RESOLUTION WHEREAS, a public hearing was held on February 28, 1972, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Gary Bragdon, 2168 Buena Vista Drive, Greeley, Colorado , requesting permission to locate a cattle and sheep feeding operation on the following described property, to-wit: That part (72. 9 acres) of Section 24, Township 7 North, Range 67 West of the 6th P. M. , Weld County, Colorado commencing at the quarter corner on the North side of Section 24, and extending thence S. 00° 19' W. 2640 feet to the center of said Section; thence N. 89° 28' E. 1268. 5 feet; thence N. 29° 27' W. 228. 5 feet; thence N. 230 33' E. 235. 5 feet; thence N. 36° 35' E. 91. 9 feet; thence N. 78° 32' E. 163 feet; thence N. 15° 02' E. 87. 5 feet; thence due North 523. 8 feet; thence N. 34° 24' W. 177. 7 feet; thence N. 26° 40' W. 103. 5 feet; thence N. 25° 42' W. 1412. 3 feet; thence S. 89° 45' W. 709. 8 feet; to beginning, and WHEREAS, the petitioner was present, and WHEREAS, there was some opposition to the request of petitioner for the location of said cattle and sheep feeding operation, and WHEREAS, the said requested cattle and sheep feeding operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle and sheep feeding operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Gary Bragdon, for location of a cattle and sheep feeding operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due _diligence to effect said cattle and sheep feeding operation and that he shall have up to one (1) year from date hereof to begin construction of same. g. That when said cattle and sheep feeding operation is completed, same shall not contain more than 2, 500 head of cattle at any one time and not more than 15, 000 sheep at any one time. That petitioner shall -construct a sealed retention pond and drain riitch to prevent pollution; also, that petitioner shall take all necessary precautions not to pollute ditches and canals of adjacent landowners and shall enter into an agreement providing therefor. 5. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with-the Zoning Resolutions of Weld County, Colorado. Dated this 3rd day of MaY 1972. DISCUSSION : Members of the Planning Commission made a field trip to the site at 1 : 30 P. M. Mr. Lorenson stated he had some add- itional comments . This item had been tabled at the previous meeting , at which time it was recommended for denial . Mr. Bragdon has indicated now that the feed lots will be located further than 1/8th of a mile from the nearest residence . Mr. Lorenson stated he is now changing his recommendation to approval subject to all appropriate protection that would be needed to keep drainage from the area out of the the nearby ditch and meet the requirements of the Health Department. Mr. Watson that the fence be of a permanent nature to protect the ditch . RESOLUTION : Be it therefore resolved to recommend approval to the County Commissioners subject to the requirements discussed. Motion by Mr. Nix , second by Mr. Anderson . The Extension office remarks were favorable , the soils report ti was favorable , the parcel is well adapted to this type of operation , conforms to this locality very well , the Health department has rec- ommended approval . It would be subject to a maximum of 50 ,000 turkeys with construction be begin within one year of approval from the County Commissioners . Mr. Andrews explained their operation and stated the new facilities will be confined . Mr. Lorenson stated the buildings will have to be 660 ' from the house on the George Barber property adjoining the area. RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the requirements discussed. A Motion by Mr . Watson , second by Mr. Nix. The land use is non-conforming with existing "A" zone regulations . Move- in housing has been approved by the building department, subject to public sewer and water and health department approval . Approval of Fredrick and Firestone . A maximum of 2_2 unit dwellings (duplexes ) . This area was previously platted . Mr. Abeyta stated he has water taps from Fredrick . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners , subject to the requirements of Mr. Lorenson . Motion by Mr. Nix , second by Mr. Anderson. APPLICANT : Marvin Knopp DISCUSSION : Mr. Deyoe stated High Country Farms would like to divide 160 acres into 20 acre lots for mobile homes . There is one well on the property. There was discussion regarding the regulations of wells . Mr. Knopp had not appeared . SUBJECT : Division of land without subdividing DISCUSSION : George Hoecher had sold several parcels south of Pinnacle Park. Some of these parcels are being divided . A third party had been denied a building permit because more than four parcels of the original property has been sold and building permits issued. Mr. Paul stated at the present time the percolation tests have met the requirements for the permits issued . These were issued before the the 7 ' minimum requirement was adopted. Mr. Lorenson reported these lots all face Highway 392 and felt there should be limited access onto this highway. In the Thoroughfare plan 392 is tentatively picked for a north by-pass around Greeley. Mr. Hoecher stated the reason for not subdividing was an over sight, Mr. Tobin purchased 13 acres of the property in question , he in turn split the 13 acres into 3 parcels . There was much discussion between the members on whether a building permit should be issued or not. Mr. Hoechel- offered to start subdivision proceedings for this area to rectify the situation . MOTION : By Mr. Anderson to turn the matter over to the Assistant County Attorney to render an opinion . Second by Mr. Heitman. A vote of "Aye" by Anderson , Bowles , Heitman , Nix and Watson. Motion carried. 744 . APPLICANTS : Mr. and Mrs . Orlie Cartwright SUBJECT : Building permit LOCATION : Sec 17 T2 R67 DISCUSSION : Mr. Lorenson stated this is the same situation as the previous case. The area sold to the Cartwrights is a part of the original property. The remainder is being platted as CasaGrande Estates . Five parcels of have been sold . MOTION : By Mr. Anderson to turn the item over to the County Attorney to render an opinion. Second by Mr. Nix . A vote of "Aye" by Anderson , Bowles , Heitman , Nix and Watson . Motion carried. APPLICANT : Marvin Knopp DISCUSSION : Inasmuch as Mr. Knopp appeared , he was allowed to discuss his proposal of 20 acre lots for mobile home . Mr. Knopp was in- formed what the requirements are . APPLICANTS : Mr, and Mrs . Orlie Cartwright DISCUSSION: Mr. and Mrs . Cartwright reappeared with their attorney Mr. Vondy. Mr. Vondy presented a certified copy of their deed dated 11 /16/71 . ,They have had a well drilled on the property costing $2488. 00. Mr. Vondy pointed out the penalty clause in the subdivision regulations and felt the party that is responsible for for the violation should be penalized. Mr. Bowles stated there had been a motion to turn the matter over to the County Attorney for a legal opinion . He will advise the Planning office on the issuance of a building permit. Lorenson stated there had been some revisions in the Subdivision Agreement. It is on the note that it is good for two years , however it is written so the County Commissioners may change the amount or the length of time it is written for. This would be a part of "Exhibit A" . This would be a break down showing how the 745 Amount was arrived at. Marshall Anderson gave a report on the status of the subdivision regulations being prepared by the State. SUBJECT : Beef management DISCUSSION: Mr. Lorenson distributed some pamphlets from Beef Management, showing how other states define "feed lots" SUBJECT: Leonard Bartels DISCUSSION : Mr. Lorenson read a letter of resignation from Leonard Bartels from the Planning Commission and the Regional Planning Commission. MOTION : By Mr. Heitman to order a placque for Mr. Bartels in recognition of his service to the County. Second by Mr. Anderson . A vote of "Aye" Motion carried . SUBJECT: Denver Regional Council of Governments DISCUSSION : Mr. Lorenson stated an invitation to a meeting by the Denver Regional Council of Governments had been received. This will be in regard to Housing and Urban Development. Reservations and cost of the conference will be made through the Planning office. Conference will be held March 13th and 14th. SUBJECT : Tie-downs and insurance for mobile homes DISCUSSION : State Farm Insurance Company gave a slide presentation of tie-downs for mobile homes especially in high wind areas and tornado and hurricane areas . Mr. Bill Dye quoted statistics on the cost and damage caused from high winds recently. Some cities have passed ordinances on requirements for tie-downs . Some insurance companies are requiring tie-downs before insurance will be issued. Meeting adjourned. Barber did not appear or a representative for Mr. Barber , no action was taken . SUBJECT: Indianhead Subdivision DISCUSSION : Mr . Lorenson stated he had prepared a letter and a list of requirements for a Planned Unit Developement as requested by the County Commissioners . Mr. Lorenson stated from the staff' s viewpoint ; the less number of people in the area the better . 