Home My WebLink About720337.tiff _k_ " RESOLUTION WHEREAS, a public hearing was held on July 17, 1972 in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Robert Barthold, LaSalle, Colorado, requesting approval of site for a dog kennel operation on the following described property, to-wit: The North Half of the Northeast Quarter of the Northeast Quarter (N+NE*NEI) and the Northeast Quarter of the Northwest Quarter of the Northeast Quarter (NEINW:NE+) of Section One (1), Township Three (3) North, Range Sixty-five (65) West of the 6th P. M. , Weld County, Colorado, containing 30 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the location of a dog kennel operation, and WHEREAS, the said requested location for a dog kennel operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3) of the Zoning Resolution of Weld County, said dog kennel operation may be authorized on the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Robert Barthold, LaSalle, Colorado, to locate a dog kennel operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That said dog kennel operation shall not contain more than 75 dogs at any one time. 3. That petitioner shall proceed with due diligence to effect said dog kennel operation and that he shall have one (1) year from date hereof to complete the construction of any and all facilities therefor, otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 4. SUBJECT: Letter regarding pollution control A letter from the Weld County Health Department was read asking cooperation by not issuing building permits for new businesses , industries , etc . , which anticipate using any device which does require controls for air pollution , until such time as they have received authority to construct from the Air Pol - lution Control Division . There is only one residence within Z mile. If approved it should be subject to a maximum of 75 dogs and providing the Health Dept . with adequate information . Mr. Paul stated he has received the necessary information and does approve the application. There was discussion regarding the entrance to the property. Mr. Bowles stated his entrance should be on the east/west road and not a road cut on the Keenesburg road . The plot plan was drawn for a previous application at another location. Motion carried . 775 SUBJECT : Minutes DISCUSSION : Mr. Heitman proposed to amend the minutes of the last regular meeting regarding the presentation by Jim Ohi and Gary Eastman on zoning and land use policy criteria to state "there. were some objections by several members to the studies being made"'. This was an informational item and no action was required and none taken. MOTION : By by Mr. Nix to approve the minutes of the last regular meeting . Second by Mr. Watson . SUBJECT: Contract with Windsor DISCUSSION : Mr. Lorenson stated a contract had been prepared between Weld County and the Town of Windsor for planning services for a 3 month trial at $200. 00 per month . They have a water tap from the Little Thompson Co. The nearest residence is 900 ' to the south and they also have dogs . Next nearest residences are 18 to 12 mile. Owners have no objections . Soil Conservation Services anticipates no pollution problem. If approved it should be subject to construction within one year of the County Commissioners resolution and a maximum of 40 dogs . A petition has been presented from other property owners objecting to the kennel . Mr. Paul stated the Health Department is giving their approval and will be presented in writing. Mr. Bowles stated the criteria of the board has been a minimum of 2 mile from any other residence for a kennel . MOTION : By Mr. Heitman that the application be taken under advisement. Motion by Mr. Nix stating he felt it is too close to the Interstate Highway and because of, the petition filed by other residents , also it does not meet the requirement of 660 ° from the highway. A letter has been received from the Windsor Planning Commission stating they disapprove of the subdivision. The land is not the best farmland . Acreage contains 9. 5 acres and there will be 8 sites . Later will be from the North Weld Water District. Mr. Deyoe stated the planning staff prompted Mr. May and Mr. Kennedy to file a plat rather than selling it off in parcels on their own . Tape 432 APPLICANT : Robert Hoff CASE NUMBER: S-101 tape 431 SUBJECT: Preliminary plat of second filing of Sandy Knolls Estates LOCATION : SEQ Sec 20 T5 R64 APPEARANCE : Mr. Hoff, Jay Freese DISCUSSION: Mr. Deyoe stated the first filing was approved 3/20/68. It complies with the Plann4n2 Commission Lard Use Policy. Street and water improvements have been made. Explained there is a pos- sibilities of two other independent filings which are adjacent to the subdivision. If sewer system is available at a future date , developers should be encouraged to obtain the service. It should be subject to some type of agreement for share cost of a 6" water main and hydrant at the intersection of State F37 and Sandy Knoll Blvd. extended 600 ' south from County Rd . 54. There is a 6" main through the middle of the subdivision. Housing Unliminted has property adjoining on the east and directly across the road is a mobile home park which is in the city limits . Felt a joint effort could give the three entities the required fire protection . Glen Paul has approved the septic system. Water will be from Central Weld Water District . Mr. Dickerson , Mayor of Kersey, was present and stated at this time, if annexation occurred , the sewer system of Kersey would not be adequate. Mr. Paul stated for this reason , the Health Department has recommended septic systems . Mr. Dickerson 777 c . stated he had no objection to the septic systems . However, there had been a misunderstanding among the town board members and the other four were opposed to them. Mr. Lorenson stated there is a question of drainage , fire protection and sewage that need to be taken into consideration and worked out before the preliminary plat is approved. Mr. Freese stated a drainage report had been filed . Mr. Lorenson stated the developer and the City of .Kersey should come to an agreement if city service should come 4bout and work out the agreements in that area after annexation occurs . Mr. Bowles requested a letter from the ditch company stating they will accept the run-off. Mr. Lorenson stated the fire protection would include the extension of the 6" line and place a fire hydrant on the north-south road out of Kersey which would provide some semblance of fire protection to the mobile home area . Mr. Freese stated he thought the city plans to extend the line in the fall , and could get a letter from the town of Kersey to this effect. MOTION: By Mr. Heitman that the preliminary plat of Sandy Knolls Estates be approved subject to