just'roughly bisects the site, this yellow . line down the middle here is drawn in there to illustrate. ' that to. you. As you :come to the east it .does, kind of . swing off a little bit to, the ,south" .direction. This • is the old reservoir lake -area (indicating) , to the south and west of this- site, if you look ate the old ' county maps . There is a natural. dyke that' is' left from that reservoir long ago. - It :isapproximately in this ' ' area , and then kind, Of -swings back into the hill: We would anticipate: a drainage' system being graded to not ' completely flatten out that whole surface, but to ,maintain that :crest and allow surface runoff of, storm .water to go- back on a , roughly north and south direction, perpendicular. That water would: then be collected in 'a collection type of ditch to go to the 'collection ponds located to the east, one to the south, one ' to. the- south and north. Then water distributed back ' from those ponds' onto the ' , ground, same type of a system that essentially is being used. at the two feed lots as far as water 'is concerned. ' These 'ponds would have to be sealed,' this one..in particular (indicating) , that part of the - old lake bed, ' and the reason the 'lake isn't there is because it wouldn't _24_ . hold water. That is' a matter we didn't point out to the planning commission when -we- made our presentation to them, plus the fact that the proximity of this pond to the new highway, whether it would be the existing highway right of way or to the 'south of the existing highway, we want - to keep that pond absolutely bone dry other than just as. a catch basin and for runoff water at the time of a storm. It's going to have an asphalt bottom, so when the water is collected we can pump the water back on the ground and keep this strictly for storm water collection and not holding the water. The pond to the northeast corner, we would have to construct an under ground pipeline parallel to the existing ditch system. To irrigate these farms on the east, you have to bring the water back up to the south and then come back on than line to irrigate these farms to the east. We anticipate doing, this with a sprinkling type of system as opposed to surface irrigation. We like that kind of system better as .far as ,utilization of water is concerned. There have been some very definite problems in using this water source_ through pumps , although we think we have solved some 'of ,that `with- the experimentation we have done at . -theGilcrest lot. And we will either line this , exposing it to air and sun, and in effect oxygenating it in going through a primary treatment , system, as opposed to going down on the ground and along -25- . it for surface running. The green belt is important here, and this goes back to our comment concerning the highway. We do and feel really the' one disadvantage this site has , and they all have some, is the proximity of Highway 34 . You are. all familiar with some of the problems that have been experienced in the state where feed lots are immediately adjacent to a, highway. We would have prefered, quite frankly, having been able to put the site on the necessary acres away' from the highway someplace, and not to be side by side with a highway. In that we are unavoidably • next to that highway, we want a pretty extensive and pretty solid type of green belt separating us from that _ highway. This leads to our feeling, as far as the advisability of Highway 34, being on the south side of the R.E .A . lines . We know that allows us to put in a green belt of our own, which would bp primarily trees and grass . We would then have an existing-Highway 34 that would sometime down the line be an access road or abandoned, an .R.E'.A. " right of way' that is there, and • then a three hundred 'foot right of way. That would be a pretty good break between the actual highway traffic . and the nearest row 'of- pens' as' far' as the feed lots are concerned. This is something that we, as Clark had said, we had gone into a great deal of discussion with the Highway Department on it. We feel that all the -26- particulars are workable and logical. Clark went into that in detail . - The only other point that I would reiterate, and as we have these two problems , number one, specifics • on that highway, if we were to put our two hundred and • twenty foot . - - now, this is out of proportion, I mean this part is in its Proper, perspective (indicating) , but this right here (indicting) is out of .proportion 'scale-wise from this :,' But to take 'a two hundred' twenty foot strip out of .this side of the existing highway; you would see what.. it would do. It would cramp us up so -tight we would have to come down here (indicating) , and down here, and it would spread us down more down here (indicating) . ' The other point is this problem of the county road - • , =that would go right across here . We have to feel pretty competent, before we can move out to that site and' start to pickup on these grounds and these options , we are . going to have an awful expensive farm ground with a road through the middle of it that we have no way to work around. With that, I think that pretty well states our