HomeMy WebLinkAbout20230295.tiffRESOLUTION RE: ACTION OF THE BOARD AT SHOW CAUSE HEARING, PCSC22-0003, CONCERNING ZONING PERMIT FOR A HOME OCCUPATION CLASS II, ZPHB16-0015 - SANTOS VEGA AND LUZ YADIRA VEGA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on October 26, 2022, a Show Cause Hearing was conducted to consider revocation of Zoning Permit for a Home Occupation Class II, ZPHB16-0015, issued to Santos Vega and Luz Yadira Vega, 909 East 16th Street, Greeley, Colorado 80631, and WHEREAS, Santos Vega and Luz Yadira Vega are the current owners of the facility located on property being further described as follows: Lot 6 of the Union Colony Lands within the SW1/4 NE1/4 of Section 9, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing on October 26, 2022, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the permit holder, and the recommendation of Planning staff, and having been fully informed, deemed it advisable to suspend said permit, effective immediately, and continue the matter to January 25, 2023, at or about 9:00 a.m., to allow the permittee additional time to bring the site into compliance, and WHEREAS, at said hearing on January 25, 2023, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the permit holder, and the recommendation of Planning staff, and having been fully informed, deemed it advisable to continue the matter to April 19, 2023, at or about 9:00 a.m., to allow the permittees additional time to submit complete Change of Zone and Resubdivision applications, with said suspension to remain in place. WHEREAS, at said hearing on April 19, 2023, the Board of County Commissioners heard all of the testimony and statements of those present, and the recommendation of Planning staff, and having been fully informed, finds that the site is now in compliance, and, therefore, deemed it advisable to lift the suspension on said permit, reinstate the Zoning Permit uses, and dismiss the matter. VIOLATION The property identified as 909 East 16th Street, Greeley, CO 80631, was not in compliance with the Zoning Permit for a Home Occupation Class II, permit no. ZPHB16-0015, Conditions and Limitations [Permit], recorded March 15, 2017, reception # 4285911, see attached. The Per an anonymous complaint submitted to Weld County Department of Planning Services on December 16, 2021, the site had numerous commercial vehicles parked on -site and the outdoor storage of construction equipment. A Probable Cause - Show Cause process was setup, case no. PCSC22-0003, to respond to this complaint. As a result of site inspections by Department of Planning Services staff on December 17, 2021, March 10, 2022, May 25, 2022 and July 20, 2022, September 14 and October 21, 2022, it was observed that the property did not appear to be in compliance with the Permit, as more than two (2) commercial vehicles (semi- truck/trailers) and the exterior storage of construction equipment were observed on -site. Specifically, the property does not appear to be in compliance with the Permit conditions A.8 and A.9, which state: A.8: On parcels of land less than eighty (80) acres, the number of commercial vehicles is limited to two (2) such vehicles with two (2) rear axles. A.9: No exterior storage of materials, goods, supplies or equipment related to the business is permitted PCSC22-0003 Memo I Vega Page 1 RECOMMENDATION The role of the Board of County Commissioner in this Probable Cause- Show cause process is to review the property, for compliance with the terms of the Zoning Permit, to determine if probable cause exists to hold a hearing on revocation of the Zoning Permit. If it is determined at the Probable Cause hearing that there is probable cause that the property is not in compliance with the Zoning Permit, the Board of County Commissioners will schedule a Show Cause hearing to consider revocation of the Permit. At the August 8, 2022 Probable Cause hearing, Planning staff presented a summary of the violation, zoning permit and inspections. It was determined by unanimous vote of the Board of County Commissioners that there was Probable Cause that the property was in violation. For the benefit of the Board, Section 2-4-40.C of the Weld County Code states: "Probable cause is defined as a reasonable ground for belief in the existence of evidence supporting the allegations of violations of the Weld County Code." To this end, a Show Cause hearing was scheduled at the Probable Cause hearing for October 26, 2022. At the Probable Cause hearing, the property owner asserted their intention to proceed with coming into compliance by pursuing a Change of Zone and Site Plan Review process and that the application would be submitted as soon as possible. This proposal was thoroughly discussed on August 9, 2022, being the day after the Probable Cause hearing, under pre -application case no. PRE22-0198. However, at the time of August 9, 2022 no application has been submitted to the Department of Planning Services for review. Given that the property did not come into compliance with the terms of the approved Zoning Permit, that sufficient time had been granted to the applicant to remedy the violation and that no application had been submitted to advance that purpose, the Department of Planning Services recommended that the Board of County Commissioners revoke the Zoning Permit. The Board of County Commissioners found adequate cause to suspend ZPHB16-0015 immediately. The Show Cause was continued to January 25, 2023 to give the applicant time to get the property into compliance and get ZPHB16-0015 reinstated. The applicant did meet with Planning staff and submit application materials for a proposed Resubdivision and Change of Zone. These documents are still being compiled together for completeness. Planning Staff did meet with the property owner on April 7, 2023 to discuss next steps and progress. The property owner stated they will remove the commercial trucks and commercial outdoor storage from site to get ZPHB16-0015 reinstated. Following the April 7, 2023 meeting Planning Staff went out to site to confirm the removal of the trucks and the commercial outdoor storage, it was confirmed by Planning Staff that the following items were removed from the site. Therefore, Planning Staff is recommending reinstating the ZPHB16-0015 permit. With ZPHB16-0005 the property owner will be allowed to have up to two (2) commercial vehicles on site. For reference, the County Attorney's Office and Weld County Department of Planning Services - Code Compliance Division have continued the violations forward with County Court per case no. ZCV21-00368. Specifically for the violations of an unscreened non-commercial junkyard, and unpermitted commercial vehicles, tires, box trucks, concrete/stone, portable toilets and other miscellaneous commercial debris. The presence of the non-commercial junkyard was the only component of this violation remaining.
