HomeMy WebLinkAbout730540.tiff RESOLUTION WHEREAS, a public hearing was held on April 9, 1973, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Continental Pipeline Company, c/o Roy Coleman, 3151 Nation Way, Cheyenne, Wyoming, requesting approval of site for the construction of an oil storage facility on the following described property, to-wit: A tract of land out of the NW 4 of Section 20, Township 2 North, Range 66 West of the 6th P. M. , described as follows: Beginning at a point for the Northeast corner of a 1, 247 Acre Tract, said point lying East- erly along Section line 992 feet and Southerly 30 feet from the Northwest corner of Section 20, Township 2 North, Range 66 West of the 6th P. M. , Weld County, Colorado; thence Westerly parallel to Section line 222 feet; thence Southerly parallel to U. P. R. R. 300 feet; thence Easterly parallel to Section line 140 feet; thence Northeasterly 311 feet to the point of beginning, and WHEREAS, the petitioner was present and represented by Roy Coleman, right-of-way agent, Robert Johnson, environmentalist, and Mack Curtis, district engineer; said petitioner was also represented by Thomas Richardson, counsel, and WHEREAS, there was no opposition to the request of petitioner for the location of said oil storage facility, and WHEREAS, the said requested location for said oil storage facility is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County, said location for said oil storage facility may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Continental Pipeline Company, c/o Roy Coleman, 3151 Nation Way, Cheyenne, Wyoming, to locate an oil storage facility on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. PL0752 730540 2. That such oil storage facility shall be limited to the item or items as shown on plan as submitted. 3. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolu- tions of Weld County, Colorado. APPLICANT : Jerry Bigbee CASE NUMBER : S-109 tape 56 SUBJECT : Preliminary plat of JB Estates LOCATION S1/2 SW4 Sec 33 T6 R66 APPEARANCE : Jerry Bigbee DISCUSSION : Mr. Lorenson presented the plats showing the general planning concept. Easements are shown as 20 ' utility ease- ments along the lot lines . There is a low area which is in- tended to be turned into a lake , from that point is a 40 ' drainage easement going - - - - down towards the Greeley #3 ditch . Mr. Bigbee stated the lake is already in . The plat notes all easements are for utilities and drainage and all 20 ' unless noted otherwise . Mr. Bigbee stated a portion of it is already subdivided and has utilities to it . They will have to bring in additional water service . Mr. Ewing asked if they have a letter from the ditch company that they will accept the drainage . Mr. Bigbee stated the way it is designed , they will not give any more water than backflow. Mr. Ewing asked if there will be a 50 ' ROW on the lots adjacent to the County Roads . Mr. Bigbee stated the ROW will be dedicated but they would like to set the fences out until such time as the County needs it . Mr. Lorenson presented the preliminary utility com- posite . Mr . Lorenson stated they had not received any comments from the City regarding the drainage into the No . 3 ditch . Mr. Bigbee stated there is another pond which they intend to enlarge for another catch-all pond for run-off. Mr . Lorenson stated this should be shown on the drainage exhibit . Mr . Bigbee stated the major grading will be done before the installation of any add- itional utilities . There was a discussion regarding the water lines . WCUCB - 101 MOTION : By Mr. Fouts to accept the Utility Plat . Second by Mr. Anderson . Question : Mr. Lorenson stated as long as there was a question regarding the grading of easements . Mr. Fouts reworded his motion to accept the Utility Plat subject to the grading of the easements according to the Subdivision Regula- tions . Second by Mr. Anderson . A unanimous vote of "Aye" . The facilities will soon be completed . There _is not a road on the north of the property which is a section line . Mr. Curtis explained how - the facilities will be used . This will be a 5000 gal . tank . Mr. Ewing stated this has been ap- proved by the Planning Commission subject to review by the Utility Board. Mr. Ewing stated their set-backs meet the re- quirements . MOTION : By Mr. Mauldin to accept the plans for the facility. Sec- on by Mr. Fouts . A unanimous