proposal, and I- •have certainly tried to cover all the -factors , the pro 's and con's , as we see them. I would be more than happy :to try to answer questions if I could. I do have more detailed drawings as far as the . -27 - L. service facilities , the pen layout, elevators , mills . This, as we anticipate them, is not with the artist 's touch, but we do have them here if you would like to go into them in: detail, or if you have other questions . CHAIRMAN GLENN BILLINGS : Any questions? MR. ANDERSON: That one access point 'is going to be right here (indicating)? DR. FLACK: Right at this point here (indicating). . The one access point would be right there. MR. ASHLEY: On your agreement with Central Weld " Water, the letter, I only have one, you referred to two, all it says , they support your move. You do have a more definite agreement with them? MR.LORENSON: This question came out so t asked them to submit another letter to you, which I have got a copy of here. But I believe that they did send one to the Weld County Planning Commission. This was back in May, this was regarding your request, addressed to. yourself, or, excuse• me, addressed to the Planning. Commission regarding your request of Monfort of Colorado 's confirmation of water service from Central Weld Water District. CHAIRMAN GLENN BILLINGS: Do you have a copy of that for the file, Mr. Lorenson? MR. ,LORENSON: Yes , sir , we do. ' MR. GLENN BILLINGS: Does the board have any other -28- . questions? • That. one• road where -you have the division between the, ,farmground on the .east, the county road, you have, no future plans or any thought about that ever being closed? DR. FLACK: .' No,, no, ` , . ' " MR. 'ANDERSON: ' :Dbwn t'"the - dump there - - . ,•%., i: , DR. FLACK: This .one.,goes down here to the bridge. f` Quitefrankly - I mean, you didn' t have that -in mind, . - but the bridge 'you put in there two years ago we wouldn't have'-been able to consider, that site without that bridge . I could say something about a potential bridge north of Gilerest, but L won't say that now. . ' (Off the record.) ' CHAIRMAN GLENN BILLINGS: Does anyone else' in the room at this time want to give testimony in favor of the. . feed lots? -. . . Let the record show that-oE. all. those people present there is no one else who wants to give testimony in favor _ 'of the feed lots .: . The board members have any other questions? -Now, at this time, I would call on any of' those • people who would like ' to give" testimony against the .granting 'of the 'site approval. for the feed lots , and for those of you who testify, please give. your name and address . so that it' can be made apart of the- record. . 'Is there, anyone in the room who desires to make a • -29_. comment against the approval of this site location? MR. COLLINS : I have a question to ask. I. am not objecting to the feed lot at all, I want you to know that. CHAIRMAN GLENN BILLINGS: Give your name and address . MR. COLLINS: Tom Collins . I live at Pierce , Colorado, and we have the South Platte Farms , which is this area right here adjacent, not adjacent, but just comes right up here to the corner on the feed lot and on this side of the road. c f.' . : ' The question I had, I didn't get in on the last hearing of the Planning Commission, however, the word that I had got through rumor, and I would only want to E clarify this , that this would be a locked in agricultural - situation for zoning for the future. This is the question that I have . CHAIRMAN GLENN BILLINGS: • I think that would probably be something that the board at this time wouldn't be able to act on. There has been no request for any locked in agricultural zone. I think the board realizes that with the growth, or if it's approved, certainly we would have to look very closely at the development in the area that wasn' t compatible with that type of an operation. MR. COLLINS : • What I am considering, Glenn and -30- • • just erase my set' of buildings right now. That is what- • I am concerned about. If this ever• happens . CHAIRMAN GLENN BILLINGS : I think Mr. Schlegel, that the State Highway Department is certainly looking toward an extension of that highway clear on out, at a later date. But"- as far as this board gbes , their proposed widening, realigning of Highway 34, -is approximately. in Their original plans are just somewhere past the underpass of the railroad -tracks at :that point. As' to`-`the future- plans of. the -State Highway. Department, 'we certainly wouldn' t be able to_ answer at this -time. - " ' ` MR. SCHLAGEL:" - We had -the hearing at Kersey last . • January and the plans at that time were approved, or the public went along with the idea that the highway was going to go on the north side. And if they change to- . the south side down there, I imagine - - ' CHAIRMAN GLENN BILLINGS : Probably the only thing we could say, if -they did go through your buildings , I know they have a, normal procedure where your buildings would either be moved to a better location on your farm • or you would be -reimbursed for them based- on that. MR. SCHLAGEL: That isn't' the problem. It's just • like we would like to make. plans . - But I would like to bring out