RE: AGREEMENT BETWEEN THE UNITED STATES DEPARTMENT
OF TRANSPORTATION, FEDERAL HIGHWAY ADMINISTRATION,
AND WELD COUNTY PROVIDING FOR EXTRAORDINARY
MAINTENANCE AND SNOW REMOVAL ON DEFENSE ACCESS
ROADS.
WHEREAS, the United States Department of Transportation,
Federal Highway Administration, has presented an agreement between
itself and Weld County, Colorado, providing for extraordinary main-
tenance and snow removal on defense access roads serving the Warren
Air Force Base Minuteman Missile Sites in Weld County, Colorado,
and
WHEREAS, Weld County, Colorado, in the interest of national
defense, is willing to cooperate by performing such extraordinary
maintenance and snow removal work in accordance with the terms of
said agreement, and
WHEREAS, after careful consideration, the Board of County
Commissioners, Weld County, Colorado, believes it to be desirous and
in the best interest of Weld County to enter into the aforementioned
agreement as proposed and submitted and upon the basis recited therein.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that said agreement providing
for extraordinary maintenance and snow removal on defense access
roads serving the Warren Air Force Base Minuteman Missile Sites in
Weld County, Colorado, per copy attached hereto and made a part hereof
by reference, be, and it hereby is approved.
BE IT FURTHER RESOLVED that the Board be, and it hereby
is authorized, to execute the agreement as submitted and to make the
same effective forthwith.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 29th day of December,
1971.

ment for extraordinary maintenance on the subject roads. This
agreement is in accordance with verbal discussions on December 10,
1971 between representatives from our office, Warren Air Force Base,
and Messrs. Buss and Warner. Please return two signed copies of
the agreement. The other copy is for your record. We would appre-
ciate receiving these executed agreements as soon as possible.

AND SNOW REMOVAL ON DEFENSE ACCESS ROADS
SERVING THE WARREN AIR FORCE BASE MINUTE-
MAN MISSILE SITES IN COLORADO - PROJECTS
OM-AD-300(2) and 300(3)
This AGREEMENT is made and entered into by and between Weld County,
State of Colorado, hereinafter referred to as Weld County, and the
United States Department of Transportation, Federal Highway Administra-
tion, hereinafter referred to as FHWA. Previous modified agreement
dated October 22, 1965 as supplemented on February 26, 1969 and
temporarily extended on October 15, 1971 is hereby superseded.
RECITALS
WHEREAS, pursuant to the provisions of Section 210 of Title 23,
United States Code, and authority delegated by the Secretary of
Transportation, FHWA is authorized to provide for the maintenance
of Defense Access Roads;
WHEREAS, the Commander, Military Traffic Management and Terminal
Service, acting pursuant to authority delegated by the Secretary
of Defense, has certified that it is important to the National
Defense to provide for extraordinary maintenance and snow removal
under the conditions herein set forth on the Defense Access Roads
hereinafter described, and has requested that FHWA take appropriate
action to provide for such extraordinary snow removal and maintenance
out of funds transferred to FHWA by the Department of the Air Force;
WHEREAS, Weld County is willing to cooperate in the interest of
National Defense by performing the extraordinary maintenance and
snow removal work herein specified under conditions that will result
in neither a profit nor a loss to that County;
NOW, THEREFORE, the parties hereby agree as follows :
1. As used herein, unless the context indicates otherwise;
a. The term "Defense Access Roads" means those public highways
shown on the attached map that are located in Weld County. These
designated roads as shown on the attached map are described as
follows:
Access road numbers 1 through 10, 12 through 23, and
27 and 28, located between R56W to R6OW and from T7N
to T12N at the Nebraska State line .

