HomeMy WebLinkAbout740369.tiff RESOLUTION WHEREAS, a public hearing was held on August 26, 1974, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing thepetition of Colorado State Highway Depart- ment, c/o Leo O'Conner, 1420 Second Street, Greeley, Colorado, (Ralph Janitell Jr. , Land) requesting permission to locate a gravel pit operation qn the following described property: A tract of land located in the East Half (EZ) of the West Half (WD of Section 1, Township 8 North, Range 61 West of the 6th P.M. , Weld County, Colorado, and more particularly described as follows: Beginning at a point which is the center of Section 1, Township 8 North, Range 61 West of the 6th P.M. , thence South and parallel to the West line of said Section a distance of 300. 00 feet to the true point of beginning; thence West and parallel to the South line of said Section a distance of 1150. 00 feet to a point; thence North 2°00' West a distance of 925. 00 feet to a point; thence North 89°20' East a distance of 715. 00 feet to a point; thence South 26°37' East a distance of 1043. 00 feet, more or less, to the point of beginning, containing 20 acres more or less, and WHEREAS, the petitioner was present, being represented by Mr. Joe Intermill, and WHEREAS, there was no opposition to the request of petitioner for the location of said gravel pit operation, and WHEREAS, the said requested gravel pit operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(8) and Section 6. 1(3) of the Zoning Resolution of Weld County, said gravel pit operation may be authorized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the peti- tioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of the Colorado State Highway Depart- ment c/o Leo O'Conner (Ralph Janitell Jr. , Land), to locate a gravel pit operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be PL0796 740369 approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect construction of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the per- mit herein granted. 3. That when gravel extraction is completed said permitee shall immediately notify the Board of County Commissioners and said permit shall automatically be revoked without further action of the Board. 4. That the operation and development of each gravel pit execava- tion and rehabilitation shall be limited to plans as submitted and in accor- dance with the rules and regulations for the operation of gravel pits as adopted by Weld County, Colorado. 5. That all applicable subdivision regulations and zoning regula- tions shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. DISCUSSION: Mr. Intermill stated this was owned by Roland Miller; pit lays in and adjacent to a present gravel pit in the area. Propose to lower and extend the southeast portion of the present pit about five to six feet. Feel there is about 4,000 cubic yards of material available. Processed through a screening plant and then stockpiled to be hauled away as needed. Used for sanding of roads in the winter. Hard to determine length of time this will be used. Will not go below present water table. Mr. Anderson looked over the site. Could see no problems. About 4/10 of an acre. Weld County Planning staff recommends approval for the following reasons: (1 ) Platteville has no objections; (2) Agrees with Weld County Comprehensive Plan in extracting our natural resources and supplements H.B. 1529 regarding sand and gravel extraction; (3) Due to the fact that this is a State Highway Dept. site, the extraction and reclamation standards are included within the cover letter. Subject to: (1 ) Reclamation com- mencing immediately after extraction; (2) Extraction beginning within one years' time from date of approval by the Board of County Commissioners and limited to the use of the State Highway Dept. This permit is to terminate at the end of the State Highway Dept. Intermill stated that the only thing that might cause a problem would be the removal to begin within one year. Really can't tell how much they will use and how soon they will have to begin operation of actual digging. No real big problem. Owned by Ralph Janitell , about 20 acres. Will strip and stockpile the overburden on this pit. As they go, will reclaim area . No set time tables. Mr. Weigand's letter states that he could see no problems. Needs geological information, EPA qualifications and Health Cept. recommendations. Pictures submitted with the letter were not there. No drainage problems. Access road there already. APPLICANT: Harold Baumgartner (Platte Gravel ) CASE NUMBER: SUP #259 Tape 545 & 546 SUBJECT: Gravel Pit LOCATION: Pt of Sections 9 & 17 T2 R68 APPEARANCE: Mr. Roman Bockus, Planning Consultant; Mr. Harold Baumgartner DISCUSSION: Since the last meeting, there has been a field trip and he (Mr. Bockus) has made changes in the plans and submitted a water augmentation plan. Submitted an addendum to the augmentation plan. Has 193 acre feet of water in the Smith & Emmons Ditch; also, 481/2 acre feet of water in the Plumb and Daily Ditch; allocated 100 acre feet to the Colorado Water 1055 Conservancy Distt Submitted amended RehabiliL..on plan. Believe they are in compliance with the Comprehensive Plan. Will utilize all the excess overburden as possible. Originally stated that there would be about 75 persons, however, it should have been 175 persons. Mr. Bockus stated that he had contacted the State Engineer's Office but had no final answer as of yet. Mrs. Lee stated that there were two new letters received from (1 ) District 6 Water Users; (2) St. Vrain Left Hand Water Conservancy District. Read them into the record. They basically are not opposed to the gravel operation; they would like an agreement between District 6 Water Users and the applicant. Mrs. Lee read both letters into the record. Planning staff recommends approval for following reasons: (1 ) Agrees with Weld County Comprehensive Plan and Weld County Zoning Regulations in extracting our natural resources; (2) It agrees with H.B. 1529 in the mining of sand and gravel ; (3) The reclamation plan has been revised and accepted by the Planning staff. SUBJECT TO: (1 ) Agreements being reached between the applicant and the District 6 Water Users; (2) Ex- traction beginning within one year from date of approval by the Board of County Commissioners and limited to the PUD as submitted. Mr. Heitman wanted to know why, if the augmentation plans were approved by the State Engineer's Office, we should be involved with District 6 Water Users. They should be concerned with the State Office, not the applicant. The people that cause the loss of water are obligated to correct the situation. Until the State Engineer gets better regulations, we have to rely on the augmentation plans. Following staff recommendations, the parcels will be 50 acres and 150 acres instead of 93 and 215. Will go about 27' deep, making it about 12' to 20' below the Boulder Creek bed. It is located partially in the flood plain as noted in the Weld County Comprehensive Plan. They are going to dike the Boulder Creek on both sides to keep it as is. RESOLUTION: Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Planning staff recommendations with the exception of Item #1 under Subject To's; change to read approval of the State Water Conservation Board. APPLICANT: Golden Harvest Ranch, Inc, CASE NUMBER: CUP #5 Tape 546 SUBJECT: Boys Ranch LOCATION: Pt NE4 Sec 5 T9 R62 APPEARANCE: Mr. & Mrs. Mount; Mr. & Mrs. Orr, Land owner; and Lee Steele, President of the Board DISCUSSION: Mr. Steele presented their plans for a boys ranch located about nine miles north of Briggsdale. Started making their plans about 12 years ago. Golden Harvest, as it is proposed, will be part of a national corporation entitled "American Youth Ranches". It is joining with Boys' World in California which has been in operation for about eight years. There are some "L" shaped buildings which will be used for staff housing. They are already on the property and the building inspector has inspected them prior to their moving them. North of there is the building that will serve as, a cafeteria and classroom areas. Round buildings will serve as cottages for the boys. These to be constructed in the future. Each will house approximately 12 boys and a set of house parents. There is also an old church building located on the premises. Mr. Steele stated they were concerned about odor control , expulsion, drainage, flash flooding, etc. 1056 The lagoon will L, .ocated quite some distance fry.... ..he buildings. It will be a series type lagoon. The overall operation will have about 50 people. Access to the property is from the North presently, coming in off of Co. Rd. 110. Approximately 22 acres of wheat, rest in pasture. Most of the boys will be ten through fourteen. Most of them will have learning difficulties or possible home problems; they will not be de- linquent boys and will not be placed by the courts. Most will be placed by private individuals. There will be a school on the property having a certified teacher. They have dug footings and poured concrete walls according to Building Code specifications. However, there are no building permits issued at this time. They were under the