HomeMy WebLinkAbout20231052.tiffRESOLUTION RE: APPROVE AMENDMENT #1 TO AGREEMENT FOR BRIGHT FUTURES PROGRAM AND AUTHORIZE CHAIR TO SIGN - THE WELD TRUST AND THE WELD LEGACY FOUNDATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Amendment #1 to Agreement for the Bright Futures Program among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, the Weld Trust, and the Weld Legacy Foundation, with further terms and conditions being as stated in said amendment, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Amendment #1 to Agreement for the Bright Futures Program among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, the Weld Trust, and the Weld Legacy Foundation, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said amendment. These itemized changes were offered along with cost estimates and potential funding sources, where available. In addition to program changes, Weld Trust offered a First Amendment to Weld County Bright Futures Program Agreement (Attachment B). This Amendment makes minor changes to the Agreement which will enable Weld Trust to get the accounting treatment that they need for the program while not substantively changing the Agreement. We are recommending the following: • Approval of the Weld County Bright Futures program changes • Approval of the First Amendment to the Weld County Bright Futures Program Agreement and required Board Chair's signature Attachment A: Financial Impact of Proposed Changes to Bright Futures Program Attachment B: First Amendment to Weld County Bright Futures Program Agreement 2023-1052 Ta031 ATTACHMENT B FIRST AMENDMENT TO WELD COUNTY BRIGHT FUTURES PROGRAM AGREEMENT This First Amendment is dated as of the (2T'dayof \ , 2023 (the "Amendment") and is to that certain Weld County Bright Futures Program Agreement dated April 1, 2021 by and between the County of Weld, a political subcfivision,of the State of Colorado, by and through the Board of County Commissioners of the County_s f Weld:("County") and North Colorado Medical Center Foundation, Inc., a Colorado itori-profit corporation now known as The Weld Legacy Foundation (the "Foundation") and The Weld Trust, a Colorado non-profit corporation ("Weld Trust")("the Agreement"). WHEREAS the Parties desire to amend the Agreement by entering into this Amendment under the terms and conditions set forth herein; NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the Parties agree as follows: 1. Paragraph 1.a. ran s. Shall be amended by the addition of the following at the end of the paragraph: " Grants shall also include payments resulting from the Bankhead-Jones, Farm Tenant Act when designated by the Weld County Commissioners, taxpayer contributions and government grants ." 2. Paragraph 1.c. Bright Futures Fund at Weld County. Shall be revised by the addition of the following at the end of the first sentence: "for use as designated by the Weld County Commissioners." 3. Paragraph 1.f. Return of Funds at Weld County Request. Shall be deleted in its entirety and replaced with the following: "f. Return of Funds. If the Foundation or the Weld Trust is dissolved, then the funds held by the Foundation shall be transferred to either Weld County or another 501(c)(3) organization in accordance with Colorado law and the requirements of the Internal Revenue Service. If the Foundation or The Weld Trust cease to have a mission consistent with Bright Futures or if the County determines it will no longer permit new funds to be held by the Foundation for Bright Futures ("New Funds"), then the County shall cease funding Bright Futures at the Foundation, upon one hundred and eighty (180) days advance written notice. In that event, the Foundation shall continue to fund Bright Futures by a donation to an entity designated by the County Commissioners which meets the requirements under Colorado law and the Internal Revenue Service with the funds transferred to the Foundation in accordance with paragraph l.a, b, c, and d. (the "Initial Donation"). Once the Initial Donation has been completely donated, the Foundation and Weld Trust shall have no further obligation to the County regarding Bright Futures." 4623 - fO ,. Scholars will be eligible for up to 6 years post -graduation, regardless of when they enroll in school (this captures the graduates who work for 3-4 years and then return for a certificate, or to start their education). Veterans will be eligible for benefits up to 6 years after discharge. (no change) , Nominal This population is anticipated to be nominal, but it does afford an additional benefit for the program. Stipend Amount ' Maximum annual stipend amount maximum total = $2,000, regardless of institution, and benefit of $8,000. Increase maximum annual stipend = $3,500 ($1,750/semester) for those attending Weld County institutions with a maximum total benefit of $14,000. $840,650 Conservatively assumes all qualifying UNC/Aims students will receive 100% of the full award. UNC and Aims students estimated at 232 and 130, respectively, 10% more than current enrollment (due to higher award incentive to attend Weld County schools). Maintain stipend at $2,000 ($1,000/semester) for those attending institutions outside of Weld County. (This will maintain the current BF footprint of CO and the 7 contiguous states.) SO Last -Dollar Versus First -Dollar • Award can be used for tuition and fees only and is last dollar in for Weld County institutions. Award will not be last dollar in for students attending Weld County institutions/programs and can be used for tuition, fees, books, bus passes, and reasonably priced personal computer (as defined by Cost of Attendance) (Cost impact included in above) See above Allowed Use of Stipend / Award can be used for tuition and fees only for COSI students and are not last dollar in. Award can be used for all qualifying Cost of Attendance (defined by Federal Student Aid office of the US Dept. of Education) for COSI students. Award will increase to $3,500 for COSI students attending Aims or UNC. (Cost impact included in above) 1) All COSI students will qualify for the full award 2) Existing COSI grant matches BF funds 100% Community Service 16 hours of qualified community service to be completed by BF Scholars in Weld County 12 hours of qualified community service to be completed by BF Scholars, no limitsgeographically. $0 By hilly integrating BF into TWT'c Workforce Development initiative, funding strategies are more aligned, resulting in additional funding opportunities from TWT and other fenders. The program enhancements below would be subject to identification of funding sources, either from TWT or other stakeholders Non-traditional Learners No funding for adult learners, re-skilling, or training _ Subject to availability, matching funds available for custom -designed (by accredited institution) industrytraining or certification for employees of Weld This will be a net -0- cost and is subject to funding availability. City of Greeley has approved $50,000 for this training for 2023. County employers in targeted industries. These funds are available to both Weld and larimer County residents, and can be used at CSU/Front Range. High School Support One College and Career Center Advisor funded by COSI Two positions funded by COSI (No new cost) •Two ;:i.)
