HomeMy WebLinkAbout20232129.tiffRESOLUTION RE: APPROVE PERMIT APPLICATION AND REPORT OF CHANGES TO CHANGE, ALTER, OR MODIFY LIQUOR LICENSED PREMISES, AND AUTHORIZE CHAIR TO SIGN - CIRCLE K STORES, INC., DBA CIRCLE K STORE 2709846 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Permit Application and Report of Changes from Circle K Stores, Inc., dba Circle K Store 2709846, for permission to change, alter, or modify its' premises, in connection with its' Fermented Malt Beverage and Wine Off -Premises (County) License, for the sale of malt beverages and vinous liquors in sealed containers not for consumption at place where sold, subject to the rules and regulations found in Articles 3, and 4, Title 44, C.R.S., as described in the application and displayed on the diagram of the premises submitted by the Licensee, and WHEREAS, said application is for the remodel of the store and to permanently expand its' product placement areas for alcohol on the premises located at 10963 West Interstate 25 Access Road, Longmont, Colorado 80504, and WHEREAS, after review, the Board deems it advisable to approve said application. While there, I made an on -site inspection regarding the Application for the Modification of the Fermented Malt Beverage and Wine Off -Premises (County) licensed premises. This item will be heard by the Board of County Commissioners as the Licensing Authority for Weld County on Wednesday, July 26, 2023, at 9:00 a.m. My inspection revealed the following: 1. The proposed modification to the licensed premises [is / is not] directly connected to a different licensed premises, pursuant to C.R.S. §44-3-301(3)(a). 2. The diagram of the proposed licensed premises [is / is not] correct. 3. There are [number (#)] of Fermented Malt Beverage and Wine Off -Premises LC0013 REPORT OF INVESTIVATION - CIRCLE K STORES, INC., DBA CIRCLE K STORE 2709846 PAGE 2 (County) Licensed premises in the neighborhood, and there is one other license type located in the immediate area: a Tavern (County) Liquor License — El Centenario Entertainment, LLC, dba El Centenario Nightclub. 4. There are no public or parochial schools, or principal campus of any college, university, or seminary within 500 feet of the proposed licensed premises, pursuant to C.R.S. §44-3-313(1)(d)(l). 5. The Fermented Malt Beverage and Wine Off -Premises (County) License classification of license requires at least twenty percent of its' gross annual revenues from total sales from the sale of food items for consumption off the premises. The proposed premises has the capability of doing so, pursuant to C.R.S. §44-4-107(3)(a). 6. The sign noticing the place, date, and time of the hearing for the modification of premises application was posted in such a manner that the notice was conspicuous and plainly visible to the public, when I was there at approximately 10:45 a.m. on Friday, July 14, 2023. I also attached a copy of the diagram with notes and several photos from my inspection. There are a couple of items of note: 1. At the end of both aisles, where it is labeled 'BARCEL' and 'WATER' on the diagram, there are actually beer cases being stored. 2. In the middle of the aisles, where the diagram labels '12 PACKS' and 'COOKIES & CRACKERS', there are actually two displays/inventory for BuzzBallz and BeatBox alcohol products. 3. Both doors to the rear storage rooms do not have locks on the doors and were wide-open. This is where surplus alcohol is currently being stored. If these items can be remedied on the diagram and at the store prior to the hearing, please send me photos of such and an updated diagram (if that is the direction you choose) so I can update the Commissioners that my concerns from the inspection have been remedied. Exterior areas should show type of control (fences, walls, entry/exit points, etc.) o Separate diagram for each floor (if multiple levels) o Kitchen — identified if Hotel and Restaurant o Bold/Outlined Licensed Premises (in black) o The diagram also needs to display where coolers/freezers, shelves, surplus storage, etc., are located. In the diagram, I can clearly identify where walls and some entry/exit points are, but the dimensions, descriptions, and associated letters for the key are all pretty illegible. Chapter 26 takes precedence, as the facility is within the boundary of the Mixed Use Development area, Section 26-2-90 addresses Sign District Regulations. Specific to the proposal, staff reviewed three sections of the Code for conformance. Section 2os2a OaD.2.a addresses Attached Signs: Size, Height and Design Limitations. This Section states: a. Awning signs shall not be larger than twenty-five (25) square feet nor ten percent (10%) of the awning surface area, whichever is smaller. b. Marquee, canopy, overhead canopy, under -canopy, projecting or wall signs: 1) Minimum height requirements. These signs shall be mounted at least fourteen (14) feet above any driveway and at least nine (9) feet above any walkway over which they are erected. 2) Maximum height requirements. The top line of these signs shall not be higher than the top of the wall, roof eaves or parapet line of the building to which it is attached 1t is staff's interpretation that the square foot area of sign face located on the overhead awning and the perimeter of the commercial sales facility exceeds this requirement specific to Section 26-2-90.2.a as outlined. Section 26-2-90.D.3 addresses Detached Signs.
