RESOLUTION WHEREAS, a public hearing was held on December 9, 1974, in the chambers of the Board of County Commissioners, Weld County Colorado, for the purpose of hearing the petition of Vessels Gas Processing, Ltd. , c/o David P. Hoover, Nine Flags Building, 180 Cook Street, Denver, Colorado, requesting approval of site for the construction of a gas pro- cessing plant and supporting facilities on the following described property, to-wit: Description of a portion of the Northeast 4 of Section 31, Township 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado,described as follows: Beginning at the Northeast Corner of Section 31, Town- ship 1 North, Range 65 West of the 6th P.M. Thence South 00°00'00" West 2652. 60 feet along the East line of said Section 31 to the East n Corner of said Sec- tion 31, said 4 Corner being also on the Northerly right- of-way line of a Public Service Company of Colorado utility easement; Thence North 89°23'14" West 1991. 69 feet along said Northerly right-of-way line of said utility easement to the Southeasterly right-of-way line of a Burlington Northern Railroad right-of-way; Thence North 36°41'24" East 3281. 72 feet along said Southeasterly right-of-way line of said railroad to the North line of said Section 31; Thence South 89°32'28" East 30. 80 feet along said North line of Section 31 to the Point of Beginning. The above described tract contains a gross area of 61. 57 acres, more or less, and WHEREAS, the petitioner was present, being represented by David P. Hoover, Consulting Engineer for Vessels, and by Phil Tracy, Gas Engineer for said company, and WHEREAS, there was some opposition to the request of petitioner for the location of said gas processing plant and supporting facilities, and WHEREAS, said requested location for said gas processing plant and supporting facilities is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County, said location for said gas processing plant and supporting facilities may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Vessels Gas Processing, Ltd. , c/o David P. Hoover, Denver, Colorado, to locate a gas processing plant PL0804 740394 and supporting facilities on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect said construction of said gas processing plant and supporting facilities and that it shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That such gas processing plant and supporting facilities shall be limited to the items as shown on plans as submitted and attached hereto and made a part hereof by reference. 4. Subject to a suitable chain-link fence six feet high being erected around the perimeter of the aforementioned gas storage and transmission facilities. 5. That all structures erected upon said premises be removed within one year from the time that said gas processing plant and supporting facili- ties cease to operate and are closed. 6. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Are referring to this as the Space City Gas Processing Plant (same thing as Lochbuie since Space City is now incorporated). Closest trailer is about a mile and a half. This will be a place to collect (gather) natural gas that has certain liquids in it, and process the liquids and then return the gas to a main transmission line. Highest tower is 56 feet high. You can barely see the property from the highway (80-S) . Will not be a hazard to air traffic. Will have to change their entranceway a bit. They have an existing crossing. Plan to either extend it and make a turn in across this natural drainage; or move it in some way that would be satisfactory to the County Engineer. Will need three trailer houses, 50' x 50' office building, set up on a septic tank system (individual ). Planning staff made a slide presentation showing different views of the property. Planning staff recommends this request be tabled for the following reasons: Subject to receipt of addi- tional information and/or plans clarifying the following: (1 ) Fire pro- tection; (2) State Health Dept. comments; (3) County Health Dept. comments (do have a letter from Mr. Paul now); (4) Signatures on well permit applications; (5) Water quality test on existing well . There is a question as to whether the road will stand up under heavy truck traffic due to an existing seep problem. Water stands in barrow ditches on each side of the County Road; (15) Plans for preventive pollution of ground water table due to seepage from burn pits; (16) Mobile homes meeting Uni- form Building Code requirements; (17) Landscaping plans to reduce visibi- lity from I-80; (18) Location of existing shallow well to be used for domestic use. Mr. Hoover replied to the fire protection question first. He stated that they would be complying with the regulations of OSHA (Office of Safety and Health Administration). Had run their own perc tests and found mostly sandy loam. The water table was variable about 4 foot 6 inches down and in the vicinity about 2 feet lower in elevation than the new plans sub- mitted for the mobile home area, storage area and office building. However, Mr. Hoover stated that he has combined these and moved them to an area where the water table level should be about 6 feet down. Will probably have to conduct another perc test to determine actual depth of water table. Mr. Fortner stated that the Planning Office had received a letter from the County Health Dept. The office building will need an engineer designed septic system and they highly recommended that the trailers be