HomeMy WebLinkAbout20231180.tiffRESOLUTION RE: APPROVE MASTER TASK ORDER CONTRACT FOR DISTRIBUTION OF FENTANYL TEST STRIPS IN WELD COUNTY (HOUSE BILL 22-1326), AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Master Task Order Contract for Distribution of Fentanyl Test Strips in Weld County (House Bill 22-1326) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Health and Environment, and the Colorado Department of Public Health and Environment, commencing upon full execution of signatures, and ending June 30, 2024, with further terms and conditions being as stated in said master task order contract, and WHEREAS, after review, the Board deems it advisable to approve said master task order contract, a copy of which is attached hereto and incorporated herein by reference. BACKGROUND: HB-1326, known as the Fentanyl Accountability and Prevention Act, passed in 2022, in part, provided $600,000 dollars to make drug checking test strips available across Colorado as part of a multi -faceted approach to combat drug overdose. The Colorado Legislature has charged the Colorado Department of Public Health and Environment (CDPHE) with the administrative oversight of the distribution program. CDPHE is seeking the assistance and cooperation of county health departments to exclusively help distribute the free fentanyl test strips (FTS) throughout Colorado. Upon the approval of this Task Order Contract, the Health Department will enter into collaboration with CDPHE to be the designated agency for the distribution of FTS in Weld County. Weld County will receive no compensation for the distribution of these test strips, nor will we be responsible for purchasing these test strips; they will be provided by the state, as they are requested, at no cost. WCDPHE will be responsible for receiving shipments of FTS, determining the recipients of the FTS (local agencies and/or individuals), providing education and technical assistance as requested/needed, and providing quarterly reports regarding the number of FTS distributed. No new FTE will be required to perform the work under this contract with CDPHE, it can be met with existing staff. The contract term will begin upon full execution of the Task Order Contract and end June 30, 2023. This task order contract may be extended pursuant to an option letter with the State for a period not to exceed five years. Assistant Weld County Attorney, Karin McDougal, has reviewed this Task Order Contract and determined that its terms are acceptable. The Board approved the Health Department's participation in the Fentanyl Test Strip program during a work session dated January 6, 2023. The WCDPHE's interest in this initiative is only to support community partners. We have no interest in being a direct community resource for the individual end -user of these test strips. WCDPHE researched this state initiative following direct contacts from representatives from the University of Northern Colorado who were aware of this program and expressed their interest in obtaining the free test strips via their local public health agency (LPHA). The local police departments of Nunn and Firestone have also requested FTS. Furthermore, based on initial discussions with the Weld County Sheriffs Office, we believed that they, too, were interested in obtaining the free FTS. However, after further investigation and evaluation of the testing processes in their agency, it was determined that this would not be a good fit for their organization, and they have subsequently rescinded their request to receive the free FTS. At this point, the Health Department is seeking to understand the Board's position regarding this initiative and determine future direction and next steps. If the Board ultimately determines that facilitating the distribution of FTS in Weld County is an initiative they would like to pursue, the Health Department is requesting the Board's approval to enter into collaboration with CDPHE to be the designated agency for the distribution of FTS in Weld County. With this approval, the WCDPHE will submit a statement of work (SOW) to CDPHE that will be incorporated into a contract with BOCC STAFF USE Date Set: Time: CDPHE, and we will then request the Board's final approval and signature following legal's approval of the contract. No new FTE will be required to perform the work under this contract with CDPHE, it can be met with existing staff. The SOW will define the reporting requirements and processes for this program. There is no budget associated with this contract; county health departments can access these FTS at no -cost. WCDPHE will be responsible for receiving shipments of FTS, determining the recipients of the FTS (local agencies and/or individuals), providing education and technical assistance as requested/needed, and providing quarterly reports regarding the number of FTS distributed. WCDPHE anticipates ordering 2,500 FTS initially to distribute pursuant to requests from local law enforcement agencies and the University of Northern Colorado, who have specifically requested most of the test strips. CLARIFICATION: There has been some discussion about the potentially perceived roles and responsibilities of the Weld Region 3 Opioid Settlement Council and Weld County's participation in it. We would like to clarify that the purpose of the Opioid Settlement Council is for the decision -making and development of a funding distribution plan and ultimate distribution of opioids settlement funding as it becomes available. It is not the role of the Regional Council to collectively develop or implement opioid abatement policies or strategies. Options for the board: Approval of this collaboration with CDPHE will allow WCDPHE to assist local agencies and at -risk individuals in Weld County to increase access to no -cost overdose prevention tools, specifically FTS. According to CDPHE's Drug Overdose Dashboard, we lost 1,881 Coloradans to fatal overdose