Therefore, there area number of important requirements which you, as a permittee, should fully understand. These requirements are listed below. Please read and initial each requirement, in the space provided, to acknowledge that you understand your obligations. If you do not understand these obligations then please contact this Office for a full explanation. 1. Your obligation to reclaim the site is not limited to the amount of the financial warranty. You assume legal liability for all reasonable expenses which the Board or the Office may incur to reclaim the affected lands associated with your mining operation in the event your permit is revoked and financial warranty is forfeited; 2. The Board may suspend or revoke this permit, or assess a civil penalty, upon a finding that the permittee violated the terms or conditions of this permit, the Act, the Mineral Rules and Regulations, or that information contained in the application or your permit misrepresent important material facts; 3. If your mining and reclamation operations affect areas beyond the boundaries of an approved permit boundary, substantial civil penalties, to you as permittee can result; 4. Any modification to the approved mining and reclamation plan from those described in your approved application requires you to submit a permit modification and obtain approval from the Board or Office; 5. It is your responsibility to notify the Office of any changes in your address or phone number; 6. Upon permit issuance and prior to beginning on -site mining activity, you must post a sign at the entrance of the mine site, which shall be clearly visible from the access road, with the following information (Rule 3.1.12): a. the name of the operator; b. a statement that a reclamation permit for the operation has been issued by the Colorado Mined Land Reclamation Board; and, c. the permit number. lcu 7. The boundaries of the permit boundary area must be marked by monuments or other markers that are clearly visible and adequate to delineate such boundaries prior to site disturbance; 8. It is a provision of this permit that the operations will be conducted in accordance with the terms and conditions listed in your application, as well as with the provisions of the Act and the Mineral Rules and Regulations in effect at the time the permit is issued. 9. Annually, on the anniversary date of permit issuance, you must submit an annual fee as specified by Statute, and an annual report which includes a map describing the acreage affected and the acreage reclaimed to date (if there are changes from the previous year), any monitoring required by the Reclamation Plan to be submitted annually on the anniversary date of the permit approval. Annual fees are for the previous year a permit is held. For example, a permit with the anniversary date of July 1, 1995, the annual fee is for the period of July 1, 1994 through June 30, 1995. Failure to submit your annual fee and report by the permit anniversary date may result in a civil penalty, revocation of your permit, and forfeiture of your financial warranty. It is your responsibility, as the permittee, to continue to pay your annual fee to the Office until the Board releases you from your total reclamation responsibility. 10. For joint venture/partnership permittee: the signing representative is authorized to sign when document and a power of attorney (provided by the partner(s)) authorizing the signature of the representative is attached to this application. -6 - NOTE TO COMMENTORS/OBJECTORS: It is likely there will be additions, changes, and deletions to this document prior to final decision by the Office. Therefore, if you have any comments or concerns you must contact the applicant or the Office prior to the decision date so that you will know what changes may have been made to the application document. Vegetation in the area of the Extraction Site consists of light native grasses and shrubs. No timber is located on the area of the proposed operation. See Exhibit B-1', Land Cover Map. The map unit descriptions, along with the maps, can be used to determine the composition and properties of a unit. A map unit delineation on a soil map represents an area dominated by one or more major kinds of soil or miscellaneous areas. A map unit is identified and named according to the taxonomic classification of the dominant soils. Within a taxonomic class there are precisely defined limits for the properties of the soils. On the landscape, however, the soils are natural phenomena, and they have the characteristic variability of all natural phenomena. Thus, the range of some observed properties may extend beyond the limits defined for a taxonomic class. Areas of soils of a single taxonomic class rarely, if ever, can be mapped without including areas of other taxonomic classes. Consequently, every map unit is made up of the soils or miscellaneous areas for which it is named and some minor components that belong to taxonomic classes other than those of the major soils. Most minor soils have properties similar to those of the dominant soil or soils in the map unit, and thus they do not affect use and management. These are called noncontrasting, or similar, components. They may or may not be mentioned in a particular map unit description. Other minor components, however, have properties and behavioral characteristics divergent enough to affect use or to require different management. These are called contrasting, or dissimilar, components. They generally are in small areas and could not be mapped separately because of the scale used. Some small areas of strongly contrasting soils or miscellaneous areas are identified by a special symbol on the maps. If included in the database for a given area, the contrasting minor components are identified in the map unit descriptions along with some characteristics of each. A few areas of minor components may not have been observed, and consequently they are not mentioned in the descriptions, especially where the pattern was so complex that it was impractical to make enough observations to identify all the soils and miscellaneous areas on the landscape. 