vote of "aye" . Motion carried . APPLICANT : Continental Pipeline Company CASE NUMBER: SUP #188 tape 56 SUBJECT : Oil storage facilities LOCATION : NW4 Sec 29 T2 R66 APPEARANCE : Roy Coleman and Malcom Curtis DISCUSSION : Mr. Curtis presented the plan for the oil storage facility at this site . The question was asked if they planned further expansion of the facility . Mr . Curtis stated it would depend on the oil fields , but it is possible in the future . MOTION : By Mr . Fouts to accept the plans for the facility . Second by Mr. Farmer. A unanimous vote of "Aye" . Motion carried . LICANT : Union Rural Electric Association SUBJECT : Del Camino Transmission Substation LOCATION : SW4 Sec 25 T3 R68 APPEARANCE FOR : John Wolker and Ron Mettler of Miner & Miner APPEARANCE AGAINST : Dr . Belchner DISCUSSION : Mr. Farmer retired from the Board during the discussion of this item. Mr. Wolker stated it will be a low profile sub- station . Power will be coming in from the west and termina- ting at the site . All services come under ground . A scale model was presented showing how the facilities will look . There will be chain link fence surrounding the facility. Mr. Mettler stated it is mainly a transmission support station to beef up the existing transmission system of Union REA. Mr. Mettler explained the operation of the system. They have code requirements that have to be met . Stated the need is critical . There was discussion regarding the need for an Environmental Impact Study and the requirements to be met . Mr. Mettler stated they do not fall under that . They have made provisions to add another bay in the future . MOTION : By Mr . Mauldin to accept the facility for the Union REA substation . Dr . Belchner asked if he could present his side 102 . at this time . Dr . Belchner read a letter requesting an impact statement before this facility is approved . He was representing a group of petitioners living in the area who are opposed to Tri -State Transmission and Union REA , stating the transmission lines are objectionable . Mr . Farmer stated this area is for the substation only , not for Tri -State Transmission line ROW which had previously been approved . Mr . Fouts asked if a study had been made as far as the need for this facility and is not a regulation of REA that prior requirements are that they serve the public which supercedes any pollution rules there are. Dr. Belchner stated it had been suggested that this line put along Highway 66 . Mr . Ewing stated on Highway 66 it would involve an interchange also there are regulations regarding set-back to allow for expan- sion of highways . Mr. Anderson stated he thought probably and Environmental Impact Statement will be required before any transmission lines can be approved in the future . Ad- vised Dr . Betchner his only alternative would be to file in District Court as this Board had no right to turn down a facility of this nature . Mr. Fouts seconded Mr. Mauldin ' s motion to accept the substation . A unanimous vote of "Aye" . Motion carried . SUBJECT : Weld County Thoroughfare Plan DISCUSSION : Mr . Lorenson presented the proposed Thoroughfare Plan . They are asking that these right-of-ways be protected , not necessarily that the roads be constructed . Road and highway standards are shown on the map . Mr . Lorenson pointed out proposed freeway systems , expressway systems , interchange points etc . There was discussion regarding the proposed by- pass at Windsor. MOTION : By Mr. Anderson that the Weld County Utility Board recog- nize and adopt the Weld County Thoroughfare Plan as presented . Second by Mr. Mauldin . A unanimous vote of "Aye" . Motion carried . SUBJECT : Utility Installation Agreement DISCUSSION : Mr. Mauldin asked that the Utility Agreement be on the next regular agenda . DISCUSSION : Mr. Lorenson asked if surveys were available , as the County Attorney will not approve the legal descriptions until these are received . Mr. Lorenson presented information re- garding the application . The construction has been done prior to the application for a Special Use Permit , possibly due to incorrect information supplied by the Planning office. The company was notified to cease construction until the Special Use Permit is granted . The turn-off on the west side of site violates the County Commissioners Resolution requiring turn- . off .being 100 ' off of a section line . The control