RESOLUTION RE: APPROVE GRANT APPLICATION FOR ENERGY AND MINERAL IMPACT ASSISTANCE FUND (EIAF) PROGRAM FOR INFRASTRUCTURE INVESTMENTS AND JOBS ACT (IIJA) LOCAL MATCH SUPPORT (AUGUST CYCLE) FOR MULTIMODAL PROJECT DISCRETIONARY MEGA GRANT (MPDG) FOR INTERSTATE 25 SEGMENT 5 IMPROVEMENTS PROJECT AND DELEGATE AUTHORITY TO DEPARTMENT OF PUBLIC WORKS TO SUBMIT ELECTRONICALLY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Grant Application for the Energy and Mineral Impact Assistance Fund (EIAF) Program for Infrastructure Investments and Jobs Act (IIJA) Local Match Support (August Cycle) for the Multimodal Project Discretionary Mega Grant (MPDG) for the Interstate 25 Segment 5 Improvements Project from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, to the Colorado Department of Local Affairs, Division of Local Government, with further terms and conditions being as stated in said application, and WHEREAS, after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference. The first one is the SS4A grant to create a safety plan to eliminate fatalities in Weld County. Project total is $500,000 (80/20), so Federal $400,000 and Local $100,000. We do not know when the awards will be announced. We cannot apply for infrastructure funding without first having a plan in place, so this funding would help us leverage dollars for future applications. If awarded, we would perform the study in 2024. The second grant Weld County will be the applicant on is the MPDG — Mega grant for 1-25, segment 5. Weld County may be contributing anywhere from $2-5M of our own funding on this project as the applicant. The request is for $100M on a $425M project. GOVERNOR'S POLICY PRIORITIES The following questions align with the "Alignment with Governor's Policy Priorities" section of the scoring matrix. 1. Collaboration. Have you collaborated with and secured other local, nonprofit, and/or private sector partners on project planning? Please describe. Yes, Weld County has many relationships with our state agencies, non -profits, private sector businesses and other local government entities. The most successful collaboration for this corridor has been the North 125 Coalition. This partnership began in 2013 with the purpose developing a plan to implement the recommendations of the North 125 Environmental Impact Statement (EIS) before 2078, as identified in the plan. This Coalition formed with the purpose of advocacy for the safety and reconstruction of north 1-25 from Thornton to Fort Collins. 2. Governor's Policy Priorities. How does this proposed project align with the Governor's policy priorities as detailed in the IIJA Priority document? This project aligns with the Governor's Transportation Policy Priorities. The major elements of the North 1-25 Segment 5 project include reconstructing 1-25 to add one 12 -foot express lane in each direction with a 4 -foot painted buffer; widening the inside shoulders to 10 feet and outside shoulders to 12 feet; providing a 30 year pavement design life; installing Intelligent Transportation Systems (ITS) equipment; reconstructing the interchange at Weld County Road (WCR) 34; and replacing 8 bridges, 2 existing drainage box culverts, and 2 existing irrigation box culverts. F. JUSTIFICATION OF NEED The following questions align with the "Justification of Need" section of the scoring matrix. 1. Other funding sources. If any other funding sources will be leveraged for this project, please list the funding source type, amount, and if these funds have been committed to the project. Besides Weld County's local match contribution, CDOT 's sources of funding for the Project may include but are not limited to, Senate Bill 260, Infrastructure Investment and Jobs Act (IIJA), Local Agency funds, Regional Priority Program, Bridge Enterprise Program, Permanent Water Quality Program, safety funding, federal funding, Division of Transit and Rail, Colorado Transportation Investment Office (CTIO) funding, state and/or federal grants, or any future transportation ballot initiatives. This funding will enable CDOT to deliver a multi -stakeholder regional project that provides critical safety improvements, congestion relief, and trip reliability while also recapitalizing or replacing aging infrastructure. 2. Additional Funding. Why can this match requirement not be met by other funding sources/reallocation of existing budgets? Strongest application has justified clearly why other funds cannot be leveraged or reallocated for this purpose, including at least 2 examples. In the absence of MPDG funds, the project would be divided into multiple construction packages spread across several years. This would require additional preconstruction expenses to update the design of the project. Construction costs would rise due to multiple mobilizations and the subsequent escalation of material and labor expenses as time progresses. 3. Project budget. Please attach your proposed budget for the federal grant application, which should include planned uses for all funds for this project (federal, state match, any other funds.) If you do not have this documentation prepared as part of the federal application, please provide a high-level project budget. The budget must specify the proposed use for IIJA State Matching funds. EQUITABLE a LONG-TERM COMMUNITY IMPACTS The following questions align with the "Projected Equitable Impacts" and "Long-term Community Impact Depth" sections of the scoring matrix. 