HomeMy WebLinkAbout710584.tiff • t BEFORE THE WELD COUNTY PLANNING COMMISSION RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS Moved by Marshall Anderson that the following resolution be introduced for passage by the Weld County Planning Commission : Be it therefore Resolved by the Weld County Planning Commissior that the following be adopted by the Board of County Commissioners : Amend Section III paragraph three : Uses permitted in the "A" Agricultural zone . See attached regulations . To be recommended favorably to the Board of County Commissioners for the following reasons : The "A" zone be representative of an agricultural district and therefore no residential subdivisions be allowed within the district without rezoning . To better contro those intents of agricultural uses and to prevent indiscriminate scattered growth throughout the county . They are located within 190' of one residence and approximately 400 ' from another residence. Recommended disapproval, primarily because of the distance from the adjacent residences. Mr. Collins presented his proposed kennel operation. SUBJECT: Population DISCUSSION: Mr, Lorenson presented some population projections which have been submitted to the Lnvironmcr:etvl Protection Agency. There hasn't been a lot of study on this. The projections were a combination of what other people have projected and what the 'past growth has been between 1960 and 1.970. This has been divided up into the rural population and the urban population. SUBJECT: Zone Districts DISCUSSION: Mr. Lorenson presented a list of the proposed zone districts, the acreage, and some el' the u.r(:u that would be persuitted in each, Those policies will hopefully Aake the dovelopucnt occur around the towns. It • was agreed to invite several. members of the Board of Realtors to the next work session on zoning regulations. Lorenson discussed the scheduling of hearings and procedure between the Planning Commission and the County Com- missioners . A proposed zoning application flow sheet has been submitted to the County Commissioners . The flow sheet has been approved by the County Commissioners . These items will have to be followed before a zoning request is placed on the agenda . Mr . Lorenson presented a procedural guide and a new zone app- lication form . A procedural guide will be given to the applicant to be returned 21 days before the hearing date . MOTION : By Mr . SUBJECT : Building Inspections LOCATION : Town of Platteville APPEARANCE : Robert Sterkel and Ken Malone DISCUSSION : Mr . Sterkel explained the Town of Platteville would like t U adopt the Uniform Building Code in the near future . The town can not afford a building inspector and would like to work out an agreement with the County to do their inspections in the incorp- orated area . They have adopted a zoning ordinance which states they shall have a building inspector . Mr . Sterkel indicated they would also like some help in adopting some Subdivision Regulation Mr . Connell stated the County building inspectors do not have the authority to enforce the City ordinances of Platteville . Mr . Lorenson asked if a violation occurs , if the inspectors could re- port the violation to the city for enforcement . Mr . Connell stated he would research the possibility , Mr . Lorenson asked if • Mr . Connell could have a model contract drawn by the next meeting for the incorporated towns who wish to have this service . SUBJECT : National Association of Counties Research Foundation DISCUSSION : Mr . Lorenson reported this association is having a meet= ing and members are invited . This will be Region 8 on Compre- hensive Health Planning Institute . Meeting will be held at the Colorado Blvd . Holiday Inn in Denver on April 15th and 16th . Rea the items to be discussed . The Health Department of Weld and Lar imer. Counties and the Planning Department of Larimer County is interested in hiring a Health Planning Coordinator . He would be coordinating a lot of the functions of the Health Department with the Planning Department on a regional basis . They will be re- _ questing from our budget one-fourth of the cost of this man . • SUBJECT : Agricultural Zone DISCUSSION : Mr . There was discussion regal-, ing how many mobile homes should be allowed on a farm . It was suggested the Planning Commission , County Attorneys consult with some of the judges and get their reaction to proposed mobile home restrictions . There was discussion regarding the powers of the Board of Adjustment . Mr . Telep agreed to render an opinion re- ' garding the Board of Adjustment making a decision regarding land use . There was discussion regarding the requirements for a San- itary Land Fill , whether they should be in the zoning regulations or the Health Department regulations . Meeting adjourned . Nix introduced Larry Simpson who is the Planning coordinator with the Northern Colorado Conservancy District . Mr. Simpson stated .he planned to