I 348 find that the county of Weld in the state of Colorado is the county which embraces the larger acreage of said proposed irrigation district . Thereupon a petition was presented to the board by W. H . Davis , praying for the exclusion from h the district of the northwest quarter of the southeast quareter of section 9 , township 1 N. R. 66 W. , owned by him, which land was included in the petition for the organization of said district ( and also in a petition for the ticlusion thereof addressed to this board , including other land) on the ground that said land was included intsaid petition by mistake , and would not be bentfitted by inclusion in said district . as said W. H. Davis has a water right for the same from sources other than those set forth in the petition for the organization cf the district . And thereupon upon motion of commissioner Estes , seconed by commissioner Bolander and unanimous ly carried, the following resolution was adopted: RESOLVED that the petition of W. H . Davis for the exclusion of the northwest quarter of the southeast quareter of section 9 , township 1 N . R. 66 W. from The Platte Valley Municipal Irrigation District , be and the same is hereby granted , and the same is hereby excluded from said district and from the operations thereof, for the refEson that the same would not be bentfitted by inclusion in said district . " Whereupon petitions were presented for the inclusion within said district of lands as follows ,to wit : By W. H . Davis , for the inclusion of the northeast quarter ( NE* ) of the northeast quarter (Nge ) of section 21 , township 2 N. And thereupon the board, upon motion of commissioner Bolender , second by commissioner gstee , and unanimously carried, proceeded to and did consider said petitions and applicatio p for the inclusion of said lands in said district , and evidence pertinent thereto , and found the recitals of said petitions to be true , and it was then ordered by the board that the above described lands be included within said district and made a part thereof and that the boundaries of said district as set forth in said petition be so modified as to include the same within said district . On motion of Commissioner Estes , duly made , seconded by Commissioner BoMlander, and unanimous- ly carried, it was ORDERED that the name of said irrigation district shall be and is " THE PLATTE VALLEY MUNICIPAL IRRIGATION DISTRICT . " r 356 Upon motion of Commissioner Bo;ilander, duly made , and seconded by Commissioner Estes , and unanimously carried, the following resolutions were adopted, namely: " RESOLVED that said irrigation district be divided into three divisions , as follows , towit : Division number I shall comprrse all that part of saiD district and the lands embraced therein which are included in said district which lie north of the north boundary line of sections 27 , 28 and 29, township 2 N . R . 66 W. Division number II shall comprise all that part of said district and the lands embraced therein which are included in said district which lie south of the north line of sections 27 , 28 and 29 , township 2 N. R. 66 w. , and north of the north line of sections 20 and 21 , township 1 N . R. 66 W. Division number III shall comprise all that part of said district and the lands embraced therein which are included in said district , which lie south of the north line of sections 20 and 21 , township 1 N . R. 66 w. RESOLVED FURTHER that each of the said divisions above described be and is hereby constituted a voting precinct for all purposes of said irrigation district as provided by law, and that the polling places within said precincts for the holding of elections are hereby fixed as follows , t owit : For precinct I , the residence of L. J. Burns situated in the northwest quarter of the northwest quarter ( NW4 of the NW4) of section 20 , township 2 N . R. 66 W. For precinct II , the residence of T. H. Winbourn, situated in the northeast quarter (NE4) of section 10 , township 1 N . R. 66 W. For precinct III , the residence of Alfred Dunn, situated in the northeast quarter (NEe) of the southeast quarter ( SEi) of section five (5) township one ( 1) South Range 66 West . UPon motion of Commissioner Bolander, seconded by Commissioner Estes , and unanimously carried, the following resolution was adopted: " RESOLVED that the entire prayer of the petition for the organization of said THE PLATTE VALLEY MUNICIPAL IRRIGATION DISTRICT be and the same is hereby granted, as hereinabove set forth, and as hereinabove modified, and that an election be and is hereby ordered and directed to be held within the said proposed irrigation district and in the various precincts thereof as above described, for