8 Custom Soil Resource Report The presence of minor components in a map unit in no way diminishes the usefulness or accuracy of the data. The objective of mapping is not to delineate pure taxonomic classes but rather to separate the landscape into landforms or landform segments that have similar use and management requirements. The delineation of such segments on the map provides sufficient information for the development of resource plans. If intensive use of small areas is planned, however, onsite investigation is needed to define and locate the soils and miscellaneous areas. An identifying symbol precedes the map unit name in the map unit descriptions. Each description includes general facts about the unit and gives important soil properties and qualities. Soils that have profiles that are almost alike make up a soil series. Except for differences in texture of the surface layer, all the soils of a series have major horizons that are similar in composition, thickness, and arrangement. Soils of one series can differ in texture of the surface layer, slope, stoniness, salinity, degree of erosion, and other characteristics that affect their use. On the basis of such differences, a soil series is divided into soil phases. Most of the areas shown on the detailed soil maps are phases of soil series. The name of a soil phase commonly indicates a feature that affects use or management. For example, Alpha silt loam, 0 to 2 percent slopes, is a phase of the Alpha series. Some map units are made up of two or more major soils or miscellaneous areas. These map units are complexes, associations, or undifferentiated groups. A complex consists of two or more soils or miscellaneous areas in such an intricate pattern or in such small areas that they cannot be shown separately on the maps. The pattern and proportion of the soils or miscellaneous areas are somewhat similar in all areas. Alpha -Beta complex, 0 to 6 percent slopes, is an example. An association is made up of two or more geographically associated soils or miscellaneous areas that are shown as one unit on the maps. Because of present or anticipated uses of the map units in the survey area, it was not considered practical or necessary to map the soils or miscellaneous areas separately. Date Prepared: 6/16/2023 3:40:21 PM EXHIBIT C Rule 6.3.3 Mining Plan Overview of Operation This operation is being permitted as an 110c exploratory frac sand operation since the size of the bulk samples required exceeded the limitation of a normal Notice of Intent (approximately 5000- 7000 tons/well). However, it is still exploratory in nature since the results from obtaining these larger bulk samples will determine if the deposit is of sufficient quality to meet the requirements of the end users. The other exploratory aspect of this site is to determine if the processing methods can be appropriately scaled up to a larger operation. If the results are favorable, it is the intent of the applicant to move forward with permitting a larger 112c operation in the same general vicinity of this exploratory site. If the results are not favorable, the site will simply be reclaimed as described in the reclamation plan. (a) Commencement and Duration of Mining Operation: The mining operation will commence upon receipt of approval from the Colorado Division of Reclamation, Mining, and Safety and receipt of other necessary permits. As sand excavation and processing will be seasonal, this operation is intended to be an intermittent operation and used for less than one hundred and eighty days per year pursuant to the provisions of C.R.S. § 34- 32.5-103(11)(b). The operation will last approximately 5 years from commencement. (b) Topsoil replacement depth: Approximately 6-12 inches of topsoil will be removed and stored as shown in the attached Exhibit C-1 (Mining Plan Map) and replaced during reclamation. Removed topsoil will be reseeded as necessary to protect from erosion. Any necessary reseeding will utilize the seed mix and application methods described in the table below. Topsoil stockpiles will be stored in places and configurations to minimize erosion and located in areas where disturbance by ongoing mining operations will be minimized. Once stockpiled, the topsoil shall be rehandled as little as possible until replacement on the regraded, disturbed area. Applicant will double the rate should the broadcast seeding method be used. In addition, annual oats may be used as a companion/nurse crop if the seeding season is favorable (March -September) when revegetating the topsoil and overburden stockpiles. (c) Thickness of overburden: There is little to no overburden available at this site. However, there will be a by-product of the processing which is oversized sand. This product will be stockpiled and then used during reclamation by replacing it across the extraction area first followed by topsoil/top sand replacement on top. If in place for more than 180 days, overburden stockpiles