work with Larimer , Boulder and Weld County . Mr . Lorenson stated that after consulting the legal department there should be something in the regulations to protect situations where they have "rock concerts " out in the country . They have net with the Highway Department , and the attornies to have some legislation regarding this problem. Mr• . Primarily it will deal with crowds of people • • • over 200 to 500 . It will require a permit and a bond related to the number of people that will participate . It requires a p •esentation to the planning department and approval of health plans , parking areas , the number of people that will arrive on buses , the number of tickets that will be sold , the number of hours it will be in progress . It excludes such places as arenas , stadiums and things of this nature so long as they are being used for the general purpose it has been established for . They will have to provide so many security officers to be in th internal area , the licensing of those guards . The bond will go for the cleaning up of the area . • They will have to• carry suf- ficient property damage insurance to protect surrounding farms . Feed lots , dug kennels and some special uses would also be excluded . There was discussion regarding dairies . It was felt the number of head is minimal and they are under stric regulations of the Health Department . They are listed under Conditional Uses in the proposed "A" zone . Lorenson stated he has recommended a maximum of 20 lots averaging 21/2 acres each and development in tract "A" be restricted and a letter from the Ogilvy Ditch Company in - dicating any easement requirements to the lake . A letter from the Soil Conservation Service was read , indicating there could be problems with septic tanks during the irrigating seasor Mr . Lorenson had suggested the developers develop some kind of of underground drainage system to drain the water table to a lower level . They have indicated that if this is a requirement , they will proceed with this plan . The application for approval of septic tank systems has been approved by Glen Paul . Mr . Ewir stated the realignment of the road proposed by the developers would eliminate a traffic problem that now exists . Mr . Lorensor stated if the preliminary plat is approved , the drainage study would be made before the final plat is approved . The City of Greeley has indicated they would not be able to serve this area with water or sewer in the near future . MOTION : By Mr . Watson to approve the preliminary plat subject to the approval of the drainage study on the final plat . Second by Mr . Weigand . A vote of "Aye " by Watson , Weigand , Bowles and Heitman . "Nay" by Anderson . Motion carried . SUBJECT : Amendment to "A" zone regarding gas installations DISCUSSION : Mr . Ewing presented his proposed amendment regarding gas installations along the County Right-of-Way . Stated the key word in the amendment is "production " . The set-back requirement would be 300 feet from any R/W and 330 feet from any section lin One advantage would be safety . The Highway Dept . stated it woul be an advantage them in in aquiring right-of-way . Mr . Ewing stated they would like to eliminate the loading and unloading of trucks on the highway . Mr . Robert Houtchens , representing the Greeley Gas Company , recommended that the companies supplying ga should be expressly eliminated . Setting the lines back 300 feet would create quite a hardship . Walker Miller , representing the Panhandle Western Gas Company , stated they are willing to work out reasonable regulations . Felt the proposed set-back would be a hardship on the companies , also the land owners . Mr . Bowles stated no structure , according to the present regulations , is allowed less than 50 feet from the right-of-way . Asked if the 50 feet set-back would be agreeable . Mr . Bart Giles of Amico Corporation stated they have been drilling in Weld County during the past year . They felt 300 feet is a little extreme . If these proposed set-backs become a regulation , they felt there should b some exceptions , especially where they would interfer with sprinklers . Mr . Bowles stated he thought some of the metering stations in the past have been set too close to the road , causin( traffic problems . Mr . Ray Fouts with the Greeley Gas Company , stated they are more concerned with farm taps . SUBJECT : Work Program `--� DISCUSSION : Mr . Lorenson stated that the funds for the Work Program for the remainder of this year are taken care of . In kind ser- vices will be matched by federal funds . Any governmental agency that wants a workable program has to adopt all of the national codes as far as enforcing housing , one of them is a housing code . A housing code sets the minimum standard of dwellings people should live in . This is different from the building code . The development of guide lines and policy statements for the Regional plan are necessary . The