That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That the owner, contractor or operator, prior to opening any pit, shall submit location of pit, owner's name, and description of pit operation to the Weld County Engineer, and shall submit complete unit development plans for each gravel pit operation for approval by the Weld County Planning Commission and such unit development plan shall be filed in the office of the Weld County Clerk and Recorder. 3. That petitioner shall proceed with due diligence to effect con- struction of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 4. That the operation and development of each gravel pit excava- tion and rehabilitation shall be in accordance with the rules and regulations for the operation of gravel pits as adopted by Weld County, Colorado. 5. Mrs. Lee read letter from City Planning Commission recommending Westridge 5th not be approved for following reasons: (1 ) Greeley Comprehensive Plan indicates that a greenbelt of undetermined width should be provided along the draw which runs generally north and south through the property; (2) Question as to the suitability of soils in this area for residential development has been raised. The developer should submit a soils study to insure that no problems will exist in the future; (3) Since there is a possibility of a gigher water table in this area, surface drainage and sub-surface drainage becomes a critical question. The Planning Director had been informed that there is possibly an alter- native proposed by the developer for sub-surface drainage of this area. Would like to have copies of engineering information on the sub-surface drainage for review before a final decision is made; (4) Traffic circu- lation within the Westridge 5th Subdivision appears to be extremely un- desirable. One point is that a cud-de-sac comes off the major arterial in the area. The length of the cul-de-sac is such that one would not be able to determine the dead end. - More desirable to have this street tie in as an access street for Westridge 5th. In addition, the half street on the north side of the subdivision could possibly cause some serious problems to the residents of the street if the street is not fully de- veloped prior to occupancy of the dwelling units; (5) The Greeley Water and Sewer Department has indicated there is a sufficient number of taps available to serve nine lots within the subdivision. No guarantee the de- veloper will have sufficient taps to develop all 19 lots. Mr. Sears has talked with the City Planning Commission and hopefully will be on their next agenda. Some misunderstandings regarding the water. In compliance with regulations, grading should be performed in a manner which will not cause erosion into the adjacent irrigation ditch. Need clarification on whether or not the ditch is inside property line or not. Mr. Straub read letter from Mr. Kelly, Engineer, stating the previous County Engineer did not need any further information. Also, that the ditch company was responsible for the upkeep and maintenance of their ditch, that is why adequate easement has been provided. Seems there might be some misunderstanding regarding erosion. Mr. Straub is requesting details on how they are going to handle the drain- age. Would insist that adequat drainage swales be provided. Mr. Rothe inspected this area and stated that the Greeley-Loveland Ditch was not involved with this. Felt that the individual ditch should be con- tacted. Mr. Whitwer stated that the City of Greeley had the maintenance obligations of that particular ditch. It is the one that furnishes water to the Highland Hills golf course lake. There are five owners of the ditch at the present time. Need to get easement settled. Mr. Paul stated that he wanted more details regarding how the perc tests were run. Property owned by Milton Nelson in the southwest portion of Weld County. Mr. Nelson will retain the residual land. Existing land use is mostly grazing and crop land. Generally a flat wide flood plain. Flood plain in this area has not been defined yet. Will probably be about 200 feet back from the Boulder Creek. About 700 acres in the parcel owned by Mr. Nelson; 300 acres on the west side of the creek. Proposing to mine about 135 acres of the 300. Water principally will be served by the Godding, Plumb and Daily Ditch which forms the West boundary of Mr. Nelson's property. Will be a dry pit operation. Will trench the area to be mined; then will cut into the shale and let the water seep into that trench and be carried around to a low point and then pump it downstream. Will move in a I portable crushing and screening plant only for short period of time each l; time they go in to crush up gravel . Three stages to take about 10 years time total . Access to the operation will be by County Road #16z. Most 11i! of the gravel will be moved out to Mineral Road. Reclamation will be done as they go. After each stage, will plant about 50 cottonwoods. Have an augmentation plan, but was not sure where to submit it. District 6 Water User's has approved