1. Intended Use. Please briefly describe the intended use of funds and relationship to state or agency key strategic goals. Strongest applications will specify how the project will have a permanent impact on health and safety of the community and a wide -reaching impact across the state. Weld County's local match funds for this very important grant project will contribute to our commitment for northern Colorado by constructing infrastructure that will have a historical importance to the region. Disproportionately Impacted Communities. What percentage of total project funding will be invested in disproportionately impacted communities? Strongest applications will align with or exceed 40% threshold per federal Justice40 initiative CDOT works closely with a variety of industry partners to ensure participation, representation, and support for every employee and partners with unions and the local general contracting group, Colorado Contractors Association (CCA), as well as Western CCA, and HCC (Hispanic Contractors of Colorado). 3. Prioritization. How will your project implementation identify and prioritize benefiting disproportionately impacted communities or communities most harmed by legacy infrastructure? The project limits are located entirely within a historically disadvantaged community - Weld County Census Tract 21.03. Additionally, the project will improve mobility to and from Longmont, Firestone, Greeley, and Fort Collins. Within these communities, numerous Historically Disadvantaged Communities are also identified. Weld County is simultaneously looking at constructing a parallel arterial corridor on the east side of 1-25 to mitigate any impacts created by the 1-25 project to ensure adequate infrastructure and modal options for everyone. 4. Counties Impacted. List the county(ies) that will be impacted by this proposed project. Weld County is the most impacted county by this project, since it is solely located within Weld County; However, the implementation of this project will significantly benefit the surrounding counties of Adams, Boulder, Broomfield and Larimer with connections to other modal options. H. IMPACTS ON WORKFORCE/JOB CREATION The following questions align with the "Impact on Workforce/Job Creation" section of the scoring matrix. 1. How many new jobs is this project expected to create? If unknown at this stage of planning, briefly describe whether and how the project will create new jobs or workforce demand. Weld County believes Segment 5 will result in similar staff numbers created in 1-25, Segment 6. Segment 6 was supported by a total of 373 staff members coming from over 20 different firms. The CM/GC procurement process created a union contractor that implements Department of Labor approved apprenticeship programs. Also, the development of the Interagency Working Group identified 25 priority geographies hard-hit by declines in coal production and consumption. These geographies are also vulnerable to further economic distress as the remaining coal mines and coal power plants close. Greeley, Colorado, located northeast of the project, was identified as an area with high concentrations of direct coal sector jobs. 1-25 will provide a connection for the Greeley community affected by the closures to other workforce centers throughout northern Colorado. With the addition of express lanes and mobility hubs, the corridor will provide reliable and affordable transportation options connecting Greeley citizens along the front range. As you know, Greeley is the largest community in Weld County. 2. What workforce plan(s) are in place to meet the workforce needs related to this project? The Segment 5 project presents a distinct chance to promote both economic expansion and workforce education. The project's specifications include the incorporation of CDOT'S criteria for On -the -Job Training, as well as the implementation of federal regulation 23 U.S. Code 140(a). This regulation sets goals for aiding disadvantaged individuals and facilitating apprenticeships in skilled trades, ultimately leading to the creation of well -compensated, high quality employment opportunities. I. SHOVEL -READY STATUS The following questions align with the "Shovel -Ready Status" section of the scoring matrix. 1. Project Phases. Briefly describe if this is an annual project, multi -year but single-phase project, or multi -phase project. If awarded funding, the first construction package could be issued as soon as summer of 2024. This project The six -mile corridor is anticipated to be completed at the end of 2027 or Q1 of 2028. 3. Project Sites. Have project sites been secured for the proposed project? Please describe. Yes, segment 5 is that portion of 1-25 from SH 56 to SH 66. This is a shovel ready project. 4. Relevant State Agencies. Have the relevant state agencies been included and/or informed of the proposed project? If so, please list the State agencies. Yes, Weld County is partnering with the CDOT on this project application. 5. Projected Start Date of Encumbrances. What is the projected start date of encumbrances for the project? If awarded funding, the first construction package could be issued as soon as summer of 2024. USDOT requires funding obligation to occur by October of 2026. This project would be well in advance of this federal deadline. 6. Projected End Date of Encumbrances. What is the projected end date of expenses for the project? This project is anticipated to be closed out at the beginning of 2028. 