State Planning Office wants to provide money for rural regional planning commissions , the was presented showing signatures o / 4 o ; the 5 property owners and 4 of the 5 directors involved , will allow the drainage to flow through the lateral . A preliminary sub-soil report has been prepared by NHP&Q . Mr . Fred Ehrlich stated he is one of the directors of the Lakely Ditch Company and stated he did not sign the document giving approval of the drainage through the lateral . He gets all of the trash in his portion of the ditch and objects to the agreement . Stated the ditch is too small with out adding more drainage . Ray Ehrlich stated he lives on the property and concurred with his father ' s objections . Mr . This regulation would take care of the loading and unloading of hydrocarbons withi the County right-of-way and the location of condensation and storage tanks . It is mutually acceptable at this time . SUBJECT : Subdivisions DISCUSSION : Mr . Paul proposed that when a subdivision is approved where sewer is not available at the time , that it be included in the plat that developers agree that when water and sewer become available that it would be connected within one year . Lorenson presented proposed regulations for the Rural -Residential zone which would be a transitional zone from the farming to the urban uses . Minimum lot size would be a minimum of 2; acres . Lorenson stated the State Planning Office is asking the planning directors from the rural planning areas to aid them in setting up a program on how the State Planning Office should function with other agencies . Temporary Assemblages a . Intent 1 . It is the purpose of the Weld County Zonin Resolution to regulate the assemblage of large numbers of people , in excess of thos' normally needing the health , sanitary , fire police , transportation and utility service regularly provided in this County , in orde that the health , safety and welfare of all persons in the County , residents and visit' alike , may be protected . 2 . It is the intent of this resolution that a sections and provisions of this resolution have an independent existence , and , should any section or provision be declared inval or unconstitutional by a court of competen jurisdiction , it is the intent of this Wel ( County body that any section or provision declared shall be severable from and shall not affect the validity of the remainder o. the resolution . b . License required 1 . No person shall permit , maintain , promote , conduct , advertise , act as entrepreneur , undertake , organize , manage , or sell or gi \ tickets to an actual or reasonably anticipz ed assembly of 500 or more people which cor tinues or can reasonably be expected to cor tinue for 2 or more consecutive hours , 4 whether on public or private property , unless a license to hold the assembly has first been issued by the Weld County Plan- ning Office , application for which must be made at least 30 days in advance of the assembly . Assembly means a company of persons gathered together at any location at any single time for any purpose . 3 . A separate license shall be required for each day and each location in which 500 or more people assemble or can reasonably be anticipated to assemble ; the fee for each license shall be $100 . 00 . 4 . A license shall permit the assembly of onl. the maximum number of people stated in the license . The licensee shall not sell tick to nor permit to assemble at the licensed location more than the maximum permissible number of people . 5 . The license shall not permit the sound of the assembly to carry unreasonably beyond the enclosed boundaries of the location of the assembly . 6 . This legislation shall not apply to any regularly established , permanent place of worship , stadium , athletic field , arena , auditorium , coliseum , or other similar permanently established place of assembly for assemblies , provided said places are being used for the established and normal use , which do not exceed by more than 250 people the maximum seating capacity of the structure where the assembly is held . 7 . This legislation shall not apply to govern ment sponsored affairs held on regularly established fairgrounds nor to assemblies required to be licensed by other laws and regulations of Weld County. C . Conditions for issuing license - before he may be issued a license the applicant shall first: 1 . Determine the maximum number of people whi will be assembled or admitted to the locat of the assembly , provided that the maximurr number shall not exceed the maximum number which can reasonably assemble at the locat of the assembly in consideration of the na ure of the assembly and provided that , whe the assembly is to continue overnight , the maximum number shall not be more than is allowed to sleep within the boundaries of the location of the assembly by the zoning or health ordinances of the County. 