it. Mr. Dikke, representing water users of District 6, would recommend adequate space be left between lakes. The drainage by-passes the Rural Ditch dam. Will return the flow back into the Creek above the Rural Ditch. Planning Commission staff recommends this be tabled for following reasons: 1' (1 ) State Engineer does not recommend approval ; (2) County Attorney re- quires better legal , and suggests metes and bounds; (3) County Engineer needs detail of entrance onto County Road 161/2; (4) We further recommend that time be allowed for the State Engineer to evaluate the augmentation )11 plans submitted. State Engineer's Office called the Planning Office today ii and indicated to Mrs. Lee that they would approve the augmentation plans. Mr. Nelson also submitted a letter stating that Flatiron would record / restrictive covenants to run with the title to the land which states the present and future owners of said premises to maintain ponds and such / structures required by reclamation plan. Mrs. Lee stated that the biggest reason for tabling was the State Engineer's comments. Mr. Straub would like to know if they have one or two entrances proposed. Also, these lakes are located close to the road, would like a letter stating this will not cause a seep problem or damage to the road (161/2). Mr. Hanna said they would get this letter(from a professional engineer) . Mr. Fortner wanted to know about the bridge (load limit) they would cross. Weld County Planning staff recom- mends this for denial for the following reasons: (1 ) The proposed de- velopment is not in conformance with the Weld County Comprehensive Plan. The plan states, "Commercial development in the unincorporated area of Weld County has not been extensive thus far. However, all of this de- velopment has occurred along the major highways, I-25, U.S. 34 and U.S. 85. This trend should not be allowed to continue, for such commercial develop- ment works against the primary purpose of transportation arteries, the rapid and safe movement of large volumes of traffic. Land along major arterials cannot be used for commercial use without disrupting the con- trolled access which is such an essential aspect of the proper functioning of arterials. . . . The motivation to lure traffic from high speed, controlled access roads conflicts with the very purpose of these roads." "Commercial development should be restricted to the incorporated areas of municipalities unless necessary to provide absolutely essential highway services. Gasoline stations, restaurants, motels and other auto oriented services should be located with care at areas where problems of access and traffic conflict can be minimized. Location of commercial use out- side of existing municipalities will encourage dispersed growth and will be of little aid to the economic well-being of the municipalities. The public has a right to control development along these major transportation routes, for it is the investment of public treasure in these roads which makes them attractive for commercial use. Commercial land use in the County should be limited primarily to those agri-business functions that cannot be located in a municipality. . ." (also given were policies which would guide commercial development in Weld County). (2) Some of the per- mitted uses under the proposed development standards are not even vaguely related to essential highway services; (3) The Weld County Zoning Reso- lution requires that Planned Unit Developments shall be located on at least 5 acres of land. The Variance approved by the Weld County Board of Adjustment was not sufficient for a PUD. Existing parcel with one half acre variance which was granted totals only 4.557 acres; (4) Proposed sewage disposal system has not been approved by the Health Dept. ; (5) Area proposed for development appears to be in the flood plain areas of Boulder and Idaho Creek. No evidence has been submitted indicating area is not in flood plain; (6) Based on maps prepared by the Colorado Geological Survey, the proposed area for development is underlain by high grade sand and gravel deposits. Refer to the Colorado Open Mining Land Reclamation Act; (7) Also need consideration of the following: (a) Com- ments by County Engineer; (b) Comments by State Division of Highways; (c) Letter by Mrs. Albert Rademacher, owner of adjacent property; and (d) Answers submitted by applicant in response to the question posed to petitioners requesting change of zoning in Weld County, Colorado. Mr. Fortner read letter from State Dept. of Highways: It states briefly, they would like consideration given to developing a frontage road as the trend seems to be towards the development of a commercial strip along this section of State Highway 119. Also, any changes in the location or size of the approach as shown on the plan be reviewed by their Maintenance Superintendent. Further, that provisions would have to be made for re- location of the sewage lagoon for accommodation of a frontage road. 1050 Mr. Fortner also read letter from Mrs. Rademache1 , surrounding property owner, stating her objections