Staff comments made during this phase of the application process may not be all- inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcels: 147130100103 Lot A 2nd Corrected RE -3362. The project proposes to: Change of Zone from the A (Agricultural) to the 1-3 (Heavy Industrial) Zone District. ACCESS: Weld County Development Review has reviewed the application materials related to access. The parcel has an existing access onto N Main Street which is under the jurisdiction of the City of Brighton. Please contact the City of Brighton regarding access permitting. ROADS AND RIGHT-OF-WAY: This portion of N Main Street is under the jurisdiction of the City of Brighton. The municipality has jurisdiction over access to the road. The applicant shall delineate on the plat the future and existing right-of-way and the physical location of the road. Pursuant to the definition of setback in the Weld County Code Sec. 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. Please contact the municipality to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. Per Sec. 23-2-30.A.4. of the Code, paved roadways are considered adequate in functional classification, width and structural capacity to meet the traffic requirements of the change of zone. Please contact the municipality to verify the right-of-way. Show and label the right-of-way. Show the approved access(es) on the plat and label with the approved access permit number if applicable. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. The existing residence is served by an individual domestic well (152851-A) and an on - site wastewater treatment system permitted for 4 bedrooms (G-19900018). A commercially permitted well and OWTS will be required when an industrial use is established on the parcel. We recommend the following appear as notes on the plat: 1. Water service may be obtained from an appropriately permitted well. 2. The parcel is currently not served by a municipal sanitary sewer system. Sewage disposal may be by an on -site wastewater treatment system designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division, and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Activity or use on the surface of the ground over any part of the OWTS must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. Kim, Please accept this email as Brighton's response as I have been unable to locate your official referral form online. lam out of town starting tonight and will not be able to reapply my comments before your deadline. The City of Brighton is opposed to this rezoning proposal. The application has an error as this is within the City of Brighton's Grown Boundary and not the City of Fort Lupton's. The City of Brighton has utilities in the area and services can be expected by the City. The proposal would allow for urban development and we find that this is best accomplished within the City Limits of Brighton. As the property is within our growth boundary, and as the adjacent ROW is already annexed, we find that City standards such as architecture, buffering, and screening should be applied to the development as site development will impact City residents and businesses directly. As such, City staff encourages the applicant to reach out to schedule a Preliminary Application Conference to discuss annexation and development within the City of Brighton. Please notify me directly of any upcoming public hearing(s) on the application as myself or another will be attending to oppose this item. If this project is to move forward, City staff requests that City of Brighton standards be applied at the time of site development given the direct impacts to our residents and business owners. Water Division 1, Water District 2 Dear Kim Ogle: We have received the November 23, 2022 referral concerning the change of zone application to allow future industrial/commercial uses by NGL Energy Patterns on 3.83 acres at 1821 County Road 27 known as Lot A of Recorded Exemption No. RE -3362. This referral does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. According to the application, the current owner of the property, Sasaki Family Holdings LLC, will continue to reside on the property until NGL Energy Patterns develops the land. The applicant proposes that the existing well, permit no. 152851-A, serve the owners' residential uses. Permit no. 152851-A was issued November 3, 1988 pursuant to section 37-92-602(3)(c), C.R.S. for the replacement of well no. 152851 (which has since been plugged and abandoned). The well produces from the South Platte River alluvium and is permitted for ordinary household purposes inside three (3) single-family dwellings, the watering of domestic animals, and the irrigation of not more than 10,000 square -feet of home gardens and lawns. As permitted, the well cannot be used for industrial and commercial uses. The well must be re -permitted and covered by a court -approved augmentation plan before it can be used for commercial and industrial uses. The proposed water supply for NGL Energy Patterns' future commercial and industrial uses is a new Laramie - Fox Hills well. The ability for the applicant to obtain a well permit and the allowed uses will be determined at the time a complete application is submitted to and reviewed by the State Engineer's Office.