5 • � • � 2 . Provide proof that he will furnish at his own expense before the assembly commences : (a7 A fence completely enclosing the pro- posed location , of sufficient height and strength to prevent people in exc of the maximum permissible number frc gaining access to the assembly ground which shall have at least four gates , least one at or near four opposite points of the compass . (c ) Separate enclosed toilets for males a females , meeting all state and local specificiations , conveniently located throughout the grounds , sufficient tc provide facilities for a maximum numb of people to be assembled at the rate of at least one toilet for every 100 females and at least one toilet for every 100 males together with an effi cient , sanitary means of disposing of waste matter deposited , which is in c pliance with all state and local laws and regulations ; a lavatory with run- ning water under pressure and a conti uous supply of soap and paper towels shall be provided with each toilet . (d ) A sanitary method of disposing of sol waste , in compliance with state and lo laws and regulations , sufficient to dispose of the solid waste production of the maximum number of people to be assembled at the rate of at least 2 . 5 lbs . of solid waste per person per da together with a plan for holding and plan for collecting all such waste at least once each day of the assembly a sufficient trash cans with tight fitt lids and personnel to perform the tas and for cleaning the premises and im- mediate surrounding properties within 48 hours after an event. (e) Physicians and nurses licensed to pra ice in Colorado sufficient to provide the average medical care enjoyed by r idents of Colorado for the maximum nu ber of people to be assembled at the rate of at least one physician for ev 1 ,000 people and at least one nurse f every 1 , 500 people , together with an closed covered structure where treat- ment may be rendered , containing sep- arately enclosed treatment rooms for each physician , and at least one emer gency ambulance available for use at times . Food service facilities , in- cluding mandatory dispensing of liqui in single service cups , shall be pro- vided to serve reasonably anticipated requirements and shall meet applicabl state and local physical and operatic al requirements . 6 ( f) If the assembly is to continue during hours of darkness , illumination sufficient to lig. the entire area of the assembly at the rate of at least five foot candles , but not to shine or reflect unreasonably beyond the boundaries of the enclosed location of the assembly. (g ) A free parking area inside of the assembly grounds sufficient to provide parking space for the maximum number of people to be asse bled at the rate of at least one parking space for every four persons ;with parking area provided at a rate of no more than 100 passenger cars or 80 busses per usable acre ( h ) Telephones connected to outside lines suffi cient to provide service for the maximum number of people to be assembled at the rat of at least one separate line and receiver for each 1 ,000 persons . (i ) If the assembly is to continue overnight , camping facilities in compliance with all state and local requirements as set forth i the ordinances of this County , sufficient t provide camping accomodations for the maxim number of people to be assembled . (j ) Security guards , either regularly employed , duly sworn , off duty peace officers or private guards , licensed in Colorado suffic ient to provide adequate security for the m mum number of people to be assembled at the rate of at least one security guard for eve 750 people , permitted for internal security only. ( k) Fire protection , including alarms extingui ing devices and fire lanes and escapes , suf ficient to meet all state and local standar for the location of the assembly as set for in the laws of the State of Colorado and re solutions of Weld County and sufficient eme gency personnel to efficiently operate the quired equipment. ( 1 ) All reasonably necessary precautions to in- sure that the sound of the assembly will no carry unreasonably beyond the enclosed boun aries of the location of the assembly . Amp lifying equipment shall control the noise level at the perimeter of the site to no mo .than to decibels on the A scale of a sound level meter which meets the specifications the American National Standards Institute . (m) A bond , filed with the clerk of this County either in cash or underwritten by a surity company licensed to do business in Colorado at the rate of $1 . 00 per person for the max mum number of people permitted to assemble , which shall indemnify and hold harmless thi county or any of its agents , officers , sery and employees from any liability or causes action which might arise by reason of grant this license , and from any cost incurred in cleaning up any waste material produced or left by the assembly or any public liabilit and property damage insurance in such form and amount as shall be determined by the P1 ning Office to be reasonable in relation to the risks and hazards relating to the event 7 D . Application 1 . Application for a license to hold an actual or anti • cipated assembly of 500 or more persons shall be ma, in writing to the Planning Office of this county at least 30 days in advance of such assembly . 