the purpose of submitting to the vote of the qualified electors the question of the formation, establishment and organization of the said proposed irrigation district , under and by virtue of and in accordance with the law, and the election of a board of directors for said district as by law provided; that Friday, the 31st day of December A. D. 1909, is hereby fixed for the holding of said election in the various precincts of said district , and the polls are directed to be opened for that purpose from the hours of' seven A. N. of that date continuously until the hour of seven P .M. of the same date ; and be it FURTHER RESOLVED that the following—named persons are appointed for judges of said election, towit : 357 Precinct number I , A. B. C. 'Jewell , L. J. Burns and William Smith. Precinct number III E. S. St .John, W. J. Winbourn and T. H. Winbourn. Precinct number III , Jacob K . Kramer, Alfred Dunn and Jacob Shepley. WHEREAS, the attention of the Bcard has been drawn to the fact that and overdraft now exists in the Road and Bridge Fund , Pauper Fund and the County Hospital Bay Branch , and WHEREAS , it appearing to the Board that there is a balance of $15 ,233 . 39 to the credit of the Contingent Fund; THEREFORE BE IT RESOLVED, that the. County Treasurer be and he is hereby authorized and directed to transfer from said Contingent Fund the sum of $13 ,767 . 27 to the Road and Bridge Fund, the sum of $1 ,326 . 41 to the pauper Fund and the sum of $139. 71 to the credit of the County Hospital Pay Branch, for the purpose of reducing the overdrafts now existing in said funds . D. 1909 , in the proposes THE PLATTE VALLEY MUNICIPAL IRRIGATION DISTRICT , and in the several divisions end voting preoienots thereof, as ordered by the board, notice of which was duly given and advertised in the Counties of geld and Adams pursuant to said order , as required by law, and for the further purpose of transacting such other business • * , • as may properly come before the board. • whereupon it was moved by Commissioner Estes , seconed by Commissioner Bolander , and unanimously carried, that the board proceed to examine the proofs and determine whether or not the notioe of i said election has been properly . advertised and'; given in the Counties of Weld and Adams , as required by law and as commanded in the order of the board calling said election. I _ ' • ' j ♦F1 ( r 384 held in the proposed THE PLATTE VALLEY, MUNICIPAL IRRIGATION DISTRICT to determine the question of whether or not the territory embraced within the exterior boundaries of said district and the lands included therein and comprising the said district , as in said notice and the orderedsof the board set forth, should be organized into an irrigation district to be known a:; THE PLATTE VALLEY MUNICI- PAL IRRIGATION DISTRICT, and for the . election of a board of directors in and for the various divisions or preciencts of said district . Then and there the returns were opened and the votes cast at said election so noticed and advertised in the counties aforesaid in the manner aforesaid, and held on the 31st day of December A. D. 1909 , were canvassed and counted, from which it was found that twelve ( 12 ) votes were marked with cross opposite the words "IRRIGATION DISTRICT - YES" , and none of said votes were marked with a cross opposite the words "IRRIGATION DISTRICT - NO " , . from which it appeared to the board and' was found by said board that the majority of eel the resident freeholders who are legal electors in said proposed district and have paid property taxes in the last year preaelding said el :t f election have voted and did vote "IRRIGATION DISTRICT-YES" ; and thereupon the board , proceeding to canvass the votes cast in se.id )district for directors , found the following results : For Director in and for Division number 1 , A. B . C . Howell , received twelve ( 12 ) votes . For Director in and for Division number 11 , E. S. St . John received twelve ( 12 ) votes . For Director in and for Division number 111 , Jacob K. Kramer received twelve ( 12 ) votes . And no person other than those above named received any votes for the ) offiee of director in and for any division of said district . Mr. Milton Smith called the attention of the beard to the fact that in the1minutes of December 6th , 1909 , in amot excluding and exempting lands from the district , section 29 , township 1 N . R. : 66 W. was omitted from the description through mistake , and that the minutes showed that the intention of the hoard was to exempt the said tract from the operation of the district , . as clearly appeared from the fact that in stating what lands were included within the operatio'"of the district it was