Buck, Pro-Tem Commissioner Scott K. James Commissioner Kevin D. Ross Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick County Attorney, Bruce Barker Department of Planning Services representative, Kim Ogle Department of Public Health and Environment representative, Lauren Light The following business was transacted: hereby certify that pursuant to a notice dated November 15, 2022, and duly published November 18, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Julie Walker, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0029, to exceed the maximum allowed building coverage (up to 12%) in a subdivision in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. ft Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and described the posting of the hearing and the location of the site, which is within the three (3) mile referral area of the Towns of Firestone and Frederick, and the Coordinated Planning Agreement area for the City of Fort Lupton and Town of Firestone. He noted the City of Fort Lupton did not return a signed Notice of Inquiry (NOI); however, the Town of Firestone returned their NOI, dated October 5, 2022, indicating they are not interested in annexation. He also stated the Towns of Firestone and Frederick returned referrals of October 25, and 26, 2022, respectively, indicating no concerns. He shared, per the Development Review staff, the parcel has two (2) existing, unpermitted accesses, one onto Del Comundo Lane and the other onto Sierra Vista Road, which are paved, local roads within the Casa Grande Estates Subdivision. Both accesses meet the minimum access spacing criteria, and the applicant is requesting a third access to the parcel onto Del Comundo Lane; however, since the parcel is less than one (1) acre, three (3) access points would not meet the minimum access spacing criteria. Consequently, the applicant should consider closing and reclaiming one existing access onto Del Comundo Lane, in lieu of the previous access to the proposed barn. He further stated, an acceptable Drainage Narrative has been received, the site meets a Stormwater Detention exemption, and the site is also located within the Municipal Separate Storm Sewer System (MS4) area, although currently no MS4 requirements have been triggered on this parcel. Mr. Ogle described the proposed structure and its use, which would cc: pl.(Tp/NN/Ko) 01/26/23 2023-0068 PL2854 HEARING CERTIFICATION - JULIE WALKER (USR22-0029) PAGE 2 complement the existing site infrastructure, and explained the allowable lot coverage is 4,454 square feet and the applicant is approximately 300 square feet over the allowed coverage. He stated Notice was sent 27 surrounding property owners (SPOs), no response or phone calls were received, nine (9) referral agencies reviewed the case, and two (2) offered comments with specific conditions that have been addressed in the Conditions of Approval and Development Standards. Mr. Ogle entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. El Lauren Light, Department of Public Health and Environment, stated the residence is served by the Central Weld Water District, with a septic system permitted for three (3) bedrooms, which is located to the southwest of the residence. She explained the proposed building is adjacent to the system, a minimum setback of ten (10) feet from the leach field and five (5) feet from the septic tank are the requirements, which is addressed in the Development Standards, and there are no outstanding issues with the application. Julie Walker, applicant, was present and had no comment. El No public testimony was offered concerning this matter. El In response to Chair Freeman, Ms. Walker indicated she had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as presented. In response to Chair Freeman, Kim Ogle confirmed the additional access is not a requirement, and one would have to be closed to establish a new access. Ms. Walker agreed she is aware of the stipulation. The Board reviewed the Conditions of Approval and Development Standards as presented. Ms. Walker agreed to abide by the Development Standards as presented. Commissioner Saine moved to approve the request of Julie Walker for a Site Specific Development Plan and Use by Special Review Permit, USR22-0029, to exceed the maximum allowed building coverage (up to 12%) in a subdivision in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Ross, and it carried unanimously.
