Dear Mr. Nader:
This letter is forwarded for information concerning the above referenced
case . The property immediately adjacent to the west of the subject property is
owned and farmed by the C. Vincent Phelps Trust. Prior ownership was in the
Delventhal family for many years, since about 1895, until purchased by the Phelps
Trust.
There is an irrigation lake on the west end of the subject property that has
historically been used to irrigate the Trust property for the past 100 plus years .
The lake, located on the subject property gets irrigation water from the Brighton
Lateral Ditch which transports Burlington and Wellington water to the farmers
along the Brighton Lateral Ditch . There is also some natural seep water that feeds
the lake in question . Water from this lake is transported via a culvert pipe into
the Lake immediately to the west on the C. Vincent Phelps Trust property. From
there, the irrigation water is conveyed to the farm ground below the lakes to the
west.
This water has historically been used on the property for the past 100 plus
years. Our concern is that the applicants for the PUD filing for six residential lots
may not be aware that the natural flow of water to the two lakes cannot be
altered to cut off or lessen the amount of irrigation water historically passed
through this natural flow through the 2 lakes and the Brighton Lateral Ditch .
The Trust would request that any approval of the final plan for the six
residential lots be conditioned upon the applicants being required to maintain the
natural and historic flow of irrigation water through these two lakes so as not to
interfere with the flow of irrigation water used on the Trust property.
Thank you for your consideration in this important matter. Irrigation water
in Colorado is probably the most valuable asset farmers possess in maintaining
their ability to produce crops.

To Whom It May Concern :
Today we received a postcard notifying us of Case # PUDF23-0002 in regards to a
proposed project to rezone our neighboring lot to plan for six (6 ) residential lots and one
( 1 ) non - buildable outlot. This letter is to serve as our complete objection to this case .
We built a custom home and outbuilding in 2022 with the understanding , as told to us by
the builder and original owner of our land , that there were limited owners and proposed
homes surrounding us - none of which included these additional six (6) residential lots .
We purposely moved here with this understanding as we are not interested in the
additional neighbors , congestion , demands on our roads and natural resources , etc.
The Nguyen family has already had significant issues with their well and these
additional homes are likely to place an increased drain on the local geologic water
conditions .
Additionally , just recently , a fracking location has been installed South of the proposed
lot , but North of County Road 2 . Again , the already increased traffic and use of the
county roads has been disheartening . The intersection at County Road 2 and County
Road 31 has grown increasingly busy , which this proposed project would add to that ,
and therefore increasingly dangerous .
In summary , we object to this project. We were assured that the open space and bigger
lots would remain and therefore we chose to invest a great deal of money and time to
build our family' s forever home here . The increased traffic and drain on our natural
resources would be potentially unsafe for our family and surrounding homes .

Over the weekend we received a postcard of Case # PUDF23-0002 in regard to a proposed rezone
project of our neighboring lot . The plan is for six additional residential lots and one non-buildable out lot.
We are writing this letter to serve as our complete objection to this case .
We will be breaking ground within the next couple weeks at our custom home . Also, my parents
at 625 CR 31 have already started on their custom home . They are months from being complete . When
we bought the lot we were told by the original owner of the land that it would be limited to 4 lots total .
That there would be no additional lots made since the proposed lot to be rezoned had to stay that size
due to something with an agricultural use . We purposely bought our lot here due to the low number of
lots and less congestion and amount of neighbors we would have .
From my understanding this would also cause more wells to be built if approved . We are
concerned with the increased drain on the local geologic water conditions. And additional roads and traffic
that this may cause . There is also a new fracking location to the South . Which has caused much more
traffic on CR 31 .
This letter is to notify that the lot owners and future homeowners of 615 and 625 CR31 object to
this project. When we originally bought, we were told that the open space and bigger lots would remain
the same . That there was an agricultural issue that would prevent them from being subdivided . My
parents are building an amazing expensive home and we will be breaking ground soon on ours . The plan
is for these homes to be our forever homes . We are concerned with the increased traffic and drain of our
natural resources which would be unsafe for our family and surrounding homes .
