My wife and I believe the BOCC should not approve the Colorado Railbike Adventure
Recreation Facility and Event Center as proposed. It is not in the best interest of Weld County,
and specifically it places undue burden on the residents of unincorporated Weld County that live
by the proposed project. Some points to consider as you make your decision.
• Liability for law -enforcement. From CR1 to CR5 about 60% of railroad tracks has
Unincorporated Weld County bordering both sides of the tracks. The other 40% has Erie
bordering both sides of the tracks. When something illegal or unsavory is taking place on
the tracks. who are we to call? It is not fair that our taxes should be used to subsidize a
venture that only brings misery to us.
• Access to the rail line via the applicants property poses problems. When something does
go wrong on a tour, the neighbors next to the tracks are the closest help.
• If I do not fence my property to the tracks and post no trespassing signs, does that allow
use of my property?
• The RTD got stuck with the spur line to gain access where they wanted it. They have
been a poor neighbor when it comes to maintenance. Now CRA has leased 9.75 acres
from the RTD. The dust abatement plan submitted by CRA stipulated mowing and
maintaining native grass cover. Looking west from CR5, all CRA has done is remove the
RTD no trespassing signs. The grass needed to be mowed a month ago. If allowed to
continue the fire hazard will become extreme. The noxious weeds such as Russian
Thistle need to be addressed.
• As we look at the business plan for the Colorado Railbike Adventure, we are concerned.
How does a bike ride less than 3 miles take 2 hours? How does CRA plan to cross the
roads and streets? If the projected ridership does not occur, how can they afford to
perform maintenance? What parts of event center and recreational facility are to be
utilized to create revenue? Can they have a concert? Can they host a wedding or similar
event?

Section I
(A) Our property is in an Agricultural Zone Distnct/Rural Residential and we purchased
here many years ago to live on a rural/non=commercial business land/area This
Commercial Recreation Facility & Event Center is Commercial property attempting to be
employed in our Agncultural Zone District It is our understanding that there should not
be commercial businesses in our Agncultural land yet under Colorado Railbike
Adventures, LLC USR Planning Narrative, Section 21(b) generally comments that
'Commercial recreation and events use cases are found throughout the Ag Zoning in
southwest Weld County'
(1) We'd like to know who and where those facilities are located but more
so, what are all the applicable Weld County Rules/Laws/Publications that allow for such
Agricultural Zone infringement to explain and understand exactly what type of
Businesses and the exact guidance they follow to meet Weld County Agricultural Zoning
exceptions Are they at all comparable to this proposed Event Center which will really
runs as even separate operation that is far from the mainly listed and described Railbike
Excursions
(2) (See this form, Section II) We'd like the Board to consider this an
official request to provide all Weld County Rules/Laws/Publications information to myself
and anyone else who may want this information concerning this matter of our
neighborhood Perhaps these resources can be posted on the Weld County Website in
association with this business/case# (As soon as possible please but Not Later Than
June 16, 2023 so as to allow for any further citizen understanding of Commercial
business requirements/laws in the middle of our Agncultural Zone District in order to
provide final inputs prior to the BOCC Hearing date of June 28, 2023)
(B) The Colorado Railbike Adventures USR Planning Narrative states in #4 that ' and
all owners will be notified by the CRBA of the new use of the tracks per the lease
agreement' That is not true We have no idea who or what "CRBA" is and NO
notification has ever been done by whomever they are, nor have we seen any 'lease
agreement' that allows business operation of the Railroad Tracks
(C) In this approval process, has there been any consideration or direct compensations
of our property devaluation with this 'Commercial Business' right between at least two
immediate properties that are horse properties in our AG Zone? Both properties to the
immediate North and South of this proposed Commercial Business have livestock
animals for many years, well prior to the Rummer's purchase of this land Can
someone knowing this is rural residential agricultural zone, just make this purchase as
their rural residential home and then pop up a complete Commercial Business that
includes an Event Center with zero care/concern for the neighbors, for our animals, the

