Esther, Houstan, and I discussed this. It is my understanding an email came in to CTB that the
Foster Provider was no longer providing services. CTB noted this email in the Tyler document
of event. However, it was later discovered that foster services had continued, and DHS and
Provider kept fulfilling duties under the Foster Provider Contract. In my opinion, under
contract law, that this inadvertent mistake technically did not cancel the Provider Contract
because both Parties to the contract kept fulfilling the terms and conditions in the contract.
In order to correct the record, CTB can add another note/email in Tyler that the previous
note/email was in error and the contract remained active. The old email/note cannot be
deleted as it remains public record, but the follow-up explanation note/email into Tyler with
the Provider Contract serves to correct this issue.
Since you are now seeking a Kinship Provider Contract, I assume the previous Provider
Contract's term date has been reached or will soon be reached, and thus that contract fulfilled
and completed. Now you would just route the new Kinship Provider Contract through as
usual.

Good morning CTB,
We have an Individual Provider Contract that was cancelled in July 2023 (Tyler #'s 2023-2305, 2023-1720
& 2022-3219). Contract Management received the notification of cancellation from Child Welfare and
communicated it to CTB. Child Welfare is under the impression that they asked to close the Foster
Contract but wanted to leave open the Kinship Foster Care Contract. After doing a little digging, I could
only find contracts for Foster Care and Respite Care since 2016 for this provider. I cannot find that this
provider ever had a Kinship contract in place, and they don't have a contract in place since the current
contract was cancelled in July. We are trying to figure out what our options are. Can we rescind the
cancellation of the current contract?
This provider was on the January recertification list and has signed a new contract which has a start date
of 1/29/2024. This was routed through CMS as a Consent item which is when Houstan discovered that
this provider's contract was cancelled.