to the zone change. She stated that when the property was sold, she was under the impression that it would be used for a residence, but now finds it is to be used commercially. There are already two liquor establishments in the area. Gates to her property have been left open and cattle have gotten out; also, has had damage to some heavy equipment located on her farm. Mr. Straub stated they failed to show sufficient drainage plans. This can be handled on the final plat. Mrs. Lee stated this was the plat and it would have to be settled before going before the County Commissioners. Mr. Freese stated that the comments made by the State Highway Dept. are a surprise as they were not mentioned at the Utility Board meeting. They (the Moore's) do have an access. Mr. Freese stated that the building per- mit shows it was taken out for a commercial building in a commercial area. Mr. Freese read letter from Ft. St. Vrain Agency that handled the land. At the time of the sale, Mr. Moore checked the zoning on the property and further, Mr. Rademacher had expressed no objections to what was planned for said parcel . Mr. Smith stated that a member of the Planning staff told the Moore's this was zoned commercial . Mr. Fortner stated that there had been an administrative error in the issuance of the building permit in 1972. The building permit was issued for a move-in carpenter shop. The building that is there now is not a move-in but a new structure. It has always been the Moore's intention to build a bar and restaurant. They informed the Rademacher's of this when they bought the land. Walls are up and the roof is just about ready to go on. Building to be 52' x 44' . Mr. Freese stated that the Board of Adjustment's intent was to grant them a variance in order to permit them to go for the PUD. Mr. Fortner agreed, it was simply a misunderstanding with the way the Board of Adjustment's motion read. Some question as to the flood plain. Also, regarding extraction of gravel along Colorado 119, Mr. Freese contacted the gentle- man at the Geological Survey, and he said yes, the gravel was very good, but they would probably write that it would be uneconomical on such a small parcel . He further stated that the chances of creating a frontage road along there at this time are pretty slim. Mr. Freese felt these comments should have been brought up at the Utility Board meeting. There is already 200' of right-of-way for the expressway. MOTION: By Mr. Heitman, To take this matter under advisement. Seconded by Mr. Rothe. A vote of "Aye" by Watson, Nix, Heitman and Rothe. Motion carried. SUBJECT: Irving Ferrell , Jr. Tape 544 DISCUSSION: Mr. Kavalec, Zoning Inspector, stated that there had been several calls regarding the moving in of manure to this property. (Located on east 16th Street, legal description is Pt Di SW4 Sec 9, Township 5 North, Range 65 West of the 6th P.M. ) It is industrial zoned and the storage of manure is not allowed. Read letter sent to Mr. Watson, Chairman, re- garding this violation. Violation letter sent June 10, 1974. The Ferrell 's would like an extension until next spring to remove the manure. Mr. McKee, Chief Building Inspector, stated that the building permits were for sheds (2), which were to be brought up to UBC standards. These have not had any inspections as of yet. There is a mobile home permit for this property. Mr. Paul stated they had issued the septic tank permit. Had inspected an area across the road; has talked with several property owners surrounding this and would recommend this pile be removed as soon as possible. Mr. Harold Wigget stated that the Ferrell 's had a big hole for a landfill right behind his fence. There is still a burned out trailer on the property. Several pieces of what looks like junk farm machinery also on property. 1051 Mr. Earl Steel J..zed his objections were mainly ___it this pile was unsightly, smelly and gave the surrounding area a bad representation. He felt that in a year's time, the damage would already be done. Would like the Planning Commission to recommend removal . Mr. Hellewell explained the process of law regarding legal action. In this case, the Planning Commission would recommend to the Board of County Commissioners who in turn decide whether or not to spend the money to prosecute. It could take several months to get any definite decision. If he has moved in more manure since appearing before the Planning. Commission, could possibly stop that. Mr. Don Hungenberg stated his objections. Could not understand why it took so long to clear this up. Mr. Ferrell is in violation of the reso- lution. However, no injunction has been issued as of this date. The Planning Commission can only recommend to the Board of County Commission- ers. Is very detrimental to the area. All the members have seen the problem. Tape 545 It was recommended that these same people appear at the County Commission- ers meeting tomorrow and bring it up as new business. MOTION: By Mr. Nix, To recommend to the Board of County Commissioners that a "Cease and Desist" Order be issued to this