Box 758 Greeley, CO 80631 970-400.4225 - -2 3 020,12-3373 SPECIFICATIONS AND/OR SCOPE OF WORK AND PROPOSED PRICING: WELD COUNTY NEWSPAPER SERVICE JANUARY 1, 2023, THROUGH DECEMBER 31, 2023 1. Pursuant to the advertisement calling for bids for "Advertisement of the County Newspaper", this contract will be good for one year only with dates set by Weld County: 2. All bidders shall certify their newspapers' compliance with the requirements of Sections 24-70-101 through 24-70-108, C.R.S., specifically, but not limited to: a. Section 27-4-101(4), C.R.S., states: "Published" means a newspaper maintains an office in the county to gather news, sell advertising, or conduct the general business of newspaper publications." b. Section 24-7-102, C.R.S., states: "Every newspaper printed and published daily, or daily except Sundays and legal holidays, or on each of any five (5) days in every week excepting legal holidays and including or excluding Sundays shall be considered and held to be a daily newspaper; every newspaper printed and published at regular intervals three (3) times each week shall be considered and held to be a triweekly newspaper; every newspaper printed and published at regular intervals twice (2X) each week shall be considered and held to be a semiweekly newspaper; and every newspaper printed and published at regular intervals once (1X) each week shall be considered and held to be a weekly newspaper. No publication, no matter how frequently published, shall be considered a legal publication unless it has been admitted to the United States mails with periodicals mailing privileges." To maintain that status, each bidder shall submit evidence of a P.S. Form 3526 (Statement of Ownership, Management and Circulation) filed with its postmaster on or before October 1st of each year. c. Section 24-70-103, C.R.S., states, "The newspaper, if published tri-weekly, semiweekly, or weekly, shall have been so published in such county, except as provided in this section, continuously and uninterruptedly during the period of at least fifty-two (52) consecutive weeks next Prior to the first issue thereof containing any such notice or advertisement: and the newspaper, if publisheddaily, shall have been so published in such county, uninterruptedly and continuously, during the period of at least six (6) months next prior to the first issue thereof containing any such notice or advertisement". The mere change in the name of any newspaper or the removal of the principal business office or seat of publication of any newspaper from one place to another in the same county shall not break or affect the continuity in the publication of any such newspaper if the same is in fact continuously and uninterruptedly printed or published within such county. d. Section 24-7-103(5), states, "When any legal notice is required by law to be published in any newspaper, the newspaper publishing the notice shall, at no additional cost to the person or entity placing the notice, place the notice on a statewide website established and maintained by an organization representing a majority of Colorado newspapers as a repository for the notices." The successful bidder shall be a member of the Colorado Press Association (CPA) and registered to place legal notices on the statewide website established and maintained by the CPA known as "Public Notice Colorado" which is found at the following website: httos flwww iiubliicnoticecolorado.com. e. All other advertising not specifically mentioned in the above shall be furnished at lowest market prices and shall not exceed prices quoted above, with the understanding that prices for publication and advertising not specifically mentioned in this bid will be determined by getting bids on these items from local firms as the need arises. The Board of Weld County Commissioners reserves the right to reject any or all bids, to waive any informality in bids, and to accept the bid that, in the opinion of the Board, is to the best interest of the Board and of the County of Weld, State of Colorado. The Board of Weld County Commissioners shall give preference to resident Weld County bidders in all cases where the bids are competitive in price and quality. A satisfactory bond, subject to the approval of the Board of County Commissioners, max be required of the firm obtaining the contract for said advertising. 4. Weld County will provide the notice to be published in Microsoft Word or Microsoft Excel format ONLY. Transfer to successful bidder shall be by E-mail, with confirmation of receipt sent to appropriate department by return E-mail within two hours. Publisher shatsld eliminate spacing where they can to ensure lower advertisement costs for Weld County. 5. It is vitally important that notices are published accurately and on time. It is the responsibility of the successful bidder to assure all items have been received and respond to E -mailed notices within two (2) working hours. Failure to publish a notice at the proper time, provide affidavits with newspaper clippings as proof of publication on a weekly basis as described in Section 24-7-105, C.R.S., or respond to E -mailed notices within two (2) working hours will be treated as a breach of contract. 6. The firm awarded the contract for said advertising shall furnish the County Commissioners and various departments with a copy of each publication thereof (number of copies to be determined at time of award) and shall also furnish affidavits with newspaper clippings as proof of publications as described in Section ?4-7-105. C,R.S., to the appropriate department on a weekly basis during the life of this contract. Billing may be done weekly or monthly. 7. ALL NOTICES WILL BE PUBLISHED IN NONPAREIL, SIX -POINT TYPE. If the successful bidder wishes to publish in a width other than given below for each type of notice, approval MUST BE GIVEN by the Weld County Clerk to the Board prior to publication. As a result, we ask bidders to price three sample notice publications, and then the cost of those sample notices is calculated to acquire an estimated annual cost based upon the average number of notices to be published in the next year. For 2023, The Greeley Tribune is the sole bidder and no change to the rates is proposed.
