HomeMy WebLinkAbout20232860.tiffRESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR ADULT TREATMENT COURT (ATC) PROGRAM WITH VARIOUS ENTITIES AND AUTHORIZE DEPARTMENT OF JUSTICE SERVICES TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding for the Adult Treatment Court (ATC) Program among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Justice Services, North Range Behavioral Health, 19th Judicial District Combined Courts, Public Defender's Office, 19th Judicial District Attorney's Office, 19th Judicial District Probation Department, Intervention, and the Geo Group, commencing August 11, 2023, with further terms and conditions being as stated in said memorandum of understanding, and WHEREAS, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding for the Adult Treatment Court (ATC) Program among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Justice Services, North Range Behavioral Health, 19th Judicial District Combined Courts, Public Defender's Office, 19th Judicial District Attorney's Office, 19th Judicial District Probation Department, Intervention, and the Geo Group, be, and hereby is, approved. Ross ri Saine 2023-2860 JS0008 BOARD OF COUNTY COMMISSIONERS PASS -AROUND REVIEW PASS -AROUND TITLE: Consider Updated MOU from the Ir Judicial District Courts Adult Treatment Court (ATC) Program DEPARTMENT: Justice Services DATE: 9/12/2023 PERSON REQUESTING: Doug Erlef9v Brief description of the problem/issue: Our department works closely with the 19th JD's Adult Treatment Court (ATC) program. They are wanting to a do a bit of housekeeping and include additional parties to the enclosed MOU, to also include our department now. ATC wrote this MOU many years ago. They indicate not changing any language, just new dates and adding participating entities. There are no financial aspects to this MOU, it appears more simply a "declaration" by agencies to continue to collaborate and support the work of the ATC. What options exist for the Board? Option 1. Support. Allow the Justice Services Department Head, and on the Board's behalf, to sign the updated MOU, with final copy retained and in following with CTB recordkeeping. Option 2. Support. Authorize the Chair to sign the updated MOU. Option 3. Work Session. Consequences: If not to support through signature, it would hurt the positive relationships gained over the years by Weld County with the ATC program and participating entities. Impacts: If approved for signature, it would continue to demonstrate Weld County's, and through our department's role, support of the work of the ATC program. Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years): None. Recommendation: OPTION 1. For ease of administration, allow me to sign this updated MOU so that Weld County, and in doing our part through its Justice Services Department, can continue to support the fine work of the ATC program, and other participating entities. The purpose of the Adult Treatment Court is to hold participants accountable and help them develop the skills necessary to attain long term sobriety. WHEREAS, 1. Above -named Agencies are dedicated to evaluate and assess defendants in the legal system and provide the appropriate level of treatment, 2. Agencies are able to serve the needs of incarcerated defendants commensurate with their capacity for self care and autonomy in the community, 3. Above Agencies wish to work cooperatively with each other regarding defendants of mutual concern, with the shared goals of providing the most appropriate setting for treatment of in -custody defendants, and to effectively reduce recidivism, for the benefit of the defendant and the community as a whole. -cont- NOW, THEREFORE, This Memorandum of Understanding (MOU) is made and entered into as of the 2nd day of September, 2008, first updated as of the 1st day of June 2018 and most recently updated as of the 11th day of August 2023, between the Parties to describe the activities and responsibilities of the various Agencies for the benefit and protection of persons of mutual concern to the Parties. It shall remain in effect unless and until terminated by any party as described in this paragraph. The Parties agree to review this MOU periodically and to make adjustments as mutually agreed. Any Party may terminate its participation in this agreement with or without cause upon thirty (30) days written notice to the other parties. The Parties shall mutually agree, in writing, upon modifications, amendments or other alterations. No Party shall hold the other financially responsible for activities or services provided to the other under this Memorandum of Understanding.
