• • • RESOLUTION - WHEREAS, a public hearing was held on Monday, May 22, 1972, in the chambers of the Board of County Commissioners, Weld County, Coloradd, for the purpose of hearing the petition of Albert Stroh, Johnstown, Colorado; requesting permission for expansion of an existing feedlot operation on the following described property, to-wit: • The South Half of the Southwest Quarter of the • • Southeast Quarter (SZSW4SE j--) of Section 20,• Township 4 North, Range 67 West of the 6th - P. M. , Weld County, Colorado; containing 20 • acres, more or less,• ' WHE AS, the petitioner was present and represented by counsel, Melvin Dinner, and WHEREAS, there was some-opposition to the request of petitioner for the expansion of an existing cattle feedlot operation, and • WHEREAS, the said-requested expansion•of an existing cattle • feedlot operation is located in an agricultural zone as set forth by the Wel'd County Zoning Resolution, and WHEREAS, according.to Section 3. 3(3)•(c) of the Zoning Resolution of Weld County, said cattle feedlot operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners • of.Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements-of those present; has studied the request of the petitioner, .and studied the-recommendations of the Weld County Planning C minission, and having been fully informed; • NOW; THEREFORE, BE IT RESOLVED, ,by the Board of County Commissioi ers, that the application of Albert Stroh, Johnstown, Colorado, for expansion of an existing cattle feedlot operation on the premises i dicated above be, and it hereby is granted under the con- •ditions foll wing: ; 1. Th t any water and sanitation facilities to be installed shall be _ approved by the State Health Department. 2. That when expansion of said cattle feedlot' operation is completed, same shall not contain more than 3, 000 head at any one time. '•3. There was discussion regarding the disposal of stock pen drainage into their irrigation ditch contained within the property. Mr. Lorenson stated the legal description should e reduced to cover the area where the dairy will be located rather than the 80 acres , or approximately 10 acres . LOCATION : SE Cor NZ Sec 34 T11 R60 APPEARANCE: None DISCUSSION : Mr. Lorenson explained they have a research center on hail . They are requesting permission to erect two communication towers . Neight will be 170 ' . in accordance with the Federal Aviation Administration . It will be a radio repeater station for air-td-ground and ground-to-ground radio communications during hail research commencing5/1 /72 and continuing through 7/31 /72 and for a like period for the subsequent four years . A letter was received from the Air Force at Ft. Warren in Cheyenne which is the nearest facility stating they had no ob- jections provided it is properly lighted . RESOLUTION : Be it herefore resolved to recommend approval to the County Commission rs subject to the towers being properly lighted. Motion by r. Anderson , second by Mr. Weigand . SUBJECT : Unrec rded plat for Mountain View Estates DISCUSSION : Mr Lorenson stated the plat for Mountain View Estates had been a proved by the Planning Commission over a year ago . It was sub ect to a bond .being posted for the roads . The bond 748 . J has ne er been posted , consequently the plat has not been referred to the County Commissioners . Most of the requirements since that time have been increased . There is a sign on the propert "Lots for Sale" . There seems to be a water table prob- lem at his location . MOTION : By r. Nix to authorize Mr. Lorenson to not issue any buildin permits on this property until it has been properly filed and recorded. Second by Mr. Watson . A vote of "Aye" by Anderso , Bowles , Heitman , Nix , Watson and Weigand . As a result of this there are quite a number of people living in the area . There is an interior road which is not on the public right-of way system , Mr. Bowles read the recommendations of the planning staff that the application be denied . It is not com- patible with surrounding land use (residences within 600' )and a. petiti n and 10 individual letters of objection to the pro- posed do kennel site . have been received . Mr. Anderson stated they had obtained a building permit and a septic tank permit. Mrs . Jul e Kollar stated when shesigned the petition she thought it was f r 4 dogs or she wouldn ' t have signed it. Mr. Stroh stated w en they found out there were going to be 30 dogs they fel it would be detrimental to the area . Mr. Bowles stated that bas d on the past practice of the Planning Commission re- garding og kennels and other animal producing operations in areas wh re there are subdivisions , they would have no choice but to r commend denial because this is basically a subdivision . There was a discussion regarding transferring a building permit to another location . Lorenson stated that Mr. Stroh had submitted an applicati n to expand his feeding operation a little over a year ago . At the time it was recommended for denial . The Plan- ning Commission tabled the matter and was never presented to the County Co mission . Additional information has been submitted since tha time . The lotting has been changed . Lot #7 is still within 660 feet of the Hick ' s residence . The draw is now pro- tected by retention ponds designed by SCS. Mr. Dinner explained the change which have been made . There was discussion regard- ing the qu lification of the feeding operation being a farm feed lot in vie, of the amount of roughage raised by the Strohs . The petition h s been signed by surrounding property owners except 749 