HomeMy WebLinkAbout740401.tiff RESOLUTION WHEREAS, it has been determined by the Board of County Commissioners, Weld County, Colorado, that Mr. and Mrs. Ralph R. Sprague are owners of approximately 79 acres of land in Weld County, Colorado, located in the Southeast Quarter (SE-i'), Section 19, Township 2 North, Range 68 West of the 6th P. M. , and WHEREAS, the Spragues are desirous of selling approximately 70 acres of this land and keeping approximately 9 acres unto them- selves, and WHEREAS, it appears that to accomplish said sale, the Spragues may apply for a Recorded Exemption from the Subdivision Regulations of Weld County, as the same is defined in Section 9-4 of the Weld County Subdivision Regulations, and WHEREAS, in addition to evidence presented by the Spragues, the Weld County Planning Commission staff has presented evidence and made representations concerning the desirability of granting said variance, and WHEREAS, the Board of County Commissioners feel that when all the evidence and representations are considered, good cause for granting a variance of up to 5 acres from the minimum lot size re- quirements of the Weld County Zoning Resolution has been shown. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers granted to the County under Chapter 106 CRS 1963 and Section 9-4A(6), Weld County Subdivision regulations as amended; that Mr. and Mrs. Ralph R. Sprague are granted an exemption of upto 5 acres from the lot size requirements of the Weld County Zoning Resolution. BE IT FURTHER RESOLVED, that this exemption is allowed so that the Spragues may proceed to apply for a Recorded Exemption and the lot size variance is conditioned on the Spragues applying for and doing all necessary to obtain said Recorded Exemption within 1 year, and said variance is limited to Mr. and Mrs. Ralph Sprague, and will terminate if they sell or otherwise discontinue their interest in the abovementioned land prior to obtaining approval for and recording the abovementioned Recorded Exemption. They are requesting an exemption from the minimum lot size of 80 acres in order to apply for a recorded exemption. They presently own 79 acres in the Southeast Quarter (SE;) , Section 19, Township 2 North, Range 68 West of the 6th P.M. I recommend you grant the variance for the following reasons : (1 ) The land is presently being farmed and the owners indicate the 70 acres they are selling will continue to be used for agri- cultural purposes. (2) There does not appear to be any attempt by the applicant to evade the requirements or intent of the Weld County Subdivision regulations. (3) Since the land is presently being farmed, this appears to be a legitimate request and use of the variance procedure in Section 9-4-A(6) of the Weld County Subdivision Regulations. Since April, 1966 when we purchased the property, Mr. Sprague has farmed the ground and held a full time job at Dow Chemical Co. in Golden, Colorado. It is not economically profitable to just farm such a small acreage and it is becoming increasingly difficult to do justice to the two occupations. We are requesting an exemption from the minimum lot size of 80 acres in order to be able to apply for a recorded exemption on the property in question. We would like topsett approximately 70 acres and keep our house and approximaSly 9 acres for, our home. The house is just a little over Pour years old and built to our specifications.
