DIVISION OF LAND NO.1313-10-2-RE103
DETERMINED TO BE EXEMPT FROM THE DEFINITION OF SUBDIVISION
RANGE 68 WEST, TOWNSHIP 2 NORTH, SECTION 10
WHEREAS , on May 5 , 1972 , the General Assembly
of the State of Colorado , enacted Senate Bill #35 as relates
to Chapter 106 of the Colorado Revised Statutes , and
WHEREAS , on August 30 , 1972 , the Board of County
Commissioners of Weld County, Colorado , adopted Subdivision
Regulations for Weld County, Colorado to comply with the
prescribed Senate Bill #35 , and
WHEREAS , the Weld County Planning Commission
has recommended to the Board of County Commissioners for
recording of plat number 1313-1O-2-RE103 as provided in
Section 9 of the Subdivision Regulations (exemption rules and
regulations) for Weld County, Colorado.
Said division of land determined to be exempt
from the definition of subdivision is more particularly
described as follows :
A tract of land located in the West one-half (W1) of the
Northwest quarter (NWT) of Section 10, T2N, R68W of the
6th Principal Meridian, Weld County, Colorado and being more
particularly described as follows:
Beginning at a point on the West line of said Section 10
from whence the Northwest corner of said Section 10 bears
N 00° 33' 05"E, 131.4 feet, thence S00° 33' 05"W along
said West line 1842.85 feet, to the Northwest corner of the
SW',SW' NW1/4 of said Section 10, thence S89° 51' 48"E, 662.25
feet to the Northeast corner of said SW',SW14,NW1/4, thence
S00° 32' 44"W 658.28' to the Southeast corner of said
SW1/4. SW3.NW', thence S89° 50' 45"E, 662.31 to the Southeast
corner of the W1, NWT, of said Section 10, thence N 00° 32' 22"E
along said East line, 2545.23 feet to a point on the South
right-of-way line of State Highway No. 119, thence N89° 36'W
along said south right-of-way line 1244.08 feet, thence
S45° 49'W, 70.80 feet, thence N89° 36'W, 30.00 feet to the
point of beginning; thus described tract contains 67.398 Acres.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners of Weld County, Colorado, that the
Chairman be and he is hereby authorized to sign the plat of a
division of land determined to be exempt from the definition
of Subdivision No . 1313-10-2-RE103 , for recording .
The above and foregoing resolution was , on

Dear Mrs. Lee,
In accordance with your request I have performed additional
surveys of the tract owned by Karl and Florence L. Schmuser
in the NW%, Section 10, T2N, R68W of the 6' P.M. , to determine
the ground surface elevations of the tract with respect to the
water surface elevations of 'St. Vrain Creek; St. Vrain Creek
being about 3 mile to the West of the Schmuser tract.
Parcel B averages seven feet above the water in St. Vrain
Creek. The South boundary of Parcel A is about six feet above
the water level and the North boundary of Parcel A at about
three feet. A line two hundred feet North of the South boundary
of Parcel A would have an average elevation in excess of five
feet above the water level in St. Vrain Creek.
Business and residential owners in the immediate vicinity
of the Schmuser tract were contacted by this office and quest-
ioned concerning flooding problems from St . Vrain. Creek run-off.
Other than run-off from the 1965 storm which was possibly equal
to the maximum 100-year frequency storm, no problems were re-
ported. However, it is obvious that problems could occur, part-
icu1•arly in Parcel A, if storms of 25-year frequency or cir_'eater
occurred. By copy of this letter, we are suggesting to Mrs
Schmu er that further *an ineering studies be conducted prior
to constructing residences, to obtain greater protection from
possible flooding damage.

SECTION II: Definitions: The following definitions .,ho.11 apply in the
interpretation and enforcement of the Regulation. The Hard "shall"
as used herein indicates a mandatory requirement.
*2.1 "Absorption Systems" means a leaching field and adjacent soils or other
system for the treatment of sewage in an individual sewage disposal
system by means of absorption into the ground.
2.2 "Absorption Trench" means one or more trenches of varying length,
and depth and of fixed horizontal separation in which sewage effluent
is percolated into the soil.
2.3 "Acceptable Design" means a standardized design of a tank, plant, or
system, the installation of which is permitted by the Department, provided
that site requirements are met.

2.4 "Aeration Plant" means equipment or devices for the aeration treatment
of sewage.
2.5 "Aerobic Sewage Treatment System" means an individual sewage disposal
system employing bacterial action which is maintained by the addition
of air or oxygen including the aeration plant and the method of final
effluent disposal..
2.6 "Analytical Parameters" means:
A. Temperature (T) : The measure of the thermal state of substance with
respect to its ability to communicate heat to its environment re-
ported as degrees Centigrade (C°) .
B. Suspended Solids (SS) : Solids in the sewage that can be removed
readily by standard filtering procedures in a laboratory reported
as milligrams per liter (mg/1) .
C. Volatile Suspended Solids (VSS) : The quantity of solids .in sewage
which are lost on ignition of the dry suspended solids at 600°C.

D. Settleable Solids: Solids in the sewage which will settle, as

a public hearing at 7:30 p.m. on September 26, 1973, in the auditorium of
the Weld County Health Department in Greeley, Colorado, for the purpose of
discussing proposed rules and regulations for individual sewage disposal
systems within Weld County. All interested persons are invited to
attend.

SECTION I: Title & Policy / 0911$L
1.1 Title: These regulations shall be known as the Individual Sewage
Disposal System Regulations.
1.2 Policy: The Weld County Board of Health declares the purpose of
the regulations is to protect the physical and mental health of the
people, .to control communicable diseases, to regulate wastes from
dwellings, business, industrial, and public buildings. These regulations
shall be applicable throughout Weld County, and shall be
enforced by the Board of Health. These regulations are designed to
control the construction, location, and operation of sewage disposal
systems, the transportation and final disposal of sewage materials and
control of Systems Contractors and Systems Cleaners..of such systems.
The Weld County Board of Health declares that as its general policy
is to require the use of public sewer systems where and whenever
feasible, and to limit the installation of individual sewage disposal
systems only to areas that are not feasible for public sewers.
These regulations shall meet or exceed the requirements of the
guidelines as adopted by the Colorado Board of Health pursuant to
66-44-4 CRS 1963.
