USR23-0011, FOR OIL AND GAS SUPPORT AND SERVICE (CNG STATION) OUTSIDE
OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE
DISTRICT — VOLTAGRID, LLC
A public hearing was conducted on May 24, 2023, at 10:00 a.m., with the following present:

The following business was transacted:
CI I hereby certify that pursuant to a notice dated April 10, 2023, and duly published April 12,
2023, in the Greeley Tribune, a public hearing was conducted to consider the request of
Voltagrid, LLC, for a Site Specific Development Plan and Use by Special Review Permit,
USR23-0011, for Oil and Gas Support and Service (CNG Station) outside of subdivisions and
historic townsites in the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney,
made this a matter of record.
El Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal,
with the natural gas being supplied from the Puritan Gas Plant, permitted via 1 MUSR18-17-0065.
He stated visitors or customers are not intended to come onsite, and drivers will deliver to
customers, in accordance with all CDOT and Federal and State regulations. He relayed the
proposed hours of operation will be 7:00 a.m. to 5:00 p.m., Sunday through Monday, the site will
have up to eight (8) full-time personnel who will work in shifts, shift hours are to be determined,
there will be at least one (1) technician and two (2) truck drivers per shift, and he detailed the
equipment and storage facilities proposed on the site. Mr. Nader also described the sign posting,
relaying no surrounding property owners (SPOs) correspondence has been received. He shared,
per the Development Review staff, the applicant has proposed two (2) accesses onto County
Road (CR) 51 and shall obtain access permits for industrial use at locations that meet the
minimum access spacing criteria. He explained CR 51 is a local gravel road, which requires
60 feet of right-of-way, and the applicant has submitted an acceptable Final Traffic Report, thus
Condition of Approval (COA) #1.D can be deleted. Additionally, Development Review has
requested a Road Maintenance Agreement, including, but not limited to, dust control and damage
repairs to specified travel routes, and the applicant has submitted an acceptable Final Drainage
Report, therefore, COA #1.E has been satisfied and can be deleted. Mr. Nader stated the site is

located within the three (3) mile referral area of the Towns of Keenesburg and Hudson; the Town
of Hudson returned a referral stating any pipeline connected to this facility that is to be located
within the town, including town rights -of -way, will be required to obtain a Use By Special Review
permit, additionally the Town is concerned with impacts to town roadways. He shared the Town
of Keenesburg's Notice of Inquiry (NOI) stated they spoke to the applicant regarding annexation;
however, an agreement was not met. Mr. Nader entered the favorable recommendation of the
Planning Commission into the record as written and displayed images of the site and surrounding
views.
Lauren Light, Department of Public Health and Environment, stated a commercial well and
commercially -designed septic system will be installed, a commercial well application has been
submitted to the State of Colorado, and portable toilets are acceptable until the permitted water
and sewer is installed. She confirmed a Waste Handling Plan has been submitted and shall be
adhered to, an Air Emissions Permit has been submitted to the State, truck wash waste water will
be contained in an underground vault, which will be periodically emptied and transported to an
appropriate disposal facility, and floor drains for waste fluids will also be connected to the
underground vault. She explained there are 11 Development Standards which shall be adhered
to and there are no outstanding issues with the request.
El Luke Seeber, Baseline Corporation, represented the applicant, and had no additional
comments. In response to Commissioner Ross, Mr. Nader confirmed there is a COA that requires
the applicant to work with the Town of Hudson concerning the pipeline going through the
community.
El No public testimony was offered concerning this matter.
The Board reviewed the Conditions of Approval and Development Standards. Chair Freeman
stated COA #1.D and #1.E, have been deleted through the presentation from staff, and no other
changes or corrections were made.
Ci In response to Chair Freeman, Mr. Seeber indicated he had reviewed, and agreed to abide
by, the Conditions of Approval and Development Standards, as modified.
El Commissioner Ross moved to approve the request of Voltagrid, LLC, for a Site Specific
Development Plan and Use by Special Review Permit, USR23-0011, for Oil and Gas Support and
Service (CNG Station) outside of subdivisions and historic townsites in the A (Agricultural) Zone
District, based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval and Development Standards, as modified. The motion was seconded by
Commissioner Saine, and it carried unanimously. There being no further discussion, the hearing
was completed at 10:10 a.m.