7. Additional Information. Is there any other information you would like to provide about this project? The fatality rate on this segment of the North 1-25 corridor is 26% higher than the fatality rate for ALL Colorado interstates. Weld County and all the 1-25 communities believes this project to be of utmost importance to Colorado. In the other project segments, more than 84 million dollars has been invested by the communities along the 1-25 corridor. We are committed to helping our state construct the infrastructure needed to serve northern Colorado. CDOT could be their own applicant on this project, but this portion of segment 5 is solely within Weld County and our leadership wants to support CDOT by showing it is a priority project for our region by being the applicant. If awarded a Mega grant, this would help Colorado be competitive with the nation for securing IIJA funding and helping implement the Governor's IIJA transportation policies. J. APPLICANT AFFIRMATIONS/AGREEMENT WITH TERMS AND CONDITIONS 1. Affirmation of Advance Request Awarded IIJA Local Match projects will not receive funding until they can demonstrate they have been awarded the federal IIJA program for which they applied. Grantees must submit, if awarded, an advance request form accompanied by the federal IIJA award or allocation letter through the DLG grants portal. The advance request form is included as part of the award agreement. Confirm/Agree to Comply. 2. Affirmation of Use of Funds Grant funds can ONLY be used for costs associated with the non-federal match requirement of an awarded federal IIJA program. Grantees who spend funds outside of this intended purpose understand that any such funds must be returned to DOLA and agree to do so within 30 days of identification of improper fund use. Confirm/Agree to Comply. 3. Affirmation of Interim Report. Grantees must provide DOLA with a minimum of one itemized interim report, as well as any other financial reports as requested by the Governor's Office through DOLA. The project limits are located entirely within a historically disadvantaged community - Weld County Census Tract 21.03. Additionally, the project will improve mobility to and from Longmont, Firestone, Greeley, and Fort Collins. Within these communities, numerous Historically Disadvantaged Communities are also identified. Weld County is simultaneously looking at constructing a parallel arterial corridor on the east side of 1-25 to mitigate any impacts created by the 1-25 project to ensure adequate infrastructure and modal options for everyone. 4. Counties Impacted. List the county(ies) that will be impacted by this proposed project. Weld County is the most impacted county by this project, since it is solely located within Weld County; However, the implementation of this project will significantly benefit the surrounding counties of Adams, Boulder, Broomfield and Larimer with connections to other modal options. H. IMPACTS ON WORKFORCE/JOB CREATION The following questions align with the "Impact on Workforce/Job Creation' section of the scoring matrix. 1. How many new jobs is this project expected to create? If unknown at this stage of planning, briefly describe whether and how the project will create new jobs or workforce demand. Weld County believes 400 to 450 people will work on this project. (300 from contractors and subcontractors, 100 from designers and subcontracting designers, 25 from owner/inspection/project management) We saw similar numbers with the construction of 1-25, Segment 6, which supported 373 staff members coming from over 20 different firms. The CM/GC procurement process created a union contractor that implements Department of Labor approved apprenticeship programs. Also, the development of the Interagency Working Group identified 25 priority geographies hard-hit by declines in coal production and consumption. These geographies are also vulnerable to further economic distress as the remaining coal mines and coal power plants close. Greeley, Colorado, located northeast of the project, was identified as an area with high concentrations of direct coal sector jobs. 1-25 will provide a connection for the Greeley community affected by the closures to other workforce centers throughout northern Colorado. With the addition of express lanes and mobility hubs, the corridor will provide reliable and affordable transportation options connecting Greeley citizens along the front range. As you know, Greeley is the largest community in Weld County. 2. What workforce plan(s) are in place to meet the workforce needs related to this project? The Segment 5 project presents a distinct chance to promote both economic expansion and workforce education. The project's specifications include the incorporation of CDOT'S criteria for On -the -Job Training, as well as the implementation of federal regulation 23 U.S. Code 140(a). This regulation sets goals for aiding disadvantaged individuals and facilitating apprenticeships in skilled trades, ultimately leading to the creation of well -compensated, high quality employment opportunities. The fatality rate on this segment of the North 1-25 corridor is 26% higher than the fatality rate for ALL Colorado interstates. Weld County and all the 1-25 communities believes this project to be of utmost importance to Colorado. In the other project segments, more than 84 million dollars has been invested by the communities along the 1-25 corridor. We are committed to helping our state construct the infrastructure needed to serve northern Colorado. CDOT could be their own applicant on this project, but this portion of segment 5 is solely within Weld County and our leadership wants to support CDOT by showing it is a priority project for our region by being the applicant. If ,awarded a Mega grant, this would help Colorado be competitive with the nation for securing IIJA funding and helping implement the Governor's IIJA transportation policies. J.