1 I "---___... for M . and Mrs . Hicks . With the new expansion the capac ty will be 3000 head. RESOLUTION : B it therefore resolved to recommend approval of the revis d application to the Board of County Commissioners subje t to 3000 head of cattle . Also resolved the ap- plica ion to be a farm feed lot and not subject to the interpretation of a commercial feed lot. Also to resolve that the applicant has a choice whether to continue through the County Commissioners for a hearing or proceed with his operatlion without any further action required . He repdrted a letter had been received from the school district stating they found no reason to support or object to the sub- division . The clearance record for the utilities has been signed , a closure sheet submitted and the street profiles . The plat is in accordance with the preliminary plat. They will be subject to a road improvement bond in the amount of $17 ,550 . 00. Sherroc Kent Wri hts , Peter Youngst and Wayne Miller DISCUSSION : Mr Cunningham presented the proposed zone changes , explaini g the area they are requesting " I " zoning for was not owned by Eastman Kodak at the time of the previous zoning . The "S" oning serves as a buffer zone around the perimeter of their pr perty except to the south where there is a bluff. Mr. Cunningham stated the Windsor Planning Commission had recommended approval by a unanimous vote . Mr . Smith stated had the property 750 - th y are 'requesting the "I " zoning for`jbeen purchased at the be inning , it would have been zoned " I " at the time and they wo ld be doing their construction there rather than farther east where their present buildings are. Stated it is important that they have flexability for their long range plans . Mr. Bowles rea the recommenatinns of the staff stating that granting an ind strial zone or scientific zone at this time without suffic- ient information removes the county ' s ability to review any future development. 443 acres of industrial land without any plai concerning future access points , rights-of-way , flood plain zone , gravel pits and their reuse , type of manufacturing oper- ation and location of facilities seem to be granting a blank cheok. Any other industrial concern requesting this much re- zoning would be requested to submit a Planned Unit Development. A generalized PUD would be acceptable if it answered some of the questions and provided a mechanism to allow the County future veto power if the best interests of the community at large were not protected. On application Z-194 the recommend- ations were for approval . It has been recommended for approval by the Windsor Planning Commission . It places more restrictive zoning on the ground than now exists . It provides a buffer use Ito the adjacent areas . Mr. Lorenson stated they are re- questing the PUD on applications Z-193 and Z-195 . Mr. Miller , mayor of Windsor stated it had been approved by the Planning Commission and the Town Council in view of their past record . Also they have a Comprehensive Plan and this zoning complies with the Plan . Mr. Lorenson explained the recommendation was not for denial but to table the applications and they develop a PUD. Mr. Heitman stated he felt requesting a PUD was a logidal request. Mr. Bowles stated he didn ' t think this would impose any great hardship on the company. MOTION : By Mr. Watson that the applications be tabled and request the ompany to present a PUD. Second by Mr. Heitman . A vote of "Aye" by Anderson , Bowles , Heitman , Nix , Watson and Weigand . White Company who is doing the Flood Plain study. As of March 7 , 1972 they had 20% of the survey done. In the le ter dated March 14 , 1972 stating they have their photography , aerial photos and field survey 50% complete , their photography 85 : triangularization 10% complete . SUBJECT: Proposed Subdivision Regulations DISCUSSIOr' : Mr. Lorenson presented the staffs version of Sections 6 ,7 and 8 of the Subdivision Regulations as prepared by the consultant . These are sections that should not be affected by anything that the State Legislature does . They cover the final pla requirements . Asked that the members review them before the next meeting . SUBJECT : egional Transportation District DISCUSSION Fir. Lorenson stated the Regional Transportation District is 9oming up with designs that affect us very much . They are suggesting if we want any kind of a transit system that we will have to do certain things in our planning. They submitted a fly page document . There are some things underlined that he fel were worthy to look at. These are interim reports . One item is financial resources discusses how are we going to get money for whatever we are going to build . Another is pro- jections , one is technology, objectives etc . They have come up with a Phase One concept of what the transportation is going to be i this area . The concept relates around growth and how your going to make the growth occur. The growth concept con- clud s that instead of allowing continual sprawl , several areas of a tivities "activity centers " should be developed throughout the Metropolitan areas of the region . Mr. Lorenson felt it deserves some study because if it is adopted , we will be re- quired to implement it. They have presented the County with work sheets . SUBJECT : MEeting dates DISCUSSION: Mr. Heitman stated he would like to having both meetings on Monday. After much discussion, it was decided the meetings would remain on Monday the first meeting of the month and Tues- day tie second meeting . SUBJECT: So l Conservation Service DISCUSSION : Mr. Lorenson