BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, JULY 10, 2023
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, July 10, 2023, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

Commissioner Kevin D. Ross
Commissioner Lori Saine

• MINUTES: Commissioner Buck moved to approve the Minutes of the Board of County
Commissioners meeting of June 26, 2023, as printed. Commissioner Saine seconded the motion and it
carried unanimously.
• CERTIFICATION OF HEARINGS: Commissioner Ross moved to approve the Certification of
Hearings conducted on June 12, and 26, 2023, as follows: 1) Service Plan for First Five Years Early
Childhood Development Service District — Early Childhood Alliance, and 2) Community Development
Block Grant (CDBG) 2022 Consolidated Annual Performance and Evaluation Report. Commissioner
Buck seconded the motion, which carried unanimously.
• AMENDMENTS TO AGENDA: Commissioner Saine moved to add a pending Code Ordinance
allowing employees with Concealed Carry Permits to have their firearm on their person while on Weld
County property. Commissioner Ross stated he is not willing to circumvent the process that is currently
in place, citing this Code Ordinance has already been publicly noticed for July 19, 2023, and there is a
work session scheduled to discuss this matter. He further stated employees are currently able to carry
their firearm with a permit, if given permission to do so. After discussion, there was no second to the
motion, therefore, the motion failed.
CONSENT AGENDA: Commissioner Ross moved to approve the Consent Agenda, as printed.
Commissioner James seconded the motion, and it carried unanimously.

• COMMISSIONER COORDINATOR REPORTS: Commissioner James stated he attended the State
Transportation Advisory Committee (STAC) and the North Front Range Metropolitan Planning
Organization (NFRMPO) meetings last week, and reported there was continuing discussion surrounding
the funding process. Commissioner Buck acknowledged various parades she attended and/or was
involved in to celebrate Independence Day. Commissioner Ross congratulated Walker Martin, former
Eaton High School Reds' baseball player, on his second round draft to the San Francisco Giants for
Major League Baseball. Commissioner Saine reported she attended the CML Conference, and
expressed the timing of the subject matter was impeccable regarding collaboration, leadership, and
vision. She stated that community dinners with communities are continuing with Towns of Severance,
Keenesburg, Fort Lupton, Platteville, Hudson, and Eaton, as a follow-up to questions being posed. In
addition, she will be attending a dinner tonight with the Town of Erie to discuss projects concerning State
Highway (SH) 7, and SH 52, and possible collaboration concerning Proposition 123, and a model village
for autistic children. Commissioner Saine further stated she met with Life Bridge Christian Church, which
has provided wraparound services for foster families for over six (6) years in Boulder County, and has
been successful at serving their community.
• PRESENTATIONS
1) PRESENTATION OF THE FAIR BOOK BY WELD COUNTY FAIR ROYALTY: Chair Freeman invited
the 2023 Weld County Fair Royalty to make their presentation of the Fair Book. Avery Loveland, Fair
Queen, thanked the Board for the recognition of the Weld County Fair and Royalty, stated she will be a
senior at Valley High School in Gilcrest, Colorado, holds the position of Secretary for the Future Farmers
of America (FFA) chapter provided through the school, and further listed all the events that she and other
Royalty have attended throughout the past year. Laura Stevens, Weld County Fair Attendant, stated she
is a recent graduate of Valley High School, and highlighted the 4-H events at this years' County Fair.
Caitie Holcomb, Weld County Fair Attendent, stated she will also be attending her senior year at Valley
High School, holds the position of President for the FFA chapter, and spoke on the general events to be
held in the Grandstand Arena. The Commissioners, in turn, commended the Fair Royalty Court for
representing Weld County and showcasing all of the participant projects. They thanked the fair sponsors,
recognized the agricultural heritage of Weld County, expressed their pride in hosting the 2023 Fair, voiced
their appreciation of the benefits of 4-H and pride in the young leadership in Weld County agriculture,
and thanked Pat Kindvall for serving as the Royalty sponsor. (Clerk's Note: The group gathered for a
photo opportunity.)
• WARRANTS:
1) GENERAL WARRANTS - JULY 6, AND 7, 2023: Commissioner Buck moved to approve the General
Warrants, as printed. Commissioner James seconded the motion, and it carried unanimously.
fi 2) COMMISSIONER WARRANTS (PERRY L. BUCK) - JULY 7, 2023: Commissioner Saine moved
to approve the Warrant, as printed. Commissioner James seconded, and upon a roll call vote of four (4)
to zero (0), the motion carried, with Commissioner Buck recused.
• 3) COMMISSIONER WARRANTS (KEVIN D. ROSS) - JULY 7, 2023: Commissioner James moved
to approve the Warrant, as printed. Commissioner Buck seconded, and upon a roll call vote of four (4) to
zero (0), the motion carried, with Commissioner Ross recused.