operation; and second, that it be removed as quickly as possible; if necessary, that the County take the necessary legal steps to remove it. SUBJECT: Mobile Home Permits Tape 545 DISCUSSION: Mr. Adams stated they had prepared a new form letter to go out with all mobile home renewals. First, would be to find out what the present use is; and secondly, if they are on ad valorum tax. Some confusion as to why they have to pay the renewal fee if they are on the ad valorum tax. Mr. Hellewell stated that as far as the form goes, no action was necessary. Those that are on a permanent foundation should not have to pay the fee every year. Those that are there for temporary reasons, that we know will have to be moved eventually (farm labor, etc. ) should pay the fee. The one's that have been told to put them on permanent foundations by the Board of Adjustment and then put on Ad Valorum tax, are pretty permanent. Referring to the enclosed sketch map, Bridges®and®were a concern of the County engineer. He and I visited the site in August and inspected the bridges with a structural engineer I retained. In a letter dated August 13, 1974 I agreed to investigate the capacity of the bridges and participate with the County in repairing or upgrading one or the other bridge if feasible. We found subsequently that BridgeOl across Boulder Creek could not economically be repaired. At the County Commissioners hearing in September we proposed that Bridge Ol would not be used, but that all our gravel traffic would go out to the West to County Line Road over Bridge® (Plumb & Dailey Ditch) which would be repaired or replaced on a participation basis with the County. Also at that hearing some residents of houses along Road #16-1/2 between Bridge O2 and County Line Road spoke to the potentially bad dust conditions along that road when gravel operations were underway. The Commissioners' decision was to table the request until some arrangement could be worked out concerning a participation by Flatiron with the County in improvement and maintenance of the road over which our trucks would be traveling. • • October 23, 1974 Weld County Commissioners Page Two Subsequently the County Engineer proposed a participation in the paving of that road without requirement for Flatiron participation in the repair of Bridge® . Since a sizable dollar value for asphalt was involved, we began to study the feasibility of the route. Since most of our traffic would go south from Road #16-1/2 on County Line Road, it would cross Bridge®on Boulder Creek. An investigation showed this bridge to be of inadequate capacity to carry our trucks, and couldn't be feasibly repaired (this is a Boulder County Bridge) . This made the entire western route infeasible. Earlier this month I met again with the County Engineer at the Nelson site to propose another route . This would involve crossing Boulder Creek and Idaho Creek on Mr. Nelson's property with a private road in line with County Road #3 as shown on the sketch map. The Crossing()of Boulder Creek would be by means of a ford or culvert at low water and a conveyor would substitute for vehicular crossings in times of high water. A small bridge or culvert would be installed on Idaho Creek. Mr. Straub and I inspected Road #3 from Road #16-1/2 to Highway 52 . He expressed two concerns: inadequate fill over a large corrugated metal pipe-arch culvert (®); and the width of a steel girder corruform deck bridge over Lower Boulder Ditch (Bridge O) . He felt that the grade over the culvert should be raised to conform with manufacturers specifications for minimum height of cover (1/10 of span or 12" minimum) . He also felt that Bridge should be widened to 30' from its present 21' width. Regrading to provide adequate cover for the culvert is no particular problem and is relatively inexpensive. Widening the bridge, however, is a costly proposition. Consi lering the local nature of Road #3 and its traffic, the volume and speed of this traffic and the limited potential of the area for growth in the foreseeable future, a 21' wide bridge seems adequate. The statistical probability of two semi-trailer gravel trucks passing each other at that particular bridge is remote. "One-way Bridge" signs could be erected in anticipation of such simultaneous crossings. If the County is adamant in its wish to widen this bridge, Flatiron will participate in the cost to the following extent: The percentage of the maximum number of tons per year to be hauled from the Nelson Development to the maximum number of tons per year to be hauled from all sources across that bridge should be calculated. Other gravel operators using that route should be required to pay their share of the costs . 