DETERMINED TO BE EXEMPT FROM THE DEFINITION OF SUBDIVISION
RANGE 68 WEST, TOWNSHIP 4 NORTH, SECTION 18

WHEREAS, on May 5 , 1972 , the General Assembly
of the State of Colorado , enacted Senate Bill #35 as relates
to Chapter 106 of the Colorado Revised Statutes , and
WHEREAS , on August 30 , 1972 , the Board of County
Commissioners of Weld County, Colorado , adopted Subdivision
Regulations for Weld County, Colorado to comply with the
prescribed Senate Bill #35 , and
WHEREAS, the Weld County Planning Commission
has recommended to the Board of County Commissioners for
recording of plat number 1061- 18- 3-RE98 as provided in
Section 9 of the Subdivision Regulations (exemption rules and
regulations) for Weld County, Colorado.
Said division of land determined to be exempt
from the definition of subdivision is more particularly
described as follows :
All of the East Half of the Southwest Quarter of Section 18 ,
Township 4 North, Range 68 West of the 6th Principal Meridan,
County of Weld, State of Colorado, more particularly described
as follows :
Considering the South line of said Southwest Quarter as bearing
North 89° 32 ' 39" East with all bearings contained herein relative
thereto .
Beginning at the Southwest Corner of said Section; thence along
the South line of said Southwest Quarter North 89 °32 ' 39" East
1, 132 . 26 feet to the Southwest Corner of the East Half of said
Southwest Quarter ; thence along the West line of said East Half
North 1°04 ' 13" East 30 . 01 feet to a point on the North Right of
Way Line of Colorado State Highway 56 , said point being also the
TRUE POINT OF BEGINNING . Thence continuing North 1°04' 13" East
2 , 577. 52 feet to the Northwest Corner of said East Half; thence
along the East-West Centerline of said Section 18 North 89° 19 ' 15"
East 925 . 78 feet to the Northeasterly line of Parcel 6 as shown
on that certain plat recorded under Reception Number 147081 in
Book 5 of Maps , Page 20 , Records of said County ; thence along said
line South 39°02' 09" East 651. 69 feet to the North- South Centerline
of said Section; thence along said Centerline South 0°57' 51" West
2 , 071. 39 feet to the North Right of Way Line of said Highway;
thence along said North Right of Way Line South 89°32 ' 39" West
1, 349 . 48 feet more or less to the TRUE POINT OF BEGINNING.
The above described Parcel contains a gross acreage of 77 . 30 Acres
more or less .
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners of Weld County, Colorado, that the
Chairman be and he is hereby authorized to sign the plat of a
division of land determined to be exempt from the definition
of Subdivision No. 1061- 18- 3-RE98 , for recording .
The above and foregoing resolution was , on

Dear Burman:
We have reviewed the Application Record Exemption, Case
No. 1061-18-3-RE 98 (Pennock).
The subject case lies adjacent to and along the north
side of State Highway 56. Any future improvement along State
Highway 56 would require a minimum right of way of 120° (60'
from centerline) with a desirable right of way width of 150'
(75' from centerline).
When the last improvement was made on State Highway 56,
the Division of Highways purchased 75' of right of way from
centerline in those locations where right of way was purchased.
It would be our recommendation, therefore, that 75' from center-
line be used as the criteria for any reservation, setback, or
dedication of right of way.