will be seeded with the seed mix identified in section (b), above. (d) Thickness of deposit to be mined: The Applicant currently estimates that the deposit to be mined may be approximately 20-30 feet thick. The target deposit in this application is a horseshoe shaped dune in the southeast portion of the permit area. Mining will commence in the northwest toe of this dune and proceed to follow the dune along its southwestern boundary, then east to the southeast corner and then back northwest along the eastern boundary. The dune will be completely removed at the completion of mining, leaving a level area equal in elevation to the surrounding area. (e) Major Components of Mining Operations: As depicted in Exhibits A-1 through A-3 and C-1, the Extraction Site will be accessible via the Existing Access Road. The Existing Access Road will not be part of the permitted acreage. This Existing Access Road will not be substantially upgraded but will be maintained as necessary for this operation and for the landowner and by Applicant to allow access to the extended access road. This road will be used for all access to and from the Extraction Site, including hauling. Equipment will be staged on the northwest part of the mining area as shown on the mine plan map. The loadout out will be adjacent to the lease road. Any topsoil will be removed using a front end loader and stockpiled as described in (b), above. The applicant intends to excavate only sand from the site. Using front end loaders, the Applicant will excavate sand material from the pit starting at the northwest portion of the extraction area, then moving in a southeasterly direction through the site. Material stockpiles will be placed between the equipment area and the mining area as depicted on the mine plan map. The raw material stockpile will be fed via jump conveyor into the portable rotary dryer/baghouse. This material will then be fed to the portable screening facility where over and under sized material will be removed and placed in a stockpile adjacent to the topsoil stockpile. The target product will then be conveyed via a radial stacking conveyor to the finished frac sand stockpile where it will be temporarily stored. Material from the finished stockpile will then be loaded onto trucks at the scale using a portable loading conveyor. There is no plan to excavate below this grade. A temporary covered storage will be erected on the site to store finished product before loading and hauling. The loading area will be adjacent to the Existing Access Road. Here, materials will be placed into semi -trailers, sand boxes and or/ dump trucks for transportation off site. A rented portable toilet will be present at the site. There will be no other permanent structures constructed on or present at the site, including but not limited to offices, shop/maintenance buildings, plants, processing facilities, and any underground openings such as adits or ventilation facilities. (f) Dimensions of Significant Land Disturbance: The entire area will be disturbed with the most significant disturbance being removal of the dunes in the southeast section of the permit area. The approximate dimensions of the Extraction Site (including excavation area, stockpiles, etc.) are shown on Exhibit C-1. (g) Road Dimensions: The dimensions of the Existing Access Road are shown on Exhibit C-1. This road will not be included in the permitted acreage as it is a pre-existing structure and will remain for the landowner's use after mining. There will be no new drainage and runoff conveyance structures associated with the Existing Access Road. There will be some internal roads as shown on the mining plan map. Some of these may be slightly improved by surfacing with a gravel road base. This material will be removed at the completion of mining and prior to final reclamation. (h) Operation Water Use: As necessary, Applicant will purchase water for dust suppression and other nonsubstantive industrial uses on the site. Applicant estimates that it may use approximately 2000 gallons of water per operating day for these purposes when mining and or trucking is occurring. (i) Groundwater/Surface Water Disturbance: Groundwater will not be exposed by the mining activities. The Applicant expects that there will be no impact to groundwater from the proposed operation. In addition, the proposed operation will not result in any impact to surface waters. Stormwater runoff from disturbed areas will drain into a small sump/basin at the north end of the equipment parking area and will seep into the ground within 72 hours. The pit floor will be graded as extraction occurs at a 1-2% slope in order to direct runoff into this sediment trap at the northeastern end of the Extraction Site. Applicant plans to manage storm water by utilizing best management practices based on guidance from the Colorado Department of Transportation Erosion Control and Storm Water Quality Guide.' Sediment transport from storm water will be minimal as the entire area consists of very porous sand. In addition, this sand substrate will facilitate the infiltration of captured stormwater within 72 hours. (j) Existing Water Rights: Existing water rights will not be affected by the mining activities. (k) Refuse and Acid or Toxic Materials: There are no known refuse, acid, or toxic- producing materials in the area of the proposed pit. If they are encountered, operations will cease and the materials will be contained in accordance with applicable laws and regulations. (1) Measures to Minimize Disturbance to Hydrologic