HomeMy WebLinkAbout730014.tiff d'1,1 ��9/ RESOLUTION WHEREAS, a public hearing was held on February 22, 1971, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing a petition of Philip Edler, 6114 South Broadway, Littleton, Colorado, requesting a change of zone from "A" Agricultural District to "C-UD" Commercial Unit Development of a parcel of land described as follows: The North 800 feet of the following described property: All that portion of the Northwest Quarter of Section Three (3), Township One (1) North, Range Sixty-eight (68) West of the 6th P. M. , Weld County, Colorado, 12. 68 acres more or less, described as follows: Beginning at a point on the West line of said Section Three (3) from which the West Quarter corner of said Section Three bears South 00° 14' West 1353. 66 feet, thence North 89° 55' East 2208. 00 feet to the true point of beginning, thence North 89° 55' East 445. 91 feet to the east line of said Northwest Quarter of Section 3, thence North 00° 17' East 1237. 06 feet along the east line of said Northwest Quarter as used and marked by old fence lines, to the South right of way boundary of Highway No. 52. Thence South 89° 51' West 447. 0 feet along said South right of way boundary, thence South 00° 14' West parallel to the west line of said Section 3 a distance of 1236. 54 feet more or less to the true point of beginning, all bearings used herein in relation to U. S. B1L. M. Resurvey of September 6, 1953, containing 8 acres more or less, and, WHEREAS, the petitioner was present, and WHEREAS, the Board of County Commissioners heard all the testimony and statements from those present, and WHEREAS, the Board of County Commissioners have studied the recommendations of the Weld County Planning Commission as submitted, and WHEREAS, it was established that petitioner proposed to build a Dakota Campground upon subject property proposed to be rezoned conditional upon adequate water supply being made available and proper sewage facility to be provided, and WHEREAS, the matter was taken under advisement upon petitioner assuring the Board that an adequate water supply would be made available and proper sewage facilities installed within a reasonable time, and I 730014 WHEREAS, a considerable period of time has elapsed (2 years), and petitioner has not made any effort to advise the Board as to the adequacy of potable water for said project, and The Board now believes it to be in the best interests of the county to deny petitioner's request for change of zone under the cir- cumstances. NOW, THEREFORE, BE IT RESOLVED, that the petition of Philip Edler, 6114 South Broadway, Littleton, Colorado, for change of zone of the hereinabove described property from "A" Agricultural District to "C-UD" Commercial Unit Development be and it hereby is denied. Let the record show that this cause came on for hearing this date, February 22 , 1971 , at 2: 00 o'clock p .m. , on the petitioner 's application of Philip Elder, 6114 South Broadway, Littleton, Colorado, for a change of zone from "A" agricultural district to "C-UD" commercial unit development, of a parcel of land located in Section 3 , Township 1 North, Range 68 West of the bth Principal Meridian, Weld County, Colorado, and more particularly described in Meets and Bounds , and containing 12 .68 acres more or less , also being known as the north 800 feet of said property. Let the record further show that this hearing was published in the Greeley Booster on January 15th and February 12th, 1971, respectively, as required by law. Let the record still further show that the location of adjoining land-owners were duly notified by certified mail of the fact that this hearing would be held �t this time on this day. -2— Let the record further show that there is on file a resolution from the Weld County Planning Commission recommending favorably upon this change of zone , with conditions . Let the record show additionally that the applicant is present , and that he will be represented by Rollie R. Kelley, who will be spokesman for said applicant. _Mr. Chairman, I believe we are ready to proceed. If he has an opening statement or anything he wishes to say, he can make some preface remarks or whatever . MR. KELLEY: One correction, the name is Edler - E-D-L-E-R, the petitioner. We propose to build at the site just described a Camp Dakota campground which will have on it seventy five overnight camp spots , with sewage, electrical hookup and water, all within the code of requirements of Weld County. And we also propose to build on the property a store , a shopping center that would have in it showers , a laundry, a Iew groceries , just necessities , and a playground for children. Now, this campground, as we see it , would probably operate about seven months out of the year at the most. It would be closed in the winter-time and secured. There would be picnic tables at each site. It will be landscaped entirely. The roads will all be surfaced, hard- surfaced of some nature , preferably of a large gravel type -3 - surface. And the balance will be all planted in grass . There will be shrubbery out around the outer perimeters of the campground as well as being fenced in completely. There will be no campers allowed to stay more than fifteen days in the campground. In other words , we don' t want it to become a permanent trailer home park at all . This isn' t our intention. It just is purely for campers that are traveling and want a place to camp at night where they can feel secure and have the things that are required for the camper of today. We, as Camps of Colorado, Incorporated, which is the name of our corporation, will maintain the campgrounds completely. We will take care of all rubbish, either have it privately hauled away, or if there is a public facility available , have them come in and haul it away daily. The campground will be under supervision twenty four hours a day so that we don't have any problems policing and things of this nature . We are proposing, or are contemplating a swimming pool in the future for further use and enjoyment by the people that will be using the campground. There will be a nightly charge for camping and using the facility. As of this moment we have from the Lefthand Water District assurance that they have the water available for us to do the job, and our sewage drawings , I believe they are in front of the board at this time, signed by and -4- prepared by an engineer in the State of Colorado. We are all ready to go with this if and when we get the property zoned. We have been dragging our feet for seven, eight months here , and we would like to have this thing in operation by May of this year , if we do get the zoning. We are ready to accept bids and start construction immediately. I would like to present to the Board some of the little fliers of a Camp Dakota campground that tells what they are . This is a national franchise that is all over the country. There are two of them in Colorado at the