HomeMy WebLinkAbout20230574.tiffRESOLUTION RE: APPROVE CHANGE IN BOUNDARY LINES OF COMMISSIONER DISTRICTS IN WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Section 3-2(2) of the Weld County Home Rule Charter says the following: "(2) The Board shall review the boundaries of the [Commissioner] districts when necessary, but not more often than every two years, and then revise and alter the boundaries so that districts are as nearly equal in population as possible," and WHEREAS, by Resolution #2015-1501, dated June 15, 2015, the Board of County Commissioners of Weld County, Colorado, revised the boundary lines of the County Commissioner Districts as shown on the map attached to that Resolution, and WHEREAS, in order that Weld County complies with Charter Section 3-2(2), it is desirable, necessary, and in the best interests of the County that the Board of County Commissioners now consider, determine, and re-establish boundary lines of the County Commissioner districts within the County, and WHEREAS, upon notice published in the Greeley Tribune on January 11, 2023, the Board of County Commissioners held a public hearing on January 23, 2023, to obtain public input regarding changing the District boundaries, and WHEREAS, the Board of County Commissioners is now of the opinion that the County Commissioner Districts do not conform to the proper division of the County with respect to population, and WHEREAS, upon notice published in the Greeley Tribune on January 29, 2023, the Board of County Commissioners held a public hearing on March 1, 2023, to determine and re-establish boundary lines of the County Commissioner Districts within the County, with the boundary lines and division of precincts as shown on the attached Exhibit "A." NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the boundary lines of the County Commissioner Districts within the County, with the division of precincts into the respective County Commissioner Districts as shown on the attached Exhibit "A," be, and hereby is, approved. I have not seen any discussion in the Greeley Tribune about the process or the request for public input. I am speaking to you today regarding the 2023 proposed Weld County Commissioner redistricting mao. The League of Women Voters Greeley -Weld County has been an active, nonpartisan organization in Weld County for over 63 years. We believe that democratic government depends on citizen's informed and active participation in government and requires that governmental bodies give adequate notice of proposed actions, holding open meetings and making public records accessible. We support an open government that is representative, accountable, and responsive to citizens. Our positions and stances on issues, in particular, redistricting are adopted after a long study and consensus process, both nationally and locally. According to our LWV Impact on Issues: A Guide to Public Policy Positions (2020-22, p. 35) the standards on which any redistricting plan should be judged must include the following: • Enforceability in court. • Requires substantially equal population, geographic contiguity, and effective representation of racial and linguistic minorities between districts. • Provides for (to the extent possible): promotion of partisan fairness, preservation, and protection of "communities of interest" and respect for boundaries of municipalities and counties. • Compactiess and competitiveness may also be considered as criteria, as long as they do not conflict with the previous criteria. • Protection of incumbents and preferential treatment for a political party through consideration of party affiliation, voting history and candidate residence are explicitly prohibited. We believe that any partisan considerations or gerrymandering distorts and undermines representative democracy and runs counter to equal and fair voting rights for all. The League of Women Voters of the United States, Colorado and Greeley -Weld County are all in alignment with the redistricting processes outlined and adopted in 2018 t passage of Amendments Y & Z to the Colorado Constitution by an affirmative vote of 71%. In addition, the state law passed by the Colorado Legislature, HB21-1047 County Commissioner District Gerrymandering, has outlined the same process for county redistricting in Colorado, especially for Arapahoe, El Paso and Weld Counties. The League of Women Voters of Greeley -Weld County has serious concerns that standards, criteria, and processes outlined in the Colorado Constitution and HB 21-1047 were not followed by the Board of County Commissioners (BOCC) in the development of the proposed redistricting map, Exhibit A. It is a major conflict of interest to have the BOCC draw the map that impacts their jurisdictions. An independent entity or citizens oversight commission should have been included in the process. We also believe the following areas are not in compliance with state law: Transparency/Access: Dissemination of information about the development process for the proposed redistricting map was not widely publicized nor were Weld County citizens educated about the map and adoption process. It was difficult to find any information on the County website, and Weld Count citizens were not adequately informed regarding the process for providing input and submitting proposed redistricting maps for consideration. Processes: • Three proposed maps are required. Only one map was submitted for approval and review by the voters. • Keep "communities of interest" together, Greeley, a "community of interest" was divided into three sectors, thus neither urban nor rural/agricultural voters can be fairly represented by one commissioner. A third of Greeley is paired with a rural area of Weld County. • Multiple opportunities for input. Hearing times were not widely publicized. Adequate time was not given for residents to provide written or oral input on the map. Only two hearings were planned prior to map approval. • Minority groups (racial, ethnic, and language) must be represented. Minority groups were not adequately provided representation in one district as other communities, like city, county boundaries or regional ones. • Competitive