2 . The application shall contain a statement made upon oath or affirmation that the statements contained therein are true and correct to the best knowledge of the applicant and shall be signed and sworn to o affirmed by the individual making application in th case of an individual , natural , human being , by all officers in the case of a corporation , by all partn' in the case of a partnership or by all officers of unincorporated association , society or group or , if there be no officers , by all members of such associ ation , society or group . 3 . The application shall contain and disclose : (a ) .The name , age , residence and mailing address of all persons required to sign the application by 4 . b and , in the case of a corporation , a certi - fied copy of the articles of incorporation toge er with the name , age , residence and mailing ad ress of each person holding 10% or more of the stock of said corporation ; together with proof financial resources sufficient to execute plans as submitted , and provide such further assuranc as may be required . (d ) The nature or purpose of the assembly . (e) The total number of days and/or hours during which the assembly is to last . (m) The plans to provide for medical facilities in- cluding the location and construction of a strui ure , the names and addresses and hours of avail • ability of physicians and nurses , and provision: for emergency ambulance service . ( n) The plans , if any , to illuminate the location o the assembly including the source and amount of power and the location of lamps . (o ) The plans for parking vehicles including size and location of lots , points of highway access and interior roads including routes between higl way access and parking lots . ( p) The plans for telephone service including the source , number and location of telephones . (q ) The plans for camping facilities , if any , incluc ing facilities available and their location . ( r) The plans for fire protection including the num ber , type and location of all protective device! including alarms and extinguishers , and the num• ber of emergency fire personnel available to operate the equipment . ( s ) The plans for security including the number of guards , their deployment , and their names , add- resses , credentials and hours of availability. ( t ) The plans for sound control and sound amplifi - cation , if any , including number , location and power of amplifiers and speakers . Issuance The application for a license shall be processed within 20 days of receipt and shall be issued if all condition: are complied with . F . Revocation The license may be revoked by the governing body of thi ! county at any time if any of the conditions necessary fe the issuing of or contained in the license are not com- plied with , or if any condition previously met ceases to be complied with . G . Enforcement 1 . The provisions of this legislation may be enforced by injunction in any court of competent jurisdictioi 2 . The holding of an assembly in violation of any pro- vision or condition contained in this legislation shall be deemed a public nuisance and may be abated as such . 3 . Any person who violates II -a or who violates any cop dition upon which he is granted a license may be fined not less than $100 . 00 nor more than $1 , 000. 00 . Each day of violation shall be considered a separate offense . n 7 . Special Uses A. The Planning Commission is authorized to recommend to the Board of County Commissioners approval or denial of the following uses and to set conditions and requiremen- for the operation of said uses . Any expansion or enlar! ment of a Special Use shall be treated as a new applica- tion under the provisions hereof. The Planning Commiss- ion and the County Commissioners shall consider the fol - lowing in making their determination : compatibility wi the surrounding area , harmony with the character of the neighborhood , need for the proposed use , its effect upoi the immediate area , its effect on future development of the area , and the health , safety and welfare of the in- habitants of the area and the County. B . Application for Special Use Permit shall be accompanied by the following : 1 . Certified boundary survey of property for which application is made . 2 . Plot plan showing location of all proposed building! parking area , ingress and egress , waste disposal areas , other constructional features , and landscapii 3 . Proposed number of shifts to be worked and maximum number of employees . 8 . Soil study of site . 10 . Application fee of $25 . 00 except where indicated otherwise . 