RE: SET HEARING DATE FOR CONSIDERATION OF AMENDED AND RESTATED
SERVICE PLAN - KITELEY RANCH METROPOLITAN DISTRICT
WHEREAS, the Board of County Commissioners of Weld County, Colorado (the "Board"),
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, the Amended and Restated Service Plan for the Kiteley Ranch Metropolitan
District was received by the Clerk to the Board on September 20, 2023, from Icenogle Seaver
Pogue, 4725 South Monaco Street, Suite 360, Denver, Colorado 80237, for filing with, and
consideration by, the Board, and
WHEREAS, C.R.S. §32-1-204(2), requires that Service Plans be delivered to the Weld
County Planning Commission (the "Planning Commission") for study and recommendation to the
Board, such recommendation to be received by the Board within thirty (30) days after the filing of
the Service Plan, and
WHEREAS, on October 2, 2023, the Board accepted the filing of the Amended and
Restated Service Plan and referred the matter to the Planning Commission for a hearing which
was held on November 7, 2023, pursuant to the schedule approved by the applicant, which
schedule waived the thirty (30) day requirement due to schedule conflicts and the fact that only
one Planning Commission meeting occurs each month, and
WHEREAS, upon receipt of said recommendation, the Board deems it advisable to set a
public hearing date for its consideration of said Amended and Restated Service Plan, said hearing
date to be December 6, 2023, at 9:00 a.m., and
WHEREAS, pursuant to C.R.S. §32-1-204(1) and (1.5), a legal notice of the December 6,
2023, public hearing on the Amended and Restated Service Plan for the Kiteley Ranch
Metropolitan District, dated November 13, 2023, was duly published on November 15, 2023, in
the Greeley Tribune, and was likewise mailed on November 13, 2023, to property owners within
the special district, as well as to the governing body of any existing municipality or special district
that has levied an ad valorem tax within the next preceding tax year, and that has boundaries
within a radius of three (3) miles of the proposed special district boundaries.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the public hearing for consideration of the Amended and Restated Service
Plan for the Kiteley Ranch Metropolitan District, be, and hereby is, scheduled for December 6,
2023, at 9:00 a.m.
BE IT FURTHER RESOLVED by the Board that, pursuant to C.R.S. §32-1-204(1)
and (1.5), the publication and mailing of said legal notice of the December 6, 2023, public hearing
on the Amended and Restated Service Plan for the Kiteley Ranch Metropolitan District, be, and
hereby is, ratified and approved.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