1 n+ . Flatiro as engaged Mr. Sal Archuleta of Johnson-Voiland-Archuleta Inc. to make a preliminary investigation of the Boulder Creek bridge to determine whether or not the bridge, in its present state, can be used or feasibly repaired for use. If the latter is indicated, further investigation and possibly a load test will be done to accurately assess the extent of repairs required. Flatiron would then participate with the County in the repair of this bridge in a manner satisfactory to both parties, if the repairs are within the economics of the operation. If it becomes apparent that the Boulder Creek bridge is not safe and cannot be made so economically we will investigate the replacement of the small bridge to the west of the access point with a culvert of suitable design. This alternative, if used, would be under a participation agreement with the County. Thank you for your concern in this matter. The present direction of groundwater flow in the flood- plain of Boulder Creek is from west to east flowing into the creek. This elevation is estimated to be 4909 ft. for Lake No. 3 . With a water surface elevation of 4909 ft. drawdowns along the southern portion of the lake may be expected to range from 1 to 3 ft. at the lake boundary. Less than 1 ft. of drawdown is expected at the southeastern corner of the lake and the drawdown of 3 ft. is expected at the southwestern corner of the lake. The maximum drawdown generated by the existence of the lake will be recorded at the lake edge. Drawdowns will decrease at distances away from the lake and will negligible within 300 to 500 ft. from the lake. With Lake No. 3 located 50 to 100 ft. away from County Road No. 162, water table draw- downs beneath the road will be considerably less than the 1 to 3 ft. Box 758 Greeley, Colorado 80631 Dear Mr. Straub: Thank you for the opportunity to comment on the proposed gravel operation near Boulder County referred to as Platte Gravel and Flatiron. The location shown on your map would indicate that the proposed haul road would be East County Line (Co. Rd. #901) . The only concern we have is the load limit on both the bridges, the 14-ton one on Boulder Creek and the 14-ton one on St. Vrain Creek. Neither of these structures is capable of withstanding repeated loadings associated with a gravel mining operation. I would request that if the Weld County Commissioners approve these requests they stipulate either a haul route other than East County Line or significant reworking of the bridges to allow for these anticipated loadings. For information only - we have instructed the Colorado State Patrol to enforce the weight limits set on County line bridges - which they are doing. A second problem - can you give me any information on the dump referred to in the attached letter? It appears to be being used rather freely without proper supervision or inspection. Thank you. This area is on a small upland remnant east of Keota. Although the deposit is primarily a sand con- taining significant fines, it is the only useable deposit in the vicinity. It serves as an important source of material to the Highway Department for maintenance and repair of roads. (2) State Highway Department, Section 30, T3, R66. This area is mapped as a T3 deposit which is located east of the South Platte River, S of Platteville. Sand has been mined in pits not far to the north of the project tract. Thickness is greater than 11 feet but total thickness is not known. The total thickness of the valley fill varies from 44 to 53 feet. The Highway Department can economically utilize this small tract as a source of aggregate for road repair and main- tenance. We see no particular problems from our standpoint. (3) Flatiron Paving, Section 20, 29, & 30, T2, R68. Three proposed excava- tion areas lie within an area mapped as F 1 located on Boulder Creek. There--- is 6 to 13 feet of gravel with 2 to 5 feet of overburden. based on the Flatiron's drilled holes. A gravel pit lies between 2 proposed excavation areas. Recla- mation is to be carried on simultaneously with mining. It appears that the i,' reclamation plan is a good one. NELSON AND HELEN C. NELSON, here- inafter termed the "Owners, " and THE WATER USERS ASSOCIATION OF DISTRICT NO. 6 , a Colorado nonprofit corporation, hereinafter termed the "Water Users" ; WITNESSETH: WHEREAS, the mining company has purchased from the Owners certain sand and gravel in place described on a map attached hereto, marked "Exhibit A, " in Sections 20 , 29 and 30 , Township 2 North, of Range 68 West of the 6th P.M. , in Weld County, Colorado, and has applied for a special use permit from Weld County and the State of Colorado; and The mining company is principally responsible for completion of mining and reclamation plans submitted to Weld County, such plans consisting of a letter from Leonard Rice Consulting Water Engineers , dated June 24 , 1974 , and such other documents, maps and plans as have been filed with and approved by Weld County; and The Owners are required to furnish augmentation water to compensate water users in Water Division No . 