11 . A public hearing is required . C . Sand and gravel pits , etc . . . Before the County Planning Commission shall approve or disapprove a special request for the location of a sand or gravel pit , rock crusher , quarry or open mining oper ation , concrete and asphalt plants in any "A" or "A-1 " Agricultural District or in any " I " Industrial District the applicant shall supply the required information and shall be subject to the following conditions : 1 . Application a . Plan . When the application is filed , the app- licant shall provide a plan showing the land from which the sand and gravel will be excavate and a plan providing for rehabilitation of the excavated area . These plans prepared by a reg- istered engineer shall show the contour interva and any improvements thereon and a distance of 300 feet in all directions from the subject pro erty. The plans shall be placed on a 24" x 36" sheet and shall contain the legal description , acreage , scale of the drawing , vicinity sketch 10 • • : and the written and graphic details of the rehabilitation . b . Rock crushers and concrete and asphalt mixing plants may be allowed . However , the Planning Commission may set out additional conditions under which these operations may be permitted ; and said conditions may vary by location due to abutting land uses . 2 . Operation Standards a . No excavation or processing of sand and gravel shall be permitted nearer than 10 feet to the boundary of adjacent property , easement , or irrigation ditch or right-of-way , nor nearer than 125 feet to any existing residence , unless by written agreement the owner or owners of such adjacent property consent to a lesser distance and the Planning Commission approves such lesser distance . The Planning Commission may set a greater distance than mentioned above when , in their opinion it is justified. b . The operation shall maintain haulage roads in a reasonable dust-free condition if within one-fourth mile of a residential subdivision . c . The hours of operation shall be unlimited unless the operation is located within one-fourth mile of a residence in which case they shall be from 6 : 00 A. M . to 10 : 00 P . M. or longer as the Plan- ning Commission may specify. d . All wet pits (definition : any pit excavated be- low existing water table or subject to undergrou seepage where water would accumulate and pond ) b excavated in such a manner as to leave an averag of not less than eight inches of undisturbed san or gravel , as evenly as possible , over the entir excavation tract to provide a water bearing stra for any existing ground water , unless rehabilita tion plans provide for a permanent lake . e . In no event shall a slope of less than 2 : 1 be le when operations are complete . f . In all pits , whether known as dry pits or wet pi the floor of the pit shall be graded in a reason ably smooth condition so that excavated areas wi not collect or permit stagnant water to remain therein ; however , where the rehabilitation plan for the subject property , as approved by the Pla ning Commission , provides for a permanent lake . g . Prior to starting excavation in certain specific instances as first determined by individual in- vestigation by the Board of County Commissions o their duly authorized representatives , where exc ations within one-fourth mile of a residential s division are considered hazardous , the Board of County Commissioners may require the excavations be fenced by standard field fence C F & I Specia fence #1047-12-122 with openings of 3" at the bo tom , graduated to 8" openings at the top or equa with 3 strands or barbed wire spaced 8" apart gi ing the fence a total height of 6 ' . Steel posts not more than ten feet apart shall be used to su port the fence . The excavated area shall remain fenced unless removal of all or any part thereof is authorized by the Planning Commission . 11 3 . Permit requirement a . Permit fee . An annual permit fee shall be paid The fee shall be paid annually upon the anniver sary date of the permit . b . Insurance . The operator shall furnish evidence he is insured to the extent of not less than $100 ,000 . 00 against liability for any negligent act or omission by the operator from the operat or maintenance of the sand and gravel and all al vities connected with or incidental thereto . c . Bond . The operator shall post a bond in the foi prescribed by the Board of County Commissioners in a sum equal to the number of acres covered b2 the permit muliplied by $500 . 00 to insure full compliance with all of the terms and conditions of the permit and the rules and regulations of 1 Board of County Commissioners pertaining to ex- traction and processing of sand and gravel . Th( minimum amount of such bond shall be $2 ,500. 00 ; the maximum amount , $15 ,000 . 