traffic, noise adherence? Who will want to purchase OUR horse properties with this
commercial business 'neighbor' connected to our land now??
(D) The Planning Use By Special Review form indicates under the "Application
Information" that property is 40 5 acres, again, that is not true Zillow describes the
property located at 4121 County Road 3, Erie, CO 80516 as 7 97 acres
(E) This application focuses mainly on the RailBike Adventures LLC Business, railbiking
part of business, and only very generally speaks of the future forecasting/expansion of
building an area to accommodate business growth into an "Event Center" with a
"regional draw", (USR Planning Narrative #21e) That portion caters to weddings
venues, birthday parties, corporate events, similar group parties/events, etc , which then
becomes a new scenario of issues, to include even likely more traffic to an already not
prepared to handle the traffic roads, noise infractions, trespassing, alcohol, drunk
driving, etc Is Weld County allowing this frankly, completely separate business to simply
get a 'back ride' on the actual business of the Rail Bike Adventures LLC? Hosting said
venues should actually require a completely different application for this business as it
IS a completely different business It is not RailBikes This seems extremely
unprofessional, and unlawful, like throwing mud up on the wall to see what sticks and
continues to have full disregard for the disruption of our neighborhood,' our own lives
(F) TRAFFIC/SPEED LIMIT CONTROLS
(1) The amount of traffic in our location has already greatly increased due
to all of the new neighborhoods being built Just as in this Use By Special Review
(USR) Application, there have been no Weld County government requirements or
considerations of installing traffic stop signs or lights or decreasing the speed limits
when they consider authorizing this commercial business in ourAgricultural Zoned
Residence, which at its requested rate, will certainly dramatically increase traffic
specifically at this intersection, (CR 3 & CR 11A), leaving rural residents to just have to
yet again, adapt and 'deal with it' Has there been any Weld County consideration for
widening lanes or adding turn lanes? There is no Colorado Railbike Adventure LLC,
(further referred to as CRA), considerations for this additional problem as described in
the USR on the "Notice,of Proposed Commercial Event / Recreational Facility on
County Road 3" which states `No information is provided as to how this proposed use
will impact traffic along CR3 or CR 1% due to the increased traffic or railbikes crossing
WCR3 ' Why not? Is Weld County actually saying that no changes need to be made
regarding the application for this overwhelming business located in our Agricultural
area? Does Weld County Representatives not have concerns for the safety of residents
here?

(2) Increased Traffic concerns are
(a) The safety of getting our mail The mailbox is located opposite
side of street from our home We have to cross the 2 laned North/South bound traffic (1
lane South Bound/1 land North Bound), to retrieve our daily mail There is possibly a
supposed discussion with the Erie Post Master to place mailboxes on the same side of
the road as our home, but those type of discussions have yielded zero results over the
last many years as we have already been asking The alternative that we've been
offered is to purchase a P O Box and pick up the mail at the Post Office but, we
shouldn't have to drive to the post office to get our mail, or pay for a PO Box when we
have nothing to do with the changes that are being made all around us, without our
consent We also shouldn't have to worry about increased traffic danger to cross the
road just to get our mail every day There is no reason the Post Master cannot
reconfigure the mailboxes to be located on the West side of the road in order to reduce
the results of accidents/fatalities This includes better delivery ease for the mail driver
person also as they can pull into the home's driveway on the west side of the street and
not block traffic while delivering our mail
(b) Installing a 4 -way BLINKING "STOP" sign at the minimum of the
CR3 and CR 1% intersection may help assist with controlling the traffic flow for safety
reasons as well as allowing complete and immediate entry into the CRA Business
allowing for more free flow of neighborhood traffic, as well as slowing the traffic flow to
the actual posted law sign speeds
(c) Reduce Speed limit to 25mph from CR 101 to CR 10 in BOTH
Directions, WITH a speed limit detector that shows the speed of the vehicles because
everyone is completely ignoring the speed limits! The speed limit ranges are already
uncoordinated as they are currently 45 mph going South Bound and 35 mph going
North bound over the same geographical space of the road Vehicles speed with no
pedestrian or animal care concern of injury or death
(d) There are no sidewalks or crosswalks at this intersection either
as it is has been/supposed to be rural, however with the new subdivision developments,
it has become very dangerous and adding more traffic at this intersection and on CR3
makes this unsafe and needs to addressed and remedied
(e) Reduce the number of projected CRA Business Customers by
at least 50%, in order for the roads to potentially be able to handle the traffic pouring
into the CRA Business The current plan, just for the RailBiking is 70-144 people at any
given time, off and on throughout the entire day and evening There is not even any
projection for how many people there may be attending when the planned Event Center
opens up The roads, the intersection, the neighborhood should not have to handle this
completely unreasonable and completely ignored traffic increase in our neighborhood

