of the Colorado Revised Statutes
To Whom it May Concern:
Connell Resources, Inc. has submitted a Division of Reclamation, Mining and Safety Reclamation
Permit application and Weld County Use by Special Review Permit application for a sand and gravel
mining operation located near the community of Carr, Colorado. Reclamation activities for the mining
operation include returning the property to rangeland. You are being notified as a mineral rights owner
or lessee with potential interests in the proposed project.
Mining activities on the 166.1 acre parcel of land will be located primarily in the:
SW1/4 in Section 22, Township 11 North, Range 67 West of the Sixth Principal Meridian, Weld
County, State of Colorado (vicinity map attached).
The first public hearing for the Use by Special Review permit application will take place in front of the
Weld County Planning Commission on June 6, 2023 at 1:30 pm in the Weld County Administration
Building, Hearing Room, 1150 0 Street, Greeley, Colorado.

In Warranty Deed dated May 17, 1965, recorded at Reception No. 1463879 of the Weld
County Clerk's records Terry Land and Livestock Company, Inc. conveyed the subject lands
to Terry Grazing Association. There is a reservation contained in the deed that states
"EXCEPTING AND RESERVING therefrom however, unto TERRY LAND AND
LIVESTOCK COMPANY, INC., part of the first part, its successors and assigns, all gas,
casinghead gas, oil and other minerals valuable as a source of petroleum in and under said
lands and appurtenances thereto..." It is the opinion of the examiner that this reservation is for
oil, gas and other hydrocarbons only and does not include other minerals such as sand, gravel,
uranium, etc. even though in some cases sand and gravel has been construed to be a mineral by
legal ruling.

The oil, gas and other hydrocarbons under the described lands may be unleased at this time,
however there is a Memorandum of Oil & Gas Lease at Reception No. 4349798 of the
Weld County Clerk's records that gives notice of an Oil & Gas from Etchepare, LLC to
Longs Peak Resources, LLC dated November 1, 2017. The initial term of the lease is for
4 years, which would have expired on November 1, 2021, however the Oil & Gas Lease
does contain a provision that states, "Lessee possesses the right to extend the Primary
Term of the lease for an additional three (3) years following the expiration of the initial
term." There is no evidence of lease extension filed in the county records. Contact with
Longs Peak Resources, LLC (10701 Melody Drive, Suite 515, Northglenn, CO 80233) is
recommended to determine if the lease was extended until November 1, 2024, or for
notification purposes.
A review of the online records of the Colorado Oil and Gas Conservation Commission
indicates that there are no producing wells and no applications to drill on or near the subject
lands or lands included in the referenced Oil & Gas Lease at this time.
This Report was prepared based upon an examination of the records of the Weld County Clerk and Recorders Office from
inception to the posted date of January 14, 2022. The report was then updated to include oil, gas and other hydrocarbons and
included an examination of the county records from inception to the posted date of April 5, 2023. This report is made solely
for the benefit of Hill Land Services, Inc. for the purpose of assisting in a determination of the apparent mineral ownership of
the captioned property with respect to all minerals, including oil, gas and other hydrocarbon interests. A more complete and
thorough examination of the title may be required to confirm the above ownership with absolute certainty. The instruments
referred to have not been examined to determine their legal sufficiency. No warranty of title is expressed or implied by virtue
of this report.