hooked up to inidividual septic tanks. Before final approval will be given by the Health Dept. , they require an 8 foot core drilling at the final site where the systems are to be installed. Mr. Paul stated that the perc tests were good. Mr. Paul stated further that he did not think they had to work with the State Health Dept. if they were going to have individual septic tanks for the trailers. There is a water well there presently for domestic use. Mr. Honn read the letter from the State Highway Dept. regarding the burn pit, shielding of. Felt that it could be a distraction to the highway users. Mr. Hoover did not feel that the burn pit would be in operation once the plant was developed. Would like the Highway Dept. to reconsider their requirement. Suggested that they get together with each other and see if they couldn't work something out. Think they are in the Hudson Fire District, but not sure. Need to check with the County Engineer regarding fire protection requirements. Need this information submitted prior to putting on County Commissioners' agenda. County Engineer had a few questions regarding their using a county road and what repair they were ready to do as this was a poor road and any heavy truck usage could deteriorate the road that much faster. Need more detail shown on the plans. Would also like a cross section of the spill protection around the tanks shown on the plans. Will have a cyclone type fence around the area. Can't really see anything except maybe the tower from the road, 1078 They are quite willing to clean up the area after the life of the operation is through. About the only time the burning pit will be used is in the case of an emergency, and then only for approximately an hour until problem is solved. About four to five wells will feed into this plant. Expected longevity is from 10 to 20 years, but closer to 10. The wells are located in about a two mile radius. RESOLUTION: Be it therefore resolved to recommend approval to the County Commision- ers subject to the following: Being fully aware of the need and necessity for the objections of the Planning staff and County Engineer; and in as much as the gentlemen have properly stated that they can get together and solve the problems and objections, time being of essence, and as soon as the information is received being put on the County Commissioners agenda. The adjacent county road may not stand up to heavy truck traffic due to the existing seep problem. Water is standing in the borrow ditches on each side of the county road. 11-. It appears that the proposed entrance is opposite an existing cross road pipe culvert. This should be verified by field survey and shown on the plan. .$( It appears that the City of Lochbuie' s sanitary sewer "discharge may cross this site and could cause future drainage problem. L. E. Epperson, Halliburton Resource Management, Inc. , and I visited with Mr. John Gettman, Jr. , Hudson Fire Chief, on October 28th concerning the above captioned subject on the Space City Gas Processing Plant. Mr. Gettman was agreeable to our fire protection plan which conforms to insurance, state and federal (OSHA) require- ments. When the plant is completed, we will invite the fire department to inspect it for additional fire protection suggestions. At that time, we will give them a key to the gate and instruction on containing a fire in and around a gas processing plant. If they determine that any additional equipment should be required, we will be willing to conform to any reasonable requirements. Mr. Gettman suggested that we install enough shut-off valves to enable the gas (or other fire sources) to be shut off so the fire can be contained. " We will not construct a burning pit to serve the gas processing plant. We will use the existing burning pit shown on the plot plan, which is used in conjunction with the regular production equipment serving the well located on these premises. This pit will no longer be used to burn off excess gas from the producing facilities once the gas processing plant is installed and operating. It is only in the event of equipment failure at either the processing plant or the producing facilities that there will be natural gas flared and burned in the burning pit. If this condition were to exist for a period in excess of one hour, the wells producing into the system would be shut-in due to the waste of the valuable natural gas product. In addition to the foregoing, once the plant is installed and operating, several of the gas flares now located closer to the highway will no longer be present except in the case of equipment failure. The gas which would otherwise be flared and burned off will go to the plant for processing and will be sold to a major transmission gas line. Highway I-80S passes within 1,000 ' at its closest location to the existing burning pit which is the one that will serve the proposed processing plant. We submit that by installing the gas processing plant, we are doing all that is economically feasible and reasonable to clean-up the gas flares in the area, and that to shield a gas burning pit with metal, the only thing that would not burn up, would create additional glare during the limited periods in which gas would be flared and burned. In our opinion, the one burning pit at its location does not create a distraction or a glare hazard on I-80S. Mr. Gary Fortner October 9 , 1974 Page Three "No. 7. Letter from Lochbuie (Mayor said they had no objections) . " It is our understanding