(3) Employ bigger street name signage for the location of CR 1% as every
single day, MANY people miss the turn for CR 1 '/ (either direction) When people are
traveling North bound, they continuously turn around in our driveway which again, is a
safety issue, especially when it happens while we are getting our mail or sometime
pulling in/out of our own driveway A 4 -way STOP Sign would GREATLY help this
problem'
(4) There are no turn lanes either North or South bound for traffic to enter
or exit into or from the CRA business There's not even an already needed turn lane to
enter the CR3 or CR 1% so, at a minimum, there should be South Bound entry lane into
the CRA business built on/into the CRA Business property That may at least help the
South Bound traffic back-up for entry into that business
(G) CRIME/DANGERS
(1) We have livestock on our property and now this business poses a threat to its
customers trespassing the overflow of people waiting on their turn for the ride, or milling
about from the Event Center to walk over to our property, especially if it's dark, and/or
people attempting to approach, pet or feed our animals which can result in injury or
death At a minimum it is breaking the law by trespassing The CRA should establish
responsibility and written guidance that their customer(s) will not ever come onto our
property or approach our animals in any way
(a) Employment of proper fencing against CR1% entire property line and
CR 3 that does not allow for passage beyond CRA's property and/or surveillance should
be managed by CRA to ensure this does not happen We should be able to have say in
this barrier as well and CRA take responsibility for making any changes if original
fencing does not keep a confined customer area
(b) There can be no doubt that the 'aesthetics' of our livestock on both
sides of the CRA property only add to the enhancement of this business but, what
thought has been put into the concern for the animals with all these people and vehicles
around now? Does CRA personnel know/understand that the horses can get spooked
just from a loose balloon or shopping bag simply blowing across the pasture and
possible fly right through a fence? That the people may try to pet or feed our animals
things that could injure or kill them?
(2) CRA currently does not allow any 'alcohol' or 'smoking' on site however,
there is more than likely that potential in the very near future or after business in
developed into a more permanent facility to include the shelter (temporary or
permanent), that plans to house the event parties, weddings, etc There is high concern
if an alcohol license is allowed and alcohol consumption is not managed by CRA, it will
incite drunk driving What is the resolve for this?

(3) If the event facility is rented out, will it be supervised by the CRA continuously
on site to take complete responsibility as attendees may not follow the rules or smoking,
alcohol or trespassing?
(4) The threat of fire is extremely high in our community as well and it's no easy
task or quick response to try to evacuate ourselves and our livestock so, smoking
should be contained in a well -ventilated and 'smoking' only area if/when it every may be
allowed by CRA There are concerns that smokers often go to find a place they can go
to smoke, to include their private vehicle, or wherever on the property and might go to
the edge of the road and toss the cigarette butt into the dry grass/weed area, potentially
starting a fire, which would immediately affect our properties & animal's safety
(H) Lighting Lights should shine onto CRA property only, not toward our homes For
instance, this includes any lights that may be lighting up'the actual railway tracks/Depot
should shine their light toward the business/home and property of CRA, (so the lights
should point SOUTH) After dark, after hours should not be an issue if the lighting is
contained to illuminate onto the property facilities only
(I) Business Hours
(1) Business hours until after 10pm is far too late in the evening, especially for
noise toleration At the very latest and very minimum, noise should be shut down no
later than 8pm every business day! Please, 8 pm is beyond reasonable and should not
be waived for any reason at any time
(2) Sitting around a campfire with small speakers may be 'quieter' but is CRA
aware that the land does echo a great deal more than one might expect/realize Do we
have to listen to their music or speakers every day all day long? Once the Event Center
is employed, it potentially means bigger speakers and/or live bands which could then
mean that all of us now have to listen to loud music all day, every day into the night
How would the Board members like this immediately beside your own home, weekends,
from sunup to sun down, holidays, up to 140-ish people mingling about, directly by your
animals and home property, and that's just the beginning
Section II
Board Request
(1) If some of the issues we've written about are not applicable to the considerations or
remedy of this Board, we request the Board's direction to the appropriate agencies and
assistance to not only find their information/points of contact, but work together with the ,
other agencies to resolve the concerns of this business in our neighborhood and