stated the SCS is indicating that they do not have the staff to give the soil information that we would like to have . We are buying all of their soil maps . They are printing them at the scale of our base maps . They are working to make us an interpretation sheet indicating what the symbgls are. Dr. Heil of CSU has been contacted and is work- ing do these interpretations for our office . SUBJECT: Progress report on County Comprehensive Plan DISCUSSION : r. A letter of complaint on the expansion of the feed lot was also read from Mr.. and Mrs. W. D. Hicks. James Stroh presented their plans and commented on the. complaint. Mr. Stroh inquired if they would move one pen (*8) .would they meet the 6601 requirement. The pen with the 20' set-back has been in existence for several years. Mr. Lorenson had recommended denial because of the. set-back. MOTION: By Mr. Weigand to table the matter until a report from the Soil 'Conservation Service is received and a letter of intent regarding pen #8. Second by Mr. Watson. A unanimous vote of "Aye". On Nevember•2, 1970 I first'wrote to Mr. Bierman Lorenson, 'Weld County Planning Commission in regard to a protest by Betty S. ,Hicks (my wife).-and W. D. Hicks against the building of n'ew-cattle feedlots directly north of the faun and our home mentioned in mgr letter of November 2, 1970. There was no answer to our'lettsr by Mr.. Lorensm. After the nay County Coffissioner§ were elected Mrs. Hicks and I attended a meeting in Oreele where Mr. Harold S. Ashley,-the new County Commissioner for our area,was-in attendance and after the we mentioned our letter of protest written to • Mr. Lorenson. Mr' Ashley stated he wbuld- investigate our protest. After two or three months pass4d I phoned Mr. Ashley and .asked him again about -our letter of protest and what was being done about it. 'On June,11, 1971 I received a short letter from Mr. Ashley. Copies of all correspondence are attached. ' Between June ll, 1971 and'July 1, 1971 Mr. Bill:Doke called my life on the phone one- night and gave her information Which was of little benefit in 'respect to our. _ ' protest, since helwas talking about something different than our protest and request ' for a hearing. Ilagain wrote-Mr.. Ashley on -July 1, 1971 which he answered on July . 9, 1971. Again Mr. Ashley was' trying' to explain-plans being made by Mr. Stroh but in no way explaining the actions Mr. Stroh,had already taken in building a new feed • lot, and as I understand the present' County Planning Commission rules, Mr. Stroh had not asked for p permit to build this -new feed lot and;had built this new feed lot too close to the county road. I answered Mi.-Ashley's letter of July 9, 1971 . on July 12, 1971. Since July 9,. 1971 I have received no correspondence from Mr: • Ashley, a-period of over two menthe.", .- My Primary concern is my health problem as stated in uuuy•first letter to Mr. Lorenson an Novembar 2, 1970. Secondly' my wife and'I are concerned about the value of our home and fixture value of the farm property due'to extensive feed lots being expanded for approldmately 1300 feet along the. county road north of our home and farm. It is .apparent that Mr. Stroh is stockpiling'a new supply of railroad ties for-the purpose of building more'new feed,lots._ .I have- not been notified of Mr. .Stroh making -application for a Permit and certainly our letter of protest has not been acted upon - to our catisfabtient as of -this date. A'very:iuportant'fact is the grbaing air and water pollution problem in our State of Colorado"and our Nation generally. In the present location where Mr. Stroh is building his cattle feed lots he cannot'help contributing to the pollution problem. • Cattle movements ir :a confined feed lot cause a great deal of dust made up of the. . . ground level contents of the feed lot during dry weather. Our democratic,method of operation has a tendency to allow our problems to develop to a catastrophic-state before we stop,nsticking air heads in the sands in hopes the problem will disappear by some miraculous means. Hicks Route 1 Johnstown, Colorado 80534 Dear Mr. Nickell •our feed lotyand h ve the following onn ' est i again informatithe status of the Albert Stroh Their orig�i"nal proposed expansion was denied by the Weld County Planning Commission and they have now applied for help from the Soil Conservation Service and the Health Department (Water Pollution Division) to aid them with a program that can be accepted by the Planning Commission. On July 7, 1971 I had Mr. William Doke check with the Loveland Branch of the Soil Conservation Service to find out the status of the Stroh application foriassistance to design a lagoon for an expansion program of a cattle operati n. They are in the process but do not have any final plans. When they have completed the plans they will be submitted to the State Soil Conservation Service Engineers and the State Health Department (Pollution Division) for their approval. When and after these steps have been completed, a new application will then be subMitted to the Weld County Planning Commission, and a hearing will be Held by the Planning Commission Board. Their recommen- dation (either dinial or approval) then will be submitted to the County ' Commissioners. The Special Use Permit is then advertised for Public Notice of the time, date, and purpose of the hearing before the County Commissioners. At that time anyone objecting or supporting the Special Use Permit will be heard. A notice of this hearing will be mailed to the adjacent landowners. It is ay understanding that theilllt feed let Mr. Stroh