facts that our area has always been neglected when it came -to the type of road system we have had; and ' - • -32-s this is going to create more problems, and I would like. to see not only directly south of the Kuner "station, but • go west, ' one 'and two, three miles , and let's get these roads improved so we can rework some of that local traffic out of that area . If this is done I am not testifying against it, but I would just like to see these improved so we could live with it. Our families would have to be on the road every day and we have to live with it and if you could make arrangements so it could be handled well, I am sure we could all get along. CHAIRMAN GLENN BILLINGS.: I am sure the board would study the road situation that would be created in that area and make whatever improvements we could with the money we have to do it. I think one of our biggest problems is we certainly don't have near enough money to improve the roads •anywhere in the county we need to, and we realize the problems . Any other comments? I would ask again is there anyone in the room who is against the granting of this application? MR. ASHLEY: I would like to ask a question' concerning •the 'closing of that road.. You picked one right through the middle: • Is• there anybody down that way. that would object to this Is there anyone in. the • room who would•want ' to "voice particular objection to . the county vacating those roads that are within the -33 Monfort proposed site? . MR. WEAVER: Mr. Chairman, • could' I turn to the • map? • CHAIRMAN GLENN BILLINGS : : Surely. ` MR. WEAVER: These are the roads that are actually within the middle, of the site, and certainly would have to be vacated for the operation of the feed lot. • CHAIRMAN GLENNBILLINGS : Is there anybody that • .woud.want to, make ,comment on that? MR. SCHLAGEL That is the road I use and there is • • a;°'lot: of farmers.=using.'-that road .to. take their beets down • to Kuner receiving station, and we will have to detour them around. Wel will have to make a left turn off the • highway; Highway' 34, when that is closed. MR. ANDERSON:. I think what is going to happen, I can't promise anything, but here, the way it looks to me -What is going to have to happen, this road will be vacated; this road .here wilLbe improved and probably • brought up to oil standards. We have spent a lot of money on this road in the' last several years,, as-you guys down there know. And this road here I 'think is going to have to -be improved on down here a mile south of Kuner. Now, that should take care of this area (indicating) clear down to the feed lot. That would be my suggestion if this road is closed. All this stuff up in here becomes ' , the highway and ,down to the Kuner station again, and the -34- • • beets would be hauled out this way instead of up this way. The beet trucks have torn up that road ever since they started hauling' beets . I am not going to be around, ' but that looks most feasible to me, bring this road south by the schoolhouse, a mile south and west of the direction line. That should take care of everybody's ' • problem south of the- highway. You have -got tp go east, so why not turn off a mile east. There would be two or three fellows up__there, Al Peters will have to go back or duck around. . But that is the way it looks to me its going to have to be built. The same thing happened at Gilcrest. 'We had' a lot 'of roads down in there that had to be improved, the need was .there. ' And it had to- be ' done. And the need is what, justifies these roads : . The need 'will be created when this thing happens . CHAIRMAN GLENN BILLINGS:I think realty this . hearing, even though in some way it- does involve the vacation of these roads, that this is certainly not a part of this hearing and something that the board of county commissioners will have to take up at a later date- with Monfort of Colorado. . - Is there anybody .else that would like to make - comments? .' If not, let the record show that even though we have numerous people within the room, 'there is no one present who is against the granting of this application. • • -35- , • • • Is there :anyone ,else who wants to make any comment? If not, then at this time, Mr. Lorenson, would you -give us the comments of the County Planning Commission. • MR. LORENSON: Mr. Chairman, the Planning • Commission recommended. favorably to the Board of County Commissioners for , the . following reasons : 1. It will relieve the area immediately north of Greeley from intensive feed lot operations . 2 . Selection site is well adapted to support this- use. 3 . Site and use fits the existing land use and zoning and the development of th'e planning 'commission's policy. - 4. Site can be well drained and sufficient water ' is available. 