impression everything was ok; not trying to be illegal . Water has been approved through a 50 gallon permit well located approximately 1500' from the east section line and 880' from the north section line; puts it over approximately between the two ponds in that area. It is the proposal to have a fire line run in front of the cabins. Do have plans to expand possibly to have a separate operation for girls. Will probably use pressure pump for the lake for fire protection. There are State regu- lations regarding fire safety; sbhooling; etc. , that will be met. Weld County Planning staff recommends approval for the following reasons: (1 ) It agrees with the Weld County Comprehensive Plan and Weld County Zoning Resolution in promoting agricultural uses of the land; (2) Health Dept. recommends approval . Subject to: (1 ) Lagoon location being shown on the plans; (2) Approval of fire protection plan by the County Engineer; (3) Construction beginning within one years' time from date of approval by the Board of County Commissioners and limited to the revised plans to be submitted. RESOLUTION: Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Planning staff recommendations. Motion by Mr. Weigand, seconded by Mr. Anderson. A vote of "Aye" by Watson, Nix, Anderson, Weigand and Heitman. Motion carried. APPLICANT: David Farley CASE NUMBER: Z-248 Tape 546 SUBJECT: Zone Change "A" to "I" LOCATION: Pt SW4 SE4 Sec 18 T3 R66 APPEARANCE: Mr. Farley; Allen Jost, representing Platteville DISCUSSION: He needs the zoning because there is already a pipe yard there. Did not realize that his zoning was inadequate. Access from Railroad Right-of-Way. Mr. Jost stated that the Platteville Planning Commission had heard a request from Mr. Farley for multiple family dwellings. The Planning Commission, however, did not approve this type use, but stated they would recommend the Industrial use. This parcel at one time was in the city limits of Platteville, but has since been deannexed. There is some problem with the access. Not sure if it has been vacated yet. There is a right-of-way lease on the railroad property. Need to renegotiate a lease with the railroad regarding uses on the property. This was considered and left up to the Town of Platteville whether or not it should be a PUD or straight zoning. They stated they would support straight "I" zoning. Is located in their comprehensive planning area. Weld County Planning staff recommends this request be tabled for the following reasons: (1 ) Although Platteville has shown support for this application, there is a need for Mr. Farley to renegotiate with the Union Pacific Railroad. The new lease should eliminate the restriction to agricultural use and also should provide access to the property. Also, at this point, the lease does not describe the entire parcel ; it falls short. The parcel is about 450' deep. If he goes to an I-UD, he would first have to go before the Board of Adjustment for a variance on lot 1057 size. It was felt that it would be better for al . it would go through an I-UD instead of straight I zoning. This will give better control re- garding what could be put into the area. MOTION: By Mr. Heitman, to table and recommend the procedures be followed for an "I-UD" . Seconded by Mr. Nix. A vote of "Aye" by Watson, Nix, Anderson, Weigand and Heitman. Motion carried. DISCUSSION: What the "I-UD" is and involves was explained to Mr. Farley. An "I-UD" will limit the uses; mainly as to what Mr. Farley wants. Any changes will have to be reviewed by the Board again. SUBJECT: Chalet West APPEARANCE: Doug Sears Tape 547 DISCUSSION: Mr. Fortner stated that Mr. Sears would like the Planning Commission to review the possiblity of changing the density. Overall density will not change. Mr. Sears felt that the PUD had created a white elephant as it is presently not marketable as is. Asphalt already installed is deteriorating from lack of use. The amendment to the PUD he is requesting is very minimal at this time. The PUD limits the use to duplexes, four-plexes and tri-plexes. About 39 total acres. Would like to take the 21 acres left and file for single-family units but keep the overall density of 6 units per acre. Put the additional units, which would be about 10 units per acre if allowed, against the mobile home court. That would make it a high density transition between the mobile home park and the single family to the north. Representing Reiker, Haney & Smith as the developers and owners of this property. Mr. Sears wanted the Board to authorize the Planning Director to give him a letter that states the amendment