provide action of our suggested recommendations (ie, adding 4 way stop sign/lights,
actual turn lanes into the business, moving mail -boxes, etc )
(2) Reminder of this letter's Section I, A(2) above for this Board to please provide the
'Commercial recreation and events use cases (that) are found throughout the Ag Zoning
in southwest Weld County' We'd like to understand who and where those facilities are
located in southwest Weld County but mainly provided information/copies of what are all
the applicable Weld County Rules/Laws/Publications that allow for such Agricultural
Zone infringement to explain exactly what type of Businesses and the exact guidance
they follow to meet Weld County Agricultural Zoning exceptions
(3) The adage of 'don't ask for permission/ask for forgiveness' is completely old news,
used up and warn out so, we sincerely hope this board and CRA will take all
considerations expressed by our neighbors in this community into appropriate and
legitimate consideration, again, as though YOU live here You represent as too Thank
you for your time and sincere considerations?
Section III
Personally
(1) The traffic has increased greatly over the last 5 years It affects the serenity
we once knew sitting on our front or back porch enjoying our morning coffee with a
beautiful/peaceful Rocky Mountain view, the sound of - peace, with a soft breeze
blowing Now we hear truck, after truck after trucks, cars, smelling exhaust, fracking
gas and on top of that we now get to listen to directly across the street here daily
business population of up to 72-144 people during the 1st season of Railbiking, who also
get to visually stare across the road into our property, our horses and ourselves while
'waiting' on their railbike ride? How much will the amount of people increase after
'Event Center' opens in the future? We already have to deal with all the traffic, and now,
once again, we're expected to endure noise from the business, more traffic, people,
weddings, parties, loud music, speakers, honking of horns, etc
(2) At what point do we the residences, who have been here for years, get asked
about our thoughts/feelings/rights of the land we have purchased, live on, build our lives
on? We just have to keep taking on the privacy intrusions for Commercial growth in an
Agriculturally Zoned District?
(3) I'm sure the Rummer's are actually a wonderful family, probably really nice
folks, but - so are we and there was no basic common courtesy to ever even introduce

themselves or tell us what the plans are that would affect OUR life, OUR home, OUR
neighborhood, asking US what accommodations/concerns we may have/want/need
Maybe we could have worked together a little more in many ways to have a strong
neighborly relationship/community
(4) The Weld County post card we did receive did not tell us who to call
regarding this information I called and left a message and did not receive any call
back The Web address took me to a site that gave a big red warning not to open it so I
didn't get information until a different neighbor brought more concern to light
(5) The Postcard from Weld County said this is a "Proposed Project" USR for a
Commercial Recreation Facility and Event Center in the Agricultural Zone District, yet
the USR addresses the business's start date now, June 2023 So, are We The People
- just going through formalities here? Has the business start date already been approved
prior to hearing from us, the neighbors who have to live here or is this a false start date?
Does the public/neighbors concerns opinions have any real weight to the matter of this
board proceeding?
(6) This business has been planning this for well over a year and a large majority
of Weld County approvals were completed in March 2023 Couldn't we have been
notified at least in April? We as the neighbors just find out about this and in some
cases, days ago It feels very much like this lack of timeliness of this 'notification' of this
plan, has been by design for the benefit of this CRA Business only This neighbor has
never bothered to introduce themselves to us to let us know what is going on When
you purchase a home as your own residential unit but you KNOW you're going to build
a business in the middle of your neighbors homes and you don't even introduce
yourselves/show us respectfully what your intentions are — it leaves only ill intention as
the true resolve
(7) Lastly but not least importantly, we as a residents in our home/of this
neighborhood, are having to adapt OUR lives at our own expenses for a commercial
business that's not supposed to be in our AG Zoned District property When our home
was purchased, it was a dirt road While we cannot stop "progress" in community
building of neighborhoods, we most certainly should have something to say about the
fact that commercialization of our rural homes is happening and should not be
allowed otherwise, truly, what is the point of having an Agricultural District Zoned??
Why is this so easily disregarded? So the county can make more money? For one
family, all others are disregarded? We moved into a rural area to have a rural quiet life
with our animals It's bad enough we are being taken over by housing developments
and traffic but to have an Event's Center directly across the street is simply not
reasonable The RailBikes are one thing, at a reasonably trafficked pace, but to have
an Event's Center directly across the street is not reasonable Please consider your