1 for anticipated evaporation losses and changes in increased water usage in the area covered by Exhibit A as a result of the mining and reclamation; and • The Division of Water Resources of the Department of Natural Resources of the State of Colorado has approved the plan of augmentation herein described, subject to the approval of the Water Users; and WHEREAS , the Water Users have objected to the mining, reclamation and augmentation plans unless additional conditions are met and the mining company and the Owners are agreeable to these additional conditions ; NOW, THEREFORE, it is mutually agreed as follows : 1. The mining company agrees as follows : a. To conduct the mining operation in accordance with the requirements set forth in the mining plan and the regulations of Weld County and the State of Colo- rado; b. To restore the premises to the condition set forth in said reclamation plan and the regulations of Weld County and the State of Colorado; c. To construct the ponds contemplated by the plans in a good and workmanlike manner, and in such a manner that the same will have outlet structures as shown on the reclamation plan; d. To cause surface and subsurface drainage to drain naturally into Boulder Creek, as has been histor- ically done, except as the same may be altered as shown on the mining plan and reclamation plan. 2 . The mining company and Owners further agree as follows: a. As long as they, their heirs, successors and assigns , own or have an interest in the property des- cribed on Exhibit A, they will maintain the restored structures shown on the mining and reclamation map, including ponds , channels and outlet structures in a good and working order and will do nothing to said structures which would adversely affect the interests of the members of the Water Users ; b. They will not claim, as a result of mining and restoration of the property, that any water has been salvaged or developed; any water to be used in the mining operation and restoration process will be considered tributary water to Boulder Creek and be subject to the appropriation system and the other existing laws of the State of Colorado; however, as -2- a result of the surrender of water referred to in paragraph 3 below, the mining company will be per- mitted to take water from the mining excavations for use in the crushing and washing of sand and gravel to be mined, and the mixing of ready-mixed concrete, during the term of the mining operation as set forth in the mining plan. 3. The Owners further agree as follows : a. They and their heirs, successors and assigns will allow all water attributable to four shares of the capital stock of The Godding, Dailey and Plumb Ditch Company, a Colorado corporation, to not be diverted through its headgate and to remain a part of the water of Boulder Creek; or, if diverted, shall not be used and shall flow back into Boulder Creek, either directly or into the ponds and without loss, into Boulder Creek; b. Upon completion of the reclamation plan, the land heretofore irrigated by, and water heretofore attribut- able to such shares, shall no longer be irrigated or used by such shares except as herein provided; c. The ditch stock certificate for said four shares shall be endorsed as follows, to-wit: "These shares and the usage of water attributable thereto are restricted by an agreement dated a 4r 7 , 1974, entered into between Milton H. Nelson, Helen C. Nelson, et al. , and The Water Users Association of District No. 6 , a Colorado nonprofit corporation, and are subject to the terms of that agreement. Said agreement is recorded in the office of the Clerk and Recorder of Weld County and affects land in Sections 20 , 29 and 30, Township 2 North, of Range 68 West" ; d. They will continue to pay ditch assessments applicable to said shares. 4 . Agreement to run with the land. This agreement shall be a covenant which runs with the land described on the attached map marked "Exhibit A" and shall continue in effect and be binding on the parties, their heirs, successors and assigns unless and until the Water Users or a majority of its voting membership or successors shall waive the terms thereof. 5. Enforcement. This agreement may be enforceable by the Water Users, or by any of its members who are adversely affected by any violation of any term hereof by seeking any -3- .. • i appropriate equitable and legal remedies, including injunctive relief, specific performance and damages . In the event such enforcement is necessary, whichever of the mining company and Owners (and their heirs , successors and assigns) who are found to have violated the agreement, agree to pay for any reasonable attorneys ' fees , engineers ' fees and costs expended in obtain- ing the enforcement of the provisions violated. However, if an action for such enforcement is brought and the mining company or the Owners (or their heirs , successors or assigns) prevail, then the claimant seeking such enforcement shall pay any reason- able attorneys ' fees , engineers ' fees and costs expended in de- fending the claims on which the claimant fails to prevail. 