proposed warrants further pre- sentation. Replatting would not solve the problem. One paragraph of the PUD needs to be changed to allow single family units. Everything else is ok to do what they are seeking. Mr. Weigand stated that all they could do today is to authorize their staff that, due to the pre- sentation today, they would accept an application with this amendment; then he (Sears) follows through with the rest of the necessary steps to get this thing done. MOTION: By Mr. Heitman, To authorize staff to give Mr. Sears the letter re- quested. Seconded by Mr. Anderson. A roll call vote of "Aye" by Watson, Nix, Anderson, Weigand and Heitman. APPLICANT: Fred Spallone (Turnpike Construction) CASE NUMBER: SUP #249 Tape 547 DISCUSSION: Mrs. Lee stated that Mr. Spallone had voluntarily shut down his operation, prior to issuance of a "Cease and Desist" order. Also, the Board required a hydrology report, do they still want it. He is asking if he could provide a water augmentation plan instead. The main reason for the hydrology report is because of the changing of the river channel . It was asked if Mr. Spallone put the river channel back to the original flow, would the hydrology report still be required. In the beginning, even the water users felt that if the creek were channeled, it would be a benefit to the entire area. Mr. Spallone was simply trying to help. The main reason it didn't work out, is because he doesn't own enough property to continue channeling it on through. He can straighten a channel on his property as such, however, if any damage comes to anyone because of it, he would be fully liable. It was felt that they shouldn't have to spend a lot of money to have a hydrology report done. The main concern is what will happen upstream and downstream because of the change in river channel . If he can prove it some other way, (the elevation of the river and consequences of changing the river) the Board would probably accept it. 1058 L Meeting adjourned. We are requesting permission to re-'ove sand and gravel from a ridge in an area of dry land pasture which is zoned Agriculture. The State, County, and Contractors have been removing gravel from this area for several years. The area is designated U-3 in Special Publication 5-B - ATLAS OF SEND, GRAVEL, AND OUPRhY AG IRFGATE RESOURCES COLORADO FRONT REL_JGE COUNTIES. The proposed pit area is covered with grass. Overburden depths range from a fe" inches up to four feet or more, with gravel depths up to alproximately ten feet. We will continue exca eting along the face of the present pit and extend it to the North-'est back into the ridge. As we extend the pit re will strip the existing vegetation and excess overburden, st. ckpile it, then spread it over the bottom and ba-ckslopes and reseed these areas. The backslopes will be lcft no steeper than 2:1. Since this is a dry land hill deposit with the bottom of the pit above the water table there will be no lake or pond formed. The gravel will probably be removed from the pit by dozer or front end loader, processed through a screening or crushing plant, then it will be stockpiled and either processed through an asphalt batch plant or hauled to the road as untreated sand and gravel. TTe will conform to Weld County Zoning and Reclamation Regulations for our gravel pit operation and the reclamation of the area. Yours truly Dwight M. This area is on a small upland remnant east of Keota. Although the deposit is primarily a sand con- taining significant fines, it is the only useable deposit in the vicinity. It serves as an important source of material to the Highway Department for maintenance and repair of roads. (2) State Highway Department, Section 30, T3, R66. This area is mapped as a T3 deposit which is located east of the South Platte River, S of Platteville. Sand has been mined in pits not far to the north of the project tract. Thickness is greater than 11 feet but total thickness is not known. The total thickness of the valley fill varies from 44 to 53 feet. The Highway Department can economically utilize this small tract as a source of aggregate for road repair and main- tenance. We see no particular problems from our standpoint. (3) Flatiron Paving, Section 20, 29, & 30, T2, R68. Three proposed excava- tion areas lie within an area mapped as F 1 located on Boulder Creek. There is 6 to 13 feet of gravel with 2 to 5 feet of overburden based on the Flatiron's drilled holes. A gravel pit lies between 2 proposed excavation areas. Recla- mation is to be carried on simultaneously with mining. It appears that the reclamation plan is a good one.