districts. All three County Commissioner districts in the proposed map have 55%+ Republican voters. If a cities/regions map was drawn as a "community of interest", the Greeley/Evans District would be more competitive at Republican (50.56% and Democrats 44.71%) See a sample Weld County redistricted map for cities/regions: https://davesredistricting.org/ioin171 fd61 a3-5638-4d67-b020-4cb1 e2785967 2 Map Proposal: • The map itself was not accompanied by any explanation describing the criteria used to develop the map and who developed it. • The map did not clearly identify the three specific County Commissioner districts or why several precincts were moved from one district to another. • An up -close map of the Greeley area was not provided so people could clearly see the definition of the three County Commissioner district lines. • Significant towns and cities in the county were identified on the published map. • The "official" redistricting map is only available for personal viewing in the Clerk to the County Commissioner's office. • Public comments about the map and name of the resident submitting those comments have not been made available to the public There are other problematic issues, however these are a few that we identified and believe are most relevant. It is for these reasons that the League of Women Voters Greeley -Weld County strongly oppose the adoption of the current proposed map. We recommend a new map for Weld County residents be drawn using the state law (HB21-1047) as well as standards and best practices for redistricting with a transparent process to produce a map that is more competitive, equitable, and fair for all voters. Every person deserves to be part of the process and know their vote counts; this is the right thing to do for the citizens of Weld County. Thank you for your attention today. EXHIBIT RECEIVED FEB 2 7 1023 WELD COUNTY COMMISSIONERS I am writing in regards to the Weld County Commissioners proposed redistricting boundaries. The map that the Board of Weld County Commissioners proposes is nearly exactly the same as the current map we operate under now. with the boundaries that have been in place since the last redistricting with the exception of changing 3 precincts in the lower west side of Weld. In esser cue, County Commissioners are choosing their voters instead of voters choosing their candidates. Greeley is divided up into three sections. diluting any influence entirely. The main majority population center of Greeley will continue to be controlled by the minority rural red populations. Their current and proposed maps favor republicans by 55%. Communities of interest are being ignored. By this gerrymandering, only Republican candidates will ever be able to vin ai seat on the Board of County Commissioners; and Independent., Democratic and minority voices are silenced This has been the case for probably the last 50 years.: and they want to use the ,3ane map, despite the double digit percentage of growth in Weld Counter, particularly Greeley and other more urban population centers. They plan on carving up the Carbon Valley. and split mar y other communities which makes no sense except to preserve Republican advantage. The Weld County Commissioners are out of compliance with the new stale law 132'1-1047 — County Commissioner Districts Gerrymandering. Being a home rule charter. does not mean we are free as a county. to circumvent: state laws and do whatever, yet that seems to be :low the Weld County Commissioners :are interpreting it. Our home rule charter does stipulate that the wards be equal in size. Some of the wards/districts in the proposed map are thousands more than others. I am pleading that the Commissioners take into account ALL constituents in the redistricting map. That being said, I take real exception to how the redistricting was handled and what the outcome looks like. The map is virtually unchanged from the last map currently in place, despite the double-digit percentage increase in the County in the last decade. In addition, the Board is not in compliance with State Law, HB21-1047 - (County Commissioner Districts Gerrymandering) - in conducting the redistricting process. I do understand we are a home rule charter, but I do not think that means as a county we can circumvent state law and do whatever. If you are unfamiliar with the law, I have here provided a summary: This is a summary of what the state law, HB21-1047 says about county commissioner redistricting. The act establishes the process used by county commissioner redistricting commissions (commissions) to divide counties that have any number of their county commissioners not elected by the voters of the whole county into county commissioner districts. In these counties, the act: • Recommends the establishment of independent county commissioner redistricting commissions and provides criteria to consider when creating these independent commissions; • Requires the commissions to hold multiple hearings, either online or throughout the relevant counties, that are broadcast and stored online and comply with state statutes regarding open meetings; • Requires the commissions to provide the opportunity for public involvement by providing the ability to propose and comment on plans and to testify at commission hearings: • Prohibits improper communication between a member of a commission and the staff of a commission or a member of an advisory committee: • Mandates that paid lobbying of the commissions be disclosed to the secretary of state by the lobbyist; • Establishes prioritized factors for the commissions to use in drawing districts, including federal requirements, the preservation of communities of interest and political subdivisions, and maximizing the number of competitive districts; • Prohibits the commissions from approving a plan if it has been drawn for the purpose of protecting one or more incumbent members, or one or more declared candidates, of the board of county commissioners, or any political party. and codifies current federal law and related existing federal requirements prohibiting plans drawn for the purpose of or that results in the denial or abridgement of a person's right