omitted therefrom; and thereupon upon motion of Commissioner Estes , second by Commissioner Bolender , the , following resolution was unanimously adopted: RESOLVED, ,that it was the intention of this board, in the proceeding taken in the matter of The Platte Valley Municipal Irrigation Distriot at its meeting on thbv6th day of December A. D. 1909. to exclude from the district , and exempt from the operations thereof section 29 , township 1 N . R. 66W. and that in fact such was the judgment and order of the board and the board so ordered , but that , by a clerioal error in preparing the description of, the lands to be excluded from the district and exempted from the operations thereof, said tract was improperly omitted when the orderer was written Up IT IS THEREFORE ORDERED, that section 29 , township 1 N. R. 66 W. , was infact excluded from said district on said 6th day of December A. WHEREAS , heretofore and on the 6th day of December A. D. 1909 , at it regular meeting of the board of County Commissioners of Weld County, state of Cc-iorado , there was presented by E. 62 St . John, A. B. C . Howell and Jacob K. Kramer , a petition signed by said persons and others , praying for the establishment , organization and creation of an irrigation district to be known as THE PLATTE VAL4,EY MUNICSPAL IRRIGATION DISTRICT , which said proposed district as described by the said petition embraced and comprised lands in the counties of Weld and Adams , state of Colorado , said county of Wild embracing the larger acreage of said proposed district , at which time in pursuance of the petition aforesaid due proof of publication in the county of Weld of the notice of presentation of said petition to said board was duly given and publication of said petition was duly had and made ; and WHEREAS, on the 6th day of December A. D. 1909, the said board did fully and carefully consider the said petition, the bond filed by the petitioners , the proof of the publication of said petition and notice of presentation of the same , and all matters pertinent to the inclusion of lands in said district and the exclusion of lands therefrom, and all matters and things pertinent to and cone corning the said petition for the formation of said irrigation district , and at such time said board did duly fix, determine and establish the boundaries of said district and the lands to be included sod._ within said district , and that said board did at said time , to wit : on thei6th day of December A. D. 1909 , order an election to be held of all of the qualified electors of said district as by the statute in such cases made and provided, for the purpose of voting upon and determining whether or not said proposed irrigationedistrict should be organixed as an irrigation district , as by law provided , to be held on Friday the 31st day of December A. D. 1909, and notice thereof should be given and published as required by law for at least three weeks prior to such election, in THE FORT LUPTON PRESS and THE BRIGHTON BLADE, the former a newspaper of general circulation printed and published within the county of Weld and the latter a newspaper of general circulation printed and 'published within the county of Adams in the state of Colorado , that said netioe was duly given and regularly printed and published in the manner required by the order of said board , as provided by law, in the counties of Weld and Adams in the state of Colorado ; and all matters and things in ' J and about said election were done and performed pursuant to the orders of said board and pursuant to and in accordance with law; that the returns of said election have been duly made to this board and the votes cast at said election by this board duly counted and canvassed; that the said election held as aforesaid for the purpose of determining the organization of said district has been carried. and that the majority of the qualified voters of said district have voted upon the question submitted to them, of the organization of said district , "IRRIGATION DISTRICT-YES" , said vote: being as follows , to wit : "IRRIGATION DISTRICT--YES " , twelve ( 12) votes . The matter of the petition for the formation of ah irrigat ion district to be known as the 11000DSDATJE IRRIGATION DISTRICT , petitioned for by Charles H Allyn, Ge4rge Branson, John J . Weaver, Henry C . Weaver , Minnie B . Allyn, J . Henry Teach , The 70 Ranch and Farms Company , Cecile N Myers , W. E . Myers , Clarence T . Neill and Frank Loustalet , came on regularly to be heard by the board , and the said petition for the formation and _organization of said district having been duly filed and presented to the Botkrd by Charles H . Allyn , George .Branson and John J .
