M., Weld County, Colorado) said Certificate more particularly described as follows: Certificate #624; dated July 6, 1971; drawn on the West Greeley National Bank; made payable to Forthyse Masonry c/o William Forthyse; with an endorsement to Weld County, Colorado. S063 28 February 1972 Board of County Commissioners Weld County Courthouse Greeley, Colorado 80631 Gentlemen, In line with the request for bond release involving road acceptance in portions of Westridge 1st, 2nd, and 3rd filings we have made inspection, and find the following. Several portions of the paving were not required by Board order, but were built for continuity with the rest of the subdivision. Therefore, no bond is held on some of the roads in Westridge. Mr. R. Douglas Sears in his letter of January 1st, 1972, requested release of a portion of the bond attributable to a Mr. William Forsythe in the amount of $500.00. Upon inspection we have found 90% of the paved roads need shoulder work. The paved portions are: 1st Filing: 100 lin ft. on 27th St west of 60th Avenue. 2nd Filing: 260 lin ft. on 27th St. west of 60th Avenue. 3rd Filing: 26th St from 65th Avenue to 62nd Avenue and old 60th Avenue south of 26th St. 330 lin ft. I would therefore find the release of the $500.00 bond 196rder. However, no other portions of road should be accepted or bonds released in any of the Westridge filings until the shoulder work is accomplished in those areas listed above. Since , ro F. Ewing i • RECORD OF PROCEEDINGS 100 Leaves m,. ..C.F.MOECKEL B.B.•L.CO. BOARD OF COUNTY COMMISSIONERS February 28, 1972 AND PLANNING COMMISSION MEETING TOPIC: PROPOSED SUBDIVISIONS David A. Mr. Lorenson reported that all requirements had been met and the Fagerberg, Jr. Planning Commission recommended favorably to the Board of County Commissioners for this subdivision. Mr. Lorenson also pointed SONNY VIEW ESTATES out that the letter from the Northern Weld County Water District was a letter of intent, and the letter of credit from the bank was not worded properly. After some discussion, the County Attorney was asked to look into this matter and get everything in order. Also there was discussion as to entrances from County Road to subdivision and it was requested to get Fire Department recommendations as to the proper placement of Fire Hydrants. After more discussion, it was moved to take this under advisement until all problems could be worked out. File was returned to Planning Commission and the County Attorney took subdivision agreement signed by Fagerbergs and Ogilvy Dicth Co. John Butcher Mr. Lorenson reported that all requirements had been met and the Planning Commission recommends favorably to the Board of County CASA GRANDE ESTATES Commissioners for this subdivision. On file there is a demand note, letter from the Health Department, and a letter from Central Weld Water District with stipulations - see letter in file. Also Mr. Lorenson asked if the board would accept letters of intent or do they want contracts. The Board requested a letter from the Health Department stating its approval or disapproval and an acceptable financial statement. After considerable discussion about water, a motion was made and seconded with a vote of 3 ayes to take this under advisement until the proper letter was received from the Health Department, a contract from the water supplier, and a financial statement along with the proper demand note. File returned to Planning Commission. / DouSears —Mr. Lorenson explained location of West Ridge, 4th filing, and stated all necessary requirements have been met and the necessary WEST RIDGE forms have been properly signed. He recommended the time limit SUBDIVISION on the note and agreement be for two years. Mr. Sears agreed to Fourth Filing this change with a clause added stating it could be reviewed in two years. A motion was made and passed to grant this subdivision request with the time clause added to the demand note. College Green, Inc. Mr. Lorenson explained that the subdividers had submitted a new c% Jake Pfleiger plan that does meet the Planned Unit Development originally filed and all requirements have been met. There was considerable discussion COLLEGE GREEN, about 16th Street and the demand note covering only half of the FIRST FILING street as the South side is to be built by adjacent owners. BILLINGS EXT. at COURT HOUSE Y COLORADO GREELEY, SOs3l February 16, 1972 Weld County Board of County Commissioners Greeley, Colorado 80631 Gentlemen: This a reply to a letter addressed to the Board dated January 20, 1972, from a Mr. R. Douglas Sears regarding paving in Westridge 1st, 2nd, and a portion of the 3rd filing. We do have a problem defining what parts of Westridge 1st, 2nd, and 3rd filings are approved. There is some.fine paving in Westridge, however since the street names have been changed, no less than three times, I would like to see a final street name plat accepted by the post office department before I recommend a release of bond by the Board to anyone. I fully realize this presents somewhat of a hardship on the people involved, but I do not feel the Board of County Commissioners should give blanket approval or accept and release bond on the wrong roads. Two weeks should be sufficient to clarify the entire issue and I do thank you for your patience. These roads were con- structed and paved in compliance with the plans and specifications as approved by Weld County. Mr. William Forsythe joined Rocky Mountain Enterprises in this construction. This letter is to request that you release Mr. Forsythe's Certificate of Deposit given Weld County as a security deposit on said construction. Mr. Bill Koehn also tendered a check to Weld County for his portion of Westridge Third roads. The portion of road for which Mr. Koehn is responsible is constructed but not yet paved therefore precluding the release of his Deposit at this time. Your prompt attention to this matter will be appreciated. Two separate owners were responsible for the completion of these roads--one being Rocky Mountain Enterprises of New Jersey, Inc. , whom I represent; the other being Bill Koehn. All of the roads for which Rocky Mountain Enterprises were responsible have been completed for some two months and our contractor, Best-Way Paving of Greeley, has informed me that you have approved these roads as completed. Will you please notify the Commissioners' office of the completion and acceptance of paving performed by Rocky Mountain Enterprises on the west 600 feet of 26th Street, 27th Street, 60th Avenue, and 61st Avenue, as these streets fall within the area of Westridge First, Second and Third Filings, in order that we may obtain a release of the Certificate of Deposit by Mr. William Forsythe, who participated in said con- struction with Rocky Mountain Enterprises, said Certificate of Deposit being in the amount of $500.00 Mr. Koehn understands that his deposit to Weld County will continue to be held until the paving for which he is responsible on the east end of 26th Street is completed and then accepted by Weld County.