737 , SUBJECT : Larimer County Planning Commission request for recom- mendation regarding the preliminary plat of Powder Horn-Frontier. DISCUSSION : Mr . Simpson stated the plat has been reviewed by the Utility Board of 'Larimer County and found there were so many questions unanswered they took no action . It is split by two different school districts , it is served by a fire district out of Windsor , it has to be served by Loveland-Ft. Collins Water District by a minimum of an 18" water line for which they have not contracted to build nor have they obtained the necessary Big-T water agreement they also have to sign an agreement to build a sanitation plant on the Poudre river , construct the nec- essary water mains , in addition to all the necessary facilities dedication . If they incorporate into a city , dedication of the necessary facilities for a poliee department , fire department city hall etc . will be necessary, MOTION : By Mr . Nix to recommend the plat be tabled as they have not met the requirements of the Utility Board and of insufficient information . Second by Mr. Anderson . A unanimous vote of "Aye" Motion carried . Bragdon APPEARANCE AGAINST : E. W. Honstein , Dave Hergert , Melvin Schmunk , Richard Nashland and Carl Winter Jr. DISCUSSION : Mr , Bowles read the recommendation of the staff for denial . Approved by the Health Department . Poses a problem because of the nearness of homes to the proposed feeding operation . Petition signed by surrounding property owners opposing the oper- ation was presented . Mr. Bragdon stated he felt it is an ideal location , the soil type and drainage are excellent. Mr. Bowles stated it appears most of the objection is regarding the odor from this size feed lot . It was brought out that there are other i feeding operations in the area . Mr. Honstein stated he under- 1 stood there were to be approximately 200 head of cattle and pos- sibly some for grazing . If he had known there were to be 2500 head of cattle and 15 ,000 head of lambs he would not have signed the petition for approval . Mr . Hergert stated he represented the two ditches and he is concerned about the run-off into the ditches . Other persons present were opposed to the operation and were con- cerned regarding the trash from the area . MOTION : By Mr . Anderson to take the matter under advisement. Second by Mr. Clark. A vote of "Aye" by Anderson , Bowles , Clark , Nix and Watson . Motion carried . RESOLUTION : tape 412 Be it therefore resolved inasmuch as this application has been scheduled for a public hearing before the Board of County Commissioners to recommend the matter be tabled until a field inspection can be made by members of the Planning Commission. Lorenson read some recommendations of Mr. Doke stating not enough information is available and recommended the application be tabled . Mr. Gurtler stated the hours and rules and regulations are set by the State Game and Fish Parks Department. For every four guns that go out a guide will accompany them. They are also restricted to certain months of the year. A trained retriever will accompany the hunters . The shooting hours would be 9 , 11 , 1 and 3 o ' clock . The kennel will be for their own dogs and professionally trained does . There will be approximately 30 dogs at all times . Mr. Lorenson stated he felt if the Qun club is governed by the Game and Fish Department, the only Question is the kennel and the operation of it. He recommended it be approved since the surrounding property owners have signed the petition . MOTION : By Mr . Nix to take matter under advisement. Second by Mr. Anderson . IT IS FURTHER AGREED that party of the first part will remove any bedding, manure, dirt, sludge or other debris at any time the flow is obstructed from said ditch canal at his own expense; if as a result of the feedlot operation. IT IS FURTHER AGREED that party of the first part will keep any bedding, manure, dirt, sludge, or debris removed from the 12 foot right- of-way between the ditch and fence so as not to interfere with any of the parties of the second part from driving beside the ditch canal. IT IS FURTHER AGREED that in the future if the party of the first part decides at any time to build more corrals, that he will extend the fence to protect said ditch canal from blowing bedding, manure, dirt, sludge and other debris. This Agreement shall be binding upon and enure to the benefit of the parties hereto, their heirs and assigns and shall be deemed a covenant running with the land.
