CLARKE AND KRISTINE STOESZ
A public hearing was conducted on March 29, 2023, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 15, 2023, and duly published
February 17, 2023, in the Greeley Tribune, a public hearing was conducted to consider the
request of Clarke and Kristine Stoesz, for a Site Specific Development Plan and Use by Special
Review Permit, USR22-0034, for a Campground outside of subdivisions and historic townsites in
the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter
of record.
Chair Freeman reviewed the procedures to follow should this case result in a tie vote, due to
four (4) Commissioners being present and Commissioner James being excused.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal,
described the sign posting and the location of the proposed site, which is within the
Intergovernmental Agreement Area (IGA) of the Town of Berthoud, as well as the Town of Mead,
who returned a Notice of Inquiry Form (NOI) indicating they would not seek annexation of the
property. He shared the site is also within the three (3) mile referral area of the Towns of Berthoud,
Mead, and Larimer County, although it is outside of Berthoud's Growth Management Area.
Additionally, the Town of Mead's 2021 Future Land Use map designated the area as
A (Agricultural), and he described adjacent Uses. Mr. Ogle stated nine (9) Notices were sent to
surrounding property owners, and no responses were received. He shared the short -term -stay
campground will utilize two (2) existing recreational vehicles which have been converted into tiny
houses on wheels for paying guests. He relayed the property owners started a non -government
organization entitled Ukraine Open Outreach in 2007, offering humanitarian aid to orphans, single
moms, the elderly, and now, the monies generated from this campground will support the

organization, in aid to the many displaced and homeless people caused by the conflict in Ukraine.
Mr. Ogle stated the Little Thompson Water District currently serves the subject property with a
residential tap, #370, from a water line on County Road 5, and an On -site Wastewater Treatment
System provides sewer disposal. Mr. Ogle relayed the property has an active Code Compliance,
Violation, ZCV22-00182, which was initiated due to the presence of an unpermitted, commercial
campground. He explained, if the application is denied, staff will issue a 30 -day Notice for legal
action to remove all associated commercial operations. He described the proposed site, stated a
Drainage Narrative has been submitted, and confirmed the site meets the accepted Stormwater
Drainage Exception. He shared, per the Development Review staff, access is from County
Road 5, which is under the jurisdiction of the Town of Mead. Mr. Ogle entered the favorable
recommendation of the Planning Commission into the record as written and displayed images of
the site and surrounding views.
E Lauren Light, Department of Public Health and Environment, reiterated the existing residence
is served by the Little Thompson Water District, with a septic system permitted for five (5)
bedrooms, the tiny homes would also be served by the Little Thompson Water District, and she
relayed Conditions of Approval (COA) required installation of a permitted septic system for the
tiny homes. She stated Development Standards (DS) #13 - 20 address Environmental Health
items, and there are no outstanding issues with the request.
Clarke and Kris Stoesz, applicants, displayed a PowerPoint presentation (Exhibit F),
explained their desire and assistance of Ukrainian refugees, relayed the history of the building of
the tiny homes on the property, explained the Air B & B business, and the animals and attractions
they provide. Ms. Stoesz stated an engineered septic and leach system is being installed, and
shared their assistance to Ukraine. They talked about the Tiny House Movement, and explained
the NOAH certification, follows the International Building Codes, which are modified for Tiny Home
living. Commissioner Saine relayed the involvement of Weld County and its leadership in the
NOAH project at an Energy and Environment Symposium, extending congratulations to Tom
Parko, who helped inspire legislation on the NOAH project.

la The Board reviewed the COA and DS, Mr. Ogle requested removal of COA #4.A (water tap),
and the Board agreed.
' No public testimony was offered regarding the change made to the Conditions of Approval
and Development Standards.
El In response to Chair Freeman, Mr. and Mrs. Stoesz indicated they have reviewed, and agreed
to abide by, the Conditions of Approval and Development Standards, as amended.
LEI Commissioner Saine moved to approve the request of Clarke and Kristine Stoesz for a Site
Specific Development Plan and Use by Special Review Permit, USR22-0034, for a Campground
outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards, as amended. The motion was seconded by Commissioner Buck,

and it carried unanimously. There being no further discussion, the hearing was completed at
10:20 a.m.
This Certification was approved on the 12th day of April, 2023.
