RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR HEPATITIS C VIRUS (HCV)
CONFIRMATORY TESTING PROGRAM AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for the
Hepatitis C Virus (HCV) Confirmatory Testing Program between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Public Health and Environment, and the Colorado Department of Public Health
and Environment, commencing July 1, 2023, and ending June 30, 2024, with further terms and
conditions being as stated in said memorandum of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Memorandum of Understanding for the Hepatitis C Virus (HCV)
Confirmatory Testing Program between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Public Health
and Environment, and the Colorado Department of Public Health and Environment, be, and
hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 23rd day of October, A.D., 2023, nunc pro tunc July 1, 2023.

Brief description of the problem/issue:
For the Board's review and approval is a no -cost agreement between the Colorado Department of Public
Health and Environment (CDPHE) and the Board of County Commissioners of Weld County for the use
and benefit of the Weld County Department of Public Health and Environment (WCDPHE).
WCDPHE seeks to enhance our outreach STI testing by offering Hepatitis 0 Virus (HCV) confirmatory
testing to clients that receive a positive result from a rapid HCV test. HCV confirmatory testing is a
necessary follow-up for most individuals living with HCV before they can be linked to appropriate medical
care. Left untreated, HCV can be transmitted between individuals and can lead to significant health
complications including organ damage, cancer, and death.
Through a prior agreement with CDPHE, the WCDPHE offers rapid HCV antibody testing free of
charge in our outreach clinics. This additional agreement will allow the WCDPHE to order from
CDPHE no -cost HCV confirmatory testing for clients via Molecular Testing Labs (MTL), a commercial
laboratory. After a positive rapid test result, staff will collect a dried blood spot specimen from the
client, order the HCV confirmatory test through the MTL online portal, and mail the specimen to
MTL. This prevents the need to schedule an office visit for confirmatory testing. The end of the term
for this project is 6/30/2024.
Activities will be conducted by current staff; no additional FTE is being requested.
What options exist for the Board?
With the approval of the Board, this will allow the WCDPHE to ensure necessary HCV confirmation
testing for those testing positive via a HCV rapid test. This confirmatory testing is necessary to get the
patient the care needed and provides for a higher -level of continuity of care and customer service.
If the Board declines this agreement, the WCDPHE will not be able to offer follow-up HCV confirmatory
testing. Patients will be referred to seek confirmatory testing from their primary care provider and/or
community health center.

Project Description:
This health project serves to increase access to Hepatitis C (HCV) confirmatory testing for individuals who have
previously had a reactive HCV antibody test. HCV confirmatory testing is a necessary follow-up step for most
individuals living with HCV before they can be linked to appropriate medical care. Left untreated, HCV can be
transmitted between individuals and can lead to significant health complications including organ damage, cancer
and death. Increasing access to HCV confirmatory testing is important in preventing health complications and
interrupting disease transmission in communities.
This project allows agencies that offer rapid HCV antibody testing, including Local Public Health Agencies
(LPHAs) and Community -Based Organizations (CBOs), to order HCV confirmatory testing for clients via
Molecular Testing Labs (MTL), a commercial laboratory. An Agency will collect a dried blood spot specimen
from the client, order the HCV confirmatory test through the MTL online portal, and mail the specimen to MTL.
MTL will provide supplies for testing as needed to an agency, perform laboratory testing on received specimens
and provide test results to the Agency via the online portal. The Agency will be responsible for giving results to
the client and providing linkage -to -care referrals as necessary.
CDPHE will cover the cost of laboratory fees as funding allows. CDPHE will suspend the program and inform
participating agencies, if funds are exhausted.

Agreement:
Under the terms of this agreement, CDPHE will provide the ability to order no -cost HCV confirmatory testing
utilizing dried blood spot specimen collection to participating agencies.
I. Process and Protocol:
This protocol is intended to explain the process for agencies to onboard into the CDPHE HCV Confirmatory Testing
Program. Funding is supported by State Opioid Response, HCV State General Funds and other funding sources as
secured by the Office of STI/HIV/Viral Hepatitis Syndemic Program.
Agencies intending to utilize the CDPHE HCV Confirmatory Testing Program must complete the following steps:
1. Identify a healthcare provider who is qualified to order and approve laboratory testing for clients and who
agrees to sign off on HCV RNA test orders on behalf of the Agency.
2. Submit the following information to CDPHE:

3. Schedule and attend a training with MTL representatives on using the MTL portal to order tests and review

II. Expectations, Standards and Requirements:
1) The Agency shall perform HCV screening in accordance with current CDC guidelines available on the
following website: https://www.cdc.gov/hepatitis/hcv/guidelinesc.htm
2) The Agency shall comply with the data collection and reporting requirements stated in the Guidelines
Regarding Data Collection and Reporting. This document can be accessed at
https://www.colorado.gov/pacific/cdphe/sti-hiv-funded-partner-policies and is incorporated and made part of
this agreement by reference.
3) The Agency shall comply with the guidelines concerning data security and confidentiality stated in the Centers
for Disease Control's Data Security and Confidentiality Guidelines for HIV, Viral Hepatitis, Sexually
Transmitted Disease and Tuberculosis Programs. This document can be accessed at

made part of this agreement by reference.
4) The Agency shall comply with the following Standards of Prevention for HIV/STI/VH and Harm Reduction
Services. These Standards are incorporated and made part of this agreement by reference:

5) The Agency shall comply with state law regarding the reporting of HCV confirmatory assay results. Reporting

and are incorporated and made part of this agreement by reference.
6) The Agency shall follow Universal Blood and Body Fluid Precautions as recommended by the CDC. These
recommendations are incorporated and made part of agreement by reference:

7) The Agency shall follow instructions from MTL for ordering tests and handling specimens.
8) The Agency that orders testing supplies through MTL shall perform the test directly. No testing supplies
provided by MTL will be distributed to outside agencies or clients for use.
9) The Agency shall solely use testing supplies provided by MTL for collecting specimens that will be delivered to
MTL.
10) The Agency shall be responsible for delivering test results to all clients for whom the Agency orders testing.
11) The Agency shall combine mailing multiple specimens in a single return mailer when possible and avoid
mailing each specimen separately when possible.
12) The Agency shall provide written confirmation to CDPHE of receipt of supplies ordered from MTL within 5
business days of receipt.
13) The Agency shall utilize their own supplies to collect the specimen for HCV confirmatory testing when supplies
are not provided by MTL. Necessary supplies which the Agency can order from MTL, at no cost, include: dried
blood spot collection cards, alcohol pads, sterile gauze pads, sterile lancets, adhesive bandages, biohazard bags
with desiccant silica gel pack, and pre -paid mailing envelopes. Necessary supplies which MTL does not provide
include but are not limited to: medical exam gloves.
14) The Agency shall have all clients receiving testing through the HCV Confirmatory Testing Program sign a form
indicating they consent to receive HCV confirmatory testing.
IV. Contingency of change or loss of funding:
The partnering Entity/Agency acknowledges that utilization of the HCV Confirmatory Testing Project is
dependent on available funding and there is no guarantee of ongoing availability. In the event that any of these
sources of funding are reduced or eliminated or expended prior to the end of the term, CDPHE has the right to
reduce, suspend or eliminate financial support for this project. CDPHE shall endeavor to give the partnering
entity/agency as much prior notice as is possible of any such situation.