built was completed after the Veld County Planning Commission had passed certain regulations yegarding the construction of feed lots, and that Mr. Stroh did not apply for or receive a permit to build his most recently constructed feed lot. Also that this feed lot is constructed tooMear the sainting road. These ars the things I as at present protesting as well as :Nature expansion of his feeding facilities. I of course will protest any future expansion Mr. Stroh plans. Apparently Mr. Stroh is in violation of the already existing Weld County Planning Commission regulations and this is the reason for requesting • hearing foz this purpose now. Later on I will protest entirely the construction of new feed lots. Therefore, I again request a hearing in regard to the last feed lot constructed as regards the regulations mentioned above. Ms will be on our vacation from July 22, 1971 to August 16, 1971. Hicks residence. All other corrals are over 500 ' from buildings other than the owners tennant house and accessory buildings. The proposed feed corrals #8 would be considereable closer probably within 250' of the Hicks home. The corrals #x'6&7 slope to the east into a draw wiich goes into the Hillsb6-7. Ditch. The proposed corral #8 site slopes to the west into a draw that drains into the ' I Hillboro Ditch. Both corrals drain into areas uhere a lagoon or settling basins could be constructed where! raw disposal could be collected. All corrals have very good drainage so they would dry faster eliminating the smell that is acquainted with corn is with poor drainage. Cattle c pacity #6&7 - 250 head, corrals #6&7 are almost- complete. No work has been done on. corral #f8 except the water lines and hydrants have been installed. Corral #6 is within 20 feet of the County Road #l2, but still on Mr. Albert Stroh's property. Distance from Johnstown is 3 miles south and 4 _ west. All measurements were stepped off and are approximate distances. We are all concerned witlh pollution , ecology and anything that might dam- age the use of the land , water , air and environment of this wonderful country in which we are privileged to live . I too have a parcel of land ( 120 acres ) near Mead in Weld County which is zoned "Agriculture" the same as yours . The purpose of an Agriculture Zone is to allow certain uses in a particular area . . • Enclosed is page 5 of the Zoning Resolutions which state the uses permitted in an Agricultural Zone. I would like to call your attention to Paragraph 3 . 3 Item (3 ) which I have. outlined in red pencil . The conditions which are mentioned in this Paragraph 3 . 3 . reler to a Commercial use (refer to Page 26 , item (9 ) "Feed Yards " . All three of these conditions must • exist before a feedlot can be considered a :'Commercial Feed lot" . Item' 12 . 2( 9) (a) - Mr . Stroh does confine hisF animals to a restricted area . Item 12. 2(9) (b) - . - Mr.l Stroh does raise 50% of the roughage type feed , such as hay or sileage. Item 12 . 2( 9) (c ) - The feed loti does not exceed 25% of the farm land area . Since Mr . However , the Planning Office has asked feeders of any size to get a Special Use Permit so they could be cleared with the Health Department , Extension office , Soil Conservation Service , etc . In this way , the Planning Commission is helping to eliminate any future problems . In all cases such as Mr. Stroh ' s , we have had very good reception and cooperation concerning the application of the Special Use Per- mitsJ each applicant knowing and being aware of pollution in it ' s different forms . The Special Use Permit which Mr. Stroh applied for was denied by the Planning Commission and fur- thur study is being made by Mr. Stroh and the Soil Conservation Service so that any additional corrals can be built in an area where pollution , etc . will be k9pt to a minimum. December 17, 1970 Weld County Blanning Commission Weld County Court House Greeley, Col rado 80631 Dear Sirs, A survey was made on December 16, 1970 of the Albert Stroh feedlots located' thre (3) miles south of Johnstown, Colorado. The survey was made in rela4ion to any possible surface, or ground-water pollution resulting from drainage of the feedlots. Based upon information received, the final area of the operation will encompass ap roximately seven (7) acres; and will accommodate one thousand (1,000) head?of cattle. The proposed area together with the existing feedlot drain into a seepage area, which in turn follows a natural water course to the Hillsboro Ditch, located about one and one-half miles to the north. fn addition this water course is fed by other tributaries of seep and natural drainage along the route. Some of these tributaries have corrals and feeding areas draining into them at the present time. Approval of the proposed increase in feed lot area cannot be justified at . the present ime. Mr. Stroh was advised to contact the Soil Conservation Service for assistance in the matter. Approval therefore depends upon a favorable report by the rrofessional engineers employed by the Service; and agreement by Mr. Stroh that any proposed plans in such report will be - complied with. SOILS The surface ;oil is clay loam (CL) . The depth of the clay loam soil varies from wo (2) to thirteen (13) feet. The soil under clay loam is clayey shale nateriai (CI) . In three of the test holes, the clayey shale material was hard and dry and the power auger would not drill below five and one-half (5.5) feet. A water table was encounterMT in test holes 103, 105 and 106. The depth of the water table varied from seven and one-half (7. ) to ten (10) feet.