6 . Objections to permit. In consideration of the cove- nants herein contained, the Water Users and its members hereby withdraw their objections to granting the special use permit and consents that the same may be issued at the discretion of Weld County and the Division of Mines of the Department of Natural Resources of the State of Colorado; and the Water Users and its members agree that none of them will claim or assert that the carrying out of the mining plan and reclamation plan, and use of water in the crushing and washing of sand and gravel and preparation of ready-mixed concrete as above set forth has an adverse effect on the water rights or any member of the Water Users . The purpose of this letter is to outline a Plan of Augmenta- tion to insure Boulder Creek water users are adequately protected from injury by the operation. Mr. Nelson' s land is in Sections 20, 29 and 30, Township 2N, Range 68W of Weld County, Colorado. It is adjacent to Boulder Creek in Water District No. 6 , Division 1. The water evaluation is based on available data of precip- itation in Boulder and evaporation recorded at Fort Collins , discussions with Mr. Nelson, a site visit of the property irrigated by the ditch, and a review of data on file at the State Engineer's office. The gravel mining operation is discussed in separate docu- mentation provided by the Flatiron Sand & Gravel Company. Briefly, it envisions a three-stage development in which three areas will be mined for gravel. The first area consists of approximately 51 acres of which a pond of approximately 38 . 5 acres will be formed from the resulting mining operation. The second mining area is 49 acres , of which a pond of 32. 2 acres will be formed. A possible third site is located still further south and will be approximately 35 acres , with a resulting pond of 21. 6 acres. Due to the phased development of the mining plan, the water-related aspects have also been phased to conform with the gravel operation. The process of mining gravel from the area will result in open bodies of water which were not in existence prior to the mining operation. The basic goal of this Plan of Augmentation is to ensure that the historic pattern of operation is not changed due to the mining operation. This is accomplished by balancing the before and after water use. Portions of the total property area will be used for agricultural purposes after gravel mining is completed. Water required to protect the stream system will be separately diverted from the Godding, Plumb and Daily Ditch, conveyed through the lakes in a wastewater system and returned to Boulder Creek. The Godding, Daily and Plumb Ditch is an incorporated ditch with a total of 40 shares equally dividing the 30 . 438 cfs decreed to the ditch. It is assumed that Mr. Nelson ' s share represents 11/40 of the total water in the ditch, irregardless of which decree is delivering water. The ditch has a strong history of diversion and consumptive use. The table below' summarizes the average diversions and the average length of the delivery season from 1964 to 1973 . Also included in the table is the year 1954 which is considered a critical year for this water district. The 10 year average from 1964 to 1973 reveals that the ditch delivered water for an average of 124 days, averaged 8. 2 cfs, and delivered an average of 2020 AF each year. Mr. Nelson' s share of the average delivery is 2 .25 cfs and 555. 5 AF annually. The table also shows that the ditch was able to deliver a greater volume of water during the 1954 dry year than under average year conditions, which indicates a very senior water right. The sources of irrigation include both surface application from the Godding, Daily and Plumb Ditch as well as groundwater from the alluvium of Boulder Creek. Mr. Nelson has an efficient irrigation system and a factor of 70% was assumed to determine the amount of surface irrigation water consumed by the area. Return flow from other areas is not a major factor due to physical con- ditions of the area. Table 1 summarizes the historic water use on the property. Water Requirements After Reclamation The process of mining gravel , as mentioned previously, will form three ponds of varying water surface area. A major portion of the land outside the mining area is expected to retain its present land use character and will be irrigated as it has historically. To compensate for the additional water loss caused by open lake evaporation over irrigated pasture, a proportionate number of shares from the Godding, Daily and Plumb Ditch will be attached to each lake formed by the mining operation. The number of shares to be attached was determined by computing the average and critical year consumptive yield of one share used on Mr. Nelson' s property and providing the number of - 4 - Mr. Robert Brand June 24 , 1974 shares necessary to compensate for the evaporation loss from the open water . The average and critical consumptive yield respectively are 35. 4 and 41. 