actions as though it is - you and your family- living in the locations that you choose to
make the decisions for

Thanks for your time in reading this email. I am writing in support of the proposal to use the railroad tracks in Erie as a
rail trail. My house backs up to the open space that the project falls into and I have received notice of this proposal via
mail. My address is 425 Balcolm Ct, Erie, CO 80516. If you care to look into this.
I fully support the project being launched and think this idea will not only help Erie financially but also environmentally
as well. Being located in a pristine open space area with stunning mountain views can only help attract people to our
town for both recreational opportunities but to then enjoy our offerings right downtown after they get done with their
tour on the rails
My family and I would enjoy having this recreational activity in our town and right in our backyard. Seeing others out
enjoying the great outdoors is something we need more of and I believe this proposal is a great way to do so.
I also feel this proposal would have minimal negative impacts on the community as a whole and especially any
homeowners in the area where this trail is expected to operate. It seems that the owner has a good handle on any
negative impact and will be on top of any potential issues right away.

My name is Bethany Pedersen and I reside at 1163 Northview Dr. in the Northridge subdivision of Erie, CO 80516. I want
to express my opposition to the request for the special use permit for commercial use, especially the event center
component.lam am also very concerned about traffic and possibly even overflow parking or turnaround in my specific
neighborhood. As the parent to 3 young children who walk and bike in and around our neighborhood and commute to
Soaring Heights school passing this property everyday at least twice a day. There are only 2 lanes in every direction, no
sidewalks, no stoplights, etc. There is no mention of how the "rules" are going to be enforced including but not limited
to hours of operation, parking lights, litter, loud, obnoxious, or disobedient biking participants, all of which could impact
the people and wildlife living in and around the area.
I was not able to attend the planning meeting in person but did watch via live stream and agree with other concerned
neighbors. It's one thing to have the rail bike business but entirely something else for an event center, parking and
bathroom concerns, and impacts to surrounding livestock and wildlife in the agriculture area.

Operational Months, Days and Hours (Development Standard #3)
Hours of operation are as follows:

Noise (Development Standard #16)
• This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone, as
delineated in C.R.S. §25-12-103. (Sound study confirms proposed activities will operate within State of
Colorado noise ordinance)
Lighting (Development Standard #9)
• Sources of light shall be shielded so that light rays will not shine directly onto adjacent properties
where such would cause a nuisance or interfere with the use on the adjacent properties in accordance
with the plan. Neither the direct, nor reflected, light from any light source may create a traffic hazard
to operators of motor vehicles on public or private streets. No colored lights may be used, which may
be confused with, or construed as, traffic control devices. Lights will be off during non -business hours.
Landscaping & Screening (Condition of Approval #1.A. and Development Standard #7)
• The proposed landscaping and screening on the site shall be maintained. Required landscaping and
screening shall be installed within one (1) calendar year of issuance of a Building Permit or
commencement of use, whichever occurs sooner. Dead or diseased plant materials shall be replaced
with materials of similar quantity and quality at the earliest possible time. (Revised L&S plan includes
significant increase in screening utilizing mix of berms, plantings, and fencing based on neighbor input)
Water Service and Restroom Facilities (Development Standards #17, 18, 19):
• Portable toilets and bottled water are acceptable for recreational facilities utilized for six (6) months or
less, per year, and for employees and clients onsite for less than two (2) consecutive hours a day, and
two (2) or less full-time employees onsite. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and avai►able for review by the Weld County Department
of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld
County, contain hand sanitizers and be screened from existing adjacent residential properties and
public rights -of -way. If the activities exceed the above requirements, then a permanent water source
and an On -site Wastewater Treatment System (OWTS) must be established to provide for business use.
• (Letter of Service from Left Hand Water District confirms availability of water; current OWTS confirms
septic potential; Town of Erie fire hydrants within 400' for fire protection water service).
Emergency Response (Condition of Approval #4.A and Development Standard #8):
The property owner or operator shall provide written evidence of an approved Emergency Action and
Safety Plan, on or before March 15th of any given year, signed by representatives for the Fire District
and the Weld County Office of Emergency Management to the Department of Planning Services
[Fire and EMS response is under the jurisdiction of MVFD, Code compliance (noise, weeds) and Public
Safety (traffic, trespass) depends on which part of the property is affected and which party raises the
concern —generally handled by Town of Erie The RTD Lease also requires an Emergency Action_and
Safety Plan as does the Colorado OPS regulation 7 CCR 1101-12]
Event Details (New Development Standard):
The Occupancy Capacity of the Storage/Event Barn will be <= 100 people
Events will conclude by 9 30 pm
There will be no more than 24 wedding events per year
No non-railbike events until the Storage/Event Barn is completed with certificate of occupancy

Environmental Noise Analysis
CO Railbike Adventures
Dear Mr. Rummer,
We have conducted an environmental noise analysis
for the proposed events area at 4121 County Road 3
in Erie, CO. The proposed area is an outdoor events
space that will feature railbikes - pedaled railcars that
will operate on the existing railroad tracks.
We do not expect any of the planned activities in the
proposed areas to exceed the limits set in the Weld
County Code.
Criteria
The Weld County Code sets the maximum noise level
for residential properties or commercial areas as 55
dBA before 9 PM and 50 dBA after 9 PM. Both limits
were analyzed for this study.
The Code specifies that the limits apply "at or within
the boundary of the property from which the noise
complaint is made." We conducted our analysis using
a grid of calculated noise levels, meaning that
predicted noise levels can be compared to any point
in space, including at any point along a property line
or within a neighboring property.
The Code does not specify the time -domain element
of dBA, so we assume that the equivalent continuous
level (Leq) is sufficient and have used that in all of our calculations. Leq
is effectively an average noise level and is frequently used for this type
of study.
Proposed Facilities
As we understand it, Colorado Railbike Adventures will be, generally, an
outdoor space with several use areas. The proposed areas include:
• Gravel Parking Lot
• Events Space - An outdoor gathering space with landscape
speakers for ambient music, but with no PA system.
• Railbike Ticketing Booth - A small building where clients may wait
in line and will briefly interact with staff.
• Railbike Loading Area - A platform where clients will gather to
wait to board a railbike.
• Individual Railbikes along Railroad - 4 -seater railbikes that will be
dispersed along the railroad. The bikes will have polyurethane
wheels and will be pedal powered.
Analysis
We used CadnaA noise modeling software to predict noise levels
throughout the project site and surrounding areas.
Noise sources were modeled as follows:
• Gravel Parking Lot - The RLS-90 standard for parking lot noise
was used. We assumed 48 parking spaces with 0.5 vehicles in and
out per space, per hour. We added the suggested 4.1 dBA penalty
to noise generated by this source to account for a gravel surface.
• Events Space - We defined an area with 36 individual point
sources. 30 of these points are set to emit 65 dBA sound power
in a speech spectrum and are intended to represent individual
people that are talking simultaneously. The remaining 6 point
sources are placed on the perimeter and emit an amplified music
spectrum, representing landscape speakers used to create
ambient music. The sound power of these sources was set by
placing a receiver in the very center of the event space and
adjusting the sound power of the speakers until the central

