RESOLUTION RE: APPROVE REQUEST TO TEMPORARILY EXTEND THE HOURS OF OPERATION FOR AMENDED USE BY SPECIAL REVIEW PERMIT, AMUSR-1102, FOR MINERAL RESOURCE DEVELOPMENT INCLUDING OPEN PIT MINING AND MATERIALS PROCESSING (SAND, GRAVEL AND STONE), INCLUDING CONCRETE AND ASPHALT RECYCLING AND A CONCRETE AND ASPHALT BATCH PLANT FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - L.G. EVERIST, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on May 18, 2011, the Board of County Commissioners of Weld County, Colorado, approved the application of L.G. Everist, LLC, Attn: Lynn Shults, P.O. Box 5829, Sioux Falls, South Dakota 87117, for a Site Specific Development Plan and Amended Use by Special Review Permit, AmUSR-1102, for Mineral Resource Development including Open Pit Mining and Materials Processing (sand, gravel and stone), including concrete and asphalt recycling and a concrete and asphalt batch plant facility in the A (Agricultural) Zone District, for property which is described as part of Section 32, Township 3 North, Range 67 West of the 6th P.M., Weld County, Colorado, and WHEREAS, Development Standard #23 was approved, to read as follows: "Section 23-4-290.8 of the Weld County Code limits the hours of operation for sand and gravel operations to the hours of daylight, except in the case of public or private emergency, or to make necessary repairs to equipment. Hours of operation may be extended with specific permission from the Weld County Board of County Commissioners. This restriction shall not apply to the operation of administrative and executive offices or repair and maintenance facilities located on the property." WHEREAS, the Board of County Commissioners has been presented with an email from L.G. Everist, Inc., dated May 8, 2023, requesting an extension of the hours of operation at the Firestone Gravel Resource site (AmUSR-1102) for early morning concrete pours scheduled to begin at 2:00 a.m. on May 16, 2023, and May 18, 2023, for the Elevations 25 project. If unforeseen circumstances prevent the pour(s), they will be rescheduled, with notification being sent to the Weld County Department of Planning Services, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Department of Planning Services, and having been fully informed, finds that the hours of operation be, and hereby are, extended to accommodate early morning concrete pours scheduled to begin at 2:00 a.m. on May 16, 2023, and May 18, 2023, for the Firestone Gravel Resource site, Elevations 25 project. cc :P1.(TP/mw). 05 /31123 2023-1361 PL1022 REQUEST TO EXTEND HOURS OF OPERATION FOR AMENDED USE BY SPECIAL REVIEW PERMIT (AMUSR-1102) - L.G. Everist, Inc. to extend their hours of operation associated with AMUSR-1102 to accommodate concrete pours on I-25 associated with several elevated structural decks. Tuesday 5/16/23 & Thursday 5/18/2023 The mine associated with this project is located near CR 15 and CR 26.75. According to the request, the activity is expected to take place on Tuesday 5/16/23 & Thursday 5/18/2023 beginning at 2am. Additional requests for the latter half of May and early June are forthcoming. The County Commissioners shall authorize this request as stipulated in the USR Resolution. Development Standard No. 23 states, "Section 23-4-290.B of the Weld County Code limits the hours of operation for sand and gravel operations to the hours of daylight, except in the case ofpublic or private emergency, or to make necessary repairs to equipment. Everist requests allowance for our lessee, Holcim, to operate a night pour this week, and 6 subsequent weeks, 1 night per week. I am sorry this is such short notice, but I just got this email and letter sent from Holcim (was Aggregate Industries) — the operating company of the concrete batch plant at our USR-1102 Firestone Gravel Resource site, located at 12248 CR 15, Longmont. For more details on the night pour, please see below and the contractor's letter (attached). The contractor, Elevated Structural Decks, and Holcim are requesting approval for a night-time pour this Thursday 5/11 to start at 2am. The contractor's project is located at 4460 Elevation Drive in Mead. Holcim will be supplying the concrete for this pour out of the Firestone plant at 12248 County Road 15 Longmont, Co 80504. The pour should last about 6 1 hours, and they suggest a back-up date of Friday, 5/12, depending on weather. etc. They would like to conduct a night pour for 6 subsequent weeks, 1 night per week. As always.. for ease of reference, for you and the Commissioners — here is language from our Firestone Gravel Resource USR-1102 resolution about requesting extended hours: 23.