building on the north section line is judged to be a set-back violation. Construction began without a building permit. Mr. Coleman stated he had checked with the Planning office approximately last August to inquire what was necessary to install the oil storage facilities . They were later notified by the zoning inspector that building permits were necessary. Later a letter was received from Mr. Lorenson stating the building permits were issued in error and to cease construction . Mr. Ewing commented on the Resolution requiring turn-offs being 100 ' off of section line . Stated he had visited the sites and judged them not to be in violation of the turn-off, also they are not in violation of the required set-back . At the present time there is not a section line road on the north of the property. Mr. Ewing stated they are under regulations of the Department of Transpor- tation . 853 Mr. Lore )r fated he would recommit a kind of treed buffering around the perimeter of the site . Mr. Coleman stated he didn ' t think the Dept . of Transportation would approve the trees because of the fire hazard in the fall . Mr . Lorenson stated the application has not been approved by the Utility Board as yet . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners . Motion by Mr. Heitman . After further discussion , it was agreed the buffering would not be required but the site must be kept in a neat condition . Second by Mr. Elliott . Coleman , Malcolm Curtis DISCUSSION } Mr. Lorenson stated other than a non-conforming building that was built a number of years ago , everything meets the re- quirements and is recommended for approval subject to a tall perimeter planted screen . It agrees with the development policy , the tank has been constructed and is compatible with surround- ing uses . Mr . Coleman stated they would not object to the tall planted screen if it could be approved by the Dept. of Trans- portation . There was further discussion regarding screening . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners . Motion by Mr. Rothe and not to require a planted screen . Second by Mr . Heitman . A vote of "Aye" by Clark , Elliott , Heitman , Nix , Rothe and Watson . Both Resolutions were subject to surveys being submitted and approv- by the County Attorney for advertising and approval by the Utility Board . APPLICANT : Mountain Bell CASE NUMBER : SUP #186 tape 471 SUBJECT : Microwave repeater station LOCATION : SW4 SW4 Sec 8 T9 R63 APPEARANCE : Silvan Charron DISCUSSION : Mr . Lorenson recommended the approval of the applica- tion , it agrees with the Land Use Policy , the surrounding land use is not affected by the proposed use , the site is needed for communication for the National Atmospheric Research and to pro- vide relief for an exhausted toll line (Greeley-Briggsdale- Grover) . If approved it should be subject to approval by the U . S . Forest Service & Federal Aviation Agency and construction to begin within one year of approval by the Board of County Commissioners, Mr . Charron stated it is automatic procedure to obtain approval of F . F .A . regarding height restrictions . They agreed with National Forest they would not construct any roads . It will be checked periodically for maintenance only. RESOLUTION : Be it therefore resolved to recommend approval to the 854 • Board of County Commissioners subject to the suggested require- ments . Motion by Mr . Nix , second by Mr. Clark . A vote of "Aye" by Clark , Elliott , Heitman , Nix , Rothe and Watson . Motion carried . APPLICANT : Tidwell , Williams , Callison CASE NUMBER : S-108 tape 471 SUBJECT : Preliminary plat of TWC Subdivision LOCATION : SW4 Sec 32 T1 R65 APPEARANCE : Mr. Callison , Mr . Tidwell , Mr . Williams , Mr . Barton , Eng . DISCUSSION : Mr. Lorenson stated the applicants did make application around the first of the year for a subdivision . When the owner- ship was checked , it was found the ownership had been conveyed essentially into the lots as shown by the individuals . Mr . Lor- enson read the following comments : Lots 1 , 2 & 3 have already been conveyed during Jan . 