receiver showed 65 dBA (independent of any other noise
sources).
• Railbike Ticketing Booth - We modeled 2 people actively talking
as point sources, each with sound power of 65 dBA using a typical
speech spectrum.
• Railbike Loading Area - We 10 people actively talking as point
sources, each with sound power of 65 dBA using a typical speech
spectrum.
• Individual Railbikes along Railroad - We modeled two people
talking simultaneously as point sources, each with sound power
of 65 dBA using a typical speech spectrum. As the bikes will be
pedaled and will have rubber wheels, we expect human voices to
be the only significant noise source.
65 dBA is the typical, measurable sound pressure level of human
conversation at elevated spoken levels. Sound pressure is numerically
e qual to sound power at 1 m, which is approximately the distance that
conversations happen. Accordingly, we have substituted sound
pressure for sound power directly in these instances.
We assumed flat terrain and ground absorption that is consistent with
loose soil or foliage.
Additional Scenario - PA Speakers
In addition to the planned arrangement with landscape speakers at the
event center, we also tested using a pair of typical PA speakers. One
n oise source for each of two speakers was placed on the western side
o f the events center, oriented to the east, and set to emit a live music
spectrum.
For the initial analysis, we adjusted the output of these speakers so that
n oise levels on the eastern side of the event center showed levels of 75
dBA. This resulted in noise levels that exceeded the limits across the
e astern property line.
Reducing the output by about 7 dBA from these levels should cause the
regulatory limits to be met. If the facility operates with this type of
speaker in the open outdoors, then property -line noise levels will need

to be monitored during events to ensure compliance. In this scenario,
noise levels inside the venue will be around 67 dBA at the eastern side
and louder on the western side, which is very realistic for the types of
events planned for this facility.
Alternatively, a building could be constructed to enclose the events
center. Most building constructions should be sufficient to keep
amplified sound from exceeding the property line limits, assuming that
events are meant to be meetings or gatherings where music is
supplemental, not rock concerts.
Results
Please see the attached noise contours that were produced by the
CadnaA for the planned scenario with landscape speakers for ambient
noise.
Where the red and yellow contours meet is 55 dBA, the daytime limit.
Where the yellow and green limits meet is 50 dBA, the nighttime limit.
Sound levels are called out at several points in the small white
rectangles.
We do not expect limit levels to be exceeded at any point at or beyond
a neighboring property line under these operating conditions. This is
true for both daytime and nighttime limits.

Event Use Vision:
• Events are ancillary/secondary to railbike bookings
• Event use is complimentary to Outdoor Recreation utilizing
the same site infrastructure and limitations
• Vision for Events is to fill-in off -hours capacity focusing on
smaller gatherings and community use

Dear Jeff & Rachel,
We appreciate you taking the time to address our concerns. We know that you are modifying your current application/standards for the county. We
thought we would outline for you a few items that are extremely important to us. This list, however, is not inclusive of everything that has been
discussed, but rather the highlights.
1) Verify compliance with Section 23-2-240; Design Standards and, Section 23-2-260; Application Requirements, especially as it pertains to the Event
Center.
2) Distinguish business daytime and evening hours, especially for Event Center, with defining limits that include no more than 2 Events per month for
evening and weekend hours and 2 events per week for daytime hours.
Example: Mon -Fri 8am-6pm = daytime hours, Mon-Thurs 6pm-10pm = evening hours, Fri 6pm — Sun 10pm = weekend hours
3) If you no longer have the Railbike Business, you agree to vacate the USR in its entirety, (including Event Center).
4) If you move or live off the property, you agree to vacate the USR in its entirety and will not sell the business at this location to the purchaser.
5) Agree that you will put up actual 5'- 6' foot earth berms and trees/plants/shrubs/ grasses that will grow a minimum 6' foot or higher. Identify where
are the locations, lengths, heights of Earth Berms to mitigate the visual and noise disturbances to our properties. (This is open to further
discussion for mitigation on August 11, 2023).
6) Ensure Event Center's MAIN Entrance door faces East.
We are looking forward to seeing your modifications as well as walking the property on August 11th. Thank you very much for your time in this