to vote or electoral influence on account of a person's race, ethnic origin, or membership in a protected language group: • Requires the commissions to approve a redistricting plan and specifies the date by which a final plan must be adopted by the board of county commissioners; and • Specifies that the staff of each commission or an advisory committee will draft no less than 3 plans. The act allows counties to complete the establishment, revision, or alteration of county commissioner districts by September 30 of the second odd -numbered year following a census, rather than the first odd -numbered year following a census. The act also ensures that, if the redistricting of county commissioner districts excludes the residence of a county commissioner from the district the commissioner represents, the commissioner may continue to hold the office of county commissioner until his or her term expires. The act aligns the redistricting population data used to establish county commissioner districts with the redistricting population data used to establish congressional districts, state house of representative districts, and state senate districts. The act also requires that, in a county where any number of county commissioners are not elected by the voters of the whole county and the board of county commissioners refers a measure to the voters of the county to change the method of electing county commissioners. the referred measure must provide at least 2 different methods of electing county commissioners. Finally, the act repeals anachronistic county precinct size rules and allows county clerk and recorders to redraw precincts less often. From the information sent to me by Ms. Gesick, and from what was presented at the League of Woman voters presentation, clearly the process and outcome of your redistricting plan is not in compliance with state law, as highlighted above, nor does it seem to be in line with your own perimeters. I am particularly disturbed by the lack of transparency, and the exclusion of coniiunities of interest being considered, as well as that there clearly appears to be no independent commission involved. This map is not competitive. In addition, our own home rule charter says the ward/districts need to be nearly the same size in population as possible. I do not know what your threshold is for size discrepancy, (the congressional maps I believe were 750 more or less per district). A 2000 person and 1300 person discrepancy in size between districts is nowhere close to being the same and also doesn't seem to follow state examples. In essence, it appears that the County Commissioners are choosing their voters instead of voters choosing their commissioners. Greeley is divided into multiple sections diluting any influence entirely. Weld's main majority population center of Greeley will continue to be controlled by the minority rural populations. The tail wagging the dog so to speak. Communities of interest have been ignored. The proposed map is just a continuance of the gerrymandered districts of the past. Only Republican candidates will ever be able to win a seat on the commission, (analyzed to be at a 55% advantage) and Independent, Democratic and even minority voices are silenced, which is how it has been for probably more than 30 years. Weld is not the same as it was even ten years ago, increasing with double-digit percentage growth. Greeley in particularly, as well as other more urban population centers. What you have presented in no way reflects this change nor will it be a viable ward/district map that will accommodate the future. I do not see a process for submitting alternative maps but you must put forth at least 3. Please advise on how we can submit alternative maps and the process involved. You have nothing on your website, and all of this process has been very covert. I also do not see a process for an open forum for discussion on counter redistricting proposals or additional maps and comments that will come to you. The Board seems to show contempt for the law (HB21 -1 047) which requires transparency and fairness and aims to combat gerrymandering. Information as to "public hearings" was limited to microprint in a far off corner of the paper. Only thanks to a more publicized meeting organized by the League of Women Voters did people have a chance to seek out information. The decades -long and continuing gerrymandering was proceeding largely behind closed doors. My expectations of Commissioners in creating new districts are that they would respect and obey the law (HB21 -1 047) which -- prohibits protecting incumbents -- preserves communities of interest, such as immigrant or minority communities --maintains whole communities such as a city or towns who share common histories and development -- creates competitive districts. The current division of districts does not answer to these criteria. The proposed map does no better and only perpetuates the unfairness and inequities in representation of our diverse populations in the county. Maps are being proposed that far better reflect fairness and the law. Hopefully, the Board will reconsider their redistricting map and not disregard reasonable and more fair and appropriate district boundaries. When districts are drawn in a way that undermines the will of the people, it creates a sense of distrust and disenfranchisement that can have long-lasting effects on the community. As a Home Rule Charter Commissioner, I understand the importance of the democratic process and the need for transparency and fairness in all aspects of governance. It is imperative that the redistricting process in Weld County be conducted in a way that ensures equal representation and provides all citizens with a fair and equal voice. My grandparents worked hard all of their lives and sacrificed so that my father could be the first member of his family to graduate from college. They never had two nickels to their names. As someone who comes from that background I am distressed that the newly proposed map for Weld County Commissioner Districts does not take communities of interest into account. The map, for all intents and purposes, has not changed perceptibly