5 . Location is in a sparcely settled area . - 6 . Recommended for, ap,proval by the health department. • 7 . Letter of Tproval by the school district. With respect to what counsel has said bout the ' ' subject I would like to talk a 'little additional about the first question, - and it reads a land swap arrangement with the• State Highway Department or. right of way or the granting of two hundred twenty .foot right of way north of existing Highway 34 and 'a single access point to Highway 34. -36'- - • We do have a letter fromi"ahe Department of Highways , and I will read it. It's under the signature of Mr. Capron,- District Engineer. We have reviewed the application for a special use permit for Monfort . Feed Lot, which, will be appearing before the Weld County Planning Commission on May 16 , 1972. In reviewing the plan we note that the proposed •development comes up to the present north right of way line of U. S . 34. Unless other arrangements can be made it should be noted that our proposed expansion 'plans for U. S,. 34 that an additional two hundred and twenty foot , of right of way from our present north right of • way line will be required: Yours very truly., W. J. Capron. CHAIRMAN GLENNBILLINGS : He doesn' t indicate in that letter that .they have purchased any right of • • way through there ; 'does he? MR: 'LORENSONs. = No. ' They have not purchased any, and I would like to relay, 'or relate several of our conversations , at least pertinent points of them with Mr.. Weaver, counsel for Monfort 's and Mr, . Capron, the District Engineer. During those conferences it came - out that there, was a hearing approximately a year ago in Kersey, and on ' their proposal that was shown, the right of way was shown to be on the, north side of 34. • - So the impression was left with the people of the area that the highway did lie, the proposed route, north of -37- • . • • the existing roadway. And Mr. ' Capron felt there would • • eventually have to be new hearings required if there was an improvement to the south of this site. We did get into.-the discussion Of trying• to figure out how to swap and so forth, and we did kind of • come to -the • conclusion that Mr,. Clark-Weaver did, that it was a ' • nearly impossible situation. I would feel that the • Planning Commission has relied on my information, and - - my information is based on the highway department 's information with respect to the recommendations . I would feel that the planning commission would be willing to alter its recommendations , but strictly based upon , •meeting the highWay•'department 's requirements... So with • • _ respect to item number one, if there is a modification • of the highway department's requirements in this area , ' - • I am sure the planning.commission would be, glad to make- - that same recommendation. . , MR. ANDERSON: Mr. Chairman, at this time I don' t think the state highway problem is •a county problem. ' I . don't think We have any jurisdiction over this , Sam, • Other than the request. • • • - MR. TELEP: None whatsoever. MR. ANDERSON:, Let 's leave it as it is . It's- the ' highway department's problem and we would request these right of ways , but we can' t demand them. - MR. LORENSON: No, - we Can' t. But we can certainly • ',3.8 • cooperate with the highway department. MR. ANDERSON: It's getting down to the point where we are talking state and federal money and stain and federal highways . I don' t think we have any jurisdiction there . CHAIRMAN GLENN BILLINGS : I .think it would probably be the feeling of the board regarding the highway there, because we are familiar with the proposed. highway, and have met with the .highway department on this numerous times, that this would certainly have to be a problem worked out between Monfort of Colorado and the State Highway Department. And whatever could be worked out between those two,' this board will certainly agree with. On that one part that has already been indicated that the access onto 34 ;would be basically where the existing access is , and the board would certainly agree on that also. Also, the one exit. MR. LORENSON: Mr. Chairman, to continue with the rest of the recommendations . The planning commission also suggested it would be subject to a green belt at least fifty feet wide along the south lot lines , screening of Highway 34 with a -suitable type of vegetation. 3 . Both proposed lagoons being sealed and the - north lagoon being protected from the flood plain. CHAIRMAN GLENN BILLINGS: . I would ask one question -39- , - of Dr. Flack". What was 'the width ofthe green belt that you are proposing: there„ a minimum, of fifty feet? DR. _FLACK:. , It would. have to be more than that to be` satisfactory. - - , CHAIRMAN GLENN BILLINGS: Then on the third one you indicated the sealing with good asphalt of the south lagoon. What type of project do you plan for the north? - - DR. FLACK: , The north one. There are two or three different techniques that are available. You presently are aware of some of the work that has been done in sealing of ponds with these different types of materials , and, _quite frankly, my experience with those materials is not, my impression has not been real satisfactory. I would like to avoid going to the full hard rock asphalt type of sealing, just because of the expense . There has been a great deal of the work cbne with some of the polyvinyl lining in these type of circumstances, and even though we haven' t specified any specific plans of this type of what sealer would be used, it would have to be capable of holding any type• of subsoil seepage. MR. ANDERSON: That would be worked out