00 d . Time of permit . All permits shall be in force until the operation is completed unless the annt permit is not renewed by the operator. e . Cancellation of permit. The Board of County Con missioners shall have the power to cancel permit for violation of any of these regulations or con ditions imposed by said Board . The Board of COL Commissioners shall cause to be served written notice upon the permittee at the address contair in the permit , setting out a clear and concise statement of the violations , and directing the permittee to correct such violation within thirt days . If the violations have not been corrected , • then the Board of County Commissioners shall dir ect the permittee to appear at a time certain be fore the Board of County Commissioners , not less than ten days nor more than thirty days after t date of service of notice . The Board of County Commissioners shall have the power , upon good cause being 'shown , to cancel or revoke the permi heretofore issued to the permittee , to require certain corrective measures to be taken or to di ect the County or it ' s agents to enter upon the premises and to take the corrective measures re- quired by the Board of County Commissioners , the cost to be assessed against the permittee and hi surities . D . Sanitary land fill - applicants for certificates of Designation for Solid Waste Disposal Sites shall make such application or a prescribed form , supplying the additional information : 1 . Copies of the information supplied to the State Heal Department as required by "Solid Waste disposal site and facilities " Chapter 35 , Article 23 - C. R. S. 1963 (Volume II ) amended 1971 by Senate Bill 132 , effecti date July 1 , 1971 . E. Outdoor shooting ranges , subject to conditions set forth below : 1 . Special permit to operate an outdoor shooting range may be issued for period up to five years . 2 . Application for a permit to operate an outdoor shoot ing range shall be accompanied by the following in- formation : 12 a . Topography at two-foot intervals . b . Plan of range with supporting data on safety factors . 3 . The following minimum standards shall apply to all outdoor shooting ranges : a . Minimum land requirements shall be set by the Planning Commission for each application . b . Shooting ranges shall be located to take advanta of natural terrain barriers . The entire range ( including danger area .if range is not of the "Safety Range" type ) shall be fenced and warninc signs posted every 200 ' . c . Line of fire shall be as nearly horizontal as is practicable and never below horizontal . Ranges may be constructed so that the firing point is below the target , provided the gradient between the firing point and target does not exceed 2%. d . Perimeter of range shall be landscaped to provid natural noise barriers . The remainder of the ra shall be planted and maintained with grass or of suitable ground-cover . e . Shooting shall be conducted by a range office or instructor qualified by National Rifle Associa- tion or military service . f. In addition to firing lines or fields , adequate space for danger areas , parking , equipment , stor age building , clubhouse and/or latrines shall be provided . 4 . Provisions for pistol , small -bore and high-caliber rifle ranges . a . "Safety Range " requirement . If range is constru ed in a built-up area , or when area is developed or when natural terrain does not offer adequate protection , overhead safety baffles may be requi b . No fewer than 16 firing points shall be available on rifle or pistol ranges . Firing points shall I four to five feet apart for shooting distances u to 200 yards . c . Rifle or pistol ranges shall not be permitted wi out bullet stops . Natural or artificial bullet stops shall be provided . 1 . Natural bullet stops . Only slopes of hills shall be used for natural bullet stops . The crest of the hill used for a bullet stop sha. be at least 30 feet above the level of the firing point for a 100-yard range . An addi - tional ten feet of hill shall be provided foe each additional 100 yards of range . The slot of the hill shall not be less than two to one A vertical cut shall be taken out of the face of the hill -side used for a backstop to pro- vide a nearly perpendicular face to catch bullets and prevent richochets . 2 . Artificial bullet stops . For up to a 300-yar range , an earth embankment at least 25 feet i height , well sodded to retain slope of 35° from perpendicular and topped by an -earth-fil timber barricade at least 15 feet high , shall be provided . Stones shall be removed from th face of the embankment to a depth of 18 inche . For each additional 100 yards of range , ten feet in over-all height of the bullet stop shall be added . Bullet stop shall extend approximately 160 feet beyond the ends of t target line for high-caliber ranges ; 25 fee for small -bore rifle and pistol ranges . 