b. The terms and conditions describing this work are as follows :
(1) Extraordinary maintenance is that work performed by
Weld County when notified by an appropriate Air Force official as
listed in the appendix to this agreement, of conditions that require
attention in order that access to the sites shall remain unimpeded.
Weld County will be expected to complete the requested work within
a matter of three days from the time of notification by the Air
Force. It is anticipated that Weld County's normal maintenance of
these public roads, including an annual blading, keeping culverts
open, and so on, should provide adequate access for the Air Force
needs except in unusual circumstances such as flooding or excessive
frost actions.
(2) Extraordinary snow removal means that Weld County, upon
notification of appropriate agents of the United States Air Force,
shall react within two (2) hours to commence the placing of snow
removal equipment in a condition to remove snow from these herein-
before designated access roads , and shall then endeavor to the best of
its ability to remove snow and snow drifts as rapidly as possible
from those access roads to control centers and launch sites designated
by the Air Force. Within a period of twenty-four (24) hours from the
time of the notification, denial of access to launch control centers
and to imoperative launching sites will become operationally unacceptable
to the National Defense. The clearing of snow and snow drifts from
access roads to other launch facilities will then be undertaken on
the priority given by Air Force agents at the time the County was
notified. It is agreed that after any snow storm Weld County will
undertake normal snow plowing operations on these access roads if
no notification is given by the Air Force that an extraordinary snow
removal effort is required.
(3) Weld County agrees to perform the extraordinary maintenance
and snow removal as herein described on the defense access roads
designated in this agreement, when notified by an authorized agent
representing Warren Air Force Base, Cheyenne, Wyoming, as listed in
the appendix to this agreement. Authorized personnel to be contacted
in Weld County for the extraordinary work are also listed in the
appendix to this agreement. These listings may be revised at any
time by either the Air Force or the County if written notice is sent
to the other party and to FHWA.
(Li) Weld County will be reimbursed by FHWA with funds provided
by the United States Air Force for actual costs of operators, labor,
equipment, and materials incurred in the performance of extraordinary
maintenance and snow removal on the defense access roads designated
in this agreement, when performed in accordance with the terms stated
herein. "Actual costs" means the costs incurred by the County for:

a. The costs of operators and labor, to include wages
for both straighttime and overtime, and for fringe benefits normally
paid, such as contributions to the retirement system, insurance
programs and annual and sick leave benefits;
b. The invoice costs of any materials incorporated
into the maintenance and snow removal task;
c. An hourly rental cost for equipment used in the
work based on rates not to exceed those established in the latest
edition of the "Construction Equipment Rental 9ate Manual" published
by the Department of Highways, State of Colorado. In accordance
with procedures on page 2 of the May 1, 1971 edition of the manual
for all publicly-owned equipment, the applicable hourly rate will
consist of the service rate plus seventy-five percent (75%) of the
listed bare rate.
(5) Weld County shall submit a semi-annual certified state-
ment of the actual costs incurred in performing extraordinary maintenance
and snow removal operations on these defense access roads. Documentation
of actual costs shall be recorded and maintained by Weld County and
are to be retained and made available for inspection and audit by
FHWA until such time as the County is notified in writing that such
records are no longer required . Documentation of equipment used should
include its rated size in the same units as given in the Construction
Equipment Rental Rate Manual. No additional reimbursement will be
made for attachments to the prime piece of equipment.
(6) This agreement shall be subject to renegotiation or
termination annually at the end of each fiscal year (June 30), upon
the request of any of the parties hereto. The agreement shall
immediately terminate upon notification to all parties concerned that
Federal funds are no longer available. This agreement shall expire on
June 30, 1976 without the request of either party. An extension of
the maintenance activities beyond that time will require a new executed
agreement.
(7) It is further agreed that, with respect to any Federal
activities and Federal property within the affected area, nothing
contained herein shall be construed as holding Meld County liable
for any personal damage or personal liability injury to any person
or thing while removing snow or snow drifts from the hereinbefore
described Defense Access Roads .
(8) It is further agreed that, except for any willful breach
of this agreement by Weld County, FHWA shall hold harmless Weld County
from any and all claims by its agents, contractors or subcontractors,
or any persons by FHWA, employed or under agreement with said FHWA,
by reason of any failure of Weld County to fulfill this agreement.

