A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
November 9,2023,via Microsoft Teams Meeting.The meeting was called to order by Chair,Michael Wailes,
at 10:00 a.m.
Members Present:Mike McRoberts,Michael Wailes,Jerry Adams,Mark Alessi,Robert Fleck,Amy Mutchie
and Andrew Holder.
Members Absent:Jared Rauch,Jeremy Young,and Shelly Bergstrom.
Also Present:Maxwell Nader,Department of Planning Services and Michelle Wall,Secretary.

Request A Site Specific Development Plan and Planned Unit Development
Final Plan for six(6)residential lots with E(Estate)Zone District
uses and one(1)non-buildable outlot with A(Agricultural)Zone
District uses.
Legal Description: Lot D Recorded Exemption RECX20-0040,being part of the S1/2
N1/2 of Section 33,Township 1 North,Range 66 West of the 6t''
P.M.,Weld County,Colorado.
Location: West of and adjacent to County Road 31;approximately 0.5 miles
north of County Road 2. (See Legal Description for precise
location.)
Maxwell Nader,Planning Services,presented Case PUDF23-0002. He stated that the applicants are
proposing to create 7 lots through the Planned Unit Development Cluster Final Plan process.The PUDF
Cluster process requires a large out lot which does not allow building to occur on it therefore utility easements
are not required.Additionally,the 6 smaller lots will have easements in place that are larger or smaller than
standard easement requirements.Additionally,these easements do not surround the entire boarder of the
lots.
Section 24-3-60.D reads the following"Easements shall be designed to provide efficient installation of utilities
and drainage swales. Proposed easements may be modified by the Utilities Coordinating Advisory
Committee.Public utility installations shall be located to permit multiple installations within the easements to
avoid cross connections,minimize trenching and adequately separate incompatible systems."Therefore,the
PUDF Cluster application shall be scheduled for a Utilities Coordinating Advisory Committee to receive
approval for the easements that do not follow standards set forth in section 24-3-60 of the Weld County Code.
Mr.Nader said in response to the proposed Planned Unit Development Final Plan,specific dimensions for
wet and dry utility easements are being requested by both United Power and Public Service Company of
Colorado dba Xcel Energy.The proposed easements will not meet the Easement Standard criteria set forth
in Section 24-3-60 of the Weld County Code.
The United Power referral dated September 1,2023,stated the following"We respectfully request 5'wide
dry utility easements on the side Lots of 3-5 and a 5'wide dry utility easement on the west side lot on lot 6.
This will allow United Power to bring the electric line north and to set any equipment for the lot(s)if needed."
The Public Service Company of Colorado dba Xcel Energy referral dated August 25,2023,stated the
following"Natural gas distribution facilities require minimum 6-foot-wide utility easements within each lot on
the side of the lot that is drivable pavement(minimum 8-feet wide,6-inches thick)with space for service
truck access and plowing in snowy conditions with a minimum 5-foot clearance from any structure."
Section 24-3-60 states the following criteria are required to be followed:
A.Fifteen(15)feet minimum drainage and utility easements are required adjacent to public road rights-of-
way,unless otherwise recommended by the Utilities Coordinating Advisory Committee for technical
purposes.

B.Twenty(20)feet minimum drainage and utility easements are required along intemal lot lines and shall be
apportioned equally on abutting properties,unless otherwise justified by the Utilities Coordinating
Advisory Committee for technical purposes.
C.Ten(10)feet minimum drainage and utility easements are required along exterior lot lines,unless
otherwise justified by the Utilities Coordinating Advisory Committee for technical purposes.Corner
exterior lots requires fifteen(15)feet.
D.Easements shall be designed to provide efficient installation of utilities and drainage swales.Proposed

Sections 24-3-60.A,24-3-60.B,and 24-3-60.C are applicable for this utility easement request.The newly
created easements along the rights-of-way for the internal road will be larger than fifteen(15)feet,it will
be sixteen(16)feet.The newly created easements along the internal lot lines for the six(6)smaller lots
will be less than ten(10)feet,they will be five(5)feet and only on one side of subject properties.There
are no easements being proposed on the external property boundaries.
The Weld County Department of Planning Services recommends that this request be approved.
Robert Fleck,St.Vrain Sanitation District,stated that normally there is a 10'easement around the property
line and asked Staff if there is a reason it is not required for this case.Staff explained that the applicant is
requesting less because of the cluster PUD and the large lot 7 that will remain open space,but that the Utility
Board has the ability to make that determination.Mr.Fleck stated that this property is close to Brighton and
could see sewer in the future.
Mike McRoberts,Development Review,said that he thinks the easements should meet the Weld County
Code from a drainage standpoint.He explained that when they start building on the individual lots,water will
drain from the east to the west and they will need to have drainage swells between the lot lines in order to not
have run off onto each other's lots.
Andrew Holder,Xcel Energy,said they share the same concerns that the easements have to meet code
because there are so many different utilities that have variances that absolutely have to adhere to.
Motion:Easements shall meet Weld County Code,Section 24-3-60.B.and Section 24-3-60.C.,Moved by
Mark Alessi,Seconded by Mike McRoberts.Motion carried unanimously.
The Chair asked if the Board if they had any other questions or comments.There were no comments.
Motion:Approve the final plan for PUDF23-0002 along with Staffs recommendations,Moved by Andrew
Holder,Seconded by Jerry Adams. Motion carried unanimously.