• BIDS:
1) APPROVE BID #B2300130, 2023 PARKING LOT POTHOLE REPAIRS - FACILITIES
DEPARTMENT: Carolyn Geisert, Purchasing Department, stated staff recommends selecting the lowest
bidder who met specifications, Lightfield Enterprises, Inc., for a total amount of $67,775.00.
Commissioner Ross moved to approve said bid. The motion was seconded by Commissioner Saine, and
it carried unanimously.
• 2) PRESENT BID #B2300141, CATTLE GUARDS - DEPARTMENT OF PUBLIC WORKS:
Rose Everett, Purchasing Department, stated two (2) bids were received and staff will make a
recommendation on July 24, 2023.
El NEW BUSINESS:
1) CONSIDER GRANT AWARD LETTER AND INTERGOVERNMENTAL AGREEMENT SUMMARY OF
TERMS AND CONDITIONS FOR DEMOCRACY SUITE ICX PRINTER REIMBURSEMENT AND
AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Rudy Santos, Chief Deputy Clerk and
Recorder, and Adam Gonzales, Election Manager, stated the County was awarded grant funds, in the
amount of $113,025.00, for the reimbursement of ballot printers required per state mandate, which covers
the entire cost. Commissioner James moved to approve said letter and agreement, and authorize the
Chair to sign. The motion was seconded by Commissioner Ross, and it carried unanimously.
2) CONSIDER GRANT APPLICATION FOR FEDERAL ASSISTANCE (FORM SF -424) FOR SAFE
STREETS AND ROADS FOR ALL (SS4A), AUTHORIZE CHAIR TO SIGN, AND DELEGATE
AUTHORITY TO DEPARTMENT OF PUBLIC WORKS TO ELECTRONICALLY SUBMIT:
Elizabeth Relford, Deputy Director of the Department of Public Works, stated this grant application for
the Safe Streets and Roads for All (SS4A), is for the requested amount of $500,000.00, and if awarded
will be used for the development and creation of a Safety Action Plan to reduce fatalities in unincorporated
Weld County. In response to Commissioner Saine, Ms. Relford stated she agreed that roadway
improvements to assist Bella Romero with sidewalks for the children walking to and from school would
be a great project, but the first step is to set up the Safety Action Plan to be able to utilize implementation
funds. Commissioner Ross commended Ms. Relford for her efforts on the grant while on vacation, and
he further moved to approve said application, authorize the Chair to sign, and to delegate authority to the
Department of Public Works to electronically submit. Seconded by Commissioner Saine, the motion
carried unanimously.
El 3) CONSIDER CONTRACT ID #7167 AGREEMENT FOR REMOVAL OF GAS/OIL PIPELINE FOR
BRIDGE 54/13A REPLACEMENT PROJECT AND AUTHORIZE CHAIR TO SIGN — DCP OPERATING
COMPANY, LP: Michael Bedell, Department of Public Works, stated this agreement is for the removal of
an existing oil and gas pipeline that is within the County's recently purchased right-of-way for the
Bridge 54/13A replacement project, and the County will reimburse DCP Operating Company, LP, in the
amount of $103,675.00. Commissioner Ross moved to approve said agreement and authorize the Chair
to sign. The motion, which was seconded by Commissioner Buck, carried unanimously.
▪ PLANNING:
1) SECOND READING OF CODE ORDINANCE #2023-06, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING AND CHAPTER 29 BUILDING
REGULATIONS OF THE WELD COUNTY CODE (AGRICULTURAL BUILDINGS) - (CONT'D FROM
6/5/2023): Commissioner James moved to read Code Ordinance #2023-06 by title only. The motion was
seconded by Commissioner Ross, and it carried unanimously. Bruce Barker, County Attorney, read the

the new Building Official for the Department of Planning Services, who briefly shared his background in
professional engineering and commercial building construction. Mr. Parko stated on June 19, 2023, a
work session was held with the Board regarding concerns that were brought up during the First Reading,
and as a result, the recommended proposed changes are to eliminate the acreage requirements,
agricultural buildings are allowed in historic townsites and subdivisions, no permit or impact fees are to
be collected unless there is a change of use, and staff added a provision stating the building cannot
exceed 100AMPs, which provides staff discretion. He stated staff has updated the application to reflect
the changes, which will be reviewed with Planning Commission on July 11, 2023. No public comment
concerning this matter was offered. In response to Commissioner Saine, Mr. Barker clarified there will be
language removed since First Reading, while there is no additional language added. In response,
Mr. Parko agreed and clarified the definition of Agricultural Building is not being changed, and reiterated
all the information agreed upon at the work session has been added or changed on the application, but
the language of the Code has not been changed. Commissioner James moved to approve
Code Ordinance #2023-06 on Second Reading. The motion was seconded by Commissioner Ross, and
the motion carried unanimously.
PUBLIC COMMENT:
1) Edwin Grant, Greeley resident, offered his comments to the Board.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2023-06 was approved on Second Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:43 a.m.