Balance, Off -Site Damage, and Provide for a Stable Configuration of the Reclaimed Area Consistent with the Proposed Future Land Use: Hydrologic Balance — The proposed operation's impacts on the hydrologic balance will be minimal. Groundwater will not be encountered and surface water will be managed as outlined in the previous section and in the stormwater management plan. Off -site Damage — The boundaries of the site will be clearly marked to prevent off -site damage during the excavation activities. Stable Configuration — During mining, side slopes in the excavation area will be managed for stability and safety of the equipment operators. Upon final reclamation, the entire site will be relatively level with a slight (1% to 2%) grade to the northwest. This area will be aggressively revegetated to provide for a stable post -mining configuration of rangeland. (m) On -Site Processing: Onsite processing will consist of first drying the raw product followed by dry screening using portable equipment for both activities. The only waste product will be over and under sized sand which will be utilized during reclamation as a subsoil prior to replacement of topsoil. Best Management Practices during Mining Activities: The Excavation Site is located in a predominately sandy area and consists of extremely porous sand. The sand substrate will also facilitate the infiltration of captured stormwater within 72 hours. Sediment transport from storm water will be minimal due to the sandy nature of the area. Any stormwater runoff from disturbed areas will drain into a small sump/basin/sediment trap at the north end of the equipment parking area and will seep into the ground within 72 hours. Stockpiled topsoil and overburden will be seeded with the seed mix identified in Exhibit C, section (b) in order to stabilize the stockpiles. The pit floor will be graded as extraction occurs at a 1-2% slope in order to direct runoff into this sediment trap at the northeastern end of the Extraction Site. Drainage ditches along the internal access roads inside the Excavation Site will direct any runoff downslope to the sediment trap. II. Best Management Practices for Final Site Reclamation (see Exhibit D for detailed reclamation process): • All disturbed areas will be leveled and reseeded with the seed mixture identified in Exhibit D, section 1(c)(iii). Applicant does not intend to change the current land use. The Applicant's Reclamation Plan Map is attached as Exhibit D-1. Reclamation of the permit area will improve the site to a post -mining land use of improved pasture/rangeland, which is consistent with the surrounding area. Grading will be done, as necessary, to create a grade that conforms to the adjacent topography and natural landforms. Grading will also be done in a manner to control erosion and siltation of the affected lands, and to protect areas outside the affected land from slides and other damage. No highwalls are expected at the site and all slopes leading into the excavated site will be relatively level. Sandy material that is removed during the screening process will be placed directly on top of the excavated area prior to topsoil replacement. Topsoil from the site will then be replaced across the entire site and will be reseeded with a mixture of native grasses to conform with the condition of the site prior to the operation. Seeding will occur during the first favorable season following topsoil replacement. No timber is present on the permitted site. Applicant will take into account the safety and protection of wildlife on the site, at the processing site and along all access roads. The internal access roads will be removed and will be included in the reclamation activities at the conclusion of mining. As the existing access road is not part of the proposed operation acreage and will continue to be used by the landowner during and after the mining activities, the existing private access need not be reclaimed (see section (d) below). The majority of the reclamation will commence immediately upon final extraction of the materials. The site will be monitored seasonally on a monthly basis to determine revegetation success and to evaluate the site stability. All necessary steps will be taken to control soil erosion and repair damaged lands. If after one season the seeding looks to be a failure, reseeding will be done in accordance with this plan. Trash will be removed from the site. Vegetation cleared from the site will be incorporated into the topsoil stockpiles. (1) Details of the Reclamation Plan are as follows: (a) Overburden Replacement: CoProp LLC Page 1 of 5 Construction Materials Limited Impact (110(c)) Operation Reclamation Permit Application Form There is little to no overburden available at this site. However, there will be excess material generated during the screening process that will be used during reclamation. If in place for more than 180 days, screened material stockpiles will be seeded with the seed mix identified in section (c), above. These screened stockpiles will be utilized for excavation backfill and site reclamation. (b) Reclaimed slope gradient: During reclamation, and as required by 2 CCR 407-4 Rule 3.1.5(1), Applicant will grade the site to conform with the natural gradient and contours of the slope and the surrounding area in order to ensure that the site complies with the intended post -reclamation use as rangeland. Applicant will mine and grade the site so as to leave the graded area at no more than 1-2% slope trending southeast to northwest from the excavation site