present time. Those two are down in the Cortez and Durango area . They are just ready to open this spring, I believe . There are some more going in in Albuquerque and in the vicinity of Albuquerque . The big areas that have been developed up to this time would be through the mid-west, the Dakotas , Minnesota , Illinois , Wisconsin, Indiana , that area . They are very particular about what we do on the campgrounds . The franchise is pretty stringent . There will be no intoxicants of any kind sold on the campgrounds . It will be a family campground. That is about all I have, unless there are questions from the members of the Board. There are seventy sites on the drawing , which you have in front of you, this official unit development plan, seventy sites plus one permanent site for the people that will be operating the campground. -5- The permanent site will probably be a forty foot trailer or something like this that will be moved in and made a permanent home for those people that will be operating it during the time that they are living there . If there are any questions I would be glad to answer them. CHAIRMAN ANDERSON: Is tis a verbal contract with Lefthand Water? MR. KELLEY: Sir , we talked with them as late as an hour ago. They have so many development plans going on over there, they assured us that they do have the water available for us . However, they had to have their Board meet and come up with what their engineers recommended. We understood a month ago that if we came in from their main line and put in a four inch line there would be no problems . We still feel there are no problems . But they do have to have a board meeting before they can give us a contract. We just, At twelve o 'clock we were over there today. We thought this was all handled and everything , through the planning commissioner 's office, but it hadn't been. And they had no record even that we were having this hearing when we were there at twelve o 'clock. So they couldn' t on this short notice give us a letter that we were asked to get. However , we feel assured - - that unless we can get water we are not going to have a camp- ground . It 's very necessary, and we wouldn't even start construction without it . And I think I would hope that this -6- could be put sn the permit or something, when we apply for A building permit. If we don 't have water we wouldn' t be able to build. But as of this moment, we do not have a letter from them. however, they did assure us that they have the water available for us and they would sell us water . But they did want to re-engineer, because they have got a lot of new development going on, and they wanted to engineer for the future as well. We are willing to spend the five thousand dollars they told us it would take to xun the water to the property. -Put they think they -might even want to go better than that apparently, and not at our expense necessarily. We are about twenty five hundred _feet from their main line. Now, they do have a two inch line running east to west, but they Aon' t want us to hook onto that . Now, the easement is no problem coming across that twenty five hundred feet, because again Mr . Edler owns all of that property, and it 's just a matter of him getting us an easement through the property to come over to the twelve acres that we are speaking of here . MR. BILLINGS : I would like to hear from Mr. -Paul as to the septic tank situation. MR. PAUL: Mr. Chairman, we have the results of the perculation tests . At first they just sent me only two holes so I asked for six more , and the perculation is very good, it 's favorable . I think it would average about -7- an inch to seventeen minutes . So I would like to recommend that the approval of the site , subject to the review of the design of the system from the State Health Department and also the water supply, before we would recommend A well on there. CHAIRMAN ANDERSON: Are you planning on watering this grass out of Lefthand Water, or are you going to water it out of wells? MR. KELLEY: Mr . Chairman, we would plan to water it out of Lefthand Water supply, yes . We would put in a sprinkler system of some type during construction. CHAIRMAN ANDERSON: Have you anything to add to that , Mr . Lorenson? 1�IR. LORENSON: Well, Mr. Chairman, I will read to you the recommendations of the planning commission. 'The planning commission recommends favorably to the Board of County Commissioners for the following reasons : 1 . That the location is appropriate for An overnight camper park, there is a need for this type of facility. All services except sewage treatment is available at the site. The soil is appropriate for the proposed septic system. Land is now idle and is poorly suited to the agricultural use. It should be subject to the zoning request being limited - - to the land being limited to the proposed plan. This has been done. They have reduced their legal description. And —8- the leech field being subject to the approval of the health department. And that the contract with Lefthand Water District be consummated. And there was comment about the planning department. Apparently it was their thought that the planning department would be working with the contract . However, that is not the case. CHAIRMAN ANDERSON: Doesanyone else have anything to add to this hearing? Is there anyone in the room that opposes this applicant? Anything else to come before this hearing'? MR. BILLINGS: Well, Mr. Chairman, I would make the motion that at this time , if there isn' t any other discussion, that we take this under advisement until they do get a letter from Lefthand Water District so that we know that you have got the water and everything before we make a decision. It would be premature for us to basically approve this and you not know that you have the water . Other than that, I see no other problems and make the motion we take this under advisement. You have negotiated with Lefthand Water and are sure about the domestic water. MR. KELLEY: Would we be looking forward to another hearing at this time then? CHAIRMAN ANDERSON: No. MR. -BILLINGS: We would just be waiting - - there is no use of us approving it at this time , as you stated, without the water, but when you have the assurance of the water and we have a letter in writing from Lefthand, why then we can take action. MR. KELLEY: Do you feel there would be a favorable action when we have this letter? _MR. BILLINGS : I haven't discussed this faith the other two commissioners , so I couldn' t answer that. CHAIRMAN ANDERSON: What you are saying is that we want a letter from Lefthand Water saying there will be water available . MR. LORENSON: Mr. Chairman, I would indicate that Lefthand Water was specifically asked, rather than a letter , that there will be some type of a contingent contract fo, water . That has been at Lefthand's request. CHAIRMAN ANDERSON: All right. I have a motion. Who will second it? MR. ASHLEY: Mr . Chairman, Z will second the motion.