0 acre-feet per share. Table 2 summarizes the future condition water use. Summary This analysis of historic and future water use has shown that water users of Boulder Creek can be protected from injury by attaching shares in a ditch with a proven history of diversion to the open water lake surface formed by the gravel mining operation. Both average and critical year conditions have been investigated. The District 6 Water Users ' Association requires that the critical ycar be the determining factor for protection of the stream. Accordingly, the number of shares for the critical year condition shown in Table 2 should be attached to each lake when and if it is formed. Please call us if you have any questions or comments. I am Ken Dickey. I have appeared before this Commission recently in similar circumstances, and I appreciate this opportunity to come before you again to present certain comments and recommendations in behalf of the Water Users Association of District 6. This Water Users Association is already on record as not being opposed to the general idea of gravel mining, but as being very much concerned that such operations are done in a manner as to provide maximum practicable protection to the rights of others insofar as life and property and insofar as water and land use are concerned. Also please understand that these comments are not mine alone, but were developed in joint communication with, and are shared in by, members of the District 6 Water Users, some of whom are here today. A review of the drawings which reportedly were submitted with the application indicates that three separate areas of excavation are proposed. None of these intercept the stream channel and no change in the present stream channel is proposed. These plans show reasonably good separation of the lakes from each other and from the stream channel except possibly a reach along the northeast point of the 49 acre area labeled, "Staging II." We recommend that either the area boundary of the excavation be relocated or that special protection be provided at any point where the excavation is within 200 feet of the stream's normal high-water line. This normal high-water line is the shore line which is reached or exceeded during high flow periods for a majority of the years on record. An augmentation plan has been developed for replacing waters lost through evaporation, etc. This plan appears to be adequate to protect against reductions in stream flows and should be a condition to your approval of the application. We note that there is an existing lake located between proposed Staging II and Staging III areas. This existing lake has very gentle sloping shorelines that appear to be regularly and well maintained. It has a gated outlet with covered pipe discharge to the main stream channel, and it also has provision for overflow into a small canal to the stream. These features permit substantial control of the lake level which with proper operation and maintenance, affords a high degree of protection against adversely affecting ground water levels or changes in underground water flows. Provisions for similarly controlling the levels of the proposed lakes appears to be included and should be considered as a condition to your approval of this application. The proposed landscaping with trees, islands, etc. , will provide some benefits in reducing erosion from wave action and apparently are also intended for making these lakes more suitable for recreational use. The recreational plans are not fully defined and the question of who willhave continuing responsibility, not only for the recreational operation, but also and particularly for the maintenance of shorelines, control works, etc. , in the future, is a matter that should be of concern to this commission. In summary, there are four items that we recommend this commission consider in its determination and action on this application. 1. The need to either maintain adequate separation from stream channel or to provide special protection. 2. The need for adequate augmentation for replacement of water losses. 3. The need for suitable features of each lake. 4. The need for definition of responsibility for future maintenance and operation. Thank you. 'P. It was certainly helpful to me to be able to discuss your concerns with you and I feel that I understand your position on several points which were raised. First, the Flatiron plans show the northernmost lake draining into a natural Thalweg (a former meander of Boulder Creek) which rejoins the creek downstream of the Rural Ditch headgate• This was designed in order to allow that drainage a small amount of flow to maintain present vegetation. This is not critical, however, as some return flow will use this drainage downstream of the project regardless . Therefore the principal outlet of this lake will be located such that overflows will be routed to the Creek above the Rural Ditch as you requested. - On Sheet #4 of the special use documents, note #2 states that "All lake overflows will be reinforced with riprap to prevent erosion. " Your concern expressed at our meeting, as to the permanency of the creek channel in present location and the possibility of permanent rechanrielization -though the mined area, is valid although the likelihood of reehannelization is remote. The point. where a lake is designed to overflow into_the next a e orrte the stream is a critical point. If properly armored at the outlet, the lake_can withstand flooding_and remain with stable banks.