73 after the application had been sub- mitted , prior to recording as the Subdivision Regulations and State law requires . The Utility Board recommends approval subject to changing the easement to meet the subdivision regulations and receiving confirmation from the Burlington Extension Ditch Co . , that the proposed easement is sufficient to maintain the ditch . Subdivision is objected to by Geo . Barnum. Adams County has no objections . Percolation tests have been approved by the Weld County Health Department for septic systems . The Hudson Fire Protection DistricI has no objection to the subdivision of three lots . There isAthe rwater is available from Wesley Runyon Dril - ling Co . Mr . Callison stated they do have well permits for the property. The property was purchased before Senate Bill #35 was passed which was over 35 acres . Mr. Lorenson read a letter from George Barnum who is opposing the subdivision . There was discussion regarding these types of developments , and the viol - ation involved . MOTION : By Mr . Lorenson stated he did not make a recommendation be- cause there appears to be some violations . The following inform- ation was supplied : Two parcels sold under recorded contract were not included in the subdivision . Section line road #14 is not constructed and would have to be built to get to this sub- division . The Utility Board approved the plat subject to in- creasing the easement to 20 ' between Lots 1 & 2 . Percolation test has been approved by the Health Dept. Only one well permit has been approved by the State , not necessarily located with-in the proposed subdivided parcel . State Engineer has requested more information be supplied . No public gas , water or sewer is present . The site is adjacent to a turkey operation . Soils were approved by the Platte Valley Soil Conservation District . Mr. Quinby stated the wells are in , he had permits for 5 wells , 2 well permits were submitted for these two lots . MOTION : By Mr. Clark to take the matter under advisement. Second by Mr. Rothe. Motion carried . • APPLICANT: Weld County Planning Commission CASE NUMBER: Z-211 tape 471 SUBJECT: Rezone property zoned conditionally - "C" to "A" LOCATION : Eh SEC4 Sec 10 T2 R68 DISCUSSION : Mr. Lorenson explained the property is located south of Del Camino. This property was zoned Commercial conditionally for 18 months . Property Was to have been developed during this time which zoning occurred several years ago . He would like a recommendation from the Planning Commission to- proceed with re- zoning the property back to Agriculture . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners to remove the conditional zoning and rezone the property in question "A" , subject to the legal des- cription being approved by the County Attorney. Motion by Mr. Nix, second by Mr. Elliott. A vote of "Aye" by Clark , Elliott , Heitman , Nix , Rothe and Watson . Motion carried. SUBJECT : Amend Zoning Resolution FILE NUMBER: A-8 PRESENTATION : Jim Ohi DISCUSSION : Mr. Lorenson stated the Planning staff has a proposal to amend the Zoning Resolution which will eliminate subdivisions in the "A" zone. A change of zone would be required for any sub- division . This proposal is in line with the feelings of the Agricultural Council . Jim Ohi presented the proposed amendment of Section 3. 3 which would delete (1 ) and add several changes . Mr. Nix aske Mr. Connell for a legal opinion regarding the pro- posed changes . Mr. Connell stated there were several paragraphs he would like to recheck before a resolution is recommended to ___ the County Commissioners . ___�_ ___ ___.___ _____ RESOLUTION : _ - Be it therefore recommended for approval to the Board of County Commissioners to amend the Zoning Resolution , Section 3 . 3 subject to clarification of the definition of single- family farm dwellings and subject to review of paragraph 16 of the proposal to be sure that the wording is proper. County Attorney Present Mr. Watson called the meeting to order. SUBJECT : TWC Subdivision con ' t . tape 472 DISCUSSION : Their violation of Senate Bill #35 was discussed . MOTION : By Mr. Heitman to recommend denial of the preliminary plat of TWC Subdivision until the violation of the deeded tracts is corrected. Seconded by Mr. Clark . A vote of "Aye" by Clark , Elliott , Nix , Heitman , Rothe and Watson . Motion carried . SUBJECT : Policy on violations DISCUSSION : Mr. Lorenson discussed a policy on violations , whether they should be processed until the violations are removed . MOTION : By Mr . Nix to give a written policy that violations will not not be processed through any hearing . The Planning Commission will not act on any violation until it has been corrected .