Dear Colonel Hansen:
In reviewing the February 26, 1969 agreement between Weld County and
your office, regarding maintenance of roads and access roads at 31 missile
sites in northeastern Weld County, we find we no longer can continue to
perform these services. Also according to our records this 1969 agreement
has never been renewed.
We applied to your office and to the United States Department of
Transportation, Federal Highway Administration, located in Denver asking
for reimbursement for the extraordinary work required by our county road
crews, this request was denied.
We have in the past considered these ioads as our number one priority
because of the missile sites, but now must give our first consideration
to the school bus routes and the local farmers and ranchers; therefore any
maintenance to the missile site roads will become secondary.
If you wish to meet with me and our Chief Accounting Officer, as
you. had previously indicated in your letter of September 19, 1969 under
item 4, we will be happy to set a time for an appointment in our office
at the Weld County Court House.
I am sure you are aware of the spiral in the cost of road maintenance,
and can understand why Weld County can no longer accept an obligation
such as this without adequate reimbursement.

Dear Sir:
This is to confirm the information discussed with you and Mr. Barton A. Buss
by Mr. Charles 3. Schroer and Mr. Perry R. Blackwell of this office when they
met with you on April 26, 1971.
We appreciate your interest in obtaining reimbursement for the extraordinary
snow removal work and extraordinary road maintenance on the Weld County
missile site roads; however, as you probably know the Federal Government
requires detailed documentation of all expenses if Federal reimbursement
is to be requested. Mr. Schroer and Mr. Blackwell discussed the type of
documentation required with Mr. Buss. They also accompanied Mr. Loyd Warner
to the road maintenance shops in Greeley to review the records but found
that there were no records kept for Calendar Years 1969 and 1970 that show
any specific expenditures on the missile site roads. It was their under-
standing that the billing you sent to us was compiled from estimates prepared
by the various grader and snow plow operators in January and February 1971.
We are unable to reimburse the county from these billings without specific
documentation.
Mr. Schroer and Hr. Blackwell also mentioned to you the possibility of
misunderstanding of the terms of the agreement in regard to the wore. desired.
The agreement provides for reimbursement for extraordinary maintenance and
extraordinary snow removal as requested by Air :Force officials from Warren
Air force Base, Wyoming. The Air Force reported the following requests for
extraordinary snow removal in 1969 and 1970 and no requests for etraordiaary
maintenance.

was not within the scope of the agreement and therefore is not re .mburceable.
If it is possible for you to furnish documentation for all or any portion
of the billing we would be happy to make the payment for that portion
documented. Mr. Schroer and 1:1r. Blackwell feel that the system of documenting
the costs that vas recently instituted is adequate and will support future
billings for the work covered by the agreement.
We will be happy to furnish you any additional information or discuss this
matter further if you so desire.

1 . This Base has need to know of any road construction or repair
which will affect the movement of the missile transporter-erector
(T-E) . Because of the size and weight characteristics of this
vehicle and because of its critical nature for defense purposes,
the Air Force has a requirement to pre-plan all movements and to
check out all road conditions. Construction areas, detours and
alternate roads must be investigated. The scheduling of. Some
T-E movements may need to be planned in advance to take into
account road construction and repair.
2. For the reasons stated above, this Base has been directed by
higher headquarters to establish procedures with civil authorities
to assure notification of planned road/highway construction or
repair.
3 . We are, therefore, asking that you notify this office as far
in advance as possible of your plans for highway construction or
repair in areas where we have defense access roads to missile sites.

1 . In accordance with Para 6 of the Supplementary Agreement for
Extraordinary Snow Removal on Defense Access Roads we are supplying
a list of the personnel at Warren AFB authorized to request extra-
ordinary snow removal for access roads to Minuteman sites in
Colorado.

2. We would particularly like to commend you for your prompt support
this past snow removal season. At times we levied requirements which
you investigated by radio and by pickup which saved much time and many
miles and we will request this cooperation in the coming year as
situations warrant.
3. In accordance with our original agreement we would like you to
/ furnish us an up to date list of your personnel to be contacted when

requesting extraordinary snow removal, with office and home telephone
numbers .
4. Please advise if you feel a joint meeting with us would be bene-
ficial before the snow season to discuss any problems we may have.

We also suggest that you road test the equipment in the coming weeks
to assure that it is ready to operate.