to the access road. Applicant will follow stormwater management best practices published by state and local authorities. The Applicant anticipates that any stormwater will collect at the sump located just north of the parking area and will be quickly absorbed into the soil. Site grading will be developed so that concentrated drainage does not occur. (c) Revegetation Measures to Reclaim the Site (i)Any topsoil previously removed will be replaced as plant growth medium. Applicant expects 6-12 inches of topsoil will be removed, as practicable. All topsoil will be evenly distributed over the areas from which it was removed in thicknesses equal to the original topsoil depths found at the site. Prior to removing topsoil, Applicant shall observe available soils sufficiently to establish quantity and quality in order to ensure consistency during reclamation. Waste sand from the screening process will also be used during reclamation. This material will be spread evenly across the regraded areas at a uniform thickness prior to re -applying topsoil. (ii) The site will be seeded upon completion of the permitted mining activities. Once topsoil has been re -applied, an organic amendment of cow manure will be applied at a rate of 20 tons/acre. The seedbed will then be prepared to eliminate compacted conditions by discing or shallow ripping followed by culti-packing to level and firm up seed bed. Seeding will occur utilizing a grass seed drill or by broadcasting. If broadcasting is utilized, the seed rate will be doubled, and the seed will be incorporated by harrowing following seed application. Straw mulch will then be applied at a rate of two tons/acre followed by crimping. Soil amendments will only be utilized if testing indicates deficiencies, but it is anticipated that none will be necessary given the short amount of time the topsoil will be stored and the use of manure. If deemed necessary based upon soil tests, the type, application rate, and soil incorporation methods of fertilizer application shall be as recommended following soil testing. (iii) Trees and shrubs are not present on the site. The following seed mixture will be used to re -seed the site. The seed rates are in Pounds of Pure Live Seed/Acre. (iv) It is the Applicant's intention to employ drill seeding." 2 As the site is not irrigated, reseeding will occur between October 15 to April 15 (e.g., dormant seeding) if possible. (v) The Applicant will use straw mulch to ensure stand establishment and assist with weed control.3 Applicant will employ the disc crimping method. Mulch shall be applied at a rate of 2 tons per acre. (vi) As trees and shrubs are not present on the site, no planting of any trees or shrubs need occur during reclamation. (vii) Weed control shall be employed for all prohibited noxious weeds and whenever invasion of a reclaimed area by other weed species seriously threatens the continued development of desired vegetation. As necessary, the Applicant will consult with the Weld County Weed Division Supervisor regarding weed control recommendations. Applicant will spray and control noxious weeds throughout the year in accordance with all treatment recommendations. (d) Remaining Structures: There will be no features such as ponds, streams, or buildings remaining on the permit site after reclamation. The landowner owns the Existing Access Road, which is necessary for the landowner to access the subject property, and all land underlying the Existing Access Road. The landowner has been using, and will continue to use, the Existing Access Road for landowner's private use. (e) Other: All features of the reclamation plan have been previously addressed. Existing Access Road. The Existing Access Road is owned by the Owner of the Subject Property. 2. Dirt two -track trail along eastern side of Section 27 (provides access to powerlines). 3. Fences. Notarized structure agreements are attached hereto as Exhibits L-1. The State of Colorado, Division of Reclamation, Mining and Safety ("Division") requires that where a mining operation will adversely affect the stability of any significant, valuable and permanent man-made structure located within two hundred (200) feet of the affected land, the Applicant shall either: a) Provide a notarized agreement between the Applicant and the Person(s) having an interest in the structure, that the Applicant is to provide compensation for any damage to the structure; or b) Where such an agreement cannot be reached, the Applicant shall provide an appropriate engineering evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining operation; or c) Where such structure is a utility, the Applicant may supply a notarized letter, on utility letterhead, from the owner(s) of the utility that the mining and reclamation activities, as proposed, will have "no negative effect" on their utility. ( Construction Materials Rule 6.3.12 and Rule 6.4.19 & Hard Rock/Metal Mining Rule 6.3.12 and Rule 6.4.20) The Colorado Mined Land Reclamation Board ("Board') has determined that this form, if properly executed, represents an agreement that complies with Construction Materials Rule 6.3.12(a), Rule 6.4.19(a), and C.R.S. § 34-32.5-115(4)(e) and with Hard Rock/Metal Mining Rule 6.3.12(a), Rule 6.4.20(a), and C.R.S. § 34-32-115(4)(d). This form is for the sole purpose of ensuring compliance with the Rules and Regulations and shall not make the Board or Division a necessary party to any private civil lawsuit to enforce the terms of the agreement or create any enforcement obligations in the Board or the Division.
