RESOLUTION
WHEREAS, a public hearing was held on June 28, 1971 at
2:00 P. M. in the chambers of the Board of County Commissioners
of Weld County, Colorado, for the purpose of hearing a petition of
' : Robert Foster and Herbert L. Schott, Route 1, Box 159, Windsor,
Colorado, requesting change of zone from "A" Agricultural District
to "H-UD" Residential T-?nit Development, in accordance with official
development plat and plan, copy attached, to be recorded in the
office of the Weld County Clerk and Recorder, and
WHEREAS, the petitioners were present and represented by
counsel, Thomas Richardson, and
WHEREAS, there was some opposition to the change of zone,
and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied
the request of the petitioners and studied the recommendations of the
Weld County Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners, that the petition of Robert Foster and Herbert
L. Schott, for a change of zone from "A" Agricultural District to
"H-UD" Residential Unit Development, said area being more particularly
described as follows:
A tract of land located in the Southwest Quarter (SW4)
of Section Twenty-nine (29), Township Seven (7) North,
Range Sixty-seven (67) West of the 6th P. M. , Weld
County, Colorado, and being more particularly
described as follows:
Beginning at the Southwest Corner (SW Cor) of said
Section 29, and considering the West line of said Section
29 to bear North 00° 00' 00" East and with all other
bearings contained herein to be relative thereto: Thence
North 00° 00' 00" East, along the West line of Section
29, 2450 feet more or less; Thence North 90° 00' 00"
East, 270 feet; Thence South 00° 00' 00" East, 422
feet; thence along the arc of a circular curve to the
left having a radius of 300 feet and a chord that bears
South 12° 30' 00" East, 129. 9 feet; Thence South 25°
00' 00" East, 585 feet; Thence along the arc of a
circular curve to the left having a radius of 150 feet
and a chord that bears South 43° 00' 00" 88. 2 feet;
Thence South 61° 00' 00" East, 140 feet to the center
line of an existing ditch; Thence along said existing
ditch by the following two courses and distances: South
30° 00' 00" West, 580 feet; South 15° 00' 00" West,
170 feet; thence South 37° 00' 00" East, 640 feet;
Thence South 00° 00' 00" East, 50 feet to the South
line of the Southwest Quarter (SW-1) of said Section 29;
Thence West, along said South line of the Southwest

less, to the point of beginning. Said tract of land
contains 26. 6 acres and is subject to any Rights-
of-Way or other easements as granted or reserved
by instruments of record or as now existing on said
tract of land, containing 26. 6 acres, more or less,
all as shown on official development plat and plan, hereinabove
mentioned, copy of which is attached hereto and made a part hereof
by reference, be, and it hereby is granted under the conditions
following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the Zoning
Resolution of Weld County, Colorado.

withdraw from consideration on a permanent basis that
portion of the Northwest Quarter of the Northwest Quarter

Range Sixty seven (S7) lying above the Lake Lee Lateral
Company 's cement ditch , consisting of approximately 2-5
acres and known as the "Northwest Acres Preliminary Plat",
It is understood -that this agreement to withdraw

Dear Sirs:
North Weld County Water District has agreed to deliver
three or four water taps to enable Northwest Estates to begin construction.
North Weld County Water District has agreed to deliver
water to the balance of Northwest Estates, however hydrolic engineering
will be required in the area of the Roth Subdivision and the Northwest
Estates Subdivision; also there is a possibility that some cost sharing
contracts will nend to be negoiated betwaen th-e owners of the afore- said
Subdivisions and Lhe North Weld County Water District.
North Weld County Water District has adequate water and
filtering facilities to serve the Roth Subdivision and the Northwest
Estates Subdivision.

Your application for approval of location for septic tank systems to
be located in Northwest Estates Subdivision , Weld County, Colorado,
has been recommended for approval for all lots having single family
dwellings. The application is returned to the Weld County Health
Department for action on single family dwelling unit sites.
Action on lots to have three- and ?our-plexes will be deferred until
I receive individual applications for each lot. Please include with

rado Water Conservancy District Water and transfer the same to the DISTRICT for

1. 5/8" meter Sap $250.00 jar single family residence.
2. 5/8" meter tap $250.-00 per duplex unit.
3. 3/4" meter tap $350.00 per triplex emit.
4. 3/4" meter tap $350.00 per fourplex unit.
5. Meter taps larger than a 3/4" shall be negotiated between DISTRICT
and 708TtR aNDscHOTT TAMS or their grantees.

B. FOSTER AND ST & C shall furnish a tank site approximately 100 feet

DISTRICT.
3.Othar Water
No party receiving water fres the DISTRICTS system in the ZOSSTIS AND SCHOTT
TARNS Subdivisions -shall malts or permit any cross connections to any other eater
supply. In the event eta emergency, residents of FOSTER AND SCHOTT DUMB Sub-
divisions nay connect er cross oonneot to other lines so long as each connections
are provided with a bank trap to prevent well eater from entering into the
DISTRICT'S system.
4.Term of Contrant
The term of this contact shall be for five (5) years beginning
day of A.D. 1971 and thereafter this contract shall be automatically
renewed from year to year without either party taking any further action to renew
the same. Any matter which either FOSTER AND SCHOTT TARNS Subdivisions or grantees
and DISTRICT have to negotiate shall be determined by either party giving written
notice to the other party presenting the ;,alter and requesting a joint meeting of
the two parties.
5. ,$evarability
If any one or-sore aeotion, clause, -sentence, or -pert of this _agreement
shall for any reason be _questioned in any court, and be adjudged unconstitutional br
invalid, such judgement shall not affect, impair or invalidate the remaining provis-
ions thereof, but shall -be confined in_its operation to the specific provisions
so -held unconstitutional or invalid and the inapplicability or invalidity n any
section, clause nr- provision of-this agreement in any one or more _instances shall
not be taken to affect or prejudice in any way its applicability or validity in any
other instance.
AIMIDMINGS
This contract shall not be assigned by -FOSTER AN1) SCHOTT BARKS -or their
grantees without the express written consent of the DISTRICT. This contract shall
be binding upon the parties and their assigns.

of the people who own it and
we have no business making any
judgment about it."
The board agreed. We'd Coun-
ty Commissioners won't be noti-
fied of their conclusions, not of-
ficially, anyway.