that the City of Lochbuie has no objections to our proposed gas processing plant at this location. If a letter from the City of Lochbuie stating their approval is considered necessary by the Planning Commission, it is recommended that the Planning Commission obtain same prior to the County Commissioners ' Hearing. However, the usual procedure would be for the City of Lochbuie to state their objections at either the Planning Commission Hearing or The County Commissioners' Hearing, or both. "No. 13. Verification of whether or not City of Lochbuies' sanitary sewer discharge will cross the site. If so, how will it be accommodated. " It is our understanding that the sewer discharge from the City of Lochbuie does not cross the highway or the site, and in the future all such discharge will lie on their side of I-80S, or approximately NW of the highway. "No. 15. Plans for prevention pollution of ground water table due to seepage from burn pits. " The primary purpose of a burning pit such as the one to be used is for the burning off of natural gas otherwise vented into the atmosphere. Obviously, there can be no pollution to ground water due to seepage from such a pit. Only through a highly unusual malfunction of equipment would crude oil or liquified petroleum gases be discharged in such a pit, and, if so, the small quantity would be immediately burned, thereby removing any possiblity of seepage causing pollution of any ground waters. Mr. Gary Fortner October 9 , 1974 Page Four "No. 17. Landscaping plans to reduce visibility from I-80 . " As submitted in our application, the plans call for the erection of a metal chain link fence 6 feet high completely enclosing the gas processing plant, office-warehouse and mobile home area. In addition to the fence, facilities such as this properly painted and installed with order and neatness in mind, is not an objectionable scene from I-80S , or any other road in the area. However, most of the plant site will be on the other side of a high fill constructed by the railroad, and only 20 feet or so of the tower can be seen from I-80S in the immediately vicinity of the proposed gas processing plant. In the event portions of the balance of the area are used for equipment storage, this will also be fenced separately with the commonly used beautifying fence material. "No. 18. Location of existing shallow well to be used for domestic use. " Inasmuch as the existing shallow well will not be used for domestic use or plant use, the location of same seems to be irrelevant; however, it will be located on the revised plans being submitted. If any of the foregoing needs further clarification prior to setting a date for the County Commissioners ' Hearing in this regard, please notify us at your earliest convenience. As the oil is being produced, gas is otherwise vented or wasted unless it is gathered, processed and sold. In fact, when the ratio of gas to oil is found to be excessive, it is unlawful to produce the oil without marketing the gas. Further, many of the marginal oil wells would not be drilled in this area unless the gas could be marketed making it economically feasible to drill for oil. Therefore, in most instances the production of oil necessarily involves the marketing of the associated gas. To accomplish this end, the proposed operation is an integrated plan designed to process the gas , yielding vitally needed propane and butane, natural gasoline , and possibly ethane, as well as permitting oil to be produced which otherwise might not be. In addition, a specification natural gas will be produced and sold to a natural gas pipeline in the area. Without this ability to produce a specification natural gas , the gas produced with the oil could not be sold. The natural gas processing plant will condition the gas for sale which is produced from the surrounding oil wells and possibly an occasional gas well. In so doing it will also produce a propane product, a butane-natural gasoline product and possibly an ethane product. The equipment consists primarily of the inlet gas compressors , a refrigeration compressor, heat exchangers for cooling the natural gas, processing towers for absorbing and separating the natural gas liquids, a heater for providing the necessary process heat, storage facilities and truck loading facilities for the liquids produced, and a unit to remove water from the natural gas stream. Weld County Planning Commission August 20 , 1974 Page Two A minimum of air pollution can be expected from the exhausts of the natural gas powered gas compressors, refrigeration compressor and the natural gas fired heaters. The only water discharged from this equipment will be in the form of steam from the unit that removes water from the natural gas. When the propane product is sold for direct resale to consumers , a mercaptan odorant is added to the product for safety reasons. With the proper installation and operation of the mercaptan injection system, there will be no objectionable odors coming from same. Some noise levels will be produced by the com- pressors and to a lessor extent by the process air exchangers using electric motor driven fans. As with any equipment handling flammable liquids and gases, there is a certain fire hazard inherent in this operation. Again, this can be minimized with proper installation of the equipment and its operation. As the natural gas processing equipment will initially produce approximately 20 ,000 gallons of liquid produce per day, one can expect