HomeMy WebLinkAbout20231027.tiffHEARING CERTIFICATION DOCKET NO. 2023-28 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR22-0035, FOR AN EVENTS FACILITY, NOT AGRICULTURE -RELATED, FOR UP TO 200 PEOPLE, LOCATED OUTSIDE OF SUBDIVISIONS OR HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - STEVEN WELLS A public hearing was conducted on April 19, 2023, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Scott K. James Commissioner Kevin D. Ross Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Karin McDougal Department of Planning Services representative, Chris Gathman Department of Public Health and Environment representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated March 14, 2023, and duly published March 17, 2023, in the Greeley Tribune, a public hearing was conducted to consider the request of Steven Wells, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0035, for an Events Facility, not agriculture -related, for up to 200 people, located outside of subdivisions or historic townsites in the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter of record. Ei Chris Gathman, Department of Planning Services, presented a brief summary of the proposal, shared the acreage of the site, stated 14 referrals were sent out, nine (9) were received back, four (4) with comments attached, and explained the facility is large enough to host approximately 200 people, primarily hosting charitable and private events. He relayed the number of employees will vary depending on the size of the event, and explained the primary hours of operation. Mr. Gathman stated a facility entrance sign is proposed and outdoor lighting is expected to include wall mounted lights, low profile, garden walkway lights, and string lights, and no pole lights are proposed. He shared parking will be on an improved gravel area, the facility will be equipped with a certified existing septic system and proposed commercial well for indoor use only. He described the location of the nearest single family residence, which is approximately 0.5 mile west of the site. Lauren Light, Department of Public Health and Environment, stated the applicant has an existing commercial septic system that is sized for 200 people, and the well will be re -permitted to commercial, which completion is listed as a Condition of Approval (COA). She explained food venders, including food trucks or catering, will be required to adhere to Colorado Retail Food Gc:PL(T? I4 /G(,) 05/05/23 2023-1027 PL2867 HEARING CERTIFICATION - STEVEN WELLS (USR22-0035) PAGE 2 Regulations, which is stated in the Development Standards (DS), and there are no outstanding issues with the request. Fi Mr. Gathman stated, per the Development Review Staff, the applicant has proposed access onto State Highway 392, as well as a Traffic Narrative, which has been forwarded to the Colorado Department of Transportation (CDOT) for review. The applicant has submitted an acceptable Drainage Report, and a Grading Permit will be required if disturbing more than one (1) acre. Mr. Gathman entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. to Tim Naylor, AGPROfessionals, represented the applicant and stated the applicant has requested CDOT install a turn lane. In response to Commissioner James, Mr. Naylor stated, in regard to the Colorado Division of Water Resources, there are some wells that have to be addressed, an approved commercial well permit is in hand, and finalization of the construction plans is pending. El No public testimony was offered concerning this matter. In response to Chair Freeman, Mr. Naylor, on behalf of the applicant, indicated they had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as presented. El The Board reviewed the Conditions of Approval and Development Standards, and no corrections or changes were made. Commissioner James moved to approve the request of Steven Wells for a Site Specific Development Plan and Use by Special Review Permit, USR22-0035, for an Events Facility, not agriculture -related, for up to 200 people, located outside of subdivisions or historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Ross, and it carried unanimously.