since the last census, even though Weld County itself has changed, demographically and population wise. The current map is not a fair reflection of those changes. Not only does it do a disservice to more urban areas by grouping them with rural areas, but it does a disservice to minority communities and folks like my grandparents. Having been a member of a family that relied on the weather and crops to make a living it seems to me that the people who eke out a living on the plains deserve a district and representation that focuses solely on them. The map, as drawn, does not reflect, nor does it serve these people and it does not reflect, nor does it serve the other diverse communities of interest in Weld County. I am also dissatisfied that there has been so little community outreach about this subject; until recently it has oeen difficult to find information regarding the redistricting. It is disturbing that we are so near the day that the final decision will be made, yet so few people have been involved. This should have been a community effort with opportunities for the residents of Weld County to have their voices heard. Information should have been widely disseminated to allow for full participation. This last week I called the number on the county website in order to access the mao. The staff was considerate and helpful, but after being transferred three times and having wa ted on the phone for almost fifteen minutes, I was unable to get access to the map... unless I came to the office in person. I do not believe that this is the correct manner to handle an issue that will decide the fate of our county for the next ten years. The process has not been transparent. Lastly, I am once again concerned that Weld does not believe that it needs to follow the law. The legal challenges that may arise from this situation will undoubtedly be financed through the public purse. As a taxpayer in Weld County it is clear to me that the solution to the legal challenges that may arise is to follow the law. I do not support a grandstanding effort made on my behalf. I ask that the final decision be postponed, that other maps be considered, that the full participation of the people of Weld County be encouraged and that this effort be transparent and fair. As it stands now it has not been transparent, nor has it been fair. Since becoming a Weld County resident twenty years ago only one political party has made the majority of decisions for everyone. It has been over twenty years since a Democrat held a commissioner's seat. Now, the proposed map , which will shape the landscape of public policy here for the next ten years, remains a mystery to the vast majority of people soon to be affected by its contents. Assuredly great care has been taken to maintain a certain status quo. Sadly, the needs of communities of interest in Weld County are rarely met. Considering the changing political implications of a growing population, it seems imperative that at least one Democrat have a fair chance to win a seat. The new map (you must appear in person to view it I was informed) will make that unlikely. Imagine a congressional body consisting of members of only one party. No dialogue. No oversight. Unquestioned decisions. Transparency invariably becomes an issue, as with the current redistricting process. I have been a resident of and practicing attorney in Weld County for 38 years and a homeowner for 26 years. I reside in Commissioner District 2. I am very concerned about the process and the product. The process by which the three 1 districts were mapped out and initially heard by the County Commissioners in January was not well publicized and until recently, the map was not even available online. I plan on being at the hearing on March 1St and plan to testify. My major concern about the product is the continued division of the City of Greeley into par: of all three of the districts. That dilutes the power of the tax paying residents of Greeley, who constitute rougily one-third of the population of Weld County. Greeley is a recognized community of interest and continuing to divide up the City results in the residents of Greeley having no representation on the Board of Commissioners and limits the concern of the Commissioners for issues involving the City of Greeley. I believe that none of the Commissioners reside in the City. Having a rural and urban mix in all three districts continues to dilute the voting power of the residents of the City of Greeley and fails to honor the concept of a community of interest. I suggest that you restart the process and propose several maps for review and commentary by the constituents of Weld County. The proposed map is almost identical to the current map. We are very disappointed and alarmed by the commissions lack of transparency and distribution of very minimal information provided to all Weld County residents. The lack of process has resulted in inadequate time for residents to ask questions, digest information and give input into these maps. State Law (House Bill 21-1347) was put in place in Colorado in order to ensure fairness, accountability and a clearly defined process. Hiding behind the excuse (or loophole) around Weld County being a Home Rule County is not, in our 1 opinions, a valid reason not to educate/inform and encourage input and participation from the residents of Weld County about redistricting their communities. We want to strongly urge the Weld County Commissioners to draw maps that are fair and representative of the different communities that make up Weld County. Extending the deadline for input would be a good place to start and then setting up meetings, sending out flyers, talking with residents and encouraging them to attend your meetings might be a good place to start. We believe it is important to go out of your way to avoid any appearance of gerrymandering in our county. I am aware some believe Weld County is exempt because it is a home rule county. I urge you to rethink that idea; the law does not exempt home rule counties. Even if HB 21-1047 were not in existence, it would still be expected for Weld County to draw fair maps where the people select their elected