Part of the Northeast one-quarter Southeast one-quarter (NEaSEa)
WHEREAS , on May 5 , 1972 , the General Assembly of the e Bill # 35 as to Statedo , ed relates
Statutes , and
WHEREAS , on August 30 , 1972 , the Board of County
Commissioners of Weld County, Colorado , adopted Subdivision
Regulations for Weld County, Colorado to comply with the
prescribed Senate Bill #35 , and
WHEREAS, the Weld County Planning Commission
has recommended to the Board of County Commissioners for
recording of plat number 1307-24-4-RE112 as provided in
Section 9 of the Subdivision Regulations (exemption rules and
regulations) for Weld County , Colorado .
Said division of land determined to be exempt
from the definition of subdivision is more particularly
described as follows :
Beginning at the Northeast corner said Northeast one-
quarter southeast one-quarter;
Thence S00°52 ' 30" E on an assumed bearing along the East
line said Northeast one-quarter Southeast one-quarter a
distance of 1314. 40 feet to the Southeast corner said
Northeast one-quarter Southeast one-quarter;
Thence N90°00 ' 00" W along the South line said Northeast
one-quarter Southeast one-quarter a distance of 1320 . 83
feet to the Southwest corner said Northeast one-quarter
Southeast one-quarter;
Thence N00°39 ' 50" W along the West line said Northeast
one-quarter Southeast one-quarter a distance of 1315. 36
feet to the Northwest corner said Northeast one-quarter
Southeast one-quarter;
Thence S89°57 ' 20" E along the North line said Northeast one-
quarter Southeast one-quarter a distance of 1316 . 00 feet to
the point of beginning, except the East 40. 00 feet thereof .
Contains 38 . 586 Acres more or less excluding said East
40. 00 feet thereof .

Dear Commissioners :
Previously we requested and received a Recorded Exemption
#1307-24-4-RE54. Subsequent to that Exemption , an abandoned
feeder lot adjacent to the property has been reopened and is
currently it operation .
To avoid the obvious disadvantages associated with building
within a hundred feet of a feeder lot , we are requesting an
amendment to that Exemption. This amendment places the pro-
posed building sites as far from the feeder lot as acreage
will permit.
Please note the attached well permits and proposed amendment
to the Recorded Exemption. The basic data remains the same ,
depth and type of wells and acreage Lot A and B.
Any consideration that may be shown in this matter will be
most appreciated.

DETERMINED TO BE EXEMPT FROM THE DEFINITION OF SUBDIVISION
RANGE 65 WEST, TOWNSHIP 2- NORTH, SECTION 24
PART OF THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER (NEaSEa) :
WHEREAS, on May 5, 1972, the General Assembly of the State of Colorado
enacted Senate Bill #35 as relates to Chapter 106 of the Colorado Revised
Statutes, and
WHEREAS, on August 30, 1972, the Board of County Commissioners
of Weld County, Colorado, adopted Subdivision Regulations for Weld County,
Colorado to comply with the prescribed Senate Bill #35, and
WHEREAS, the Weld County Planning Commissioner has recommended to
the Board of County Commissioners for recording of plat number 1307-24-4-RE-54
as provided in Section 9 of the Subdivision Regulations (exmption rules and
regulations) for Weld County, Colorado.

8. In the event the seller fails to approve this instrument in writing within 10 days from the date
hereof, or if title is not merchantable and written notice of defects is given to the seller or agent within the time
herein provided for delivery of deed and shall not be rendered merchantable within 60 days after such written notice,
then this contract, at purchaser's option, shall be void and of no effect and each party hereto shall be released from
all obligations hereunder and the payments made hereunder shall be returned forthwith to purchaser upon return of
the abstract, if any, to seller; provided, however, that in lieu of correcting such defects, seller may, within said 60
days, obtain a commitment for Owner's Title Insurance Policy in the amount of the purchase price showing the title
to be free from such defects and seller shall pay full premium for such Title Insurance Policy.
9. Additional Provisions:
This contract contingent upon buyers applying and being approved for
a recorded exemption by Weld County Commissioners to allow the
construction of two houses on subject• property.
10. Upon approval hereof by the seller, this agreement shall become a contract between seller and purchaser and
shall inure to the benefit of the heirs, successors and assigns of said parties.

INFORMATION ABOUT YOUR EXEMPT WELL PERMIT
The enclosed copy of your exempt well permit is a vnlut,ble document. It is evidence
of the initiation of your water right. Please note carefully any conditions of
approval that may be written on your permit. These conditions must be complied with
in order for the penult to be valid. The original copy of this permit is on file in
the office of the Division of Water Resources. Additional copies may be obtained
there for a fee of $0.50 per page.
Please note the expiration date of your permit carefully. This date may be extended
for good cause shown to the issuing agency. This means that the permit shall expire
and. be of no force or effect unless your well has been drilled and the Well Completion
Report (Form WRJ-26-72) has been completed, notarized and submitted by the driller
to the Division of Water Resources prior to the expiration date of the permit.
The enclosed Statement of Beneficial Use of Ground Water (Form WRJ-25-72) should be
completed, notarized and filed with the Division of Water Resources as soon as
possible after the water from the well has been put to beneficial u.se. Only when the
water is actually being put to beneficial use can the right to the use of the water
be perfected.
In the event that two copies of the permit are enclosed, one of them should be given
to the well driller you select. Your ;;ell must be drilled_ by a well drilling con-
tractor and the pump installed by a pump installation contractor, both of whom must
be licensed br the State of 2oleor24n. One er both ,
by you/self only if you own and operate the equipment used.
Any change in your mailing address or a change in the ownership of the well should
be reported to the office of the Division of Water Resources as an Amendment of an
existing Record (form WRJ-25-72). 1'he fee for a change of record is $1.00.
The following information, as well as the Table of Water Equivalents on the back
side of the Statement of Beneficial Use of Ground Water are provided as an aid in
completing that form.
The "maximun sustained pumping rate of the well" is the greatest stabilized pumping
rate of the well with the eenneeent equipment installed. The "pixmoing a clai of
hereby" is the punpi.ng rate approved. on your permit, or the maximum sustained
pumping rate, whichever is less. This is the pumping rate for the normal operation
of the well.