with the health department. DR. FLACK: This would,be under the control of our local health department as far as the approval would be concerned. -40- • CHAIRMAN GLENN BILLINGS: The board would be in approval with that, whatever meets the health department requirements would be satisfactory. with the board. ,Do ;you have;anything else, Mr. Lorenson? • MR. LORENSON: No. That is all I have . CHAIRMAN GLENN BILLINGS': Any other questions . about this? • The Board will declare a five minute recess , and. after that recess . a decision will be made. (A short recess was taken.) (After recess . ) CHAIRMAN GLENN BILLINGS : We will call this hearing back to order. Is there anyone else who has decided they want' to make a comment of any kind? I-f not, . at this time the Chair would entertain a motion for approval or denial of the land use fot Monfort Feed Lots . MR. ASHLEY: I' move approval in case number 156 • for Monfort Feed Lots , Incorporated,- for the recommendations of the Planning Cothmission, with' the exception of number one, the land swap' arrangement and highway situation be eliminated. Otherwise ,- I would -go along with their recommendations . CHAIRMAN 'GLENN BILLINGS: Do . I have a second- to the motion? - MR. ANDERSON: I second the motion. -41 • • CHAIRMAN GLENN BILLINGS : How do you vote, Mr ., Anderson? • MR. ANDERSON: Yes . - CHAIRMAN GLENN BILLINGS.: Mr . Ashley? MR. AHSLEY: Yes . CHAIRMAN GLENN BILLINGS : And the Chair, votes yes . Let the record show that Monfort Feed. Lots , Inc. , P . 0. Board of County Commissioners of Weld County, Colorado Weld County Court House Greeley, Colorado 80631 .RE: Application by Monfort Feed Lots , Inc. for Approval of Kuner Feedlot Site. • Gentlemen: • In connection with the above-mentioned application presently scheduled for public hearing on June 30 , 1972 , Monfort Feed Lots, Inc. hereby makes the following request: That the portions of presently existing County roads herein described be vacated by the County: 1. That portion of an existing County road starting at a point located 2,500 feet east of the northwest corner of Section 26 , Township 5 North, Range 64 West of the 6th P.M. , said point being the intersection of said County road and presently existing U.S . Highway 14 ; thence continuing in an easterly direction for a distance of approximately 6 ,500 feet; • thence continuing in a southeasterly direction for a distance of approximately 1,500 feet to a point located approximately 650 feet south of the northwest corner • of Section 30 , Township 5 North, Range 63 West of the 6th . P.M. , said portion of the County road encompassing a total • of approximately 8,000 feet; • 2. A County road (believed to be abandoned) starting at a point approximately 650 feet south of the northwest corner of Section 30 , Township 5 North, Range 63 West of the 6th P.M. ; thence continuing generally in a westerly direction a distance of approximately 2 ,000 feet; thence continuing in a northwesterly direction 'a distance of approximately 1 ,000 feet to a point on the' County road described in 1. above located approximately 2 ,700 feet east of the northwest corner of Section 25 , Township 5 North, Range 64 West of the 6th P .M. It is believed that this County road encompasses a total of approximately 3 ,000 feet. [ • Page # 2 June 9 , 1972 Board of County Commissioners 3. That portion of an existing County road starting at a point located on the County road described in 1. above which is the northeast corner of Section 26 , Township 5 North, Range 64 West of the 6th P .M. ; thence continuing in a southerly direction a distance of approximately 1,700 feet to the intersection of said County road and existing U.S. Highway 34. It is believed, that this portion of the County road encompasses a total of approximately 1,700 feet. The portions of the County roads in 1. , 2. and 3. above are also as described in red on Exhibit A attached hereto. In support of this request , Monfort Feed Lots , Inc . hereby states that if the application before the Board of County Commissioners for public hearing on June 30 , 1972 is granted, Monfort Feed Lots , Inc. intends to exercise options on those surrounding lands served directly by the roads to be vacated. The lands presently subject to option are generally as described in blue on Exhibit A attached hereto. Since the land to be purchased subject to site approval by the Board of County Commissioners is to be used as a feedlot, it is extremely important that our request for the vacation of these County roads be considered no later than June 30 , -1972. I might also reiterate that notice of the exercise of the options on a majority of this property must be given no •later than July 1, 1972 , or the options will, by their terms , expire. We are presently preparing notices of exercise of our options for delivery on July 1, 1972 in the event that approval of our application and the request herein contained is granted. If approval is not granted by that date, the options will, of course, expire. If you have any questions concerning the foregoing request for vacation of the County roads, please do not hesitate to contact me . Thank you very much for your consideration.