drainage , fire district approval , and approval of the sewage disposal by the Town Board and possibly the inclusion of Housing Unlimited in the plat. Shore and Sullivan had planned to develop 8 lots , however at this time they are requesting two building permits and will plat at a later date . They are pre- senting a dedication of ROW at this time for acceptance. ROW has also been obtained from Harvey Mathias on 38th Avenue between 20th street and property owned by Dr. Shore and Dr. Sullivan . They have also agreed to install all improvements up to the first cul -de-sac. They have signed a subdivision agreement for the improvements . They will install septic systems until such time as they have annexed to the City and sewer is available. All im- provements must meet the City of Greeley' s standards . These parcels have been sold to various individuals who are now seeking building permits for an illegal subdivision. . Mr. Fedrizzi explained he bought the original 120 acres and his intention was to sell 4 parcels , one of which , was sold to Mr. Staley who in turn divided his parcel . There was discussion regarding what constitutes an original parcel . Dept . of Highways APPEARANCE : Al Chotvacs tape 423 DISCUSSION : Mr. Chotvacs presented a map showing the proposed 34 By-Pass going east . On the northern alternate which was chosen to be constructed , just east of the Kersey bridge , . the county road which is between sections 14 and 15 , T5N„ R65W, they have two alternatives . The ultimate is to close that roadway, however they could leave it open temporarily to some future date when they have completed the diamond inter- change . There will be complete access control from GreeRey to Kersey on the By-Pass . They don ' t want people building in the area thinking they will have access to the Highway. Mr. Bowles asked what justification would the County Commissioners have for closing the road at this time .when the road is not under con- struction . Mr . Chotvacs stated they will draw up a three-way agreement with the County that certain county roads will have access and others will not. They just want it understood if someone develops there they will have to connect up with the frontage road . RESOLUTION : Be it therefore resolved to recommend the closing of County Road #45 access to Highway 34 at a suitable date . Motion by Mr. Weigand , gecond by Mr. Nix. The Soil Conservation Service has designed a holding pond which he will construct. The Health Dept. has given their approval and has been reviewed by the County Agent. RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the recommendations by the staff for a maximum ob 2850 head , construction of the holding pond and construction to begin within one year of the approval by the County Commissioners . Robert Barthold DISCUSSIONS Mr. Lorenson explained there were no staff recommend- ations as they had been informed in the morning that Mr. Barthold was unable to obtain a clear title to the property in question and has located another site for the dog kennel , approximately two miles north . Mr, Lorenson informed Mr. Barthold the new application would have to be processed in the normal way and be placed on the next agenda . This cannot be heard before the County Commissioners earlier than June 12 , 1972. Mr. Paul would like to review the application before it is approved . Mr . Bowles stated there would be no action taken on the application at this time until the site can be inspected and be heard by the Planning Commission on May 16 , 1972 . Mr. Barthold stated he planned to have 40 adult and from 75 to 100 puppies . SUBJECT : Dacono Fire Protection District DISCUSSION : Mr. Lorenson stated Dacono is trying to form a fire protection district but elected not to appear at this time. SUBJECT: Fire and Water Districts DISCUSSION : Mr. Lorenson reported on a meeting held with the Fire Protection Districts and the Water Districts to review the section of the Subdivision Regulations that are proposed on fire protection . They were of the opinion the regulations should stick to the Fire Underwriters Code . Those present would be will - ing to adhere to those codes and recommend them.. SUBJECT : Next agenda DISCUSSION : Mr. Deyoe reported on some of the items that will be on the next agenda. SUBJECT : Airport zoning DISCUSSION : A proposed zoning map for the airport has been submitted which relates to heighth restrictions for the airport: The in- tention is to have these written in the regulations . 765 An executive meeting was held at 6 : 00 P. PRESENTATION : Mr. Bowles presented a plaque . to Leonard Bartels in behalf of the Planning Commission for serving on the Commission for seven years . SUBJECT : Housing Inventory DISCUSSION: Susan Shermac of Allan M. Voorhees and Associates 'pre- sented inventory and analysis of housing in the Larimer-Weld Regional Planning area . This includes a summary of all of the data gathered plus suggestions and recommendations and a report on each town . Each town will receive a summary and a copy of the analysis made for their individual town . A mock up of what will be the comprehensive plan package for individual communities was presented . Mr. Lorenson stated there will also be model zoning , model subdivisions , and model annexations that will accompany this . Jim Ohi and Gary Eastman have contacted the towns and are working with them to develop their comprehensive plans and how to implement them. Mr. Bowles reported on the impact Jim Ohi has had On the town board of Keenesburg and the planning people. SUBJECT : Information on over-lay system DISCUSSION : Mr. Lorenson explained Gary Fortner is an intern student hired to determine what land should remain agricultural . Felt that the information he is developing is the best decision making tool we have . He has been working closely with the Ag Council . Gary explained the information and evaluations that will be gained by the over -lay system in an effort to protect the agricultural land. Mr. Lorenson stated he would like to retain Gary for the remainder of the year so he can continue with the work he has been doing . This can be done without any increase to the budget because of some other circumstances . 766 J MOTION : By Mr. Watson to hire Gary Eastman for the remainder of this year. Second by Mr. Nix. Coulson have requested this office to furnish you with the soils interpretation for an area of land in the SEA, Section 13-3-65 , Weld County, Colorado (Lot 21, Milton Lake Estates) . The land in question is to be used for dog kennels plus a home with a septic tank filter field for on site sewage disposal. The area is mapped as deep, coarse to moderately coarse textured well drained soil. The area has very little runoff, if any, and is not subject to flooding.
