Tuesday, July 11, 2023
A regular meeting of the Weld County Planning Commission was held in the Weld County Administration
Building, Hearing Room, 1150 O Street, Greeley, Colorado. This meeting was called to order by Chair,
Elijah Hatch, at 1:31 p.m.
Roll Call.
Present: Elijah Hatch, Skip Holland, Sam Gluck, Butch White, Pamela Edens, Michael Palizzi.
Absent: Michael Wailes, Shana Morgan.
Also Present: Chris Gathman, Diana Aungst, and Tom Parko, Department of Planning Services; Lauren
Light, Department of Health; Karin McDougal, County Attorney, and Kris Ranslem, Secretary.
Motion: Approve the June 6, 2023 Weld County Planning Commission minutes, Moved by Butch White,
Seconded by Sam Gluck. Motion passed unanimously.

Township 8 North, Range 66 West of the 6. P.M., Weld County, Colorado.
West of and adjacent to County Road 29; 0.5 miles north of County Road 90.
Chris Gathman, Planning Services, presented Case USR23-0015, reading the recommendation and
comments into the record. The Department of Planning Services recommends approval of this application
along with conditions of approval and development standards.
Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site
dust control, and the Waste Handling Plan.
Steven Bingley, 44485 CR 29, Pierce, Colorado, stated that they intend to put ten (10) RV campground
spaces on their property. He added that they moved to Colorado in 2016 for a new position and he stayed
in an RV and feels that there is a need for transitioning people to and from Colorado especially with the
ever-increasing housing market in the area. Mr. Bingley thought this was an opportunity to make a good
use of the 30 acres they purchased.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
Commissioner Gluck asked where the campground will be located on the property. Mr. Bingley said it will
be located on the northeast part of his property and will be approximately one (1) acre in size. He
understands there are some comments from the Town of Pierce regarding this project, however, he added
that this is their permanert home and they are in it for the long haul.
The Chair asked the applicant if they have read through the Development Standards and Conditions of
Approval and if they are in agreement with those. The applicant replied that they are in agreement.
Motion: Forward Case USR23-0015 to the Board of County Commissioners along with the Conditions of
Approval and Development Standards with the Planning Commission's recommendation of approval,
Moved by Skip Holland, Seconded by Michael Palizzi.
Vote: Motion carried by unanimous roll call vote (summary: Yes = 6).

Request: Change of Zone from the A (Agricultural) Zone District to the C-3 (Business
Commercial) Zone District.
Legal Description: Lot A Recorded Exemption RECX13-0054; being part of the SW1/4 of Section 34,
Township 1 North, Range 67 West of the 6th P.M., Weld County, Colorado.
Location: East of and adjacent to County Road 19; approximately 890 feet north of County
Road 2.
Commissioner Hatch stated that he is very familiar with the applicants, however, he believes he can be fair
and impartial regarding this case.
Diana Aungst, Planning Services, presented Case COZ23-0002, reading the recommendation and
comments into the record. Ms. Aungst noted that two surrounding property owners provided letters of
support for this change of zone. The Department of Planning Services recommends approval of this
application along with conditions of approval.
Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements.
Commissioner Holland asked if they have any need for water on this site. Ms. Light said that Todd Creek
Village Metro District will provide water. She added that the applicants are expanding the existing RV site.
Jennifer Johnson -Seltzer, 33641 CR 83, Briggsdale, Colorado, stated that this project is an expansion of
their existing storage facility. She added that currently there are 900 spots and they filled those spots much
faster than they expected so they are requesting to expand the facility.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
The Chair asked the applicant if they have read through the Conditions of Approval and if they are in
agreement with those. The applicant replied that they are in agreement.

Approval with the Planning Commission's recommendation of approval, Moved by Butch White, Seconded
by Sam Gluck.

The Chair called a recess at 2:02 p.m. and reconvened the hearing at 2:10 p.m.

Request: A Site Specific Development Plan and Use by Special Review Permit for
Agricultural Support and Service and Oil and Gas Support and Service (truck
parking) outside of subdivisions and historic townsites in the A (Agricultural) Zone
District.
Legal Description: Lot A Recorded Exemption RE -4147; being part of the S1/2 SW1/4 of Section 14,
Township 2 North, Range 67 West of the 6. P.M., Weld County, Colorado.
Location: North of and adjacent to County Road 20; approximately 0.5 miles west of County
Road 23.
Diana Aungst, Planning Services, stated that the applicant is not present today. During the recess, Staff
had a conversation with the applicant and they are agreeable to continuing this case to the August 1, 2023
Planning Commission Hearing.

Ordinance 2023-09
Tom Parko
In the Matter of Repealing and Reenacting, with Amendments, Chapter 23 Zoning
of the Weld County Code (Limited Event Permits).
Tom Parko, Planning Services, presented Ordinance 2023-09, and provided a brief summary of the
proposed code changes relating to limited event permits. Mr. Parko stated that Staff recommends approval
of this Ordinance and added that they had some work sessions with the Board of County Commissioners,
who are also in favor of this permit.
Commissioner Edens asked what the process would be for a fifth (5th) event. Mr. Parko said that they would
have the conversation with the applican) of having to go through a USR Permit or Zoning Permit.
Mr. Parko clarified that if someone wanted to have a private wedding event on their property then a permit
wouldn't need to be required. However, if public is invited then you would need a permit.
Commissioner Wailes referred to the requirement of a bond or cash retainer and asked for clarification. Mr.
Parko said that if you have more than 100 people then you would have to post a bond. He added that Staff
will not go onto the property itself to clean up but this is mainly meant for impacts to offsite properties. Mr.
Wailes asked if this should be spelled out in the code. He added that it might be possible that someone
could interpret this as staff can go onto their property.
Commissioner Wailes asked what the permit fee would be. Mr. Parko said they haven't established fees
yet but have talked about $100 to $300.
Commissioner Hatch asked what the violation fee would be if they didn't get a permit. Mr. Parko said that
it would be a zoning violation and Staff would send the property owner a letter that they would be required
to submit a permit for this the next time they host such an event.
Commissioner Palizzi asked what the reason was for removing that process back in 2019. Mr. Parko said
that there were a number of events and there were some County Commissioners back then that didn't see
the value in it, although there were a lot of staff presence saying that there was value in having a permit in
place.

Commission's recommendation of approval, Moved by Sam Gluck, Seconded by Skip Holland.