5 . Provisions for trap and skeet fields . a . A 100 by 300-yard danger zone shall be provided for trap fields . b . A 300 by 600-yard danger zone shall be provided for skeet fields . c . Trap and skeet fields may be combined ( traps la; out super-imposed on skeet field ) where 300 by 600-yard zone shall be required . d . The trap field layout shall meet the requiremen of the American Trap Association . e . The skeet field layout shall meet the requiremei of the National Skeet Shooting Association . F . Adequate mechanical means for scraping , grading and cleaning of area is provided at all times ; and that scraping , grading , and cleaning of the area be accompli as approved by the Weld County Health Department . 6 . Drainage facilities or improvements shall be constructec to protect any adjacent rivers , streams or other bodies of water from pollution . G . Poultry Production : chickens , ducks , geese , turkeys 1 . Shall not be located closer than 2 ,640 feet to any resi - dential zone district or subdivision nor nearer than 66( feet (1 /8 mile ) to any existing residence not located or the site without the written approval of the fee owner of the structure . 2 . Manures shall be handled and disposed of in a sanitary manner approved by the Weld County Health Department , without creating public health hazard or nuisance . 3 . Chemical and scientific controls shall be provided for rodent and insect control . H . Sewage System : pumping station , sludge drying bed , treat- ment plant , lagoon - applicants for site approval shall also submit copies of the information supplied to the State Healt Department. 14 I . Fertilizer (organic ) storage and sale , where the fertilizer is stored for longer than one year , provided the following conditions are met : 1 . Shall not be located closer than 2 ,640 feet to any residential zone district or subdivision , nor nearer than 660 feet ( 1 /8 mile ) to any existing residence not located on the site without the written approva. of the fee owner of the structure . 2 . Storage of fertilizer shall not be permitted closer than 300 feet to any public right-of-way or lot 1in( 3 . Council to work on the revision of the Weld County A Zone with the weld County Planning Director and the Weld County Planning Commission makes the following report and recommendations. Since we were not consulted in writing the revisions but handed a revised copy for our inspection and comments this document as written is not a joint effort in which the Ag. Council participated. Therefore on behalf of the Ag. Council we make the following general recommendations and several specific recommended changes. 1. In the A Zone we can see no reason to have any size limitations as to acres per house. We feel that to preserve prime agricultural land if any housing except that provided in the regulations is allowed the change should be made to AR Zone. Then in the AR Zone a lot size minimum of 1 (one) lore should be allowed providing soil analysis warrants no increase in future leech field requirements or if a sewer district is pending. Lot size to be 2 acres if soil analysis determines possible increase needed in leech field. These zones will limit: themselves unless domestic water and sewage systems are developed. The trend for anyone moving to a rural area is to own horses and other livestock. This will tend once again to help keep lot size larger. Agriculture does not feel it to be in anyones best interest to have either a lot of small part time farmers or a lot of untended acres growing up in weeds and making insect breeding grounds. In regard to Public Utilities going to conditional use these projects after completion should be placed on a permanent status. The past policy of the Utilities of "go where we please when we please" needs to be regulated to a reasonable basis as to best location, type of structures, time of construction and paying for crop damages. 3. As representatives of agriculture we spangly urge that all regulations limiting distances of feed lots and other uses to 2,640 feet (i mile) to existing residences should also apply equally to any new construction of residences. This is needed especially to protect those people engaged in production of meat, milk, and eggs. 4. In regard to mobile homes, if a landowner in an A Zone chooses to live in one as a permanent residence, it is discrimination to deny him that right. 5. The requiring of permits for supporting buildings and animal lots in an A Zone is in our opinion both uninforceable and the cause of the most resentment from agriculture. We can see no really practical purpose in these and recommend that they be discontinued. 6. The Weld County Planning Commission's main responsibilities are in the unincorporated areas of the county. Since these areas are agricultural we strongly urge that a majority of these members should be from organized agri- culture. The commission should contain individuals knowledgeable in water, domestic water districts and soil conservation work as well as area representation. We recommend that this be done as soon as possible and the people appointed have agriculture as their principal livelihood. 7.
