HomeMy WebLinkAbout20232000.tiffHEARING CERTIFICATION DOCKET NO. 2023-42 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND FIRST MAJOR AMENDED USE BY SPECIAL REVIEW PERMIT, 1MJUSR23-14-0005, FOR OPEN MINING (SAND, GRAVEL AND STONE), MATERIALS PROCESSING, AN ASPHALT BATCH PLANT, EMPLOYEE AND EQUIPMENT PARKING ASSOCIATED WITH OPERATIONS, AND MINE SUPPORT INFRASTRUCTURE OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - TERRY GRAZING ASSOCIATION, C/O CONNELL RESOURCES, INC. A public hearing was conducted on July 19, 2023, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Scott K. James Commissioner Kevin D. Ross Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Karin McDougal Department of Planning Services representative, Kim Ogle Department of Public Health and Environment representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated May 15, 2023, and duly published May 17, 2023, in the Greeley Tribune, a public hearing was conducted to consider the request of Terry Grazing Association, c/o Connell Resources, Inc., for a Site Specific Development Plan and First Major Amended Use by Special Review Permit, 1MJUSR23-14-0005, for Open Mining (sand, gravel and stone), materials processing, an asphalt batch plant, employee and equipment parking associated with operations, and mine support infrastructure outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, provided the general location of the site, stated the Department of Planning Services sent notice to surrounding property owners (SPOs) and received one (1) letter in opposition. He shared, per the Development Review staff, there is a permitted access point on County Road (CR) 26, and no additional traffic associated with the amendment, is expected. He relayed the Improvements and Road Maintenance Agreement for the original permit was reviewed, it adequately addresses the site and traffic, and indicated the site meets an exception for stormwater detention. Mr. Ogle discussed the number of employees, mining plan, existing and proposed infrastructure, and the Reclamation Plan. Lastly, he entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. cc: PL (TP/MN/Ko/DA//hw) og/Ig/23 2023-2000 PL2275 HEARING CERTIFICATION - TERRY GRAZING ASSOCIATION, C/O CONNELL RESOURCES, INC. (1MJUSR23-14-0005) PAGE 2 El Lauren Light, Department of Public Health and Environment, explained that since the request is considered a temporary use, portable toilets and bottled water are acceptable. She stated the site must meet the industrial noise level, which the Noise Modeling Report indicated is possible, discussed the Dust Abatement Plan, and relayed an Air Pollutant Emission Notice (APEN) is required. la Bill Schenderlein, Blue Earth Solutions, LLC, represented the applicant and provided a PowerPoint presentation (Exhibit D). He discussed the existing permit, site location, and history of Connell Resources, Inc., as well as the existing site conditions, including dry mining, Tri-state transmission lines, Union Pacific Railroad lines and the Lone Tree Creek. He explained the Reclamation Plan, and relayed the land will be reclaimed as self-sustaining range land. No public testimony was offered concerning this matter. ▪ Mr. Ogle confirmed for Mr. Schenderlein that Development Standard (DS) #7 (number of on -site employees), is only applicable to the amended area, not the existing site. The Board made no changes to the Resolution. • In response to Chair Freeman, Mr. Schenderlein indicated he had, on behalf of the applicant, reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as presented. En Commissioner Buck moved to approve the request of Terry Grazing Association, c/o Connell Resources, Inc., for a Site Specific Development Plan and First Major Amended Use by Special Review Permit, 1MJUSR23-14-0005, for Open Mining (sand, gravel and stone), materials processing, an asphalt batch plant, employee and equipment parking associated with operations, and mine support infrastructure outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Ross, and it carried unanimously.