officials and not the other way around. It is troubling as to the lack of notice given to the process. Being a home rule county does not exempt officials from keeping constituents in the loop. A postage sized stamp notice coupled with declining to publicize the actual proposed (until close to the last minute) map is not a way for people to feel they are represented. A previous county commissioner (who served at large) told us at least one time the he felt he did not represent people who lived in the city of Greeley. Not sure of his reasoning but that sentiment still seems to be part of county governance. I would hope that roughly 1/3 of the population of Weld County is not ignored in the drawing of the maps (the map that is drawn serve to split up Greeley). Since HB21-1047 is law, I would note the following: 1. At lest 3 proposed plans should be considered and pubicized to the public, 2. There needs to be more opportunities for the pubic to be heard (unfortunately, a meeting held during business hours does not suffice), 3. The drawers of the maps should actually consider what the public proposes. I regret I will not be able to join you in person. I'd like to submit that your preferred option is unfair, particularly to the folks in Greeley and more particularly to the Latino community. It is also an almost exact 3 -way split in population. I certainly would never suggest that you're trying to disenfranchise our minority communities, but your proposed plan does exactly that. Although the majority of Weld County Voters vote consistently for Republicans, it is entirely possible to draw a map that has at least one competitive district. I would like to request that the commissioners consider maps that allow for this possibility. The proposed map is not fair or representative of communities of interest within the county. Second, this map does not adhere to state law as written in House Bill 21-1047. I would urge you to follow the law as it is written - not simply because it is the law, but because it is the right thing to do. Can we all agree that it is, at best, suspicious when maps are drawn to favor the folks who hold the elected positions and are proposed only by those who answer to the elected officials for their jobs? I am writing today to share my strong disapproval of the proposed map that has been released as part of the commissioner district re- districting process. It is plainly gerrymandering. Dividing Greeley in three makes no sense. Greeley is a clear geographic community of interest. At this time, all five county commissioners could live outside the most populous city in Weld County —the same would be true if the proposed map stands. We are roughly one-third of Weld County's population and roughly one-half of the county's tax base. We deserve elected representation. We deserve a representative that has our interests top of mind. We deserve a commissioner who lives in and understands the issues that matter to this community. Besides being part of a geographic community of interest as a city, East Greeley has a Latino population that is nearly 50% of its total population. As a community of interest, they deserve fair representation. As it stands now, folks that live in East Greeley are spread across all three of the newly proposed districts. In gerrymandering terms, that is fundamentally "cracking." This important community is clearly being divided in the proposed maps. I certainly hope that has not been intentional. However, if that is not your intention, new maps will need to be drawn. The people of Greeley, and East Greeley in particular, have issues that are different than the folks this map currently lumps them in with on the Eastern plains. Greeley residents are more likely to live in multifamily housing and are statistically more likely to work in the healthcare, education, or service industries than their counterparts on the Eastern plains. We deserve the opportunity to elect someone that understands our diverse population and the complex policy issues that we face going forward. Dividing East Greeley into three districts dilutes the voices of this community at the ballot box. 1 I am very disappointed with the direction that the re -districting process has gone in Weld County so far. I recall Ms. Kirkmeyer being quoted in the Trip saying that she loved working with like-minded people because it made the job easier. I also remember having some young Democrats stop by while a group of us were holding signs encouraging voters to help remove the former President from office and they remarked that they didn't think any Democrats lived in Weld County. Both sad situations. The current boundaries that you are planning to approve are not equitable but those boundaries surely keep the Republicans in good stead come election time. Please remember that you have many non -Republican constituents most of whom you really do not consider to be important enough to have a voice in Weld County. Good Evening, I am a resident of Severance and have recently learned of the proposed redistricting of the county's voting districts. A quick, lay persons view of the proposed changes seems to indicate a bias that would favor more sparsely populated rural areas over the denser populated urban and suburban areas. Additionally, these proposed new boundaries clearly favor one political party above another. These two facts, coupled together, are the very definition of gerrymandering. Such practice goes against the basis of a free, equitable voting process that our country is based upon. I vehemently oppose these proposed boundary lines. I would request that a non-partisan commission be formed to make any revisions to voting map lines. As a resident of Weld County, I am concerned about the impact that this map will have on our community. This map does not protect the voters of Weld. The current and proposed maps do not give proper representation to our cities, towns, or rural communities. The County Commissioner Districts Gerrymandering Act (HB21-1047) passed in 2021 provides clear guidance on creating maps that protect the civil rights of our communities of color and do not divide communities that face similar issues.