two or three tanker truck loadings per day. Additional traffic can be expected from operation and maintenance personnel driving to and from the plant. The housing units and separate office for the processing plant are considered necessary for the efficient operation of the plant. It is most important that there be three resident operators as they will contribute significantly to increase plant efficiency, safety and security. Necessary sewage facilities will be provided with septic tanks and leach fields capable of handling foreseeable effluent and will be approved by the County Health Department. The maintenance shop and area production office are necessary in order to maintain an efficient and economic operation of the producing wells in the area. The personnel attendant to the operation will not live on the premises and will drive to and from these facilities during the day as their use becomes necessary. Minimum air pollution can be expected from this operation and the toilet facilities in the office and shop will be served by a septic tank and leach field approved by the County Health Department. The balance of the area will be for storing equipment necessary for operating the plant and equipment necessary for completing and producing the wells in the area. There- fore, it will have casing and tubing storage racks; an area sufficient to park a service rig; and an area to store wellhead equipment; oil and gas separators; heater-treaters and miscellaneous production equipment. Noise, glare, fire and other safety hazards would be at an absolute minimum. One could expect approximately a three to four truck per day increase in traffic use in the immediate area. Water for the aforementioned proposed facilities should not exceed 5 ac. ft. per year. At present, there is a shallow domestic water well located on the site and capable of producing most of the required water. However, due to the life of this project and its projected water use, a water well application has been filed with the Board of Water Resources for a well to be completed in the Fox Hills Acquifer, the use of which will be limited to the proposed facilities. Summary of proposed facilities considered necessary in association with operations as described above. 1. Natural gas processing plant and equipment. 2. Housing for plant operators. 3. Office incident to plant operation. 4. Area production office and equipment maintenance shop. 5. Equipment storage yard. David P. When the propane product is sold for direct resale to consumers, a mercaptan odorant is added to the product for safety reasons. With the proper installation and operation of the mercaptan injection system, there will be no objectionable odors coming from same. Some noise levels will be produced _by the com- pressors and to a lessor extent by the process air exchangers - `using electric motor driven fans. `'l -- - Aswith any equipment flammable liquids and handling q gases, there is a certain fire hazard inherent in this operation. 1 ; Again, this can be minimized with proper installation of ^ ` , he equipment and its operation. As the natural gas processing equipment will initially produce approximately 20 ,000 gallons of liquid produce per day, one can expect two or three tanker truck loadings per day. • Additional traffic can be expected from operation and maintenance personnel driving to and from the plant. The housing units and separate office for the processing plant are considered necessary for the efficient operation of the plant. It is most important that there be three resident operators as they will contribute significantly to increase plant efficiency, safety and security. Necessary f`�� r; sewnc.e�fac ities will be provided with septic tanks—and -leach_ �`" _fi.elds___ca_ ah1e_ of _handling- foreseeable effluent and will be �;1'�J' `\' approved by the Cunty Health Department. - The maintenance shop and area production office are necessary in order to maintain an efficient and economic operation of the producing wells in the area. The personnel attendant to the operation will not live on the premises and will drive to and from these facilities during the day as their use becomes necessary. Minimum air pollution can be expected _ from this operation and the toilet facilities in the office end shop will be served by a septic tank and leach field approved by the County Health Department. The balance of the area will be for storing equipment necessary for operating the plant and equipment necessary for completing and producing the wells in the area. There- fore, it will have casing and tubing storage racks; an area sufficient to park a service rig; and an area to store wellhead equipment; oil and gas separators; heater-treaters and miscellaneous production equipment. It was stated on the individual sewage system permit application that an office and 3 mobile trailers would be installed at this site. The Rules and Regulations governing the installation of Individual Sewage Disposal Systems in Weld County state that all commercial buildings shall have a system designed by a registered professional engineer which would include the proposed office building. It is highly recommended that the trailers be connected to individual systems rather than one large system, and these systems could be de- signed by our office. At the time the percolation test was run, a high water table was noted at 4'6" . It is our understanding that the original plot has been moved to higher ground.