in 2021— at least 912 of those deaths due to fentanyl. Since 2001, half of all fatal overdoses in Weld County involved opioids. Declining this initiative in Weld County may result in reduced access to this important overdose prevention tool for community partners and at -risk individuals in Weld County. However, the health department could refer agencies to other LPHAs who do decide to participate in this state initiative, effectively making it available regionally, if not locally. Recommendation to the board: Health staff is neither recommending approval or rejection, simply seeking guidance from our Board regarding this collaboration with CDPHE for the FTS distribution initiative. Time Limit For Acceptance Of Deliverables. a. Evaluation Period. The State shall have forty-five (45) calendar days from the date a deliverable is delivered to the State by the Contractor to evaluate that deliverable, except for those deliverables that have a different time negotiated by the State and the Contractor. b. Notice of Defect. If the State believes in good faith that a deliverable fails to meet the design specifications for that particular deliverable, or is otherwise deficient, then the State shall notify the Contractor of the failure or deficiencies, in writing, within forty-five (45) calendar days of: 1) the date the deliverable is delivered to the State by the Contractor if the State is aware of the failure or deficiency at the time of delivery; or 2) the date the State becomes aware of the failure or deficiency. The above time frame shall apply to all deliverables except for those deliverables that have a different time negotiated by the State and the Contractor in writing pursuant to the State's fiscal rules. c. Time to Correct Defect. Upon receipt of timely written notice of an objection to a completed deliverable, the Contractor shall have a reasonable period of time, not to exceed thirty (30) calendar days, to correct the noted deficiencies. 2. Health Insurance Portability and Accountability Act (HIPAA) Business Associate Determination. The State has determined that this Contract does not constitute a Business Associate relationship under HIPAA. 3. Entity Name: Weld County Department of Public Health and Environment (WCDPHE) Project Description: This project serves to increase the availability of overdose prevention tools, specifically synthetic opiate detection tools, across the state of Colorado as part of a fentanyl education and prevention campaign. According to CDPHE's Drug Overdose Dashboard, we lost 1,881 Coloradans to fatal overdose - at least 912 of those deaths due to fentanyl. Colorado is seeing more fatal overdoses due to fentanyl than ever before with annual increases since 2018. Fatal overdose is preventable. These test strips will help save the lives of people who use drugs across the state because if fentanyl is detected, then people can use that information to make informed decisions about their drug use. This project is funded by HB22- 1326 Fentanyl Accountability And Prevention Act through appropriation for non -laboratory synthetic opiate detection tests pursuant to section 25-1.5-115.3 (1), C.R.S.. CDPHE has defined eligibility as any local public health department in the state of Colorado. Definitions: 1. CDC — Centers for Disease Control and Prevention 2. Work Plan Goal #1: Provide high -quality HIV, STI, and VH prevention services to increase the priority population's access to testing, education, and treatment, and reduce the acquisition of HIV/STINH throughout Colorado in order to disrupt health inequities. Objective #1: No later than the expiration date of the Contract, improve access to overdose prevention tools for the priority population in the service area. Primary Activity #1 The Contractor shall distribute fentanyl test strips to the priority population within the service area. Sub -Activities #1 1. The Contractor shall distribute fentanyl tests strips to the following: a. Agencies that serve people at risk of an opiate overdose. b. Individuals at risk of an opiate overdose. 2. The Contractor shall monitor documents and website content for updates and comply with all updates. 2. CDPHE will provide fentanyl test strips at no cost to the Contractor. a. Contractor shall place an order using the Fentanyl Test Strip Order Form. The Contractor shall submit a quarterly progress report utilizing the CDPHE REDCap quarterly survey form via email to CDPHE. No later than 30 calendar days following the last day of each quarter. V Monitoring: CDPHE's monitoring of this Contract for compliance with performance requirements will be conducted throughcut the Contract period by the CDPHE Contract Monitor. Methods used will include a review of documentation determined by CDPHE to be reflective of performance to include progress reports and other fiscal and programmatic documentation as applicable. A Final Contractor Performance Evaluation will be conducted at the end of the life of the Contract. VI. Resolution of Non -Compliance: The Contractor will be notified in writing within 15 calendar days of discovery of a compliance issue. Within 30 calendar days of discovery, the Contractor and the State will collaborate, when appropriate, to determine the action(s) necessary to rectify the compliance issue and determine when the action(s) must be completed. The action(s) and time line for completion will be documented in writing and agreed to by both parties. If extenuating circumstances arise that requires an extension to the time line, the Contractor shall email a request to the CDPHE Contract Monitor and receive approval for a new due date. The State will oversee the completion/implementation of the action(s) to ensure time lines are met and the issue(s) is resolved. If the Contractor demonstrates inaction or disregard for the agreed upon compliance resolution plan, the State may exercise its rights under the provisions of this Contract.
